| TECHNICAL QUESTIONS AND VA RESPONSE TRACKING SHEET | ||||
| ITEM # | MATOC | SEED PROJECT | QUESTION | GOVERNMENT RESPONSE |
| 1 | X | In the event of contract modifications/change orders, should performance and payment bond premiums be applied to each individual change order proposal or wait until the end of the project where a final modification is issued for the overruns? We ask this because VA Acquisition Regulation (VAAR) clause 852.228-70, titled "Bond Premium Adjustment” states “in determining the basis for final settlement.” | Yes, please ensure that the bond premium adjustment is applied in each individual modification/change order proposal. | |
| 2 | X | Will the VA allow for stored material so that we can procure and lay down long lead items and/or critical path material/equipment? | No. The VA will not allow for materials to be stored on-site due to the space limitations at the facility. | |
| 3 | X | Will the VA fully pay for this material/equipment if stored onsite? | VA will fully pay for material/equipment provided it has been inspected and accepted by the COR. | |
| 4 | X | Would the Government prefer allowance pricing, unit pricing, or a change order approach for conditions identified post-award through testing? Without knowing the actual moisture or pH conditions of the concrete prior to bid, there is significant risk in trying to price products like moisture remediation coatings (epoxy vapor barriers, etc.), cementitious self-leveling underlayment, or trowel-applied patches. Including these without confirmation could lead to either inflated pricing or post-award cost disputes. Thus, under FAR principles of clarity in solicitation documents and equitable risk distribution please provide clear direction on what is to be included in our base bid for subsurface preparation. | Refer to FAR Part 52.236-2 for different site conditions. Also, refer to the project specifications with regard to the requirements for this specific issue on moisture and pH conditions of concrete and required efforts for moisture mitigation. |
Refer to the project specifications with regard to the requirements for this specific issue on moisture and pH conditions of concrete and required efforts for moisture mitigation. This is a firm-fixed price contract. Refer to FAR Part 52.236-2 for different site conditions.
| 5 | X | Spec Section 01 32 16: In the event contractor’s work has to be postponed on a given day due to “Acts of God” will contractor be able to get this day back for POP? | Decisions to extend the POP will be based in accordance with the requirements specified in specification section 01 32 16.15, parts 1.11 and 1.12. |
| 6 | X | In response to Sheet AE 100 - Hazardous Material note #1, we respectfully request clarification regarding the expectation for discovery and removal of unknown hazardous materials during the bidding and construction phases. It is not feasible for the contractor to be held responsible for hazardous materials that have not been disclosed or identified prior to bid submission. Please clarify or revise the language to reflect that the contractor is not responsible for identifying or pricing the removal/disposal of unknown hazardous materials during the bid phase, and that any such discovery during construction will be addressed through a change order or owner-provided direction? | The note is very clear and the language will not be revised. Refer to FAR Clause 52.236-2 Differing Site Conditions, and 852.223-71 Unsafe conditions due to presence of hazardous materials. |
| 7 | X | AE-100 Hazardous Material Note 1: In the case contractor encounters hazardous materials through survey and is in confliction with contractors SOW. Will VA issue change order for the material to be removed & additionally extending the POP for this task? | Refer to FAR Clause 52.236-2 Differing Site Conditions, and 852.223-71 Unsafe conditions due to presence of hazardous materials. Decisions to extend the POP will be based in accordance with the requirements specified in project specification section 01 32 16.15, part 1.12. |
