About this file
This is an Asbestos Inspection and Lead Paint Chip Sampling Report prepared for the Syracuse VA Medical Center EHRM Upgrades project at two locations: 800 Irving Avenue in Syracuse, New York and 125 Brookley Road in Rome, New York. The report was prepared by Performance Environmental Services, Inc. in coordination with subcontractor Lozier Environmental Consulting, Inc. and was submitted to Spees Design Build, the project manager, dated October 5, 2023. The inspection was conducted on August 15 and October 4, 2023 at the Syracuse location and August 18, 2023 at the Rome location by certified and accredited asbestos inspector Frank Golojich.
At 800 Irving Avenue, inspections identified 22 types of materials suspected of containing asbestos. Laboratory analysis confirmed asbestos in two homogeneous areas: carpet glue, floor tile, and mastic in location C106 (330 sf) containing 4.6% to 5.8% Chrysotile, and wall and ceiling seam caulk in location S196 (20 sf) assumed to contain asbestos due to inaccessibility. Eight of nineteen paint chip samples tested positive for lead, with results ranging from 0.0082% to 0.21% lead content across locations C507, C607, C907, C703, C303, C273, AL08, and BT03. At 125 Brookley Road, one asbestos-containing material was identified: firestop caulk in location G120 (1 sf) containing 5.5-6.9% Chrysotile. One paint chip sample from location G120 tested positive for lead at 0.033%. The report includes recommendations for abatement, Operations and Maintenance Program preparation, and compliance with EPA NESHAPS and New York State Department of Labor regulations based on project classification and material quantities.

PERFORMANCE PROJECT # 2320288
Dear Mr. Good:
In accordance with your request, Performance Environmental Services, Inc. (Performance) was contracted by Spees Design Build to conduct asbestos inspections and lead paint chip sampling at specific renovation areas within the buildings located at 800 Irving Avenue in Syracuse, New York and 125 Brookley Road in Rome, New York. Performance subcontracted with Lozier Environmental Consulting, Inc. to conduct the asbestos inspection and paint chip sampling activities at the above referenced locations. The inspection included an on-site investigation and collection of samples suspected of containing asbestos and paint coatings which may contain lead in accessible areas within the study area. The purpose of these inspections was to locate and identify building materials suspected of containing asbestos and lead.
A. 800 Irving Avenue, Syracuse, New York:
As a result of our asbestos inspection and subsequent laboratory analysis, the following asbestos-containing materials were identified:
HA
# Material Description Asbestos-Containing
Material Location ~ Quantity
05 Carpet glue (tan) over 12” x 12” floor tile (white) and black mastic
Carpet glue, floor tile and mastic
C106 330 ft2
09* Wall and ceiling seam caulk (pink) Caulk S196 20 ft2
* Material assumed to contain asbestos due to material being inaccessible for sampling.
The red firestop caulk (HA#04) contained a trace amount of Chrysotile which is BELOW the regulatory threshold of >1% asbestos for the material to be considered an asbestos-containing material. For these situations, OSHA regulations require wet methods, prompt clean-up and disposal of wastes in leak-tight containers, no high-speed abrasive disc saws that are not equipped with point-of-cut ventilator or enclosures with HEPA filtered exhaust air, no compressed air used to remove asbestos, and no employee rotation as a means of reducing employee exposure to asbestos. Further information can be obtained from the OSHA Interpretive letter entitled “Compliance requirements for renovation work involving material containing 1% or less” dated 11/24/03.

5.0 DISCUSSION
5.1 Asbestos Control and Management
Renovation and demolition activities, as well as some maintenance activities have the potential to disturb materials and release asbestos fibers into the environment; therefore, government agencies have created regulations to protect the health of workers potentially exposed as well as the environment.
PERFORMANCE ENVIRONMENTAL SERVICES, INC. PAGE 5
WEXFORD, PENNSYLVANIA
EPA:
The Environmental Protection Agency (EPA), under the National Emission Standards for Hazardous Air Pollutants (NESHAPS), requires notification and procedures for emissions control depending on whether the asbestos material in question falls into the definition of “Regulated Asbestos-Containing Material” (RACM). NESHAPS defines RACM as:
(a) Friable asbestos material,
(b) Category I nonfriable ACM that has become friable,
(c) Category I nonfriable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading, or
(d) Category II nonfriable ACM that has a high probability of becoming or having become crumbled, pulverized, or reduced to powder by the forces expected to act on the material during demolition or renovation operations.
