SLPS M/WBE Pre-Bid Guidelines

Revised 6/30/25 – MKN (PCG)

The below forms should be submitted with the bid. They are used to verify that the GC/Subcontractor has a plan to meet the M/WBE goals. If the GC or subcontractor is not on track to meet the goals at the time of bidding then they must provide Good Faith Efforts (GFEs) that state why they are unable to meet the goals and steps they are willing to take to resolve the issue/s.

1) SLPS M/WBE Utilization Plan: The form detailing the goods and services to be provided to the prime contractor by each M/WBE listed to meet the M/WBE goals. The M/WBE Utilization Plan must be provided at bid opening by each bidder and include the name(s) of all M/WBE subcontractors to be utilized in the contract, the items of work to be performed, and their percentage of the bid amount. All subcontractors MUST perform a commercially Useful function (CUF).

2) Certification of each M/WBE Subcontractor . As per the Pre-Bid SLPS document section 7.3. They must be certified by State of Missouri Office of Equal Opportunity https://oeo.mo.gov/ They must be certified and present the certification at the time of the bid.

3) Notice of intent to perform a subcontract shall mean the form the bidder is required to submit to the District at the time of bid opening signed by each subcontractor listed in the M/WBE Utilization Plan. Failure to include a completed Notice of Intent form signed by each subcontractor will be sufficient cause to reject a bid as non-responsive.

4) Good Faith Efforts - If the M/WBE Utilization Plan falls short of the M/WBE goals then they will need to submit why they are unable to meet the goals and the efforts put in to research and achieve the goals at the beginning of the bidding process. They will also have to submit GFEs each month or an email stating that no GFEs were completed that reporting month.

Make sure the M/WBE subcontractors chosen are comfortable with providing all of the information for the certified payroll (specifically the address, gender and ethnicity of their workers). The General Contractor should include this within the subcontractor’s contract or they may try to ‘push back’ during the compliance monitoring process and this causes delays in reporting.

If the above forms are not submitted with the bid, then the bid may be considered non-responsive and rejected.

INSTRUCTIONS: All bidders submitting responses to this procurement must complete this M/WBE Utilization Plan and submit it as part of their proposal.
