About this file
This is a Design-Build Scope of Work for the construction of an emergency generator building at Retamal Dam in Hidalgo County, Texas, issued by the United States Section of the International Boundary and Water Commission (USIBWC) under Solicitation 191BWC26Rxxxx, dated February 24, 2026.
The project comprises two phases: a Design Phase and a Construction Phase, each with a separate Notice to Proceed. The Design Phase includes site investigation, surveying, geotechnical investigations, design development, and production of construction documents and reports. The Construction Phase encompasses site preparation, construction of a metal building with a new diesel emergency generator, concrete mounting pad, fuel tank with spill containment, electrical interconnections to an existing automatic transfer switch, perimeter security fencing, quality control testing, and commissioning. The Design-Builder must provide all labor, materials, equipment, and services to deliver a fully commissioned, turnkey facility. Work is restricted to USIBWC right-of-way and must comply with facility operating hours (7:30 am to 4:00 pm, Monday through Friday, excluding federal holidays). The Design-Builder is responsible for identifying and coordinating with existing utilities, obtaining all necessary permits (including SWPPP and TPDES permits), and managing environmental compliance including protection of migratory bird breeding seasons, water quality, and fuel tank secondary containment per Texas Administrative Code. All designs must be signed and sealed by Texas-licensed professional engineers. The project includes minimum warranty requirements of 5 years for the generator and automatic transfer switch, and 20 years for roofing systems. The Design-Builder must submit required premobilization submittals—including construction schedule, quality assurance plan, safety documentation, SWPP plan, and condition survey—for Government compliance confirmation before construction mobilization. The contract uses FAR Part 52.236-3 (Site Investigation and Conditions) and is subject to the Davis-Bacon Act wage requirements.

1.6. INVESTIGATION OF SITE CONDITIONS
1.6.A. The Bidder, as well as their subcontractors, is urged to visit the worksite and project area to become fully aware as to the existing conditions affecting the work to be performed under the Contract Documents. A site visit will be announced during the solicitation. Each Bidder shall attend at their own expense. The Government will not pay for any site visits. This visit is intended to provide the potential Bidders the opportunity to observe site conditions and incorporate into their proposal any required work based on site conditions. The Bidder will have the opportunity to walk around during the site visit. Unless otherwise noted, no other opportunity will exist for visits to the site.
1.6.B. The Bidder shall be responsible for ensuring that all of its suppliers, manufactures and subcontractors have reviewed all applicable Contract Documents relative to their work. The Bidder shall provide all labor, material, equipment, and services not provided by the Bidder’s suppliers, manufacturers, fabricators, and/or subcontractors but required for complete and operable facilities as described in the Contract Documents.
1.6.C. Bidder has the sole responsibility to make such independent investigation and examination as they deem necessary in order to satisfy themselves as to the conditions to be encountered in the performance of work and the quantities required to complete the work in accordance with the SOW.

1.8. STATEMENT OF WORK
1.8.A. The Government does not implicitly warrant performance specifications (SOW requirements) for complete accuracy or adequacy. Typical performance type requirements set forth an objective or standard to be achieved, and the successful Bidder is expected to exercise their ingenuity in achieving that objective or standard of performance, selecting the means and assuming a corresponding responsibility for that selection.
1.8.B. When a particular product or manufacturer is identified by name, but permits substitution of ‘an approved equal,’ such a requirement is ‘performance’ in nature and, as a result, carries no implied warranty.

Environmental Information February 24, 2026 00.31.24.01-Page 2 USIBWC Solicitation 191BWC26Rxxxx
1.5.B. These documents lists environmentally and culturally sensitive areas that need to be protected from any disturbances of construction activities. The environmentally and culturally sensitive areas that were identified on the document are identified below.
1. Environmentally Sensitive Areas
a. USIBWC will be responsible for compliance with National Environmental Policy Act (NEPA).
USIBWC may prepare NEPA documentation concurrent with this contract and/or solicitation. The Contractor must incorporate any environmental protection measures identified in the NEPA document
2. Culturally Sensitive Areas
a. Although this area has not been previously surveyed nor cleared archeologically, USIBWC has determined that the construction of a new building on this location would not result in adverse effects on cultural properties as no historic properties will be affected.
3. Biological Resources Work should be scheduled to occur outside of the bird breeding season whenever possible.
Migratory birds may be present within the project area; birds, nests, and eggs are to be protected and avoided during construction. The breeding and nesting season is identified in Section 01.57.19.01. If work continues into the bird breeding/nesting season the areas proposed for disturbance shall be surveyed in order to avoid the inadvertent destruction of nests and eggs.
4. Natural Resources Equipment cannot be parked, staged, or used under large, mature trees. Keeping equipment away from the large, mature trees will prevent incidental damage to the tree and prevent compression of the root ball.
5. Water Quality
a. The Contractor must ensure that construction will not adversely impact on the water quality of the Rio Grande during construction (per 01.57.19.01 Part 1.9.).
6. Fuel Tanks
a. Fuel storage tanks must comply with Texas Administrative Code (TAC) 30 TAC Chapter 334 Subchapter F for aboveground storage tanks, including secondary containment.
1.5.C. Further details of environmental requirements are in Sections 01.57.00.01 and 01.57.19.01.
1.6. PRESERVATION OF CULTURAL AND NATURAL RESOURCES AND THE ENVIRONMENT
1.6.A. If the Design-Builder initiates changes to the Contract and USIBWC approves the changes, the Design-Builder is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.
1.6.B. Culturally Sensitive Areas If a site, building, or location of historical, archaeological, educational, or scientific interest is discovered within the right of way, cease all work immediately, secure the site from further disturbance and possible vandalism, and notify USIBWC. The site, building, or location will be investigated and evaluated by
USIBWC.
1.7. OTHER CONSIDERATIONS
The Design-Builder is required to ensure that all Environmental Permits, Issues, and Comments (EPIC), which are included within the Contract Documents are followed and implemented to ensure potential impacts are avoided.
February 24, 2026 Environmental Information USIBWC Solicitation 191BWC26Rxxxx 00.31.24.01-Page 3
1.8. USE OF GEOLOGIC MATERIALS ON A FEDERALLY FUNDED PROJECT
1.8.A. To ensure preservation of historical and archaeological data, prior to use of any soil, rock, or gravel including aggregate in concrete, the source must first be compliance confirmed by the COR to ensure compliance with Section 106 of the National Historic Preservation Act (NHPA).
1.8.B. Take no action to use or alter the proposed location until written approval for site use is received from the
COR.
1.8.C. If the quarry or borrow site already provides materials for TxDOT, USACE, or other governmental agency, a copy of the environmental approvals from said agencies may be provided to the COR.
1.8.D. Include permission for Government access to any geological source locations.
1.8.E. Full details of requirements for geological materials are in Section 02.21.13.01.
