Supplemental Specifications

SECTION 1

1.1 SCOPE OF WORK

It is anticipated that the work to be performed under this Contract may include but is not limited to the installation of water mains, reclaimed water mains, and wastewater force mains and miscellaneous installations and/or modifications at various water, reclaimed water, and wastewater facilities, pumping stations and equipment utilized by the Hillsborough County Water Resources Department.

Range of Duties - The Contractor shall have a working knowledge of underground water/wastewater utilities and must have experience in each of the following:

• Utility location and verification

• Installation of PVC and Ductile Iron water, reclaimed water and wastewater force mains 4" to

12" inch in diameter in the public right-of-way.

• Replacement of active water, reclaimed water and wastewater force mains located in the public right-of-way.

• Installation or modifications to pipelines at water, reclaimed water, or wastewater treatment facilities 4" to 12" diameter.

• Projects located in the public right-of-way requiring the installation of steel casing pipe by Jack and bore.

• Projects located in the public right-of-way requiring deep excavations, shoring, sheeting, and well point dewatering.

The Contractor(s) shall furnish all labor, fuel, tools, transportation, materials, equipment and all other expenses as may be necessary for the accomplishment of all work as described in the Specifications, and/or as shown on Plans, if any, and/or as directed by the Project Manager in strict accordance with the expressed or obvious intent of this Contract.

The inclusion of the above capabilities does not guarantee that such work will be performed. All work shall be on an as needed basis. The County Project Manager shall be the sole judge as to the Scope of Work for each work site.

1.2 TECHNICAL SPECIFICATIONS

All work regardless of the scope, shall be performed in strict accordance with the Hillsborough County Standard Specifications For Construction (latest edition) and/or Hillsborough County Water, Wastewater, and Reclaimed Water Technical Manual and/or Technical Specifications (latest editions) and/or Hillsborough County Standard Pump Station Drawings, and/or Utility Accommodation Guide (latest edition), and/or Hillsborough County Stormwater Technical Manual (latest edition), The Hillsborough County Standard Pump Station Drawings, Technical Manual, and Technical Specifications may be located on the Water Resources Department Website:

https://www.hillsboroughcounty.org/en/businesses/land-development/technical-publications/public-utilities-technical-specifications

In all conditions the most stringent requirement/specification as determined by the Project Manager shall apply to the project. It is the Contractor's sole responsibility to purchase/locate at their expense the necessary drawings, specifications, and technical guideline material to perform the necessary scope of work and be advised of any updates, modifications, alterations, and any deviations of the above mentioned during the life of the contract.

1.3 CONTRACT ESTIMATED QUANTITIES

https://www.hillsboroughcounty.org/en/businesses/land-development/technical

Unit quantities are provided as a means of comparing bid proposals and as a basis for award. However, these quantities are estimated and actual unit quantities may vary greatly during the term of this contract. THE

BIDDER IS ADVISED THAT THE TOTAL QUANTITY OF WORK REQUESTED MAY BE LESS

THAN THE QUANTITY ESTIMATED, AND IN FACT THE COUNTY ONLY GUARANTEES A

MINIMUM OF $10,000 USAGE ON TIDS CONTRACT.

Bidders are cautioned against predicating their bid prices on an assumed scope of work or estimated bid quantities.

The amount of award represents only the upper dollar limit beyond which no further work shall be ordered, except as may be approved by the Board through a Change Order. It is not known how much or how little work will be ordered during the term of this contract.

Bidder acknowledges that actual quantities may be significantly less than those indicated in the bid, and agrees that, as the Contractor, he/she will not make any claim for damages or for loss of profits because of a difference between the quantities bid and the quantity of work actually ordered.

Work Order pricing shall be based on actual field measurement, not estimated bid or planned quantities.

Because quantities are estimated and actual requirements will not be determined until time of need, Section "Change in the Work" and Section "Change of Contract Price" of the General Terms and Conditions are hereby modified to delete the necessity for a Change Order in the event of line-item quantity over or under runs, provided that total purchases do not exceed the amount of award.

1.4 WORK ORDER ROTATIONAL PROCEDURE

In the event the County awards this contract to more than one Contractor, Work Orders will be issued on a determination of the best overall value for the County.

