About this file
This is a Justification for Other Than Full and Open Competition (FAR 6.301) submitted by the United States Department of the Interior, United States Wildland Fire Service at the National Interagency Fire Center (NIFC), for Solicitation 140L0626R0002 covering NIFC 100 ADM Repairs. The justification supports awarding a sole-source contract to Johnson Controls International PLC (JCI) for building automation system components and services. The government requires that all controllers and equipment interfacing with the proprietary Metasys® Building Automation System (BAS) be manufactured by JCI, and that system integration and programming be performed by a JCI-certified vendor. The requirement is justified under 41 U.S.C. 3304(a)(1) and FAR 6.302-1, as only JCI's proprietary Metasys® software can satisfy agency requirements. The Metasys® system is currently operational across 19 buildings on the NIFC campus and is the only building automation system authorized by NIFC to connect to the Bureau of Land Management (BLM) network for remote monitoring and troubleshooting of HVAC systems, having received Security Impact Analysis approval in April 2012 after nearly four years of evaluation.
The project involves building repairs requiring the HVAC (Heating, Ventilating, and Air Conditioning) system to interface with the Metasys® control system. While JCI uses the open protocol BACnet communication language, the central building automation system integration is proprietary and programmable only through Metasys® software, which provides building-wide logic directing individual equipment to function cohesively. NIFC facility managers and engineers rely on Metasys' graphical user interface for troubleshooting and issue tracking. Market research confirmed that Metasys® software and JCI-certified controllers are proprietary with no alternative products available. The contracting officer determined anticipated costs to be fair and reasonable, with the sole-source requirement to be included within a competitive construction solicitation expected to attract numerous small business offers. No other sources expressed written interest in the acquisition. The justification will be posted via the System for Award Management (SAM) to provide potential offerors an opportunity to propose alternative solutions. Future acquisitions will pursue market research to identify comparable alternatives if they become available, and NIFC permits non-JCI contractors to work on the system if they obtain JCI manufacturer certification.

United States Department of the Interior
UNITED STATES WILDLAND FIRE SERVICE
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Naonal Interagency Fire Center (NIFC)
NIFC 100 ADM Repairs
Solicitaon 140L0626R0002
This document sets forth the jusficaon and approval as required by FAR 6.301.
1. Idenficaon of the Agency and the Contracng Acvity:
The United States Department of the Interior, United States Wildland Fire Service at Naonal Interagency Fire Center (NIFC), requests the DOI acquision office to contract on a brand name basis.
2. Nature and/or descripon of the acon being approved:
The government requires that controllers and equipment interfacing with the proprietary Metasys®
Building Automaon System (BAS) be manufactured by Johnson Controls Internaonal PLC (JCI), and that integraon and programming of the system be done by a cerfied vendor. As outlined in FAR
6.302-1, this document jusfies that only one brand name will sasfy agency requirements.
Metasys® is currently in use for the buildings on the NIFC campus. This requirement is a very small component of a much larger construcon project which is currently under solicitaon by the government.
3. A descripon of the Supplies or Services required meeng the Agency’s needs.
The project includes building repairs that requires the HVAC (Heang, Venlang, and Air
Condioning) system to interface with the Johnson Controls Internaonal PLC Metasys® control system.
4. An idenficaon of the statutory authority permi2ng other than full and open compeon:
41 U.S.C. 3304 (a) (1), this covers only the poron of the acquision which is brand-name or peculiar to one manufacturer and no other product will sasfy agency requirements as implemented by FAR
6.302-1.
5. A demonstraon that the proposed contractor’s unique qualificaons or the nature of the acquision requires use of the authority cited:
Johnson Controls Internaonal PLC (JCI) is uniquely qualified to produce the Metasys® control system including its so;ware to the Bureau of Land Management (BLM), based on the following:
a. JCI Metasys is a proprietary so;ware system.
Johnson Controls Internaonal (JCI) is one of many DDC integrators able to install control sensors and devices to operate HVAC systems to meet occupant comfort goals in a building. JCI uses an open protocol communicaon language called BACnet which is not proprietary, but the integraon of the DDC system into a central building automaon system is programmed through a proprietary interface so;ware called “Metasys”. This so;ware provides building-wide logic that directs the acons of the individual pieces of equipment to funcon as a cohesive system.
