Part I

Section B

1) Subsection B.3.2, Temporary Additional Services.

Reference to Pricing subsection stated in paragraph B.3.2, Temporary Additional Services, is hereby corrected to reflect the Base Year, 4 Option Years and 6-month extension to be included in this contract. Therefore, subsection B.3.2, Temporary Additional Services, is hereby deleted in its entirety and replaced to read as follows:

“B.3.2 TEMPORARY ADDITIONAL SERVICES

The Contractor shall provide Temporary Additional Services at any government-owned facilities, when requested by the Contracting Officer's Representative (COR) through a written order. Temporary Additional Services delivered shall be in addition to the Standard Services and shall be priced at the unit price shown in subsections B.5.2, B.6.2, B.7.2, B.8.2, B.9.2 and B.10.2. The tasks to be accomplished shall be additional quantities of the same tasks described in Subsection C.1.”

2) Subsection B.4.2, Janitorial Temporary Additional Services Pricing.

Paragraph B.4.2.1.3, Task Order for Reimbursement, is hereby corrected to reflect the applicable subsections for the Base Year, 4 Option Years, and 6-month extension. Therefore, Paragraph B.4.2.1.3, Task Order for Reimbursement, is hereby replaced in its entirety to read as follows:

“B.4.2.1.3 Task Order for Reimbursement.

All reimbursements will be processed with a separate Task Order.

Total Reimbursement shall not exceed the amount stated in subsections B.5.3, B.6.3, B.7.3, B.8.3, B.9.3, and B.10.3.”

3) Subsection B.4.3, Zero-Cost Concessions Agreement.

A requirement for revenue reporting is hereby added under subsection B.4.3, Zero-Cost Agreement. Therefore, this subsection will be deleted in its entirety and replaced to read as follows:

“B.4.3 ZERO-COST CONCESSIONS AGREEMENT

The Concessions Agreement for Food Services will be a zero-cost, non-procurement agreement. Prices, revenue and services are reportable to the Government and subject to review or audit to ensure compliance with the agreement and ensure they are consistent with reasonable market values. This review will be performed on a three-month basis. There are no revenue sharing requirements.”

4) Subsection B.5.1, Base Year Janitorial Standard Routine Services.

A note is added to subsection B.5.1 to reflect the amendments in section F.2, Period of Performance, below. Therefore, this section shall read as follows:

Section C

7) Subsection C.1.3.1.1, General Requirements for Standard Routine Services

– (c) Entrances, Common Aeras and Offices.

Additional information is added under Paragraph (c), Entrances, Common Areas and Offices. As a result, this paragraph is hereby deleted and replaced in its entirety to read as follows:

“(c) Entrances, Common Areas and Offices.

i. Services Required

Doorway glass and frames, doors, stairs, ramps, handrails, ceiling vents, elevator walls, doors and tracks, window and glass walls, windowsills and blinds, counters, security screening equipment, shredders, interior signage, photo frames, paintings, extinguishers, wall mounted furniture and décor accessories, office partitions, trash cans and any other item located in common areas and offices must be free of soil, cobwebs, dust, litter, food, fingerprints, streaks, insects, bug marks, adhesives and water stains. Items on desktops such as pictures, adding machines, pencil holders, etc., must be free of soil, dust, dirt, fingerprints and food. Shredder wastebaskets must be emptied, and shredder bags must be replaced when needed.

ii. Windows and Blinds

There will be 223 windows with blinds, those facing the façade and some overlooking the interior courtyards, are equipped with shades. In addition, the 80 small teller windows also have shades installed. Other than these, no enclosed office spaces or other areas are equipped with shades.

The contractor vendor is responsible for developing a strategic plan to ensure compliance with the expected standard for blinds, as outlined in this subsection. The strategic plan must specify the cleaning frequency necessary to meet this standard.”

8) Subsection C.1.3.1.1, General Requirements for Standard Routine Services

– (d) Break Rooms.

Break Rooms and Kitchenettes refer to the same areas/rooms at the NEC.

