About this file
This is a Questions and Answers document containing 214 contractor questions and government responses regarding solicitation 140P2025R0008 for the rehabilitation of the El Portal Wastewater Treatment Facility (WWTF) and Administrative Camp at Yosemite National Park.
Key clarifications include: proposal due date extended to January 6, 2025; no Project Labor Agreement required; NPS will provide the Process Testing and Startup Manager; contractors must provide full propane tank after testing; leak detection cable not required on double containment piping; excess soils must remain on site; and NPS will provide 12 pneumatically actuated butterfly valves for the tertiary building. Technical clarifications address pipe materials, valve types, coating systems, electrical components, concrete specifications, and equipment requirements. The Q&A also confirms that reseeding/replanting is not part of the contractor's scope and that safety forms/insurance letters are excluded from the 20-page technical approach page limit.

| Question | Solicitation Reference | Answer | Amendment | |
| 1 | In the summary of Work, Section 01 11 00 Part 1.12A it is noted that Onsite Work hours are to be during normal business hours of 6:30am to 4:30pm. Under A-4 (Same Section) it is noted that no construction material deliveries will be allowed during the hours of 8:00am through 2:00pm between May 15 and September 15.Due to limited winter access, the amount of work to be completed November through April will be very limited. With these unrealistic restrictions the NPS is only allowing necessary daily construction deliveries to take place from 6:30am to 8am every morning and 2pm through 4:30pm Monday through Friday. With limited storage and staging onsite, the critical ready mix concrete and reinforcing steel deliveries, installations, and placements would in essence be limited to 1.5 hours in the morning and 2.5 hours in the afternoon. When the placement of cast-in-place concrete for these structures start we cannot simply stop and pick it back up after 2pm. These delivery restrictions are not realistic for a project of this magnitude in a weather constricted remote location such as this. Please revisit and reconsider your delivery restrictions. | Section 01 11 00 Part 1.12A | Specification 01 11 11, Part 1.12A, REVISE Paragraph 4: Material deliveries are allowed within normal business working hours. | 6 |

| 3 | In the Administration Camp plan set on drawing G1.3 (Sheet 4 of 77) General Note No.3 states, the Contractor shall be responsible for locating all NPS and Non-NPS owned utilities. A General Contractor cannot be made responsible for locating utility owners utilities. Per USA guidelines, the excavator/contractor is required to provide proper notification prior to underground exploration and/or excavations (Dig Permits) and clearly mark and identify the areas to be excavated so that the utility owner can properly identify the location of their utilities. The excavator/contractor has an obligation to then verify the extend of the utility that may conflict with the proposed excavation to confirm its location. Please clarify if it is the NPS intent to have the contractor hire a 3rd party service on behalf of the NPS to perform Ground Penetrating Radar services for all utility locates prior to excavations or is this note in error and the NPS will be performing this service? | Administration Camp plan set on drawing G1.3 | Refer to section 01 73 40 3.2 and 01 11 00 1.12B for expectation of contractor responsibilities regarding existing utilities. | 4 | In the Administration Camp Plan set on drawing C2.0 (Sheet 7 of 77) Note 7 state the contractor shall be fully responsible for all damage of utility lines, both above and below ground, resulting from construction operations. A General Contractor cannot be made responsible for unknown, or unidentified utilities that the utility owner failed to identify when the contractor/excavator obtained the necessary Dig Permit allowing the utility owner to properly mark/identify the location of their utilities. Please remove or correct this note in accordance with federal and state law governing utility owners obligations. | Administration Camp Plan set on drawing C2.0 | Refer to section 01 73 40 3.2 and 01 11 00 1.12B for expectation of contractor responsibilities regarding existing utilities. | 8 |

| 48 | 1) Solicitation 140P2025R0008, 1452.228-70 LIABILITY INSURANCE (JUL 1996)(a) requires the United States of America be included on the liability insurance as a “named insured” rather than as an “additional insured”. The differences between the two types of insured states are significant as outlined below. Named insureds are normally tied to the First Named Insured (the entity shown on the declarations page) by sharing more than 50% common ownership. Additional Insureds are a third party that requires protection under the Named Insured’s policies as the Additional Insured has a business interest that may result in both parties being brought into a suit. |
Named Insured duties/rights include:
• Pay premiums
• Report claims
• Policy cancellation rights
• Administer and authorize changes to the policy Additional Insured duties/rights include:
• The policy provides indemnity and defense in the event of a covered claim
• Receive notices of cancellation
• No obligation to pay premiums
• No ability to make changes to the policy
For the reasons above, Contractor cannot add the United States of America as a Named Insured on its corporate insurance program. Further, the United States of America does not want or need the additional risk and responsibility for premium payment or changes to the Contractor’s liability insurance. Please confirm that the United States of America will accept “additional insured” status.
| Solicitation | NPS is only required to be "named insured". | 8 | ||

| 62 | 1.05.D. Requires the shop to hold a RTP-1 Certification. |
Would you be willing to accept Midwestern Fabricators as a manufacturer that can provide FRP Tanks that are designed, fabricated, inspected and documented per the ASME RTP-1 program but is not a certified facility?
If so, our recommendation would be to reword the statement found in 1.05-D with the following statement that has been widely accepted in other engineered FRP Tank specifications:
“The tanks should be designed, fabricated, inspected and documented per the ASME RTP-1 standards, but shop certification is not required”
| To further expand: Midwestern does not participate in the RTP-1 certification program. However, their in house engineering staff and full time QA/QC inspector are well versed in the ASME RTP-1 level 2 requirements and use this as their in house standard for the design, fabrication and testing of their manufactured FRP Tanks. They would be able to provide all the documentation and requirements associated with the standard. If this request was to be implemented you would receive all the same requirements sought after by having the ASME RTP-1 specified without the unnecessary inflated costs associated with it being a certified project. | 43 40 02 FRP Tank | FRP tanks should be proposed as specified. | 4 | ||