This includes occupied and unoccupied mes of the day or when a temperature control zone is too cold to acvate heang from the central boiler system. Each piece of HVAC equipment requires direcon and the Metasys provides this direcon in addion to a graphical user interface that NIFC facility managers and engineers use to troubleshoot and track issues.
b. Metasys controls are the only method to connect to the NIFC Network to allow remote monitoring and troubleshoong of the HVAC system.
JCI Metasys controls are connected to the BLM Network to allow remote monitoring and troubleshoong of the HVAC system. NIFC currently has 19 buildings using the JCI Metasys building automaon/energy management hardware/so;ware to control their HVAC systems.
Reliable and repeatable operaon of the HVAC system is essenal to provide adequate indoor environmental condions in a facility that houses crical fire workers. The HVAC system for this building is complex. Balancing the air flow and maintaining appropriate temperatures in different zones in the building requires experse in Metasys so;ware that only cerfied control technicians possess.
The system will consist of an open architecture that ulizes EIA standard 709.1, the integral ANSI
/ ASHRAE™ Standard 135-1995 "BACnet" funconality to assure interoperability between all system components.
Having Metasys communicate on and be available to the BLM Network allows real me interacon with HVAC systems regardless of the user’s locaon. Metasys is the only building automaon/energy management system allowed by NIFC to be connected to the BLM network.
GeLng this permission took almost four years. The Security Impact Analysis (April 2012) that approved the connecon of Metasys to the BLM network may be provided as a separate document along with this sole source jusficaon.
6. A descripon of efforts made to ensure that offers are solicited from as many potenal sources as praccable, including whether a noce was or will be publicized as required by FAR Subpart
5.2 and, if not, which excepon under FAR 5.202 applies:
In accordance with FAR 5.102(a)(6), the government will post this jusficaon in conjuncon with the solicitaon via the System for Award Management (SAM). This will provide potenal offerors with an opportunity to specify an alternave soluon if they believe this jusficaon is improper.
7. A determinaon by the Contracng Officer that the ancipated cost to the Government will be fair and reasonable.
The contracng officer determines that the ancipated cost to the Government will be fair and reasonable. The Government intends to include the sole source within a compeve construcon solicitaon. It is ancipated that numerous small businesses will provide offers in response to the solicitaon. As a result, the Government believes compeve market forces will assist in receipt of the most advantageous price for items encompassed within the brand name requirement.
8. A descripon of the Market Research conducted (see FAR Part 10) and the results or a statement of the reason Market Research was not conducted:
Market research was conducted in accordance with FAR 10.002(b)(2) to determine if any other product could sasfy agency requirements under the specific circumstances. Through research, it was found that Metasys is proprietary so;ware and the programming and controllers must be installed by a contractor cerfied by Johnson Controls Internaonal PLC.
9. Any other facts supporng the use of Other Than Full and Open Compeon, such as: (i) explanaon of why technical data packages, specificaons, engineering descripons, statement of work, or purchase descripons suitable for full and open compeon have not been developed or are not available, (ii) When 6.302-1 is cited for follow-on acquisions as described in 6.302-1(a)(2)(ii), an esmate of the cost to the Government that would be duplicated and how the esmate was derived., (iii) When 6.302-2 is cited, data, esmated cost, or other raonale as to the extent and nature of the harm to the Government.
The Government doesn’t own the data or the rights to the data needed to contract the purchase of Metasys® so;ware from other sources. It has been determined to be uneconomical to buy the data or rights to the data. Further it is uneconomical to reverse engineer the Metasys® so;ware.
10. A lisng of the sources, if any, that expressed in wring, an interest in the acquision:
None.
11. A statement of the acons, if any, the agency may take to remove or overcome any barriers to compeon before any subsequent acquision for the Supplies or Services required:
Connuous market research will be performed to ensure that the Government is aware of compable products/systems if/when they become available. Addionally, any acquisions that allow integraon of a new system will be made available to all offerors with similar capabilies and products. NIFC allows JCI or contractors who are not employed by JCI to work on the system if they are manufacturer cerfied, so as addional contractors receive the cerficaons they will be allowed to work on the system.
12. Cerficaon:
I cerfy that any supporng data that is the responsibility of technical or requirements personnel
(i.e. verifying the Government’s minimum needs or schedule requirements or other raonale for other than full and open compeon) and which form a basis for the jusficaon have been cerfied as complete and accurate:
MARK JOHNSON, P.E., Mechanical Engineer and Technical Representave
Contracng Officer Representave
I cerfy that the jusficaon is accurate and complete to the best of my knowledge and belief:
