INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS
PART I – GENERAL
1. Request for Proposal.
This is a Request for Proposal (RFP) in accordance with FAR Part 15. Award will be made to the offeror whose proposal represents the “best value” to the Government utilizing the Lowest Price-Technically Acceptable (LPTA) source selection process. Evaluation Factors include Past Performance, Relevant Experience, and Construction/Project Management contained in Volume I (Non-Price Factors) and Price contained in volume II (Price).
In order to be eligible for award, a rating of ACCEPTABLE must be achieved for ALL FACTORS in Volume I (Non-Price Factors).
A responsibility determination will be made in accordance with FAR 9.1, Responsible Prospective Contractors. All proposals shall be subject to evaluation by a team of Government personnel.
In accordance with FAR 52.215-1, Instructions to Offeror-Competitive Acquisition, The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offerors initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
If the Offeror communicates in its proposal any qualifications, exceptions, exclusions, or conditions to the proposed prices in the Offerors proposal documents, the Contracting Officer may reject the proposal and exclude the Offeror from further consideration.
2. Gender: Whenever the feminine gender is used in this solicitation and contract documents, it shall be considered to include masculine.
3. The Government makes no guarantee as to the accuracy of the electronic copies of drawings.
4. Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at http://www.beta.SAM.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Offerors are encouraged to ensure that they are registered in SAM prior to submitting their proposal.
5. Mailing List: Offerors are encouraged to enter their contact information in the Contracting Opportunities website at https://beta.sam.gov/.
6. Amendments: Amendments to Solicitation No.36C10F20R0042 will be posted at https://beta.sam.gov/. Paper copies of the amendments will NOT be individually mailed. By registering to Receive Notification list at https://beta.sam.gov/, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Potential Offerors are advised that they are responsible for obtaining and acknowledging any amendments to the solicitation. Failure to acknowledge an amendment may result in your proposal being considered non-responsive.
7. A public bid opening will not occur under this RFP solicitation.
8. VETS 4212: Title 38, USC Section 4212(d) and Public Law 105-339, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS 4212 reporting information can be done electronically at: https://www.dol.gov/agencies/vets/programs/vets4212. FAR 22.1303(c) states The Act requires submission of the VETS-4212 Report in all cases where the contractor or subcontractor has received an award of $150,000 or more, except for awards to State and local governments, and foreign organizations where the workers are recruited outside of the United States.
9. Contractor CPARS.
(a) As prescribed in Federal Acquisition Regulation (FAR) Part 42.1502, the Department of Veterans Affairs (VA) evaluates contractor past performance on all contracts that exceed $700,000 and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement VA uses online databases located at the Contractor Performance Assessment Reporting System (CPARS) website http://www.cpars.gov/.
(b) Contracts. Except as provided in paragraphs (e), (f), and (h) of this section, agencies shall prepare evaluations of contractor performance for each contract that exceeds the simplified acquisition threshold and for each order that exceeds the simplified acquisition threshold. Agencies are required to prepare an evaluation if a modification to the contract causes the dollar amount to exceed the simplified acquisition threshold.
(c) Orders under multiple-agency contracts. Agencies shall prepare an evaluation of contractor performance for each order that exceeds the simplified acquisition threshold that is placed under a Federal Supply Schedule contract or placed under a task-order contract or a delivery-order contract awarded by another agency (i.e., Governmentwide acquisition contract or multi-agency contract). Agencies placing orders under their own multiple-agency contract shall also prepare evaluations for their own orders. This evaluation shall not consider the requirements under paragraph (g) of this section. Agencies are required to prepare an evaluation if a modification to the order causes the dollar amount to exceed the simplified acquisition threshold.
(d) Orders under single-agency contracts. For single-agency task-order and delivery-order contracts, the contracting officer may require performance evaluations for each order in excess of the simplified acquisition threshold when such evaluations would produce more useful past performance information for source selection officials than that contained in the overall contract evaluation (e.g., when the scope of the basic contract is very broad and the nature of individual orders could be significantly different). This evaluation need not consider the requirements under paragraph (g) of this section unless the contracting officer deems it appropriate.
(e) Past performance evaluations shall be prepared for each construction contract of $700,000 or more, and for each construction contract terminated for default regardless of contract value. Past performance evaluations may also be prepared for construction contracts below $700,000.
(f) Past performance evaluations shall be prepared for each architect-engineer services contract of $35,000 or more, and for each architect-engineer services contract that is terminated for default regardless of contract value. Past performance evaluations may also be prepared for architect-engineer services contracts below $35,000.
(g) Past performance evaluations shall include an assessment of the contractor's-
(1) Performance against, and efforts to achieve, the goals identified in the small business subcontracting plan when the contract includes the clause at FAR 52.219-9, Small Business Subcontracting Plan; and
(2) Reduced or untimely payments made to small business subcontractors, determined by the contracting officer to be unjustified.
10. Offeror shall include the Safety or Environmental Violations and Experience Modification Rating Information, including filling out Attachment Safety or Environment Violations and Experience Modification Rating.
