c. CENAE-ZC Memorandum For the District, dated 09 March 2018, re:

Delegation of (signature) Authority Pursuant to 33 U.S.C. 408.

3. This S408 permission request is being processed in accordance with reference 2.a.

and the procedures outlined in reference 2.b. where “…the scope of analysis for S10 and S408 are the same…” under which Regulatory Division is responsible for the Public Interest Determination (PID) and Environmental Compliance (EC) and Navigation Section is responsible for making the Impacts to the Usefulness (of the FNP) Determination resulting in one permit decision and document (permit). The application, in its entirety is included in Attachment 2.

4. Authorized FNP:

The Federal Navigation Project (FNP) affected by the proposed action is the New London Harbor in New London Connecticut.

The Thames River is formed by the confluence of the Shetucket and Yantic rivers in Norwich and flows south for 12 miles to New London Harbor. It serves (in upstream order) commercial and recreational waterfronts in the communities of New London, Groton, Waterford, Ledyard, Montville, and Norwich.

The earliest work on the Thames River was completed by the Corps in 1836 and modified in 1879. This work included dredging and deepening the river channel and constructing several piers. The most recent work on the river, completed in 1942, provides for:

-A 25-foot-deep channel, about 10.5 miles long, extending from the area east of Mamacoke Cove in New London (almost two miles north of the New London Highway Bridge) to Norwich, at the mouth of the Shetucket River. The channel is 250 feet wide from Mamacoke Cove to Bartlett Crossover (about four miles upstream of the New London Highway Bridge), then 200 feet wide from Bartlett Crossover to Norwich. (In 1980, the Department of the Navy deepened a portion of this channel to 36 feet. The new depth begins at the US Route 95 Bridge and extends to the upstream end of the U.S. Naval Submarine Base in Groton. The Corps is responsible for maintaining this part of the channel to a depth of 36 feet and a width of 250 feet if required by military and commercial vessel traffic).

-Widening the channel opposite the U.S. Naval Submarine Base from 250 to 350 feet, with the widened area having a depth of 20 feet. This work was completed by the Department of the Navy in 1940.

-Five training dikes in the upper three miles of the river that help keep sediment from settling at the bottom of the channel. These dikes are: Norwich Dike (1,050 feet long); Rolling Mill Dike (3,480 feet long); Trading Cove Dike (2,370 feet long);

and Mohegan Dike (2,990 feet long).

-The removal of obstructions at the mouth of the Shetucket River.

The last maintenance dredging of the entrance channel (to -40’ MLLW) occurred in 1984 and was performed by the Government owned hopper dredge McFarland.

5. Project Description:

The proposed maintenance dredging within the federal navigation is part of larger project that would demolish Pier 32, Pier 17 stub, and Pier 10 at SUBASE and construct a new, larger Pier 32 that meets current Navy pier standards for submarines.

The end of the new Pier 32 would be approximately 205 feet east of the federal navigation channel. The quay wall north of Pier 32 would be reinforced, and concrete pads added, for a crane weight test area.

The project would conduct maintenance dredging of the pier areas and the federal navigation channel in the Thames River. The purpose of the maintenance dredging in the navigation channel is to maintain safe entry and departure of submarines.

Sediment dredging would be conducted at the new Pier 32 berth and slip areas, portions of the turning basins in the federal and Navy-maintained navigation channels, and sediment mounds in the footprints of the existing Piers 32 and 10 after demolition.

Assuming 2 feet of allowable over dredge depth in each area, the estimated volume of sediment to be dredged for the whole project is a maximum of approximately 54,000 cubic yards (cy) from a total area of approximately 720,000 square feet (16 acres). See figures 1 and 2 for project details.

The dredged material would be placed in an existing Confined Aquatic Disposal (CAD) cell located in the Thames River federal navigation channel south of SUBASE in the vicinity of the Submarine Force Museum at Crystal Lake Road in Groton. Based on a 2018 bathymetric survey, the current capacity of the CAD cell is 166,000 cy (approximate total 6 acre area). The dredged material would be placed in the center of the CAD cell at its deepest point, and the cell would be capped/covered with 2 feet the cleanest of the 54,000 cy of dredged material. An alternative source of cap material would be an unexcavated southern portion of the existing CAD cell in the navigation channel.

All cap material will be placed into the CAD cell using a tremie (i.e., pipe that directly deposits solids under water) to reduce sediment suspension and mixing with moderately contaminated sediment. Dredging would only occur during the period between October 1 and January 31 to avoid potential impacts on shellfish and fisheries resources in the area during the spring/summer spawning season.

The proposed project is anticipated to begin in late 2020 and take 3.5 years to complete. Dredging will be conducted in two or three different time periods beginning in October 2021. Dredging of the new Pier 32 area and the northern portion of the channel and slip areas would be conducted in the first construction year. The footprints of the demolished Pier 32 and Pier 10, and the southern portions of the channel dredge areas would be dredged after demolition of the existing piers in the third year of construction (2023-2024).

Figure 3 Detailed Dredging Plans

6. In accordance with ref. 2.a. and 2.b. the Navigation Section performed the ATR on the proposal to determine if the proposed work would impair the usefulness of the FNP.

