About this file
This document is an amendment (Amendment 0002) to a federal solicitation for Willamette National Cemetery Grounds Maintenance Services, issued by the Department of Veterans Affairs National Cemetery Administration. The amendment provides three key clarifications: 1) Gas-powered leaf blowers are permitted for contract work, despite local municipal restrictions, 2) Disease control is not a required contract element, and pest control should focus solely on pest management without plant or turf disease treatment, and 3) The maximum aggregate contract value remains $7,000,000 for the base year plus three option years, with offerors expected to develop proposals that can be performed within this ceiling value. The solicitation (Solicitation Number: 36C78626Q50019) covers grounds maintenance services at Willamette National Cemetery, with contractors responsible for developing proposals that meet the specified scope of work within the stated maximum contract value.

36C78626Q50019 Clarifications Amend 0002
CLARIFICATION #1
Applicability of Portland Gas Blower Ban
Final Contracting Officer Clarification:
The Portland Gas Blower Ban does not apply to this contract.
While a small portion of Willamette National Cemetery extends into Multnomah County, the majority of the cemetery is located in Clackamas County within the City of Happy Valley. The Government has determined that the Portland gas-powered leaf blower restrictions, which are a municipal policy not mandated by EPA, NEPA or Executive Order, are not applicable to this federal contract. Contractors may utilize gas-powered leaf blowers in performance of this contract, subject to all other applicable federal, state, and local safety and noise regulations. This clarification supersedes any prior Government responses indicating that gas-powered blowers are restricted or prohibited.
CLARIFICATION #2
Disease Control vs. Pest Control Requirements (Resolution of Questions 51 and 78)
Final Contracting Officer Clarification:
The Government acknowledges that prior responses created confusion regarding disease control requirements. The Government’s final position is as follows:
· Disease control is not a required element of the scope of work.
· The references to “disease” in Section 5.2.3.1 were included in error and should be disregarded.
· The 99 percent disease-free standard in Section 5.2.3.1 does not apply.
· The contractor is required to perform pest control in accordance with the Performance Work Statement.
For purposes of this contract, pest control does not include treatment or prevention of plant or turf diseases. This clarification supersedes any prior Government responses suggesting that disease control is required.
CLARIFICATION #3
Maximum Aggregate Contract Value
The Maximum Aggregate Value is $7,000,000 for the base year plus three option years remains unchanged. The Government does not intend to increase the maximum value or reduce the scope of work.
Offerors are responsible for developing proposals, pricing, staffing approaches, and efficiencies that enable performance of the required scope of work within the stated maximum value. Cost estimates, production rates, assumptions, and individual contractor business models represent professional opinions of the offeror and do not constitute a determination by the Government that the ceiling value is insufficient or will be reassessed.
Offerors may determine, based on their independent business judgment, whether to submit a proposal.