1. All Offerors shall submit information pertaining to their past Safety and Environmental record. The information must contain a certification that the Offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years. If such certification cannot be made, an Offeror shall explain why and submit as much information as possible regarding the circumstances of its past safety and environmental record, including the number of EPA violations and/or the number of serious, repeat, and/or willful OSHA violations, along with a detailed description of those violations.
2. All Offerors shall submit information regarding their current Experience Modification Rate (EMR). This information shall be obtained from the Offeror’s insurance carrier and be furnished on the insurance carrier’s letterhead. If an Offeror’s EMR is above 1.0, Offeror must submit a written explanation of the EMR from its insurance carrier furnished on the insurance carrier’s letterhead, describing the reasons for the elevated EMR and the anticipated date the EMR may be reduced to 1.0 or below.
3. Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.
4. If the NCCI cannot issue an EMR because the Offeror lacks insurance history, Offeror shall submit a letter indicating so from its insurance carrier furnished on the insurance carrier’s letterhead, and include a letter from the NCCI indicating that is has assigned Offeror a Unity Rating of 1.0.
5. The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases, will be used to make an initial Determination of Responsibility.
6. This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.
*If the EMR rating for the subcontracting tiers cannot be provided at time of proposal submission, the prime contractor shall acknowledge this and provide as a submittal with the insurance and bonding requirements.
11. VOLUME I, TECHNICAL FACTORS.
DEFINITIONS
Recency: “Recent”, for the sake of this solicitation, refers to construction project/contract work experience performed in the last five (5) years (between 2015 to 2020). Projects may be completed or “well underway”. A "well underway" construction project is at least 50-percent complete at the time of proposal submission.
Relevancy: “Relevant” experience is defined as construction contracts of a similar size (projects of 10 acres or larger and exceeding $15M in construction costs) and comparable level of complexity to the Massachusetts National Cemetery, Phase 4 Project. Relevant complexity aspects are identified as the examples in the bullets below. All examples identified below are of equal relevance.
· VA/NCA National Cemetery projects
· State/local/private cemetery projects
· Golf courses, national, state and regional parks, multiple sports-fields complexes or multi-phased recreation-oriented land development projects of 10 acres or larger
5.0 EVALUATION FACTORS
Technical qualifications evaluation factors consist of: (1) Past Performance, (2) Relevant Experience, and (3) Construction/Project Management.
FACTOR 1 - PAST PERFORMANCE
The Government will utilize the Past Performance Information Retrieval System (PPIRS) as a source for past performance data. The focus of the Government's PPIRS query will be for construction projects recently completed or “well underway” within the past 5 years.
Offerors shall provide the following.
1. Offerors shall submit Past Performance Questionnaire (PPQ) Forms (See Attachment 10) for no less than THREE (3), and no more than FIVE (5), construction contracts or “well underway” contracts. Each submitted Past Performance contract must meet Recency and Relevancy definitions as described in solicitation section entitled “TECHNICAL EVALUATION RATING DEFINITIONS”. Offerors shall have their project reference fill out a PPQ Form and email them directly to the Contracting Officer on or before the closing date of the RFP. For the Government to solicit candid, fair comments, the Government will not release the PPQ Form to the Offeror. The Offeror may supplement the PPQ with additional information at their discretion.
If a completed past performance evaluation is available in CPARS, it shall be submitted with the proposal for each project referenced for Past Performance. If there is not a completed past performance evaluation available in CPARS, then the Offeror shall submit a Past Performance Questionnaire (PPQ) (reference Attachment 10) for each project referenced for Past Performance. The Offeror shall notify their client that the PPQ shall be submitted via email to the Government’s point of contact, Athena.jackson@va.gov.

Offerors are responsible for ensuring that the telephone numbers provided for the owner’s representative provided are accurate and that the representative is aware that the TEB may be contacting them regarding the questionnaire and the Offeror’s past performance.
Past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. It considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract requirements. One past performance recency rating and one past performance relevancy rating will be assigned for each offeror after evaluating the offeror's recent past performance, focusing on performance that is relevant to the contract requirements. (see FAR 15.305). There are three aspects to the past performance evaluation:

Relevancy: Each project submitted for evaluation will be assigned a Relevancy Rating factor as defined in Section 4.0 Technical Evaluation Rating Definitions.”
Quality: “Quality” refers to how well the contractor performed on the recent and relevant past contracts. This process gathers and evaluates information from customers on how well the offeror performed those past contracts. The TEB shall identify the summary performance rating for each contract and identify, in narrative format, all past performance information that would bolster or diminish the Government’s confidence in the offeror’s ability to perform work on this contract.
MINIMUM REQUIREMENTS: Offeror provides Past Performance Questionnaires for at least three (3) completed construction contracts or “well underway” projects that are recent and relevant as defined in the TECHNICAL EVALUATION RATING DEFINITIONS for which the customer indicates that their overall satisfaction with the Offeror’s performance is Satisfactory or better.
NOTE: If no recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, Past Performance will be identified as a Neutral with a Rating of Acceptable. In accordance with FAR Part 15.305(a)(2), such offerors may submit relevant past performance information regarding predecessor companies; key personnel who have relevant experience; or subcontractors that will be performing major or critical aspects of this requirement; provided that such information is relevant to the construction in this solicitation.
