TECHNICAL QUESTIONS AND SOLICITATION #: 36C77626R0022
RESPONSES TRACKING SHEET PROJECT TITLE: Lexington Construct Replacement CLC - Complex Care Minor Construction
# CONTRACTOR QUESTION VA RESPONSE
1 Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please change the contract type to a fixed-price contract with economic price adjustment pursuant to FAR 16.203.
In accordance with FAR 16.202 and 52.216-1, this requirement will remain a firm-fixed-price contract.
2 Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please reduce the price-hold period to 30 days.
The Government standard concerning price-hold period is 90 calendar days and will not be altered.
3 The solicitation does not currently include an economic price adjustment clause such as FAR 52.216-4. In today’s market, significant volatility in both labor rates and material costs presents a challenge for bidders to estimate pricing accurately without including broad contingency allowances. This may result in higher bids and reduced competitiveness.
The inclusion of an EPA clause would allow for fair price adjustments tied to actual cost changes, improving pricing accuracy for the government.
Will the Contracting Officer consider including FAR 52.216-4 Economic Price Adjustment – Labor and Material in the contract to mitigate risk related to market fluctuations and reduce the need for contingency-based pricing?
FAR 52.216-4 will not be included.
4 Economic Price Adjustment for Labor and Material Due to the fact that this solicitation requires us to “hold” our pricing for 90 calendar days for acceptance and given the recent uncertainty in materials and labor costs and risk of tariffs; would the government consider including the FAR Clause 52.216-4, Economic Price Adjustment for Labor and Material in this solicitation?

5 We respectfully request clarification regarding the applicability of FAR 52.229-3 – Federal, State, and Local Taxes in the context of potential material price escalations arising from pending tariffs. Specifically, we are seeking to understand whether this clause would afford any contractual relief or price adjustment mechanisms in the event that new or increased tariffs are imposed on imported materials after contract award, thereby affecting the cost basis for materials included in our pricing proposal. Our intent is to ensure that any potential risk from such government-imposed cost changes is addressed appropriately under the contract terms, or whether alternative provisions (e.g., economic price adjustment clauses or contract modifications) may be more applicable for consideration. Please confirm if FAR 52.229-3 is intended to apply to increases in material costs due to tariff changes?
If after the contract is awarded, the contractor becomes liable for an increase (or receives a reduction) in a federal excise tax or duty “which was not otherwise anticipated,” the contract price may be adjusted accordingly.
To recover under FAR 52.229-3, the contractor generally must show:
The tariff was not in effect or anticipated at the time of award;
The tariff is a federal duty or tax covered by the clause;
The tariff directly increased the contractor’s cost of performance;
The contractor timely notifies the contracting officer of the change; and The contractor can substantiate the increased costs attributable to the tariff.
6 The new administration has indicated that they intend to impose tariffs on many imported goods. Under the Buy American Act components of end products that are sold to the federal government can also be subject to tariffs. These tariffs will most likely cause a significant escalation in material and equipment prices at the time of implementation not only for imported goods, but also items produced domestically that compete with imported goods. Tariffs may also delay the receipt of material/equipment processing times at the ports of entry. The potential monetary and schedule impacts are impossible to quantify prior to any action being taken by the administration. If tariffs are instituted after award of a contract, will the Government provide relief through a contract modification for any unforeseen cost escalations and/or schedule delays created by tariffs?

