About this file
This is a Florida Trench Safety Act Certification and Disclosure Statement document issued by Hillsborough County, Florida, pertaining to the Kirby Street Pump Station #08 Rehabilitation project. The document serves as a mandatory certification requirement for bidders on this construction project, which involves the construction of a new stormwater pump station on a County-owned parcel north of the existing facility located at 5201 E. Kirby Street, Tampa, Florida, with an estimated total project cost of $1,473,476.90. The document establishes that bidders must acknowledge compliance with the Florida Trench Safety Act and federal excavation safety standards set forth in 29 CFR Part 1926.650, Subpart P, which serve as the interim State standard until Florida's Department of Labor and Employment Security adopts updated standards. Bidders are required to certify their commitment to compliance and to disclose all excavation and trench safety measures anticipated for the project, including itemized descriptions, quantities in linear feet, unit costs, and extended costs for each safety measure.
The certification document emphasizes that contractors are solely responsible for selecting geotechnical data and designing appropriate trench safety systems, and that disclosed trench safety costs represent only a portion of the contractor's compliance obligations. Contractors must expend additional sums at no additional cost to the County as necessary to achieve full compliance with applicable standards. The County reserves the right to accept bids without evaluating cost adequacy for trench safety compliance, and acceptance of a bid does not relieve the contractor of its responsibility to fully comply with all applicable excavation and trench safety requirements. The project includes a 10 percent Small Business Enterprise (SBE) subcontractor participation goal, and questions or requests for interpretation must be submitted no later than 14 calendar days after the solicitation issuance date, site visit, or pre-bid conference, whichever occurs last.

FLORIDA TRENCH SAFETY ACT
CERTIFICATION AND DISCLOSURE STATEMENT (MANDATORY)
The undersigned acknowledges the requirements of the Florida Trench Safety Act and hereby certifies that the undersigned is an authorized representative of the bidder and in that capacity commits the bidder to the following in the performance of the work in the event that the subject contract is awarded to and executed by said bidder.
1. The bidder acknowledges the Florida Trench Safety Act and the requirements established herein.
2. The bidder further acknowledges that the aforementioned Act established the Federal excavation safety standards set forth at 29
CFR Part 1926.650, Subpart P as the interim State standard until such time as the State of Florida, through its Department of Labor and Employment Security, or any successor agency, adopts, updates or reviews said interim standard. This State of Florida standard may be supplemented by special shoring requirements established by the State of Florida or any of its political subdivisions.
3. The bidder, as Contractor, shall comply with all applicable excavation/trench safety standards.

The Contractor shall consider the geotechnical information available from the County, its own sources and all other relevant information in its design of the trench safety system it will employ on the subject project. The Contractor acknowledges that it is solely responsible for the selection of the data on which it relies in designing said safety system, as well as for the system itself.