Therefore, for the purpose of avoiding confusion, title of subsection (d) under C.1.3.1.1., General Requirements for Standard Routine Services, is hereby changed from Break Rooms to Kitchenettes to provide uniform room identification. Additional information to clarify the items included in the scope of this contract is also provided. As a result, this paragraph shall read as follows:

“(d) Kitchenettes

i. Tables, chairs, countertops, sinks, trashcans, cabinets, appliances, vending machines, water cooler dispensers, and water fountains, should be free of soil, mineral deposits, dust, soap, food, drink spills and fingerprints.

ii. Floors, walls, built-in surfaces, government-provided appliances (microwave, refrigerator, and coffee maker) are included within the scope.

iii. Personal appliances and dishes in the kitchenette areas are not included in the scope of services.”

9) Subsection C.1.3.1.2 – Frequency of Services.

The titles of subsection C.1.3.1.2 Paragraphs (g) Windows and Glass Walls Schedule and (h) Façade Glass and Frames require to be renamed. As a result, these paragraphs are hereby deleted and replaced in their entirety to read as follows:

“(g) Individual Window Units, Storefront, and Curtain Wall Systems up to 3.5 Meters in Height.

10) Subsection C.1.3.1.3, Special Considerations – (d) Musset and Seneca Trash Collection.

Additional information is added under Paragraph (d), Musset and Seneca Trash Collection. As a result of the additions, this paragraph will be renamed as (d), Trash Collection at Satellite Locations. Therefore, paragraph (d) under subsection C.1.3.1.3, Special Considerations, is replaced in its entirety to read as follows:

“(d) Trash Collection at Satellite Locations

i. The contractor is responsible for collecting waste and placing it in trash containers at all locations (Musset, Seneca, CMR, and Warehouse).

ii. The contractor is responsible for removing naturally dead vegetation, such as dead tree leaves, from common areas ensuring that all areas listed in RFP section C.1.6.2, CMR, C.1.6.3, Musset Complex, and C.1.6.4, Seneca Building, are cleaned as requested.

iii. Janitorial staff are not responsible for cleaning up cut grass or gardening waste resulting from gardening activities.

iv. The contractor is responsible for cleaning general waste, dust, or remnants and within reasonable expectations, debris accumulated from regular or routinary maintenance activities, and debris resulted from small renovation projects.

v. Janitorial staff are not required to dispose of the debris that is the result of major renovation projects. A rough estimation is less than 2 cubic meters every six months.

vi. The contractor is responsible for ensuring that municipality disposes of waste in Musset, Seneca, CMR.

vii. The Contractor shall be responsible for the daily (Monday through Friday) trash collection performed by the municipality. This shall include construction debris (as stated in paragraph iv, above), and to provide a monetary tip/compensation to the garbage truck from the municipality.

viii. All garbage must be removed daily at the time of pickup.

ix. Additionally, contractor shall ensure that all waste in the trash area is properly disposed of, and shall keep the trash area in clean condition at all times.

x. In the Warehouse, a different contractor is responsible for waste disposal.”

11) Subsection C.1.3.1.3, Special Considerations – (j) through (q).

Additional information is added under Paragraph (j), Window Cleaning Services and the title requires it to be renamed. Furthermore, the following paragraphs are added to this section for clarifications required during the Questions & Answers stage: (k) FEBR glass, (l) NEC Parking Floor Cleaning,

(m) Benjamin Franklin Center, (n) Health Unit, (o) Consular Plaza, (p) Roof, and (q) Extraction Cleaning. As a result, paragraphs (j), (k),(l), (m), (n), (o),

(p) and (q) shall read as follows:

“(j) NEC Window Washing Deep Cleaning Services

i. Services Required - Trained Technicians

Inside and outside window cleaning service shall be performed by Contractor’s trained technicians. Glass should be washed, scrubbed, and cleaned and shall be free of dust, fingerprints, streaks, insects, and adhesives. Tracks and frames shall be free of cobwebs, dust, and dirt. Trained technicians should have DC-3 training or equivalent for working from heights. Embassy personnel will provide an orientation on the Building Maintenance Unit’s operation before being permitted to use at no cost to the contractor. The Contractor shall provide their window trained technicians with personal protective equipment including suspended access equipment or ground access equipment.

