140P2022R0036 Questions and Answers – Amendment #0010 11/29/2022

The following is a consolidated list vendor questions submitted. Responses in red address questions not previously responded or provide updates to questions in which responses had been previously provided.

1. After review of the submittal schedule, we note that the pre-proposal site visit is October 19, 2023, pre-proposal questions must be submitted by October 24, and the proposal submittal date is November 2, 2022. This schedule does not provide adequate time to incorporate information from the site visit and NPS responses to questions into the final proposal. Therefore, [the Vendor] requests that the submittal date be extended to November 23, 2022.

Response: The date for submission of proposals has been extended to 2:00 pm EST, Friday, November 18, 2022. See Amendment 0002.

2. For Volume 1, Factor 5 Small Business Participation, what kind of documentation is NPS looking for proposing teams to submit to demonstrate supporting proposed quantitative participation?

Other than call log spreadsheets and binding commitments, what would NPS like to have submitted?

Response: A sample copy of the requirements identified in Section M, Paragraph C.e, (pages 55-

56) have been provided for your use in the proposal submission package attachments included in the solicitation. Other forms of contractor developed information will be accepted.

3. Can previously completed/submitted Past Performance Forms be used for this submittal for relevant projects or are we required to seek new forms from each client?

Response: Previous project questionnaires may be reused; however, the past performance questionnaires must be submitted by the reference directly to NPS and the reference point of contact shall reference this project.

4. For Volume 1 Evaluation Factor 1 – Project Experience – requires that the proposing team demonstrate “barging experience for transporting equipment and materials.” Will the successful team be permitted to transport equipment and materials over the access bridge from Liberty State Park in New Jersey, or will barges need to be used?

Response: The barging experience requirement was erroneously incorporated into the evaluation factors and has been removed. See Amendment 0002.

5. In the clerestory windows drawings, A2.0 and A2.1 there is missing text pointing to scopes of work. Please clarify what that missing text next to the pointers yes.

Response: The leaders with no text on clerestory drawings A2.0 and A2.1 do not include additional scopes of work. The text removed from these drawings is scope that is included on the crack and patching repairs shown on the STLI 312431 construction drawings.

6. Please clarify if drawing H2.0 shows that window are ACM and require an Abatement Contractor to do the removals or if it’s just the caulking that can be removed prior to dismantling the windows.

Response: The drawing indicates the location of ACM at the exterior window glazing and “Exterior Window Frame Caulk – Gray”, please see the attached “Limited Asbestos Inspection Report at Main Immigration Building, Ellis Island, New York, NY”, prepared by AIM Environmental LLC., AIM Project # 20-07-210, dated July 22, 2020.

7. Drawings A3.0 calls out work at light fixtures are Bid Option 3 while the Bid Schedule calls it as 4.

Clarify which is correct Response: Work at light fixtures shown on drawing A3.0 of the clerestory window package is included in Bid Option 4.

8. Drawing A4.0 note 9 references Bid Option 1 as providing a secondary metal storm windows. Bid option 1 in the bid schedule is Atrium Skylight Replacement. Please clarify where to include the storm windows.

Response: Note 9 on Drawing A4.0 referencing secondary metal storm windows as Bid Option 1 is incorrect. Secondary metal storm windows for the clerestory windows are part of the base bid in CLIN 1. (STLI 312431 specification section 012700).

9. Please clarify the expected working hours of the project

Response: Per STLI 312341 specification section 011000, working hours are as follows:

On-Site Work Hours:

1. Seven days a week, 6:00am to 6:00pm, subject to limitations on deliveries and hours for passing through USPP Security.

2. Liberty State Park opens at 0600.

3. Restrictions/Accommodations for special events may be encountered. Notification will be provided to give the Contractor as much advanced notice as possible. No additional costs will be provided for coordination with NPS events.

10. Please clarify if suspended scaffolding will be allowed for the exterior rehabilitation work.

Response: It is the contractor’s responsibility to determine appropriate means and methods to complete the work. However, in accordance with Specification Section 040322, scaffolding may not be mechanically fastened to the building.

11. Please provide load restrictions for the Ellis Island Bridge.

Response: Please see STLI 312431 specifications section 011100 - SUMMARY OF WORK -

APPENDIX C.

12. Will a Crane and heavy machinery be allowed on site? If yes, please show points of entry for a barge or will be use of the bridge be allowed.

