About this file
This document is an Amendment (Amendment 0004) to Solicitation 140PS125R0009 for a federal contract, with key details as follows:
The solicitation due date has been extended to January 20, 2026, at 12:00 Noon Eastern Time. The amendment addresses a technical discrepancy regarding refrigerated cargo space, specifically reducing the required number of reefer carts from 9-10 to 8 due to space and stanchion configuration constraints. The government provided a sketch showing two potential layout options for accommodating 8 carts with 4" of insulation around the reefer space. Additionally, the amendment clarifies that while previous documents referenced different cart capacities, this amendment takes precedence in case of conflicting information. The document also addresses potential change order procedures, referencing FAR Clause 52.243-1 (Changes – Fixed Price) which allows for equitable adjustments under certain conditions.

Solicitation: 140PS125R0009
Amendment: 0004 – Answers to Questions
The solicitation due date is extended to January 20, 2026, 12:00 (Noon) Eastern Time.
Included in this amendment are updated attachments labeled:
• 140PS125R0009 Amendment 004 Solicitation Question_Response
• 140PS125R0009 Amendment 004 R4 Reefer Space Conflict
• DI-035 REV 8_ Bidding Specifications
QUESTION ONE: Review of section 150.4 of the Bidding Specifications, Sheet 7 of General Arrangement drawing DI-026-01, Sheet 2 of Superstructure drawing DI-026-07 Rev 1, and Sheet 2 of Deck and Platform drawing DI-026-06 indicates the dimensions and number of reefer carts required, the dimensions of the reefer space and the structural layout in the area of the reefer space. It does not appear to be physically possible to accommodate the carts within the space indicated with the stanchions located in their current location.
Section 150.4 of the Bidding Specification indicates: There shall be fixed refrigerated space with cart roll-in/roll out capability. There shall be storage for 9 carts for refrigerated cargo space inside in the interior cargo area. Contract Design Drawing DI-026—1_Rev_6_General Arrangement also indicates 9 carts for refrigerated cargo. Page 10, Section (iii) Refrigerated Cargo of DI- 007_REV_2_REQUIREMENTS_VERIFICATION_MATRIX indicates a minimum of 10 carts within the refrigerated cargo space. It is unclear from the list which takes precedence, as it appears that item (8) Other Documents, exhibits, and attachments is most applicable to both DI-025-01 and DI-007_Rev_2, which are in conflict and take precedence over the specification. Considering the issue with fitting 9 carts in the current arrangement, please provide clarification for the number of carts to be facilitated in the refrigerated cargo space.
ANSWER ONE: To eliminate the apparent conflict between the reefer walls, stanchions, and reefer carts, the required number of reefer carts is reduced to eight (8). The Government will not direct the method of construction for the reefer space, but provides the attached sketch showing two potential options that accommodate eight (8) carts while providing for 4” of insulation around the reefer space and stanchions.
While previous documents (e.g., DI-026—1_Rev_6_General Arrangement, and DI- 007_REV_2_REQUIREMENTS_VERIFICATION_MATRIX) reference capacities of 9 or 10 carts, these are superseded by the amendment, revised documents not attached. This amendment takes precedence in the event of conflicting information.
QUESTION TWO: In light of the sentence in C.2 (b), "The Contract Design shall not be a basis for constructive change orders or any form of Equitable Adjustment of this Contract. Any change is subject to review and approval by NPS, in accordance with Clause H.20.", how will discovered discrepancies such as this be adjudicated, as they can have a significant impact on the overall design and cost if changes need to be made?
ANSWER TWO: As stated in Clause C.2(b), the Contract Design is not a basis for constructive change orders or equitable adjustments. However, the solicitation includes FAR Clause 52.243-1, Changes – Fixed Price, which allows for equitable adjustments under certain conditions.