7 Please confirm if project is tax exempt. If so, will VA provide the documentation to the prime contractor after award.
No, this project is not tax exempt. See Special Note regarding FAR 52.229-3 Federal, State, and Local Taxes in the solicitation.
8 Will the VA allow deviations to Buy American Act if the noted products are not available?
The process of requesting exceptions to the Buy American Act is detailed in the provision at FAR 52.225-12, Notice of Buy American Requirement—Construction Materials Under Trade Agreements, and the clause at FAR 52.225-11, Buy American—Construction Materials under Trade Agreements, in the solicitation. Any items not compliant must be specifically listed in the offer.
9 Please confirm this project must meet the buy American act requirements. The requirements in FAR 52.225-11 and FAR 52.225-12 must be met for this project.
10 As this project is a small business set-aside, please confirm FAR clauses 52.225-11 and 52.225-12 are applicable on this contract
Both FAR 52.225-11 and FAR 52.225-12 are applicable and included in the solicitation.
11 Please confirm the basis of award will be evaluated on price alone. All proposals shall be subject to evaluation by a team of Government personnel. The proposals will be evaluated in accordance with the criteria provided in the solicitation. Using the tradeoff process under best value, it may be in the Government's best interest to consider award to other than the lowest price Offeror or other than highest rated Offeror. The intent is to award to the Offeror that offers the best value to the Government. “Best Value” means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirements. Past Performance is approximately equal to Price.
12 Is it still accurate that we are not pricing the alternates listed in the specifications?
Yes.
13 The solicitation page 5 of 64 shows only base bid on the bid schedule, however, the spec section 01 00 00 1.3 list base bid and 3 alternates.
Please provide a revised bid schedule listing a line item for all 4 bid items.
As stated on page 1 of the solicitation and in the price schedule notice, any references to deducts in the specifications and drawings shall be disregarded, as they are not applicable at this time. This note encompasses the three alternates listed in the statement of bid items and any references to them.
14 The solicitation includes a Division Cost Breakdown form; however, the contract documents do not define how this form is to be completed.
Please provide explicit direction on the following:
1. Confirm the required level of detail for the Division Cost Breakdown.
2. Confirm whether general conditions, overhead, and profit are to be shown as separate line items or included within the divisions.
3. Confirm how any alternates are to be incorporated into the Division Cost Breakdown, if applicable.
1. Breakdown to the division level is sufficient. I.E. provide total cost per division, no need to break down work further. Only the SUMMATION tab needs to be completed and submitted.
2. General Conditions / Overhead / Profit to be included within the divisions.
3. There are no alternates for this project. There is only one line item and all work is considered to be base scope.
15 The solicitation requires submission of up to three (3) projects exceeding $7.5M within the past five (5) years, with emphasis on healthcare environments.
Please confirm whether the Government will consider comparable non-healthcare federal projects (e.g., DoD) that demonstrate similar size, scope, and complexity, including multi-disciplinary coordination and execution within an active/occupied federal installations or facility.
Given that this project includes new standalone construction (separate from the existing medical facilities) with significant sitework and infrastructure, we request confirmation that relevant federal construction experience outside of healthcare settings may be considered in the past performance evaluation.
The Government will consider non-healthcare federal projects demonstrating similar size, scope, and complexity. Healthcare projects may be considered more favorable.
16 The solicitation requires that submitted past performance projects be completed within the past five (5) years.
Given the specialized nature of this procurement and the SDVOSB set-aside, please confirm whether the Government will consider relevant projects completed within the past ten (10) years, particularly where such projects demonstrate similar size, scope, and complexity.
This clarification would help ensure increased competition and adequate consideration of qualified SDVOSB firms with highly relevant experience that may fall outside the five-year window.
The Government will consider projects completed within the past 10 years. See updates to past performance requirements and methodology in Amendment 0002.
17 It is becoming increasingly difficult to obtain Past Performance Questionnaires from Federal Contracting Officers on a project-by-project basis when they have already completed a CPARS evaluation for us.
Considering this, will Government consider allowing us to submit completed CPARS evaluation forms with our proposals in lieu of having our references send the provided PPQ? Several Contracting Officers declining to fill these out have sited From FAR 42.1501 General: (b) Agencies shall monitor their compliance with the past performance evaluation requirements (see 42.1502) and use the Contractor Performance Assessment Reporting System (CPARS) metric tools to measure the quality and timely reporting of past performance information.
CPARS is the official source for past performance information on federal projects.
Not only is a CPARS evaluation allowed, it is required if one is available for a project being submitted. The PPQ form is only to be used if a CPARS evaluation is not available.
The instructions state, “If a completed past performance evaluation is available in CPARS, it shall be submitted with the proposal for each project identified. If there is not a completed past performance evaluation available in CPARS, then the offeror shall submit Attachment 10 - PPQ for that project.”
18 If CPARS are acceptable, may they be emailed directly to the Contracting Officer by (ADD DUE DATE OF PPQ’S FROM RFP) or to be included as an addendum that does not count against the page requirement in the final proposal.
CPARS evaluations and/or PPQs must be incorporated into the Volume I pdf and will count toward the 30-page limit.
19 I was reaching out regarding the classification of this project. Can you tell me if this project is only open to SDVOSB contractors or if contractors without that classification will be allowed to submit a bid for this project?
Yes, this project is a 100% set-aside for SDVOSBs. The prime contractor submitting the offer must be certified as such in the SBA certification database or comply with the joint venture certification requirements in 13 CFR 128.402.
20 Please clarify that a joint venture offeror is not required to be listed as “certified” in the SBA’s certification database since the SBA no longer certifies SDVOSB joint ventures. Only the SDVOSB managing member of the JV offeror is required to be listed as “certified” in the database.
Correct. A joint venture may be considered eligible as an SDVOSB if the joint venture complies with the requirements in 13 CFR 128.402.
21 I received an email in Planhub for the “Construct Replacement CLC Complex Care” project in Lexington, KY and was touching base to see if the kitchen equipment on page 35 of the “RFP 36C77626R0022 - 3-10- 26” drawings was available for bid on this project.
This construction contract will be awarded in whole to a prime contractor who will coordinate their own subs. We do not issue separate solicitations for different portions of the work, and we will not consider offers for individual products or services.
22 Please confirm that this project is a competitive SDVOSB set-aside and that any bonding provided by a contractor must be through an SDVOSB or SBA/VA approved Mentor-Protégé partnership under the SBA/VA Mentor- Protégé program in which the partnership has been approved prior to the due date.
This project is set aside for SDVOSBs. The bonding requirements must be met for this project per the applicable clauses, provisions, and instructions to offerors.
23 Please confirm that a large business not part of an SBA/VA approved Mentor-Protégé team under the VA Mentor-Protégé program cannot provide a bid guarantee or a payment & performance bond for an
SDVOSB.
This project is set aside for SDVOSBs. The bonding requirements must be met for this project per the applicable clauses, provisions, and instructions to offerors.
24 Please confirm that any designers or consultants who provided professional services for the construction documents, including reports, are precluded from pursuing this project as a Prime contractor, Mentor- Protégé partner, or subcontractor.
No member of the design team of this project is permitted to be part of the construction team.
25 We were planning to attend the site visit currently scheduled for 9:00AM ET on March 18, 2026, but due to the inclement weather issues ongoing we are having difficulty getting a flight out of our area.
Would the VA be open to scheduling a second site visit at a later date due to this issue?
Unfortunately, we will not be able to schedule a second site visit.
26 The time period between the scheduled site visit and the current RFI deadline does not provide sufficient time for our team and our subcontractors to adequately review the solicitation documents. The project includes more than 100 pages of drawings and over 2,200 pages of specifications, and a thorough review is necessary to identify unclear scope, missing information, coordination conflicts between drawings and specifications, and other items that may affect pricing and constructability.
Allowing additional time for this review will help ensure that bidders can submit complete and well-informed RFIs, which ultimately benefits the Government by improving the overall accuracy and competitiveness of bids. With bid quality and pricing accuracy in mind, we respectfully request that the RFI deadline be extended to Monday, April 6, 2026.
The question deadline will not be extended. The VA will try to answer any late or follow-up questions received but cannot guarantee responses will be provided.
27 Please extend the proposal due date for a minimum of 2 weeks, preferably 3 weeks after the date that RFI answers are posted to allow sufficient time to properly react to the RFI answers.
The due date will not be extended at this time. The VA will consider extending the due date if it is deemed necessary.
28 Please extend the due date for questions two weeks prior to the submission date. Many subcontractors have not had a chance to review this far in advance.