The objective of this determination is to ensure that the proposed alteration will not limit the ability of the USACE project to function as authorized and will not compromise or change any authorized project conditions, purposes or outputs. The ATR analysis included: a determination of any Non-Federal Sponsor(s) (NFS) interest; evaluating the proposal’s potential impacts on navigation; potential impacts on FNP users and potential impacts on future maintenance and improvement of the project.

7. Reference 2.b. requires that a statement of “no-objection” be obtained from NFS associated with the Civil Works Project being altered. The intent of the no-objection statement is to document that the NFS is aware of the scope of the S408 request and does not object to the request being submitted to the USACE to initiate the evaluation of the request. There are no NFS associated with the FNP in New London Harbor.

8. The proposal involves maintenance dredging of the pier areas, maintenance dredging of the federal navigation channel in the Thames River, and placement of approximately 56,000 CY of dredged material into the Thames River CAD cell. Pre-placement survey conducted shows that approximately 166,000 CY of CAD cell space remain and therefore the proposed project material disposal is well within the allowed space within the CAD cell. Detailed volume calculations are included in Table 1 of the S408 Permit Application Request.

11. Based on the above factors, the ATR concluded that: there is no objection by any NFS; that there are no foreseeable negative impacts to the usefulness of the FNP, its users, or to future maintenance or improvement of the project that should result from the proposed alteration. The US Navy’s proposal to perform the maintenance dredging will not limit the ability of the FNP to function as authorized and will not compromise or change any authorized project conditions, purposes or outputs.

12. Based on information contained herein, the Navigation Section, has made the determination that the U.S. Navy’s proposal will not impair the usefulness of the FNP and recommends approval of the proposed maintenance dredging at the United States Submarine Base in New London, Connecticut, provided that the applicant meet all conditions (at Attachment 1) to be provided for inclusion in ref. 2.d.. The Office of Counsel and the District’s S408 Coordinator will provide legal and policy certification once Regulatory Division has completed the PID and NEPA compliance.

13. In accordance with references 2.b. and 2.d., signature below indicates concurrence or non-concurrence with Navigation Section’s recommendation of approval of the U.S.

Navy’s proposal to perform maintenance dredging at the US Naval Submarine Base New London, Connecticut.

Christopher Hatfield Section 408 Coordinator U.S. Army Corps of Engineers New England District 696 Virginia Road Concord, MA 01742-2718

Subject: Request for Permission Pursuant to 33 U.S. Code 408 (Section 408) for Dredging for Pier 32 Replacement Project at Naval Submarine Base New London

Dear Mr. Hatfield, The United States Department of the Navy (Navy) is requesting permission to modify the river bottom of the federal navigation channel in the Thames River at Naval Submarine Base New London (SUBASE), in Groton, CT. The proposed modification is maintenance dredging, and will not impair the usefulness of the USACE navigation channel in the Thames River, is not injurious to the public interest, and complies with the following relevant policies in Engineering Circular (EC) 1165-2-220: it will not compromise or change any authorized USACE project conditions; it will not have the effect of deauthorizing a federal navigation project or eliminating an authorized project purpose; the alteration meets current USACE design and construction standards; and there will be no hydrologic or hydraulic impacts or changes in water surface profiles.

Assuming 2 feet of allowable over dredge depth in each area, the estimated volume of sediment to be dredged for the whole project is a maximum of approximately 54,000 cubic yards

(cy) from a total area of approximately 720,000 square feet (16 acres).

An alternative source of cap material would be http://www.cardno.com/ an unexcavated southern portion of the existing CAD cell in the navigation channel. All cap material would be placed into the CAD cell using a tremie (i.e., pipe that directly deposits solids under water) to reduce sediment suspension and mixing with moderately contaminated sediment. Dredging would only occur during the period between October 1 and January 31 to avoid potential impacts on shellfish and fisheries resources in the area during the spring/summer spawning season.

The proposed project is anticipated to begin in late 2020 and take 3.5 years to complete. Dredging would be conducted in two or three different time periods beginning in October 2021.

As outlined in EC 1165-2-220, the following specific information is being provided with this request:

1. The location of the proposed activities relative to the federal navigation channel, project plans, and estimated dredge volumes are provided in Attachments 1 through 6 and in Table 1.

2. The Navy has submitted an application for USACE permits pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, and the project has been the subject of USACE regulatory program coordination. Diane Ray of the New England District is the USACE contact for the current permit application.

3. The Navy has also submitted an application for a Water Quality Certificate to the Connecticut Department of Energy and Environmental Protection pursuant to Clean Water Act Section 401. Project plans are provided in the permit application package.

4. The Navy completed a National Environmental Policy Act Environmental Assessment and Finding of No Significant Impact in January 2019. Consultations were concluded under Section 7 of the Endangered Species Act, Magnuson-Stevens Act for Essential Fish Habitat, Section 106 of the National Historic Preservation Act, and with federally recognized tribes.

5. Credit is not being sought under Section 221 of the Flood Control Act of 1922, as amended, nor is approval under Section 204(f) of the WRDA 1986 being sought.

6. As shown in the attached plans, the proposed project will involve use of both property owned by the Navy and the federal navigational channel.
