About this file
This is a Student Data Usage Questionnaire document issued by the Clark County School District's Technology and Information Systems Services Division in Nevada, designed to ensure compliance with Nevada Revised Statutes 388.291 and federal privacy regulations. The questionnaire requires all current or prospective educational software and educational services application vendors to provide comprehensive information regarding their collection, use, and protection of confidential student data before their applications or services can be utilized by Nevada school districts. The document serves as a compliance and approval mechanism for educational technology vendors and includes assessment of whether applications are educational in nature, collect personally identifiable information (PII), enable teacher-student communication, and comply with the Family Educational Rights and Privacy Act (FERPA), the Protection of Pupil Rights Amendment, and the Children's Internet Protection Act (CIPA).
The questionnaire addresses critical data security and privacy considerations, including vendor terms of service and privacy policy locations, types of student information collected, parent/guardian consent requirements, data retention and deletion policies, and security measures protecting personal information confidentiality and integrity. Vendors must disclose whether their applications use artificial intelligence with student data, enable student access to inappropriate internet content, provide direct electronic communications, allow unauthorized access or disclosure of PII, and whether logging of communications is available and meets the district's seven-year data retention requirement. The document requires vendors to explain all uses of student PII and provide detailed responses regarding safeguards and compliance certifications, ensuring that the Clark County School District can make informed decisions about educational software and services that protect student privacy and meet all applicable state and federal regulatory requirements.