Response: Cranes and heavy machinery are allowed on-site. Access for larger machinery may be limited by existing conditions (sidewalk widths, trees, etc.). Contractor shall get Contracting Officer’s approval for modifications to existing conditions for access purposes. Contractor is responsible for any additional costs associated with modifications to existing conditions for mobilization and operation. Contractors are allowed to use the bridge, following loading restrictions. See question 11 above.

13. Will a helicopter be allowed for the transportation of the skylights to the roof of the building?

Response: Yes, a helicopter may be permitted provided all appropriate safety, access and coordination plans are coordinated and approved by the Contracting Officer, STLI, United States Park Police and other applicable agencies.

14. In the façade scope, On Drawing A1.2 detail note 2/A1.2/A5.3 shows tile and lighting protection work while at the same time the note to the right says, “Existing terra cotta tile roof protect areas not in scope”. Please clarify if that is not actually in scope and not many tiles will have to be removed on each side.

Response: Contractor is required to protect the existing roof at all times. Removal and replacement of terra cotta tiles is required to complete some scope items. Work plans reflecting impacts to terra cotta tile and associated scope shall be submitted to Contracting Officer for approval prior to commencement of work.

15. Will scaffolding we allowed inside the rooms under the skylights that are to be replaced?

Response: Scaffolding will be allowed pending approval of proposed work plan.

16. Please provide the sign-in list for the walkthrough dated 10.19.2022.

17. Please provide the insurance requirements for this project.

Response: Insurance requirements are provided in contract clause 1452.228-70, Liability Insurance (page 30 of 57 in the contract clauses). Specifications section 013100, paragraph 1.4.D.7 of the STLI 312431 specifications addresses the contractor’s requirement to provide a certificate of liability insurance. General liability, automobility and workman’s compensation must be provided by each firm performing on-site work on this project.

18. Please verify if this project is CCIP or OCIP and if there is Builder’s Risk + deductable.

Response: Refer to Question 17 for insurance requirements. Insurance above and beyond the general requirements provided is at the contractor’s discretion.

19. After review of the project construction documents and based on information gathered during two site visits, [the vendor] believes that the current due date for this bid proposal, November 18, 2022, does not provide adequate time to incorporate into the final proposal. In addition, Requests for Information are due November 11, 2022, which only allows for a very brief window for review and incorporation of responses to the requests. Therefore, [the vendor] requests that the submittal date be extended to December 2, 2022.

Response: The submittal date for this solicitation is being extended to Friday, December 2, 2022, per Amendment 0007. The date for submission of questions is also extended, but has been changed from Wednesday, November 23, 2022, to Friday, November 18, 2022, due to the holiday per Amendment 0008.

20. Is only the removal and reinstallation of the existing lighting at the (6) Clerestory Windows to be included in Base Bid 001 Lump Sum price for Clerestory Window Replacement? If so, is only the addition of supplying new lighting to be included in Bid Option 4: Replace Clerestory Lighting?

Response: Yes, please include the removal and reinstallation of the existing lighting in the base bid. Please include only the additional price for the addition of new lighting and new lighting controls in Bid Option 4.

21. Please confirm that all “repair sill” comments shown on the Window Restoration Schedule are in reference to the wood sills of the window (not the stone sills).

Response: Correct, any repairs identified on the Window Restoration Schedule are for wood sills and all stonework is shown on other drawings within the Construction Drawing Set.

22. Where are the structural drawings mentioned in the Façade Package Drawings?

Response: All the structural drawings for this project are noted on the sheet list for STLI 312431 and included within that Construction Drawing Set.

23. Are pubic areas under the Reading Room (south), Listening Room (North), and Atrium Skylights able to be closed to the public during the skylight construction? If so, is there a time limit on the area being closed?

Response: Yes, subject to an approved work plan as reviewed and approved by the Park and Contracting Officer. All closures shall be minimized.

24. The allowed time defined for work is 6am to 6pm, seven days a week. Is the intention for there to be work ongoing 7 days a week in twelve hour shifts or would you like our proposals to reflect regular hours?

Response: Contractors may utilize their own work schedule to meet the period of performance within defined work hours. Work outside of these hours may be permitted pending request and approval by the Contracting Officer.

