1. Responses to PPI:

Question No. 2

FAR Clause 52.225-11, Buy American-Construction Materials Under Trade

Agreements (Oct 2016), Alternate I (May 2014)

QUESTION: Scheduled S-1 on PR1.0 has a domestically fabricated sink which would qualify and a faucet fabricated in Mexico which would not qualify. The value of the sink is substantially higher than the faucet. The other trim for the sink such as basket strainer, P-trap, supply stops etc. are compliant per listed FAR.

If the materials for the whole segment S-1 as installed and ready for use is higher than 51% domestic content, does it qualify as compliant?

ANSWER: In accordance with FAR 52.225-11(a), the faucet is considered a “component” and a “designated country construction material”. Mexico is considered a “designated country” with a Free Trade Agreement with the United States of America. If all the components described in the question above, when combined, are a “commercially available off-the-shelf item” (COTS) offered to the government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace, then the component test of the Buy American statute is waived.
