About this file

This document is a Questions and Answers clarification issued by the State of New Mexico Facilities Management Division on August 28, 2026, addressing inquiries submitted by prospective bidders regarding RFP 70-350-26-08806 for the Carlsbad State Veterans Cemetery construction project. The project encompasses construction of a new approximately 2,810 gross square foot administration and maintenance building, a committal shelter, precast columbarium units, and site development on a 15-acre tract (with less than 4.9 acres of disturbance) including paved asphalt roads, concrete curbs, subsurface stormwater drainage cells, ornamental and chain-link fencing, site gates, and pre-placed in-ground crypts and cremains burial units with xeriscaping and irrigation. Alternate No. 1 includes interior improvements to the administration and maintenance building with a public information center, director's office, honor guard areas, restrooms, and equipment service bays. The mandatory pre-proposal conference was held on August 24, 2026. Key deadlines include questions and substitution requests due September 1, 2026, at 3:00 PM MDT, with responses provided by September 8, 2026, at 3:00 PM MDT, and proposals due September 11, 2026, at 3:00 PM MDT. Proposal pricing must remain firm for 120 days after the proposal due date or 90 days after a Best and Final Offer, if applicable.

Prospective general contractors must demonstrate experience with two or more completed public or private projects exceeding $6 million (Attachment A) and projects exceeding $15 million completed within the last ten years (Attachment E). The assigned project manager and project superintendent must each have experience on construction projects valued at $10 million or more. The bid documents identify an FF&E allowance included in the base bid amount, which does not include New Mexico gross receipts tax; all costs related to final FF&E placement are included within the allowance. Crypts and cremains units, as well as columbarium niche covers, are provided by DVS with the contractor responsible only for installation work. The base bid includes 250 columbarium niches, while Alternate No. 1 adds an additional 250 niches. Fire suppression, Division 21, and Divisions 27 and 28 (Communications and Electronic Safety & Security) were removed from the scope as owner-provided items and excluded from the revised bid sheet. The allowable overhead and profit percentages for direct work costs remain at 5% or 10% per the State of New Mexico contract template and will not be revised despite bidder concerns regarding current market conditions.

Project Experience / Past Performance Requirement Clarification

Generated on Aug 25, 2026 7:29 AM MDT - Camille Cordova

Question 4, Aug 24, 2026 7:34 AM MDT

There appear to be conflicting project value and quantity requirements regarding the experience/past performance criteria: Appendix F – General Contractor Qualifications, Section 2(b) states: “Provide information about five (5) or more completed public or private projects over $10 million. Complete Attachment A for five (5) maximum projects listed.” Attachment A – Reference 5.2, Experience states: “Experience in public or private facilities projects over $6 million.” Additionally, the Bonfire e-Procurement electronic system, under Section 5.2 – Evaluation Factors, Past Performance (See Table 1) (80 Pts.), Item B, states: “Attachment A – For each of two (2) completed projects over 6 million dollars.” Please clarify the project experience/past performance requirement that Offerors should follow. Specifically, what is the minimum required project value ($6 million or $10 million), and how many completed projects/Attachment A forms are required to be submitted (two or five)?

Answer. Appendix F Section 2b shall be revised to “b. Provide information about two (2) or more completed public or private projects over $6 million. Complete Attachment A for two (2) maximum projects listed. “. See amendment 1. See updated notice from 8/28/26.

General Contractor Qualifications – Attachment E Project Experience

Question 5, Aug 24, 2026 7:37 AM MDT

The General Contractor Qualifications, Section 2(a), requires Offerors to list projects completed or at least 75% complete for FMD, other governmental bodies, or private entities within the last five (5) years and directs Offerors to complete Attachment E. However, Attachment E – Reference 2.a states that projects worth more than $15 million completed within the last ten (10) years may be included. Please clarify the applicable project experience requirements for Attachment E. Specifically, should Offerors provide qualifying projects from the last five (5) years or the last ten (10) years, and is the $15 million project value stated in Attachment E a mandatory minimum requirement?

Answer.

Appendix F Section 2a shall be revised from “in the last 5 years” to “in the last 10 years.”

The $15 million project value is correct. It is a mandatory minimum requirement. See updated notice from 8/28/26.

Project Manager and Project Superintendent Experience Requirements

Generated on Aug 25, 2026 7:29 AM MDT - Camille Cordova

Question 6, Aug 24, 2026 7:38 AM MDT

The General Contractor Qualifications require the assigned Project Manager and Project Superintendent to each have experience in their respective roles on one (1) or more construction projects valued at $10 million or more. However, Attachment A – Reference 5.2, Experience references public or private facilities projects valued at over $6 million. Please clarify whether the project experience identified in Attachment A must also demonstrate that the proposed Project Manager and Project Superintendent served in their respective roles on projects valued at $10 million or more, or whether projects valued over $6 million submitted under Attachment A will satisfy the experience requirements for the proposed Project Manager and Project Superintendent.

Answer.

Since this is a general inquiry about the person’s overall experience, the $10 million threshold applies. This project is over $10 million so it is a reasonable threshold.

Attachment A is specific to a ‘similar’ project in scope of work.

Section 2.3 – General Requirements, Item #7 – Proposal Offer Firm:

Question 7, Aug 24, 2026 7:40 AM MDT

This section states that responses to the RFP, including proposed pricing for services, will remain firm for one hundred twenty (120) days after the proposal due date, or ninety (90) days after the due date for receipt of a Best and Final Offer, if applicable. Please clarify whether FMD will consider a change order or other equitable adjustment for documented material price increases that occur during the 120-day proposal validity period and prior to contract award or Notice to Proceed.

Answer. No.