ii. Safety Plan

Prior performing window cleaning services, the Contractor shall present a Safety Plan that shall complies with the latest published version of the Safety and Health Requirements Manual “EM 385-1-1” (available for download from U.S. Army Corps of Engineers Headquarters > Missions > Safety and Occupational Health > Safety and Health Requirements Manual.

iii. Trained Technicians

The Contractor shall provide their window trained technicians with personal protective equipment including suspended access equipment or ground access equipment.

iv. Types of Glazing Systems

The building incorporates three types of glazing systems:

Individual Window Units, storefront systems at access points, and Curtain Wall Systems located on the façade and interior courtyards.

v. NEC Windows Heights

Individual window units and storefront systems reach a maximum height of 3.5 meters above each finished floor level.

The interior main courtyard's curtain wall system reaches a maximum height of +25.55 m above the finished floor level 0 (FFL) and begins at varying elevations. The corresponding heights and widths are detailed in the following table:

There are eight secondary interior courtyards featuring Curtain Wall Systems that reach a maximum height of +12.00 meters above finished floor level (FFL).

vi. Strategic Plan for Window Cleaning

The contractor is responsible for developing a strategic plan to ensure compliance with the expected standard for windows, as outlined in subsection C.1.3.1.1 – General Requirements for Standard Routine Services, item (c), which states that windows must be free of visible soil, fingerprints, smudges, dust, cobwebs, insect marks, and any adhesive residue. The strategic plan must specify the cleaning frequency required to meet this standard.

vii. Frequencies

Recommended frequencies are provided in subsection C.1.3.1.2 – Frequency of Services. Item (g) refers to windows and glass surfaces reachable up to 3.50 meters from the floor, assuming the use of standard cleaning tools such as a squeegee or extension pole. Any window or glass surface above 3.50 meters should follow the suggested frequency outlined in` item (h), which pertains to façade glass and frames.

viii. High-Rise Exterior Cleaning

1. High-Rise exterior cleaning shall be done using the specialized equipment installed for that purpose.

This equipment is manufactured by Tractel. This company provides trainings and certification for use of the equipment. Details on any certifications will be conveyed after award.

2. The operator of high-rise exterior cleaning equipment shall receive training/orientation for equipment operation.

3. Personnel doing the cleaning shall be trained on how to work within the basket and are required to obtain regular working from heights approval before scheduling the work.

4. Contractor must complete a Job Hazard Analysis before using the equipment and follow regulatory standards. These include, but are not limited to, the following:

• OSHA 29 CFR 1926.1431 – Hoisting personnel using cranes.

• OSHA 29 CFR 1926.1400 – Cranes and Derricks in Construction.

• OSHA 29 CFR 1910.180 – Mobile cranes in general industry.

• ANSI A92.2 – Vehicle-mounted elevating and rotating aerial devices.

• ASME B30.23 – Personnel lifting with cranes.

ix. Anchor Points

1. There are 136 “D Ring” anchors distributed along the interior perimeter of the rooftop, standing 2.5 meters from the edge of the building to facilitate Deep Cleaning operations.

2. It is the contractor’s responsibility to assess any area, verify the availability of approved anchor points, and plan their operations accordingly.

3. The contractor is free to propose an alternative access strategy as part of their overall cleaning approach.

4. If the contractor chooses not to use the existing anchoring system, they shall account for any specialized equipment required to safely and effectively carry out the work.

5. Standard routine services are not expected to require anchoring, as the glass surfaces included under these services are within reachable height.

6. The use of tools such as telescopic poles may be considered by the contractor; however, it is ultimately the contractor’s responsibility to determine how they will perform the tasks required to meet the standards for both routine and Deep Cleaning services.

