About this file

This document is an Amendment of Solicitation/Modification of Contract (Standard Form 30) for a Department of Veterans Affairs contract issued by the Network Contracting Office 21 at the VA Southern Nevada Healthcare System. The amendment (number 0005) extends the receipt of offers deadline to January 12, 2026, at 10:00 AM PST, and provides an answer to a previously unaddressed question regarding an Arc Flash Study procurement.

The amendment includes a detailed Q&A addressing the classification of Arc Flash Studies as engineering services (NAICS code 541330) and clarifies the evaluation criteria for quotes. Specifically, offerors will be required to provide electrical engineering certifications, electrical licenses for NFPA70E compliance, documentation of 3 years of past arc flash studies, and demonstrate capability to meet the statement of work requirements. The contracting officer confirmed that the Request for Quote (RFQ) is consistent with previous arc flash study procurement approaches and will be evaluated based on technical competence and qualifications.

Questions & Answers

1. Arc Flash Study falls under engineering services 541330 as you have selected in the solicitation. This should come through the AE Engineering / Construction Team traditionally. Additionally, based on the Brooks Act Engineering Services cannot be priced and must follow a qualifications-based selection criteria. So essentially you all need to follow standard AE procurement process in accordance with 36.601-4 of the FAR. We are a firm that do these arc flash studies nationwide and were a part of the CFM IDIQ for the arc flash studies. Please let me know if you will change the process based on the FAR clause below:

The definition of Engineering Services is listed in the FAR clause below:

36.601-4 FAR

(a) Contracting officers should consider the following services to be "architect-engineer services" subject to the procedures of this subpart:

(1) Professional services of an architectural or engineering nature, as defined by applicable State law, which the State law requires to be performed or approved by a registered architect or engineer.

(2) Professional services of an architectural or engineering nature associated with design or construction of real property.

(3) Other professional services of an architectural or engineering nature or services incidental thereto (including studies, investigations, surveying and mapping, tests, evaluations, consultations, comprehensive planning, program management, conceptual designs, plans and specifications, value engineering, construction phase services, soils engineering, drawing reviews, preparation of

A: The FAR reference specifies that a Contracting Officer should consider, so the concerns raised in regard to that FAR reference were considered. After a review of previously awarded requirements, the RFQ was consistent with previous request for quotes for Arc Flash Studies.

Also, the technical aspects of the quotes will be evaluated by the requiring agency and their technical experts for technical acceptability. The evaluation will evaluate quotes based on demonstrated competence and qualifications. Please also note that in 52.212-2 under Factor 1

– Technical, it includes the following:

- Offeror shall provide all electrical engineering certifications and electrical licenses to meet the electrical arc flash study requirements to work on electrical distribution per NFPA70E.

- Offeror shall provide documentation for 3 years of past arc flash studies performed.

- Offeror shall detail capability to meet the scope of work and requirements stated in the statement of work.