The proceeding items summarize basic requirements for demolition and renovation projects according to
NESHAPS:
If the facility is being renovated, notification requirements and procedures for asbestos emission control apply if the combined amount of RACM to be stripped, removed, dislodged, cut, drilled, or similarly disturbed is (i) at least 260 linear feet on pipes, or (ii) at least 160 square feet on other facility components, or (iii) at least 35 cubic feet off facility components where the length or area could not be measured previously.
NEW YORK STATE DEPARTMENT OF LABOR:
The New York State Department of Labor (NYDOL), under Part 56 of Title 12 of the Official Compilation of Codes, Rules and Regulations of the State of New York, requires specific notification and removal procedures to be completed for all asbestos-containing materials (ACM) and presumed asbestos-containing materials (PACM) according to the amounts that are to be disturbed or removed regardless of EPA classification:
(a) Large asbestos project: An asbestos project involving the removal, disturbance, enclosure, encapsulation, repair or handling of 160 square feet or more of ACM, PACM or asbestos material; or 260 linear feet or more of ACM, PACM, or asbestos material.
(b) Small asbestos project: An asbestos project involving the removal, enclosure, repair, disturbance, or any handling of more than 10 and less than 160 square feet of ACM, PACM or asbestos material; or more than 25 and less than 260 linear feet of ACM, PACM, or asbestos material.
(c) Minor asbestos project: An asbestos project involving the removal, encapsulation, enclosure, repair, disturbance, or any handling of 10 square feet or less of ACM, PACM or asbestos material; or 25 linear feet or less of ACM, PACM or asbestos material.
PERFORMANCE ENVIRONMENTAL SERVICES, INC. PAGE 6
WEXFORD, PENNSYLVANIA
5.2 Inspection Limitations and Miscellaneous Field Notes:
The Performance inspection activities were limited to the rooms within the buildings identified in the Bulk Sample Location Maps as provided in Appendix 3. No other areas were assessed during the inspections.
Performance did not complete destructive bulk sampling in areas such as behind finished surfaces (e.g.
plaster or drywall walls, hard ceilings), inside mechanical pipe chases, behind mirrored walls or behind chalkboards; therefore, the inspection was limited to areas that were accessible and/or easily exposed.
Performance did not sample any system that presented a health and safety hazard to the inspector such as energized electrical systems, elevator components, active mechanical systems, or within confined spaces.
Remodeling and renovations within buildings often result in asbestos-containing flooring products (flooring and mastics) being covered with non-asbestos flooring products. Although every attempt is made to delineate flooring types during inspection activities, due to the limited destructive nature of sampling Performance assumes asbestos-containing materials may be present below sampled flooring in areas not inspected. It is imperative that if flooring finishes in an area differ from areas where samples were collected; additional samples are collected and analyzed of the newly uncovered material before disturbance occurs.
If there are any friable asbestos-containing materials present and there is either limited or no visibility above a ceiling area, then Performance assumes that there may be suspect asbestos-containing debris above the ceiling areas. Performance recommends abating the assumed debris if located later prior to any work that might disturb this material.
Throughout this document, when the term “inaccessible” is used, it is defined as areas of the building that were locked or where admittance was not permitted. If any inaccessible areas inside the study area are noted, then Performance assumes there may be suspect asbestos-containing materials inside. If renovation, demolition, or maintenance activities have the potential to disturb inaccessible materials and release asbestos fibers into the environment, then Performance recommends sampling the materials before disturbance. If the test results verify the materials are asbestos-containing materials (greater than 1% asbestos), then Performance recommends abatement before disturbance. If abatement is not performed and the materials are not disturbed, then Performance recommends that an Operations and Maintenance Program be prepared to facilitate the in-place management of these asbestos-containing materials. Federal, state, and local laws regulate removal, transportation, and disposal of asbestos materials.
Performance has prepared this report for the express use of its clients and their approved agents.