29 What is the approximate duration between issuing the award and issuing the NTP?
The VA expects to issue the notice to proceed within 90 days after award. However, the government does not guarantee that timeline.
30 For planning the preliminary project schedule, please provide an anticipated award date.
Since the solicitation has not closed yet and we do not know the results or if negotiations will be necessary, we cannot determine a specific award date. We intend to award as soon as we can after proposals are received.
31 How many calendar days should be included in the critical-path method schedule for owner and A/E submittal review?
How many calendar days should be included in the critical-path method schedule for the owner and A/E to review and respond to RFIs?
Spec section 01 33 23, 1.10 VA Review of Submittals and RFIs currently states these timeframes in business days. This should be revised to say:
D. VA review period is 28 calendar days for submittals.
E. VA review period is 14 calendar days for RFIs.
This will be updated in the final contract documents.
32 How soon after NTP issuance will the owner and/or designer of record provide and confirm the complete set of contract documents including all amendments?
The final complete set of specifications and drawings will be provided with the contract at award.
33 What is the policy if conditions not clearly identified within the contract documents are encountered during construction? Will the VA consider this a differing site condition and issue a contract modification for the additional work required?
The contractor must exercise due diligence in the preparation of their offer to reasonably account for all work the contract identifies or establishes. Any discrepancies with existing conditions must be brought to the attention of the COR and CO. If the Government determines any work necessary to be performed is not already a requirement of the contract, an appropriate modification will be issued IAW FAR 52.236-2, Differing Site Conditions, and FAR 52.243-4, Changes. No modification will be issued for work determined to be within the contract requirements.
34 Due to the work timeline, construction materials will need to be procured prior to installation and stored for an extended amount of time. Will the VA pay the contractor for procured and/or stored materials?
In accordance with contract terms and conditions, contractors should not submit an offer assuming the Government will approve monthly progress payments for material and/or equipment procured by the contractor and stored on the construction site, as space is available, or at a local approved location off the site. Payment of stored materials and/or equipment is at the Contracting Officer’s discretion and will be handled on a case-by-case basis during the contract and under such terms and conditions as the Contracting Officer approves. Routine construction materials are not likely to be approved for stored material payments (wood, metals, fiber cables, wires, piping, etc.). Items that are unusually long lead that must be procured far in advance to ensure their availability during construction and custom fabricated major components may be considered, however that decision will remain with the Contracting Officer. Stored material payments are not a method to finance the contract; contractors shall be financially fit enough to perform the contract’s requirements.
35 Will the Government provide detailed written requirements for contractor badging? Please clarify the process for obtaining PIV badges, including required documentation, background checks, and estimated processing timeframes.
Regardless of affiliation, everyone working within VA facilities or requiring access to VA information systems requires a VA PIV card.
PIV badging requirements can be found at https://www.osp.va.gov/How_To_Get_A_VA_ID_Badge.asp Immediately after the bonds are provided to the Government, the contractor must start working with the identified COR at the site to commence the VA PIV process for all known contractor personnel that will be working the project. All contractors must have a PIV card in order to work on site.
36 Are guarantee period services included in this project? No.
37 I was wondering if there is a geotechnical report for this project? I’m seeing where it calls out for helical piers, so I would like to view that report.
Geotechnical report is included in specifications Appendix 1.
38 Refence C400 key note 7 where it states 8’ Construction Fencing. Note, Specification 01 00 00 1.6.I. states 7’. Is the temporary construction fencing to be 7’ or 8’ and does it require a wind screen?
7’ construction security fence is acceptable. Wind screen will be required.
39 Will the large pile of spoils be a part of this contract? All spoils are to be hauled off site by the contractor.
40 Concerning this large pile of export – is it to be hauled off site or is there another location on campus for export material?
All exports are to be hauled off site by the contractor.
41 Are three separate individuals required for the on-site team of Superintendent, QC, and SSHO?
Three separate individuals are required to fulfill the roles of Superintendent, QC and SSHO.
42 Is a full-time submittal clerk required for this project? This is not required per the Specifications. The contractor shall staff the project appropriately to manage submittals to meet the project schedule and fulfill specification 01 33 23.
43 Are there any fees associated with the NPDES permit that prime contractor is required to include in our bid.
Contractor will be responsible for all fees for the NPDES permit.

