About this file

This is a minimum insurance requirements attachment for a contract with the Harris County Flood Control District in Texas related to professional architectural and engineering services for the South Mayde Creek Bypass Channel and Stormwater Detention Basin project. The document establishes mandatory insurance coverage that contractors must maintain throughout the contract term at their sole expense. Required coverage includes Workers Compensation with Employers' Liability limits of $1,000,000 per accident and per disease claim, Commercial General Liability with per-occurrence limits of $1,000,000 and a general aggregate of $2,000,000, Automobile Liability with combined single limits of $1,000,000 per accident for all owned, hired, and non-owned vehicles, Umbrella/Excess Liability of $1,000,000, and Professional/Errors & Omissions Liability of $1,000,000 where applicable. The Harris County Flood Control District must be named as an additional insured on a primary and non-contributory basis for general liability, automobile liability, and umbrella coverage.

All insurance must be provided by companies licensed by the Texas Department of Insurance with an A.M. Best rating of at least A-VII, unless coverage is unavailable or economically infeasible through standard carriers, in which case excess or surplus lines companies registered in Texas are acceptable. Contractors must provide unaltered insurance certificates as evidence of coverage and must include subcontractor insurance requirements in their contracts. Policies must waive all rights of subrogation against the County and its personnel. Any policy cancellations, material changes, or non-renewals require 30 days' written notice to the County with evidence of replacement coverage within 30 days thereafter. Failure to maintain required insurance may result in contract termination. The insurance requirements do not establish limits of contractor liability, and the County reserves the right to require additional coverage as necessary.