25. Are there any day or time constraints for delivering materials on site via loading bridge?

Response: Specification Section 01 1100 Appendix B under “Truck Deliveries & Access” indicates deliveries via Post IV may be arranged (7) days a week between 0700 and 1400 (48) hours in advance. Deliveries will be scheduled with NPS on a delivery-by-delivery basis. There will be coordination with other active construction projects.

26. Upon review of the Limited Asbestos Inspection Report, dated July 22, 2020, and specification

028200, the following quantities of asbestos were reported:

• Roof 600 sf (Remove approximately 600 square feet of waterproofing tar and remnant flashing applied at flat roof parapet and roof transition)

• Clerestory windows 3rd Floor – Exterior (Within Areas of Window Work) – 4,200 lf

Are these the quantities of asbestos requiring abatement?

Response: The quantities are provided for bidders; however, the contractor shall field-verify all quantities prior to the start of construction. Any quantity difference between the contract documents and field-verified condition shall be addressed via the contract changes clause.

What area of the roof requires abatement?

Response: Areas of the roof requiring asbestos abatement are shown on drawing ABT1.0 in the STLI 312431 construction drawings.

27. Is Drawing H1.0 referring to the correct location of windows requiring asbestos abatement? It appears to be in conflict with Drawing H2.0. Are the locations of the windows to be abated shown in red arrows below?

Response: Yes, drawing H1.0 shows the correct locations of windows requiring asbestos abatement. The 8 clerestory windows requiring abatement are shown on both H1.0 and H2.0;

however, the contractor shall field-verify all quantities prior to the start of construction. Any quantity difference between the contract documents and field-verified condition shall be addressed via the contract changes clause.

28. Stripping – Wood Windows: In reviewing the specification, it is not entirely clear whether the windows are to be stripped to bare wood or just scraped and painted. Which is being required?

Response: Per A4.5 “stripping” is required for all level 1 and level 2 windows. Stripping shall be full paint removal to bare wood so that all surfaces are sufficiently clean and free of paint prior to refinishing.

29. Removal – Wood Windows: Can the window sashes, wood trims, and hardware be restored offsite? The only place we see direction is in Part 3 -Execution. Section G. Protection of Openings:

where sash or windows are indicated for removal, cover resultant openings with temporary enclosures so that the openings are weather tight during the repair period. We find no indication anywhere for what windows are to be removed.

Response: Windows may be removed for restoration on or off-site per Contractor’s means and methods. An inventory of all windows shall be conducted as noted in the Project Manual prior to removal to locate, identify, and label all elements appropriately.

30. Steel Windows: The steel windows for the same reasons as stated above should be removed for a complete rehabilitation. Can the steel windows be removed from the job site?

Response: Windows may be removed for restoration on or off-site per Contractor’s means and methods. An inventory of all windows shall be conducted as noted in the Project Manual prior to removal to locate, identify, and label all elements appropriately.

31. Are the louvers on the Type A windows wood or aluminum?

Response: The louvers are metal – assumed to be aluminum.

32. Window Type B4 is marked as having a quantity of 2 on the Window Type Sheet. We have found only 1 Type B4 window on the Window Schedule. Is there only 1 Type B4 window?

Response: Yes, there is only one (1) B4 type window (1-N.28).

33. Window Type C1 is marked as having a quantity of 12 on the Window Type Sheet. We have found only 9 on the Window Schedule. Which is correct?

Response: The Window Schedule is correct – there are nine (9) type C1 windows.

34. Windows Type C 3, and C4 are to be replaced. Can these windows be restored? Are they the original windows? Is the wood still good but they need to be altered in some way? Can we provide an alternate for restoration in lieu of new milling?

Response: Window Type C3 and C4 shall be replaced in accordance with the contract documents.

35. Are Unit Prices required to be submitted for all Façade details? In case, additional quantities are found?

Response: No, please submit pricing per the Contract Price Schedule.

36. “Bid Option #8 (Line Item 018) – Repoint Open Brick Joints 1000 LF” – Will pointing be quantified by LF for Brick Masonry? Or Square Foot?

Response: The specifications documents incorrectly reference SF. LF is correct per the Contract Price Schedule.

37. Are Unit Prices to be provided for both (Brick Repointing LF) & (Brick Repointing SF)

Response: No, please see response to question 36. Please submit pricing per the Contract Price Schedule.