Value shall be determined by the Project Manager based on the following factors; Scope, Schedule, and Cost.

The Project Manager shall develop a preliminary scope, schedule, and cost estimate for each task order and determine the best value for the County. If it is determined to be in the best interest of the County, a Work Order may be awarded to the Contractor with the lowest time estimate (schedule) for the completion of the work. The Project Manager shall continue the Work Order Assignment Procedure described herein for the duration of the Contract, including all subsequent renewal periods.

1.5 AUTHORIZATION OF WORK

No work may be performed under this term contract except as authorized by a Work Order issued by the Public Utilities Department Director, or designee and a Purchase Order. The Work Order will establish the Notice to Proceed date. The Contractor shall not proceed with, and shall not be compensated for, any work that is not authorized by written Work Order. Verbal authorization may be given when immediate response conditions occur at night and/or on weekends and followed-up with a written authorization within 24 to 48 hours of the occurrence.

1.6 AUTHORIZED CONSTRUCTION DAYS

It is anticipated that this contract may include projects (Work Orders) of both short and long duration. Prior to issuance of a particular Work Order, the Project Manager and the Contractor will mutually agree as to a fair and reasonable anticipated number of days necessary to achieve Substantial and Final Completion on all Work Orders.

Once the number of days has been determined and mutually agreed to, a Work Order may be written as specified in the Contract Documents. The liquidated damages amounts specified in the General Terms and Conditions, entitles the County to assess liquidated damages per calendar day of delay, excluding circumstances that are beyond the control of the Contractor as outlined in the contract. In addition, failure on the Contractor to complete the Work Order work within the time specified in the Work Order may result in no further Work Orders being issued under this Contract and/or termination of this Contract and/or any pending Work Order(s).

1.7 SIMILAR WORK BY OTHER CONTRACTORS

Award of this term contract to a particular Contractor shall impose no obligation on the County to utilize that Contractor for all work of this type which may develop during the period of this contract. This is not an exclusive contract. The County specifically reserves the right to concurrently contract with other companies for work of this type if the County deems such to be in the County's best interest.

1.8 MOBILIZATION ALLOWANCE

A total allowance in the amount of sixty thousand dollars ($60,000.00) shall be included in the Total Award and distributed among the awarded Contractors as determined by the County. The Contractor shall be reimbursed for mobilization costs associated with the transportation and delivery of all equipment and materials required for the Work to the project site. The County will pay a fixed price of $1,000.00 per Work Order for the Contractor's mobilization cost. The Mobilization Allowance is not precluded from being utilized for regular line items included in this Contract.

1.9 PROCEDURE FOR DEVELOPMENT OF A PROPOSAL, EVALUATION OF THE PROPOSAL,

AND ISSUANCE OF WORK ORDERS

Upon identifying the need for work to be performed under this contract, the Project Manager, or other designated staff person, will meet with the Contractor to review the scope of work. This may also include an on-site visit.

The Contractor shall prepare a detailed cost estimate using their bid prices. This shall include a Contractor-developed and detailed statement of work and shop drawings/sketches for the project. The Contractor shall ensure that its proposal is complete using the applicable specifications and standards included herein.

Shop drawings/sketches showing the quantities of line items required and cross-referencing line items on the Contractor's cost estimate shall accompany the initial proposal. The detailed (Contractor-developed) statement of work must be supported by all necessary documentation to indicate that adequate planning to accomplish the required work has been performed. Costs for the aforementioned documentation shall be included in the Contractor's bid prices and will not be paid separately by the County.

The Contractor's bid prices, shall serve as the basis for establishing the value of the work to be performed on a unit price basis.

Timeliness of services: Since the primary goal of work order contracting is the speedy acquisition of cons1ruction services, Contractor responsiveness under the terms of this contract is paramount. Upon notification of a need for routine services, the Contractor shall acknowledge the request and reply to the Project Manager, or designee, within twenty-four (24) hours. The Contractor shall be expected to expeditiously prepare its proposal and in no event shall the proposal preparation time exceed more than five (5) calendar days. Failure to respond within the time specified above may result in: the work being performed by others; no further Work Orders being issued to the Contractor;

termination of the Contract; the filing of a claim by the County against the Performance Bond.