45 Will the owner accept Procore Project Management software as the primary submittal and data tracking tool for this project?
VA accepts utilizing of Procore for submittal and data tracking.
46 Will the owner accept the “P-6 Primavera” for schedule submission and monthly updates?
VA accepts utilizing P-6 for schedule submission and monthly updates.
47 Because of COVID-19 throughout the U.S. and the resulting Federal, State and local governments’ responses/requirements, are there any new work requirements or mandates that will be required by the VA on this project?
COVID-19 requirements will not apply on this project.
48 Many VA campuses are beginning to address tuberculosis protocols on VA campus projects, including the 90-day screening before assignment to the worksite. This requirement will limit the amount of personnel who can immediately perform work right after the award. Will this project be required to follow 01 35 26 1.13 for TB-required protocols and a requirement to follow the 90-day screening before beginning work on the project?
Contractors will be required to comply with the Tuberculosis Screening portion of 01 35 26 found in section 1.16.
49 Where will the laydown area for our trailer, storage container, etc. be located for this project?
See attached 0002 - Contractor Laydown for overhead view of CLC complex which marks the laydown area, as well as the project location.
50 Please confirm that dual hatting/triple hatting is permitted on this project. Not allowed. See response to question #41.
51 Can you confirm that the owner will be contracting directly with a third-party commissioning agent for commissioning the project and that the Contractor is only to include participation/coordination with the Commissioning Agent?
Owner has 3rd party commissioning agent. Draft commissioning plan is included in specifications which outlines commissioning process and milestones. Contractor shall incorporate elements from draft commissioning plan into baseline schedule.
52 Knowing that the campus is limited on space and parking, it is critical that the contactor project superintendent have freedom of access and close proximity to the work. Can the VA/Owner provide a designated parking spot for the contractor project superintendent?
Contractor will have laydown area designated near construction site.
This will allow for vehicle parking.
53 Has the facility Operation & Maintenance team reviewed the Contract Documents for operability to avoid change orders?
M&O team has reviewed documents.
54 Can the contractor use the existing on-site utilities for temporary electrical and water free of charge?
Contractor to meter use of electrical at construction trailer for reimbursement to the VA in the form of a credit. Current rates are $0.03221 per kWh. Contractor to provide as a part of their monthly invoice updated electrical consumption for the month. Credit will be provided at the end of the project when trailer is removed from site.
Contractor to utilize New Era Meter: NE-5000, or similar meter. Water is free of charge.
55 Will the owner provide the fire watch during the period that the fire suppression and/or fire alarm system is not in service?
Owner will not provide fire watch. Contractor will be responsible to provide their own fire watch.
56 Please provide detailed guidance for noise and vibration operations, including acceptable levels/duration, hours of operations for acceptable levels, and acceptable noise levels after hours.
There are no noise restrictions between normal working hours, 0700 to 1700.
57 Sheet C400 - Note 18 states "Contractor provide add alternate for pavement rework....". Specification page 01 00 00-2 - 1.3 - gives the statement of bid items, including 3 bid alternates. On the solicitation, there is only one item on the price schedule. 1. Can you please confirm whether there are bid alternates on this or not. 2. If so, can you please send a revised price schedule. 3. Can you confirm which alternate Note 18 on sheet C400 falls under?