38. Any acceptable preblended pointing mortar manufacturers? For example; Spec Mix?

Response: The Specifications are provided for bidders; however, the contractor may propose a substitution per Specification Section 01 33 23.

39. DWG ABT1.0, General Abatement Note 4 mentions a hazardous material survey report done by

Mabbett & Associates. Can you make a copy of this survey report available to the bidding contractors? It says its attached but I did not see it.

Response: The referenced report has been provided as part of Amendment 009. Please see documents titled “Ellis Island Hazardous Materials Survey-Final with attachments” (Attachment 01a) and “STLI 312431_SD_Hazardous Testing Report” (Attachment 01b).

40. The Drawing cover sheet, Site Access Note 6 says “All entrance doors shall remain operable at all times”. I’d like to clarify the note to better understand how to develop our work plan. For example (Refer to DWG A2.2) would it be acceptable to restore the façade by breaking it into three sections and shutting down one door in the section being worked, but redirecting visitors and staff with way finding signs?

Response: Closing exterior doorways may be considered following submission of a proposed work plan by the Contractor for review and comment by the Government. At a minimum, advanced notice shall be provided as noted per Specification Section 01 3591 for activities impacting National Park Service operations. Sufficient emergency egress shall be maintained at all times.

41. Specifications Section “086300 - METAL-FRAMED SKYLIGHTS “ in the STLI 312431 Specifications and Section “085200 - WOOD WINDOWS” in the STLI 305028 Specifications mention “heat-strengthened glass;” however, this is not required by code. Heat-strengthened specialty glass will significantly drive up the price of the glass for this project. Please confirm that that is correct.

Response: For the skylights, the outer (sky-facing) lite should be heat-strengthened, for resistance to impact.

42. Is there any sidewalk bridge requirements pertaining to the perimeter of the building?

Response: Sidewalk bridges may be necessary to maintain required egress and operations, as access to entrances / exists must be maintained at all times. Closing exterior doorways may be considered following submission of a proposed work plan by the Contractor for review and comment by the Government. At a minimum, advanced notice shall be provided as noted per Specification Section 01 3591 for activities impacting National Park Service operations. Sufficient emergency egress shall be maintained at all times.

43. is there a logistic plan for this project?

Response: Contractor is required to submit a logistics plan for the work on this project.

44. Please clarify the small business goals for this project, since one document states two different goals – i.e., one says 20% and the other says 44% is the goal?

Response: The 20% reflected in Special Clause 4 (Section H) is an SBA requirement that a minimum 20% of the total contract value must be awarded to small business for this project. This requirement applies to both small and large businesses submitting proposals for this solicitation.

The 44% reflected on the Small Business Subcontracting Plan attachment provided in the proposal submission package attachments is the minimum percentage goal to be performed by small business if a large business is subcontracting any part of its contract out to other businesses. A small business subcontracting plan is required to be submitted only by large businesses submitting proposals for this solicitation.

45. Please confirm all stones highlighted in red, yellow, and blue (see photo below) are to be included in the “Repoint Open Joints at Limestone Entablature; Assume 100%” Shown on A2.0.

Response: All stones in dashed red line on A2.0 are to be included, see snapshot below:

46. Please clarify if the (2) call outs circled below on A2.1 are meant to be Replace Failed Repairs (FR & green hatching) or Replace Incompatible Repairs (IR & orange hatching)

Response: Callouts are meant to be Replace Failed Repairs.

47. Please clarify if the red circle call outs shown below on A2.1 are meant to be the purple circle call outs identifying the “Removal of Ferrous Inserts”

Response: Confirmed, red circles should be purple callouts for removal of Ferrous Inserts.

48. Drawings ABT-01 calls out (2) locations totaling 600 SF of abatement (circled above). Roofing at all called out locations were recorded to be installed in 2010, making them void of hazardous material unless it is remanence of previous roofing. Please clarify. Additionally, no other roofing work has been defined at these locations; please provide description and detail of put back after removal.

Response: No areas circled in drawing above. Please refer to Mabbet & Associates Inc Hazardous Materials Survey Report identifying locations of asbestos in flat roof (please see response to question 39).

49. Please provide the Mabbett & Associates Inc Hazardous Materials Survey Report (Note #4 on

Drawings ABT-01).

Response: Please see response to question 39.

50. Please confirm if there is any abatement work required at curbs around skylights.

Response: NPS is not aware of any additional hazardous materials reports. The roof and accompanying flashings are understood to be less than 20 years old.

