Question Answer
In regards to Amendment 0001 questions 3, 4,19, and 28 speak directly to Continuity of Services and Key Personnel. The Government has expressed an interest in maintaining the same level of services without disruption and allowing the interviewing of incumbent employees post award, however bid submission requirements for key personnel resumes and letter of intents make it necesssary to allow offerors to contact some personnel prior to submission. The requirement to submit a Letter of Intent for proposed key personnel other than incumbent key personnel is prejudicial to all offerors other than the incumbent contractor.
Having expressed a desire for subsequent contractors to employ incumbent employees will the Government provide contact information for current Key Personnel for offerors to:
1) Ascertain if the employees desire to remain on contract
2) Allow employees to provide a resume to prospective offerors
As stated in the Government response to question 3: "The Government cannot dictate that specific employees be hired under any contract as that is strictly an employer/employee issue. It is noted that both the existing contract and this solicitation contain the clause 52.237-3, Continuity of Services. This clause requires the incumbent to allow the successor to conduct on-site interviews with employees and release them. See subject clause for full text.
https://www.acquisition.gov/content/52237-3-continuity-services".
While the Government does require the level of service and qualified key personnel as outlined in the PWS, there is no contractual requirement, implied or otherwise, that the existing employees be hired. Individuals proposed for filling the various positions must meet the qualification requirements as stated in the RFP.
The government is prohibited from providing information for current contractor employees.
For additional information relating to Key Personnel your attention is called to clause H.9, 1352.237-75, Key Personnel (Apr 2020)
The PWS states that the contractor has to maintain a 10% inventory of all lighting on the site, interior and exterior.
Does this include just the CUP building or is the entire Boulder site?
Can NIST provide a current list of all lighting that is to be included in this contract?
The lighting preventative maintenance covered by Job Plans JP-H-BL-A, JP-H-BL-S, JP-H-INT-A, and JP-H-INT-S are to be completed at the Hawaii site. No lighting is included for Boulder or Ft. Collins.
PWS Attachement 12 Lighting Summary WWVh Field Site Kekaha, HI has been added by Amendment 0006
Can NIST provide pictures of the control room inside the CUP Building? Access to the control room was not given during the walk-thru on 7-14-20.

Question Answer
The generator PM Job Plan states that a full load test has to be run on the generator every month for 30- 60 minutes.
Is this accurate or is the monthly requirement to just run the generator for 30-60 minutes?
If full load testing is required monthly are there load banks available on site to run the full load tests or does the contractor have to provide them?
It is NIST's intent to run load test on the generator once per month. This is an automatically scheduled event through the transfer switch programming. No load bank will be required.
Can NIST provide the model and serial numbers for the 3 (three) Generac 300 kW generators outside of the CUP building?

2.1.4 Can you please clarify the purpose within 180 days if the new hire cannot hold the position of Stationary Engineer until the certificate is received by the City and County of Denver, assuming this after award of the intial solicitation?
NIST recognizes that it may be difficult to obtain this certificate prior to award and the grace period will allow a qualified person with another license or certificate to obtain the certificate from City and County of Denver.
As long as the documentation demonstrating that the person is qualified at time of award or at the time they are hired is provided to NIST, they can work as stationary engineer. The individual must obtain the City and County of Denver certificate within 180 days.
2.1.4/2.1.5 Please clarify if the certifications of Key personnel are due 30 days prior to award or within 30 days after award
As stated in PWS 2.1.4 proof of qualifications for stationary engineer's certification/license shall be provided no later than 30 days after contract award or after employee starts work...
As stated in PWS 2.1.5 - proof of certification(s) is required 30 days prior to the employees start of work; which would make the initial submission no later than 30 days after award.
These requirements are independent of the information required as part of any proposal submitted in response to this solicitation.
