About this file

This document is a pre-solicitation notice for a multiple award task order contract for construction services in Minnesota. The Department of Veterans Affairs intends to award a minimum of eight indefinite-delivery, indefinite-quantity contracts ranging from $2,000 to $10 million each, with a total maximum value of $70 million over five years. The contracts will cover construction, maintenance, repair and alteration projects at VA facilities in Minnesota. A bid bond will be required for the initial $2-5 million seed project. Task orders will be competitively issued to the selected contractors, who will be given the opportunity to bid. The solicitation targets service-disabled veteran-owned small businesses. Respondents must register in SAM and ORCA and complete Vets 100 prior to award.

BASIS FOR AWARD AND EVALUATION FACTORS

1. BASIS FOR AWARD

1.1 This is a competitive procurement using the best value tradeoff source selection process identified in FAR Part 15.101-1. For this procurement, the government will award contracts resulting from the solicitation to the responsible offerors whose offers conforming to the solicitation are evaluated as being the most advantageous to the government, price and other factors considered. A contract will only be awarded to an offeror who is deemed responsible in accordance with FAR Part 9 and whose proposal conforms to the RFP’s requirements (to include all stated terms, conditions, representations and certifications).

1.2 The Government estimates awarding a minimum of eight (8) contract awards to Offerors that conform to the proposal requirements set forth in the RFP and represent the best value to the Government.

1.3 BASIS FOR AWARD (SEED PROJECT): The SEED project shall be awarded based on the lowest priced proposal from the successful IDIQ contract award recipients.

1.4 The Contracting Officer will conduct proposal compliance review for determination of basic proposal adequacy prior to providing the proposals to the board. Non-compliance with the RFP requirements may be grounds to eliminate the proposal from consideration for contract award.

1.5 Although the assessment of Past Performance as a specific evaluation factor is separate and distinct from the Determination of Responsibility required by FAR Part 9, Past Performance information obtained herein will be used during the Government’s responsibility determination. The Government also reserves the right to obtain additional information solely for the purpose of making a responsibility determination from all Offerors after receipt of proposals. Requests for responsibility information do not constitute discussions.

1.6 ENFORCEABILITY OF PROPOSAL: The proposal must set forth full, accurate and complete information as required by this solicitation. The Government will rely on such information in the award of a contract. By submission of the offer, the Offeror agrees that all items proposed will be utilized for the duration of the contract and any substitutions (e.g., key personnel, subcontractors, plans, etc.) shall require Contracting Officer's approval.

1.7 The Offeror shall be held responsible for the validity of all information supplied in his/her proposal, including that provided by potential subcontractors. Should subsequent investigation disclose that the fact and conditions were not as stated the proposal may be rejected and removed from consideration for award.

1.8 The Government reserves the right to reject any or all proposals at any time prior to award if such action is in the Government's best interest.

2. EVALUATION FACTORS

2.1 The following factors will be included in the solicitation and will be used to evaluate proposals:

1.Technical Approach
2.Company Experience
3.Project Management
4.Past Performance
5.Price

2.2 All non-price factors are of equal importance and, when combined, are significantly more important than price.

2.3 TECHNICAL FACTOR 1 – TECHNICAL APPROACH

This factor will be used to assess an offeror’s understanding of the scope of work required for the project along with the appropriate plans that will ensure achievement of the objectives. The government will evaluate each offeror's approach for scheduling capability, capacity, and methodology. As part of the schedule approach, the offeror shall provide a detailed schedule relevant to the seed project. The government will evaluate each offeror's approach to quality control, infection control, and safety control/plan. The offeror shall submit a proposed/draft safety plan but discuss the planned approach for quality and infection control. The safety plan shall demonstrate familiarity with and adherence to OSHA standards and State OSHA safety requirements. The proposed/draft safety plan must address the following:

(1) Work activity safety measures

(2) Emergency response measures

(3) Safety reporting plan

(4) Safety plan shall outline training requirements to ensure that the Project Superintendent has completed OSHA Construction 30-hour training and each employee has completed OSHA Construction 10-hour training.

(5) How it is to be monitored and enforced under any task order awarded.

2.4 TECHNICAL FACTOR 2 – COMPANY EXPERIENCE

This factor will be used to assess an offeror’s experience in performing construction work in a health care environment. The offeror shall discuss construction projects that have been completed successfully that show experience in a health care or similar environment. The government will evaluate each offeror's company experience in providing construction services, which are of similar nature to the work which could appropriately be awarded as an order under this MATOC as defined for this requirement. The company’s relevant experience will be assessed on the basis of its breadth and depth. Offeror shall have a minimum of 3 years’ experience performing construction in a health care environment. Other relevant (other Government, Institutional, Commercial) will be considered.

The offeror shall discuss any subcontractor relationships. The offeror shall show the ability that they can provide, maintain, and manage multiple subcontractors. The offeror shall identify any subcontractors, if applicable for the seed project and provide capabilities and qualifications (resumes) to show they can meet the required planning, implementation and completion of the project.

2.5 TECHNICAL FACTOR 3 – PROJECT MANAGEMENT

The offeror will be evaluated based on the resumes for the Project Manager, Site Superintendent, Quality Control Manager, and Safety Officer. Resumes should reflect current employment within the company of the offeror. Resumes will be evaluated on the level and type of experience and education.