(No Subject)

Question 8, Aug 24, 2026 7:53 AM MDT

Generated on Aug 25, 2026 7:29 AM MDT - Camille Cordova

The Draft Contract includes an Allowable Overhead and Profit Schedule for Direct Work Costs, which limits Contractor and Subcontractor overhead and profit markups to 5% or 10%, depending on the category of work. These percentages appear low in comparison with current construction industry costs and current market conditions. Please confirm whether the Owner will consider revising the allowable overhead and profit percentages to better reflect current labor, administrative, insurance, operational, and other costs associated with performing and managing change order work.

Answer. Please read section 2.3 Items 15, 16 and 17 for the process for this item. The current thresholds will not be changed as this is the State of New Mexico Contract template in which Facilities Management Division utilizes. Potential bidders are welcome to submit in their proposal following Section 2.3 for consideration.

(No Subject)

Question 9, Aug 24, 2026 8:27 AM MDT

Please clarify whether Builder’s Risk insurance is required for this project and, if so, whether the policy is to be provided by the Owner or the General Contractor.

Answer. Please refer to sections 3,4 and 5 of the Request for proposals document for all requirements on this project.

Question 10, Aug 25th 2026, 12:12 PM MDT

Please clarify the pre-proposal conference requirement for RFP 70-350-26-08806.

The RFP contains inconsistent guidance concerning the conference

Page 5 describes participation using permissive or encouraging language.

Section 2.1, page 12, does not provide a date for the pre-proposal meeting.

Section 2.2.3, page 13, states that the in-person pre-proposal meeting was mandatory and identifies August 24, 2026, as the meeting date.

A prospective offeror relied on the earlier event information and did not identify the mandatory language in Section 2.2.3 before August 24. Consequently, the prospective offeror was unable to attend the conference.

Generated on Aug 25, 2026 7:29 AM MDT - Camille Cordova

Given the conflicting and incomplete solicitation language, please confirm that nonattendance will not render a prospective offeror ineligible or nonresponsive and that an otherwise complete and responsive proposal may be submitted for consideration.

Answer. Section 2.3 Explanation of Events as well as the portal events section was very clear this was a mandatory requirement to bid on the project. Pages 5 and 12 have been updated to reflect the same information.

Question 11, Aug 25th 2026, 1:01 PM MDT

Please clarify the controlling project-experience thresholds and submission deadlines for RFP 70-350-26-08806. The Bonfire Project Summary conflicts with the RFP in several material respects.

Project-experience thresholds

The Bonfire summary states that Attachment A requires two completed projects exceeding $1 million, while RFP Section 5.2, page 31, states that the two completed projects must exceed $6 million.

The Bonfire summary states that Attachment E must identify projects exceeding $25 million, while RFP Section 5.2, page 31, states that projects exceeding $15 million must be listed.

Please confirm that the controlling thresholds are:

Two completed projects exceeding $6 million for Attachment A; and

Projects exceeding $15 million for Attachment E.

Solicitation deadlines

The Bonfire summary lists the questions, substitution requests, and proposal submission deadlines as 9:00 PM MST/MDT. The RFP and Bonfire event schedule identify the applicable deadlines as 3:00 PM MDT.

Please confirm the following controlling deadlines:

Questions and substitution requests: September 1, 2026, at 3:00 PM MDT;

Responses to questions and substitution requests: September 8, 2026, at 3:00 PM MDT; and

Proposal submission: September 11, 2026, at 3:00 PM MDT.

Generated on Aug 25, 2026 7:29 AM MDT - Camille Cordova

Please also confirm that the RFP and subsequently issued addenda govern if any information in the AI-generated Bonfire Project Summary conflicts with the solicitation documents.

Answer. Please see updated notice dated 8/28/26 as all items above have been addressed.

Question 12 , Aug 26th 2026, 11:08 AM MDT

Could you please clarify how we will be notified when new documents or addenda are uploaded to the portal? Will a notification be sent to the email address on file, or is there another method of notification? Please advise. Thank you.

Answer: Responses to all questions and answers will be posted to the portal as they get answered thru the time allotted in the sequence of events listed in the portal.

Question 13, Aug 26th 2026, 2:32 PM MDT

Answer. Fire suppression is not a part of this project. New Bid sheet has been amended to reflect this item not being on bid sheet. See updated notice from 8/28/26.

Question 15 , Aug 26th 2026, 2:35 PM MDT

The RFP pricing form appears to combine the Administration/Maintenance Building interior improvements and the additional columbarium work under Alternate No. 1.

Please confirm whether Alternate No. 1 is intended to be accepted or rejected as one combined alternate or whether the following components may be selected independently:

Administration/Maintenance Building interior improvements.

Additional columbarium units and associated site, foundation, utility, and finish work.

If the components may be selected independently, please revise the pricing form to provide separate alternate line items and clearly define the scope associated with each component.

Generated on Aug 25, 2026 7:29 AM MDT - Camille Cordova

Please also confirm that offerors should submit a single combined price for Alternate No. 1 unless a revised pricing form is issued.

Answer. Alternate #1 will be approved or denied based on bids. The request is that the items be priced individually on line items A & B for owners' use and future consideration.

Question 16, Aug 26th 2026, 2:37 PM MDT

Drawings A110 and A111 indicate interior work associated with Alternate No. 1, but the extent of the Administration/Maintenance Building work required under the Base Bid is not fully defined.

Please provide a clear pricing convention so that all proposals are submitted and evaluated on the same tax basis.

Answer. Gross Receipts tax is not included. The state will not issue nontaxable transaction certificates. Future tax rate changes will be addressed in a change order. If the rates go up it will be an added cost, If the rates go down it will be a credit.