Although some information included in this report or in portions of this report may be required to be included in notifications to various parties, this report is not intended to be used as an asbestos specification or work plan.
This report is based upon conditions observed at the property at the time of the inspection. This report does not intend to identify all hazards or to indicate that other hazards do not exist at the project site.
Environmental conditions and regulations are subject to constant change and reinterpretation.

6.0 SUMMARY AND RECOMMENDATIONS
ASBESTOS
Friable Materials:
Performance did not identify any friable materials within the inspected areas at either physical building address.
Category I Nonfriable Materials:
Referring to the definition of RACM in section 3.3.1, EPA NESHAPS requires removal of Category I nonfriable ACM prior to a renovation or demolition if they have become friable or if they will be or have been subjected to sanding, grinding, cutting, or abrading. Performance recommends abating the flooring material (HA#05) at the 800 Irving Avenue, Syracuse, NY address if renovation or demolition work would disturb these materials. If the identified materials are not removed or disturbed and remain in place, then Performance recommends that an Operations and Maintenance Program be prepared to facilitate the in-place management of these asbestos-containing materials.
Category II Nonfriable Materials:
Referring to the definition of RACM in section 3.3.1, EPA NESHAPS requires removal prior to a renovation or demolition of all Category II nonfriable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material during demolition or renovation operations. Due to this requirement and regulatory enforcement, Performance recommends abating the firestop caulk (HA#04) at the 125 Brookley Road, Rome, NY address if it has the potential to be disturbed. If the identified material is not removed or disturbed, then Performance recommends that an Operations and Maintenance Program be prepared to facilitate the in-place management of this asbestos-containing material.
Assumed Materials:
The pink wall and ceiling seam caulk (HA#09) at the 800 Irving Avenue, Syracuse, NY address is assumed to contain a Category II nonfriable ACM and it has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material during demolition or renovation operations. If the material becomes accessible for sampling at a future date, and prior to disturbance, Performance recommends sampling the material by an EPA certified and NY DOL accredited and licensed asbestos inspector to confirm the asbestos content.
Performance recommends removing the caulk if it has the potential to be disturbed. If the identified material is not removed or disturbed, then Performance recommends that an Operations and Maintenance Program be prepared to facilitate the in-place management of this asbestos-containing material.
PERFORMANCE ENVIRONMENTAL SERVICES, INC. PAGE 8
WEXFORD, PENNSYLVANIA
LEAD
Visual observation revealed that paint was noted throughout the work area. Laboratory results verified the presence of lead greater than the laboratory limit of detection (LOD) in paint coatings at both locations.
Since the facility is not regulated under the EPA or HUD as “target housing” or a “child-occupied facility” or regulated under any federal or state housing assistance, no further action for these regulatory agencies is required.
If the lead-containing paint identified in this inspection has the potential to become disturbed such as through demolition or renovation, then OSHA requirements would apply. The OSHA Lead in Construction Standard (29 CFR 1926.62) defines work as:
• Demolition or salvage of structures where lead or materials containing lead are present;
• Removal or encapsulation of materials containing lead;
• New construction, alteration, repair, or renovation of structures, substrates that contain lead, or materials containing lead;
• Installation of products containing lead; or,
• Lead contamination/emergency cleanup.
OSHA lead regulations mandate proper Personal Protective Equipment (PPE), engineering controls and various other requirements for certain construction and/or demolition activities as detailed in 29 CFR
1926.62 for building components containing detectable levels of lead. Since there were detectible levels of lead present, OSHA regulations do apply.

Notes:
Note 1: Callout tags showing the location of asbestos-containing materials may only be used to locate which room or corridor contains the material. The tags do not indicate the location of the material within the room or corridor.
Note 2: All doors, door frames and firehatches may contain asbestos materials that should not be disturbed.
Performance recommends testing any doors, door frames, firehatches or firehoses for the presence of asbestos prior to any activities that may disturb them.
Note 3: Performance assumes concealed flooring materials beneath finish floor surfaces contain asbestos unless sampled. If demolition or renovation work uncovers previously inaccessible flooring materials, please review the associated survey report to ensure all layers of flooring have been sampled before disturbance.