58 Can we get CAD drawings for the sitework? SAM does not support this file type. CAD drawings can be provided at award with the final contract documents. If the CAD file and .pdf file conflict, the .pdf file will be the governing document.
59 Please confirm the steel supplier/installer does not have to be AISC certified.
Per Spec Section 05 12 00 – 1.5.A: the fabricator is required to be an AISC Quality Certification participant designated as AISC Certified Plant, Category STD.
Per Spec Section 05 12 00 – 1.5.B: the installer is required to be an AISC Quality Certification Program participant designated as AISC- Certified Erector, Category ASCE. Installer must regularly install the project specified products with satisfactory service on five similar installations and for a minimum of five years.
The Steel Specifications follows IBC language. Since AISC certification is required per code, the requirement will remain in the Specifications for the fabricator/supplier and the installer to be AISC Certified.
60 There are multiple references in the contract documents to “Phase 2” work currently under construction, which appears to include the parking lot northeast of the proposed building. Civil notes also indicate coordination with a Phase 2 contractor.
Additionally, Sheet C600 (Note 1) appears to request alternate pricing associated with this work. However, the RFP and Price Schedule indicate a single lump sum base bid with no alternates.
Please clarify:
Is any work associated with the Phase 2/parking lot area to be included in the base bid?
Are bidders to provide any alternate pricing for this scope?
If not included, what is the extent of coordination required with the Phase 2 contractor?