As part of the price proposal, the Contractor shall also develop a schedule for completion of work, if the schedule was not previously provided to the Contractor by the Project Manager.

The Contractor shall submit its proposal to the Project Manager, or his designated representative, who will evaluate the proposal and, if approved, issue a Work Order Notice to Proceed. The Project Manager reserves the right to disapprove the proposal, in which case he shall not have an obligation to issue the work order.

If, in the Project Manager's opinion, additional unit price items or quantities are required to complete the project, a revised work order detailing the additional work will be issued. The Contractor shall review the revisions and submit a detailed cost proposal. The Project Manager will review the Contractor's proposal and, if approved, will issue a revised Work Order.

If, in the Contractor's opinion, additional unit price items or quantities are required to complete the project, it is the Contractor's responsibility to advise the Project Manager, or his designated representative, and obtain approval prior to utilization of said materials.

It shall be the Contractor's responsibility to notify the Project Manager, or his designated representative, if the additional quantities are likely to exceed the Work Order limit and obtain prior approval. Prior approval shall be granted by way of a Revised Work Order.

The Project Manager, or his designated representative, reserves the right to reject any proposal, in which case the Project Manager, or his designated representative, shall have no obligation to issue the Work Order or revised Work Order.

1.10 RESPONSE TIME AND MOBILIZATION

The Contractor should expect to have crews available to notify Florida One Call Center "Sunshine 811", acquire permits and start work at the job site within two (2) days from notification by the Project Manager. The Contractor will be required to respond to the request of the Project Manager within two (2) hours and mobilize with crews and necessary equipment and materials within forty-eight (48) hours of verbal notification, including weekends and holidays. Longer times may be allowed by the Project Manager depending on the urgency of work. Work within Hillsborough County requires permitting by the Contractor. No permit fees will be assessed: however Traffic Control will be the responsibility of the Contractor. The Contractor is responsible to submit Traffic Control Plans per agency requirements and maintain devices for the duration of the project.

1.11 STANDARD WORK HOURS

The standard work hours shall be 7:00 A.M. to 4:00 P.M., Monday through Friday, excluding County-observed holidays and weekends. Work outside these hours shall require twenty-four hours notice to and written approval from the Project Manager. Standard work hours may be impacted by the requirements of Right-of-Way or MOT permits.

1.12 NON-STANDARD WORK HOURS (OVERTIME WORK)

In the event the County requires work to be done outside standard work hours, the Contractor shall be entitled to adjust their Work Order Cost for work performed during non-standard hours in an amount not to exceed ten percent of the Work Order Cost.

1.13 DISPUTES REGARDING WORK ORDERS

In the event the County and Contractor are unable to agree on final quantities or items for the performed work, the County may reject the Contractor's pay request and require the Contractor to provide verifiable documentation as to the quantities and items actually used. The burden of proof is on the Contractor. If the Project Manager finds the verifiable documentation sufficient, the pay application will be processed. If the Project Manager finds the documentation insufficient or unverifiable, the Contractor and the Project Manager may appeal to the Public Utilities Department Director. The decision of the Public Utilities Department Director is final.

If the Contractor refuses or otherwise fails to perform any of its obligations under the Contract or fails to perform the Work Order work, the County reserves the right to take any or all of the following actions:

Obtain the services from another Contractor;

Terminate the Contract;

Debar the Contractor from bidding on County construction projects for a period of up to 24 months;

The County shall furnish all required environmental agency permits. It shall be the Contractor's sole responsibility to obtain the Right-of-Way Use Permit, and Maintenance of Traffic Permit (MOT) permit for all Work Orders. The Contractor shall remove and relocate signs to the new Work Order construction sites as needed, or at the direction of the Project Manager, and maintain storage of the signs between Work Orders. The Contractor shall remove and dispose of the signs at the completion of the contract term or as directed by the Project Manager. Disposal of the signs shall be at no additional cost to the County. All costs associated with this item should be included in the Contractor's overhead.