7. Deep cleaning of façade glass is required twice per year as stated in section C.1.3.1.2, Frequency of services, item (h).

x. Main Courtyard

1. The main courtyard features a curtain wall system, which is considered part of the building façade.

2. Its cleaning is expected to occur twice a year, as specified in section C.1.3.1.2 (h) – Window washing Deep Cleaning.

(k) FEBR glass

FEBR glass surfaces require special care to preserve their coating and finish. To prevent damage or deterioration, only water and microfiber cloths shall be used for cleaning. The use of abrasive materials, chemical agents, or detergents is strictly prohibited. All cleaning procedures must be conducted in a manner that avoids scratching, staining, or compromising the integrity of the glass surface.

(l) NEC Parking Floor Cleaning

i. General Requirements

Parking Floor surface is finished with a polyurethane-based coating system. As indicated in Section C.1.3.1.1 – General Requirements for Standard Routine Services, parking area floors must be free of visible debris.

ii. No Drainage System

The contractor shall consider that the parking area lacks a drainage system; therefore, Deep Cleaning must be carried out using controlled methods to avoid water accumulation.

iii. Frequencies

The contractor is responsible for developing a strategic plan that defines the cleaning frequencies necessary to meet this standard. While suggested frequencies are provided in Section C.1.3.1.2 – Frequency of Services, including spot cleaning as needed upon identification and full surface Deep Cleaning on a quarterly basis, these are recommendations only.

iv. Schedule

The contractor is fully responsible for determining and justifying the appropriate cleaning schedule to ensure compliance with the required cleanliness level.

v. Guidance

The contractor may request guidance from the COR, such as manufacturer-recommended cleaning procedures.

(m) Benjamin Franklin Center

The Benjamin Franklin Center includes three different floor materials:

i. Carpet is used in the main library space.

ii. Granite stone is installed in all circulation areas and restrooms. The granite flooring has been treated with a professional-grade penetrating sealer.

iii. Glass mosaic tile, which is a decorative finish, is used only in the gallery area. For a comprehensive list of floor type quantities, please refer to the table provided in Section C.1.7.1, Floors.

(n) Health Unit

In addition to the general cleaning requirements, the staff assigned to clean the Health Unit shall comply with specific training and vaccination requirements which include without limitation the following:

i. CA93 – Bloodborne Pathogen training which will be provided and renewed by the Embassy Health Unit at the beginning of the contract and on an annual basis thereafter, according to the Health Unit schedule.

ii. Hepatitis B Vaccine

1. A Hepatitis B titer is required to determine if the individual has sufficient antibodies. If sufficient antibodies are present, no vaccine is needed.

2. If no sufficient antibodies are found, Hepatitis B vaccine is needed, the Embassy Medical Unit can provide information on how to obtain it.

3. The cost for the Hepatitis B titer and vaccine shall be covered by the contractor.

4. If the Health Unit has vaccines available, they may offer them to the contractor at no cost. However, this cannot be ensured. Therefore, the contractor shall always consider the cost of the vaccine as part of their costs and expenses.

(o) Consular Plaza

The contractor shall take into consideration the following information to schedule services accordingly:

i. The Consular Plaza is located at the intersection of Casa de la Moneda and Presa Falcón.

ii. It serves as a waiting area for applicants and their family members prior to entering the facility.

iii. Applicants typically begin forming lines around 7:00 a.m., with appointments concluding by approximately 3:00 p.m.

(p) NEC Roof

i. The Roof level includes a classified area, a non-classified area and mechanical rooms.

ii. There are no cleaning requirements in the roof classified area.

iii. Window cleaning twice a year is the only service where access to roof classified areas would be needed. Access shall be arranged with the COR to obtain proper authorization and escorting.

iv. The hallways on the non-classified area of roof level do not require an escort.

v. Access to the mechanical rooms on the roof level shall also be coordinated with the COR as with any other mechanical room located in other levels of the building.

vi. Cleaning of the mechanical room and hallways on the roof level will be done no more than once per month.

(q) Extraction Cleaning

i. Extraction cleaning refers to a deep-cleaning method for carpets that uses hot water extraction (commonly known as "steam cleaning") to remove dirt, debris, and contaminants embedded deep within the carpet fibers.

ii. The contractor is fully responsible for determining the most appropriate method to meet the expected service standards, as outlined in Section C.1.3.1.1, General Requirements for Standard Routine Services.”