Phase II project has completed and contractor has demobilized.
61 Can you please provide complete phase 2 drawings? See attached 0002 - Phase II As-Builts.
62 There are several mentions of add alternates mentioned throughout the drawings. Can you clarify which alternates in the drawings fall under the alternates listed in the specifications?

63 Are any utilities under this contract required to connect through or within areas constructed under Phase 2? If so, who is responsible for:

General contractor will be responsible for all demolition / restoration / coordination. Phase II is completed and contractor has de-mobilized.
64 Can you please further detail and specifications for the screening on the screened in porch?
The screen is to have a fixed aluminum frame and is to be white to match the columns. BOD would be Fast Track by Screen Tight.
65 Can you please provide the specification for the windows? See provided spec in attached 0002 - Addendum 01.
66 What is the basis of design for the windows? Pella’s Reserve – Traditional Aluminum-clad double-hung windows.
67 Can you please provide a window schedule? See window types on A604.
68 Can you please provide specifications on the overhead door that the Owner is providing and that the contractor is to install?
GC to provide and install overhead door. See spec in attached 0002 - Addendum 01.

Physical Access Control and Video Surveillance will be tied into campus wide system utilizing the VA network. System manufacturer information is provided on questions #72 and #73. Electronic Personal Protection is not be tied into campus wide system and is the patient elopement system for this building to prevent wandering patients.

113 01 45 00 3.4.B says QCM must be graduate engineer or architect or construction management graduate with 10 years similar experience. Will the VA allow someone with 10 years’ experience on projects of similar magnitude and scope without the construction management degree?

114 02 21 13 3.3.C.7 says “When authorized, by the COR, to perform aerial mapping (using manned aircraft)…”. A manned aerial mapping of the VA campus will be a significant expense and cannot simply be implemented at the direction of the COR. We request this requirement be removed from the project or provide a responses allowing for this to be handled as a change order in the event the COR would request it.
When “authorized” is interpreted by the VA as the contractor can request and the VA will authorize if able. The VA will not require the contractor to perform an aerial mapping using manned aircraft.
115 Specification 31 20 00 requires classification of on-site soils for fill and structural fill. Please confirm whether excavated soils are anticipated to be suitable for reuse as structural fill beneath pavements, footings and slabs, or if import material should be assumed.

116 Note #6 sheet C101 says to strip unsuitable soil from the site and to place and backfill material at Geotech engineers recommendation. Without more information this will result in large variation of quantities between proposals received by the Government. To ensure accurate pricing to the Government please provide the quantity of unsuitable soils to be removed and suitable soil to be imported.
Note #6 only applies if unsuitable soils are encountered. Precise quantities will be unknown until they are discovered. Contractor shall make assumption based upon Geotechnical report.
117 There are various notes indicating that Phase II is still progressing. It appears the designs have not been updated since completion of Phase II CLC projects. Please confirm that the bid documents are accurate to the site as it currently exists.
Phase II has been completed and contractor de-mobilized. Contractor shall utilize bid documents for their pricing.
118 Architectural Sheet A102 shows at least 15 downspouts present on the roof and notes that downspouts connect to the civil storm system.
However, the civil drawings appear to only show 4 downspout tie-ins to the storm drainage system. Please clarify ALL downspouts that tie in to the storm drainage system and ALL that receive splash blocks.