Evaluation of the Project Manager and Site Superintendent will include types of projects managed, types of subcontractors supervised and the ability to coordinate multiple contract tasks. Resume shall demonstrate at least 7 years’ experience on construction projects similar in nature of work, which could appropriately be awarded as an order under MATOC as defined for this requirement.

OR

A graduate of a 4-year accredited college program in one of the following disciplines: Engineering, Architecture, Construction Management, Engineering Technology, Environmental Health, Building Science or Project Management Professional (Project Management Professional (PMP) is a credential offered by the Project Management Institute (PMI)), AND a minimum of 3 years’ experience as a project manager, superintendent and/or construction manager on projects similar in nature of work, which could appropriately be awarded as an order under this MAOTC as defined for this requirement.

Quality Control Manager and Safety Officer shall have at least 4 years’ experience in a construction related environment.

OR

A graduate of a 4-year accredited college program in one of the following disciplines: Engineering, Architecture, Construction Management, Engineering Technology, Environmental Health, Building Science or Project Management Professional (Project Management Professional (PMP) is a credential offered by the Project Management Institute (PMI)), AND a minimum of 2 years’ experience as a quality control manager and/or safety officer on projects similar in nature of work, which could appropriately be awarded as an order under this MATOC as defined for this requirement.

2.6 FACTOR 4 – PAST PERFORMANCE

The Contracting Officer will evaluate past performance to assess the risk associated with an offeror’s likelihood of success in performing the solicitation’s requirements as indicated by an offeror’s record of past performance under other contracts. The Contracting Officer will consider references from either inside or outside the federal government, so long as the performance is recent (within the last three years) and relevant (for the same or similar work). The Contracting Officer may also consider past performance information from sources other than those provided by the offerors.

In the case of an offeror without a record of recent/relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror will not be evaluated favorably or unfavorably on past performance.

2.7 FACTOR 5 – PRICE

The Offeror’s price proposal for the seed project will be evaluated by the Contracting Officer. The Offeror’s price evaluated will be the price for construction submitted for the seed project and presented to the Contracting Officer for consideration. Price breakdown by division will be evaluated.

Price Completeness: Price proposals will be evaluated to determine if the proposal contains costs to perform all tasks as required by the Statement of Work, Specifications, and Design Drawings.

Price Reasonableness: Reasonableness is based on the total evaluated price compared to historical prices for similar efforts, comparison to the Independent Government Estimate (IGE), and price competition obtained by the other offerors’ proposals submitted in response to this RFP. A reasonable price represents an amount that a prudent person would pay in a competitive business environment.

3. EVALUATION

3.1 COMPETITIVE RANGE

3.1.1 The Government reserves the right to limit for purposes of efficiency pursuant to FAR 15.306(c)(2), the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated. If the Contracting Officer decides that an Offeror’ s proposal should no longer be included in the competitive range, the proposal shall be eliminated from consideration for award and written notice of the decision shall be provided to the unsuccessful Offeror in accordance with FAR 15.503.

3.2 DISCUSSIONS

3.2.1 The Government may award without discussions; however, if after initial evaluations, the Contracting Officer reserves the right to conduct discussions if they are determined necessary to obtain the best value, based on the requirements and the evaluation factors set forth in this RFP. If discussions are necessary due to perceived weaknesses or other issues, which must be addressed before award, they will be conducted with only those Offerors determined to be within the competitive range. Discussions may be conducted either orally or in writing. The scope and extent of discussions are a matter of contracting officer judgment. Accordingly, Offerors are advised to submit initial proposals which are fully and clearly acceptable and without the need for additional information. Offerors may be restricted to a short turnaround (i.e., less than 24 hours) in responding to the contracting officer during any discussion period.

4. FINAL PROPOSAL REVISIONS

4.1.1 If discussions are conducted, final proposal revisions will be required in determining the award of a contract resulting from this RFP. Offerors may be required to respond with their final proposal revision within 3-5 business days. However, the Government reserves the right to award a contract without discussions or opportunity for proposal revisions, in which case, final proposal revisions will not be required.

5. AWARD DECISION

5.1.1 As a result of this solicitation, the Government anticipates awarding a MINIMUM of eight (8) IDIQ contracts to offerors that conform to the proposal requirements set forth in the RFP and represent the best value to the Government; however, the Government shall reserve the right to make more or less IDIQ awards.

6. DEBRIEFINGS

6.1.1 Offerors excluded from the competitive range or otherwise excluded from the competition before award may submit a written request for a debriefing to the Contracting Officer in accordance with FAR 15.505.

6.1.2 After award, unsuccessful Offerors may submit a written request for a debriefing to the Contracting Officer in accordance with FAR 15.506.

6.1.2.1 Those offerors that had been debriefed as a result of not being included in the competitive may NOT request a debriefing after award.

(b) For each task order awarded (including SEED project), that shall exceed $150,000, a proposal guarantee (bid bond) is required in an amount not less than 20 percent of the proposed price of the task order, but shall not exceed $3,000,000. Failure to furnish the required bid guarantee on form SF24, in the proper amount, by the time set for submitting a proposal, will result in rejection of the proposal in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

(c) For each task order awarded (including the SEED project) under an IDIQ Construction Base Contract that shall exceed $150,000 (see FAR 28.102-1 for lesser amount), the vendor will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum of the task order award.