12) Subsection C.1.6 – Sites.

As a result of questions received during the Questions & Answers phase, additional paragraphs to clearly detail the areas included and not included in CMR, Musset Complex and Seneca Building are hereby added. Therefore, sections C.1.6.2, Chief of Mission Residence – CMR, C.1.6.3, Musset Complex, and C.1.6.4, Seneca Building are hereby replaced to read as follows:

“C.1.6.2 Chief of Mission Residence – CMR

C.1.6.2.1 Areas

14) Subsection C.1.7.1.8 – Painted Concrete.

The characteristics and cleaning requirements of Painted Concrete are the same as the characteristics of Sealed Concrete. Therefore, the title of subsection C.1.7.1.8 Painted Concrete is hereby renamed read as follows:

“C.1.7.1.8 – Painted /Sealed Concrete

Concrete with 1/8” liquid rubber latex polymers incorporating dehydrating powders, vulcanizers and special aggregates for waterproofing.

(a) Cleaning Requirements

Wash with a mild cleaning solution. Use a brush to remove tough, ground-in soil, stubborn stains, or residual compounds. Rinse thoroughly with clean water. Regular cleaning will prevent build-up of residue, which can make the floor coating slippery when wet.”

15) Subsection C.1.7.1.10 – SDT.

SDT cleaning frequency is amended to no more than once a month. As a result, section C.1.7.1.10, SDT, shall read as follows:

“C.1.7.1.10 SDT

Static dissipative vinyl tile flooring, 12” x 12”. SDT shall be cleaned no more than once a month. Access will be agreed upon during the review of the workforce schedule/program as stated in Section F.5.

(a) Regular Maintenance

i. Sweep, dust mop or vacuum the floor daily to remove dust, dirt, grit and debris that can damage the floor and become ground into the surface.

ii. Spot mop as needed. Any spills should be cleaned up immediately.

iii. Damp mopping of the floor should be performed on a regular or daily basis depending upon traffic and soil levels in the space. Use a properly diluted neutral (pH 6 to 8) detergent solution.

(b) Periodic Maintenance

i. When needed, after sweeping, dust mopping or vacuuming, machine scrub the floor with a properly diluted neutral (pH 6 to 8) detergent solution and the appropriate scrubbing pad (3M™ red or equal for light scrub, 3M™ blue or equal for a deep scrub) or equivalent brushes.

ii. Thoroughly rinse the entire floor with fresh, clean water.

Remove rinse water and allow the floor to dry completely.

iii. Heavy-traffic areas may require extra coats of floor polish on a more frequent basis. If needed, additional coats of floor polish should be applied at this time. The floor may also be spray buffed to restore gloss and peak electrical performance. Spray a diluted solution of floor polish (1 part FP to 2 parts water) onto the floor. Before the liquid can dry, buff it with a floor machine capable of 175 to 1100 rpm, equipped with a buffing pad or brush (3M™ white pad or equal or equivalent brush).”

16) Subsection C.1.7.2.7 – Wallcovering.

Quantities of wallcovering stated under paragraph (c) Quantities are updated to reflect more accurate numbers. As a result, the chart under paragraph (c) Quantities, is hereby deleted and replaced in its entirety to read as follows:

Section F

20) Subsection F.2, Period of Performance.

Subsection F.2, Period of Performance, is hereby amended to reflect the different stages of performance at the different locations included in this contract. As a result, this subsection is deleted in its entirety and replaced to read as follows:

F.2.3 Two months before moving into the NEC, Partial Performance of Janitorial Standard Routine Services at the NEC will be expected. Required services shall be as agreed with the COR upon award.

F.2.4 The performance period for Janitorial Standard Routine Services at CMR, Musset, Seneca and Warehouse shall start on September 1, 2026, and shall continue for the remaining months of the existing period of performance for Janitorial Standard Routine Services at the NEC and Food Services through the Concessions Agreement as stated in the Award Letter or in the corresponding SF- 30 Modification Form

F.2.5 The Government may extend this contract for up to four

(4) additional 12-month periods in accordance with the option clause in Section I, FAR 52.217-9, Option to Extend the Term of the Contract, which also specifies the total duration of this contract. See also Section I, FAR 52.217-8, Option to Extend Services, for up to an additional six months of optional performance, if required by the Government. The initial period of performance includes any transition period authorized under the contract.”