51. There are a few discrepancies regarding the counts.

• Type B4 shows 2 windows on the window type sheet (A4.3), and 1 window on the window schedule (A4.5)

• The door type sheet shows 3 type P1’s (A4.4), and the door schedule has 1 type P1 (A4.8)

• The door type sheet shows 7 type P2’s (A4.4), and the door schedule has 5 type P2’s

• The door type sheet shows 1 type P3(A4.4), and the door schedule has 4 type P3’s (A4.8)

Response: Please see responses to question 32 and 64.

52. Approximately how old are the insulating glass units on the type H windows? Insulating glass units have a warranty and life cycle of 10 years. If those windows are going to be restored to have a longer life cycle, the IG glass life cycle might not be in sync with the other upgrades.

Response: Bidder to price window restoration and IGU glass replacement as scoped in the bid documents.

53. Are the metal guards in front of the Type M windows supposed to be stripped and refinished?

Response: Please see response to question 64.

54. Is there currently access above the arches in the atrium to install the new secondary joists? Will the ceilings need to be cut / patched at all?

Response: There is a small existing exterior access hatch to the attic space below the pitched clay tile roof / above the Guastavino tile vaulted ceiling of the Registry Room. All cutting/patching necessitated by work requires restoration in kind to match existing (typical throughout the project) and shall be proposed as part of the work plan to be approved prior to commencement of the work.

55. Should options 1a, 2a and 3a be priced as add alternates of options 1, 2 and 3 respectively on the bid form? If we include the full price for the upgraded assembly, and not just the add, then there will be a double count in the line item for “Total Price of all Options” as well as “Total Price of Base Plus All Options”.

Response: Please see the attached revised Contract Price Schedule (Attachment 01a to Amendment 0010), which includes new total rows that include a line for just the add alternates and updated totals. This price schedule shall be used in submitting your price proposals in lieu of any previous versions.

56. The quantities of window types listed below the elevations on a4.3 and a4.4 do not match the quantities on the window schedule. Please confirm which is correct.

Response: Please reference responses to questions 32 and 33 as provided within Amendment

008. The Contractor shall utilize the quantifies noted in the Window Schedule for bidding. Any quantity difference between the contract documents and field-verified condition shall be addressed via the contract changes clause.

57. Please quantify the number of controllers required for the new clerestory lighting.

Response: Controllers are shown on drawing L1.1 of the STLI 305028.

58. Please provide the locations for the clerestory light controls.

Response: The clerestory light controls are located on a wall panel on the east side of the Registry Room (2nd floor, near northeast stair tower). See floor plan snapshot below.

59. Will we be able to have a laydown delivery area on the north-western side of the bridge?

Response: Laydown areas are identified on the cover page of the Contract Documents.

60. As seen on Google maps the NJ/NY border line goes right through the building. Which State/City taxes and insurance requirements will prevail?

Response: New York County, New York

61. Will there be any Tree/Garden Permits required by NPS?

Response: Specific Permits are not required. However, the Contractor shall submit a work plan for approval prior to commencement of work.

62. Still confused on the Treatment of Historical Windows. Traditional historical treatment dictates that we leave as much existing sound material and coating as possible. The following sections support this:

a. Section 080352 1.5, A , 4 ,a - “Remove loose paint. Remove paint to bare wood where repairs are needed.”

b. Section 080352 3.2, B - “In treating historic items, disturb them as minimally as possible.”

c. Section 080352 3.2 B, 2 – “Remove Coatings according to Section 090391 Historic Treatment of

Plain Painting”

d. Section 090391 3.2, B – “Remove failed coatings…”

e. Section 090391 3.10 Surface Preparation Schedule B, 2 – “Paint Removal: Not required.”

The Question 28 response is requiring a complete abatement of paint on ALL of the level 1 and 2 windows. Please verify the scope is “full paint removal” as this changes the specifications considerably.

Response: The project paint analysis found that none of the existing paint finishes dated to the original construction of the building – they are believed to date no earlier than the 1980s restoration. A number of windows were found to have been previously stripped and completely refinished so that no previous paint layers remain, thus the direction to strip to bare wood for all windows requiring type 1 and 2 treatment.

63. Are there CAD files available for assistance in developing site plans (.NWD or .RVT)?

Response: DWG files may be provided following award of the project.
