About this file
This is Amendment 0003 to Solicitation 36C24426R0021 for Wheelchair Van Transportation Services at the Altoona Veterans Affairs Medical Center (VAMC), issued by the Department of Veterans Affairs Network Contracting Office 4. The amendment addresses two contractor questions regarding pricing adjustments and billing methodology, clarifying that all CLINs (Contract Line Item Numbers) 0001-0006 are subject to the same price adjustment mechanism using a 15% fuel cost basis as specified in the contract terms, with adjustments calculated annually rather than quarterly. The amendment also clarifies that round-trip transportation is billed on a per-leg, one-way basis, with each leg charged according to the county from which the Veteran is departing, rather than the originating county of the complete round trip.
Additionally, Amendment 0003 incorporates FAR 52.222-90 (Addressing DEI Discrimination by Federal Contractors, effective April 2026) into the contract requirements. This clause prohibits contractors and subcontractors from engaging in racially discriminatory diversity, equity, and inclusion (DEI) activities and requires contractors to furnish compliance information upon request. The clause establishes that noncompliance may result in contract cancellation, termination, suspension, or contractor ineligibility for future Government contracts. All other terms and conditions of the original solicitation remain unchanged.

X X X X The purpose of this amendment is to answer Questions 1 and 2 as well as ADD Clause FAR 52.222-90. Below is the Clause in Full Text for your review.
All other terms and conditions shall remain the same.
Cynthia Laemmerhirt The purpose of this amendment is to answer Q1, Q2, and to add Clause FAR 52.222-90.
Q1. (1) Are all CLINs 0001-0006 subject to the same price adjustment?
(c) states: The Adjusting Index shall be the most recent Index published prior to the date of contract adjustment, as specified in paragraph (f).
(c) For purposes of this clause, it will be conclusively presumed that 15.00 percent (%) of the price of per mile transportation CLINs for Wheelchair Van Transportation Services represents the Base Cost of fuel and the resulting Base Cost will be the basis upon which adjustment will be made under this clause.
The example uses a 10.00 percent of total gasoline price per mile. Will this contract use 15.00 percent or 10.00 percent price adjustment?
(B) Will the dates of the contract adjustment be annually as stated in (f) or quarterly as stated in the (g)1 example?
A1. All of the CLINs listed are subject to the same price adjustment because they all have fuel included. VA will be using 15% as stated in (c). In (g), the example presents using 10%. This calculation will be made Annually on or about prior to the annual date of the new task order.
Q2. “I do have one more question. Will both legs of “round trips” be paid based on the originating CLIN? An example of this is a patient is transported from a location in Elk county to Cambria county and back to Elk county. Will each leg have a charge based on the county the trip originated from, with mileage or does each trip leg have a different price based on the county the leg is leaving from? I understand that trips within their originating county are not receive a mileage charge. I am asking CLIN to CLIN round trips.”
A2. Each trip is considered a one-way trip. So, according to your example, the Veteran went from Elk County to Cambria County, the trip would originate in Elk County and end in Cambria County. The return trip, a one-way trip, would originate in Cambria County and end in Elk County. So, in this example, since each leg is a one-way trip, the base rate will be different based on the county the Veteran is leaving.
A.1 52.222-90 ADDRESSING DEI DISCRIMINATION BY FEDERAL CONTRACTORS (APR 2026).
(a) Definitions. As used in this clause— Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.
Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.
(b) In connection with the performance of work under this contract, the Contractor agrees as follows:
(1) The Contractor will not engage in any racially discriminatory DEI activities;
(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;
(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;
(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and
(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.
(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).
(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.