21) Subsection F.4, Transition Plan.

Subsection F.4, Transition Plan, is hereby amended to reflect the requirement to include both Janitorial Standard Routine Services and Food Services through the Concessions Agreement in the Transition Plan.

Therefore, this section is replaced to read as follows:

“F.4 TRANSITION PLAN

F.4.1 Within thirty days after contract award, the Contracting Officer will request that the Contractor develop a plan for preparing the Contractor to assume all responsibilities for Janitorial Standard Routine Services and Food Services through the Concessions Agreement at the NEC. The plan shall establish the projected period for completion of all clearances of Contractor personnel, and the projected start date for performance of all services required under CLIN 0001 – SUBCLIN 001 and CLIN 0004 – SUBCLIN 004, of this contract. The plan shall assign priority to the selection of all supervisors to be used under the contract.

F.4.2 The Contractor shall develop a second transition plan in preparation to assume all responsibilities for Janitorial Standard Routine Services at CMR, Musset, Seneca and Warehouse.”

Section G

22) Subsection G.1, 652.242-70 Contracting Officer's Representative (COR).

The position title of the COR information in subsection G.1, paragraph (b) requires a modification. As a result, this paragraph is hereby deleted and replaced in its entirety to read as follows:

“(b) The COR for this contract is the FAC Budget and Procurement Analyst”.

Section H

23) Subsection H.3, Safety.

Paragraph H.3.5 is hereby added under subsection H.3, Safety, to read as follows:

“H.3.5 CONTRACTOR’S RESPONSIBILITY

Compliance with safety standards is the sole responsibility of the contractor. The U.S. Government will not provide training to contractor personnel, as this obligation rests entirely with the contractor. The contractor is also responsible for developing and implementing their own safety management plan, as outlined in this Section H.3 Safety.”

Part II

Section I

24) Subsection I.1.1 Federal Acquisition Regulation (48 CFR CH. 1):

In order to comply with Federal Acquisition Regulation (FAR) Class Deviation for Executive Orders (EO) 14173 Ending Illegal Discrimination and Restoring Merit-Based Opportunity and 14168 Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government, as well as FAR Class Deviation Regarding Executive Order (EO) 14148, Initial Rescissions of Harmful Executive Orders and Actions, and Section 2 of EO 14208, Ending Procurement and Forced Use of Paper Straws the following paragraph is added at the end of subsection I.1.1 Federal Acquisition Regulation (48 CFR CH. 1):

“System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Examples include 52.222-25, Affirmative Action Compliance; 52.223-22, Public Disclosure of Greenhouse Gas Emissions and Reduction Goals—Representation, and paragraphs (d) and (t) of 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services.

Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.”

FAR Clause 52.228-16 is hereby added in full text as paragraph I.2.8 to read as follows:

“I.2.8 52.228-16 PERFORMANCE AND PAYMENT BONDS-OTHER THAN

CONSTRUCTION (NOV 2006)

(a) Definitions. As used in this clause-

"Original contract price" means the award price of the contract or, for requirements contracts, the price payable for the estimated quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.

(b) The Contractor shall furnish a performance bond (Standard Form 1418) for the protection of the Government in an amount equal to __20%__ percent of the original contract price.

(c) The Contractor shall furnish all executed bonds, including any necessary reinsurance agreements, to the Contracting Officer, within __10__ days, but in any event, before starting work.

(d) The Government may require additional performance bond protection if the contract price is increased. The Government may secure the additional protection by directing the Contractor to increase the penal amount of the existing bond or to obtain an additional bond.

(e) The bonds shall be in the form of firm commitment, supported by corporate sureties whose names appear on the list contained in Treasury Department Circular 570, individual sureties, or by other acceptable security such as postal money order, certified check, cashier's check, irrevocable letter of credit, or, in accordance with Treasury Department regulations, certain bonds or notes of the United States.
