Amendment 0006 is hereby issued to:
1. Provide the following responses to questions received as a result of the issuance of Amendment 0005:
Question #1: CLIN 0003 Contract Type (RFP § M; Attachment J.2)
Please confirm that the term “NTE” as used in the RFP is synonymous with a CPFF Total Estimated Price calculated by adding Total Estimated Cost plus Fixed Fee.
Please confirm that the “NTE” for CLIN 0003 will be the initial amount entered into RFP § I.72 CAR 1352.216-70 ESTIMATED AND ALLOWABLE COST (APR 2010), and subject to FAR 52.232- 20/52.232-22.
Please also confirm that CLIN 003 is a fully CPFF CLIN and will not be converted to FFP.
Response #1: Yes, the Not to Exceed (NTE) amount associated for each Cost Plus Fixed Fee (CPFF) CLIN (0003, 0005, 1002, 2002, and 3002) will be calculated by adding the Total Estimated Cost and Fixed Fee.
The amount specified in CAR 1352.216-70 ESTIMATED AND ALLOWABLE COST (APR 2010) will consist of the total estimated amount for all CLINs that are funded at award.
CLIN 0003 is a fully CPFF CLIN and will not be converted to Firm Fixed Price (FFP).
Question #2: CLINs 0005, 1002, 2002, and 3002 Contract Type (RFP § L, M; Attachment J.2)
Please confirm that the term ‘NTE’ as used in the RFP is synonymous with a CPFF Total Estimated Price calculated by adding Total Estimated Cost plus Fixed Fee.
Please confirm that the “NTE” for CLIN 0005, 1002, 2002, and 3002, if unilaterally exercised, will be the estimated cost amounts added to RFP § I.72 CAR 1352.216-70 ESTIMATED AND ALLOWABLE COST (APR 2010), and subject to FAR 52.232-20/52.232-22 for each of those CLINs.
Relative to the provisions for converting CLINs 0005, 1002, 2002 and 3002 from CPFF, please provide clarification on the process and timeline utilized for this conversion, including in particular any details that may impact an offeror’s proposal.
Please confirm that any future conversion of CLINs 0005, 1002, 2002 and 3002 from CPFF to FFP (or any other contract type), would require a bi-lateral modification following the submission and negotiation of a change proposal.
Please confirm that the USG does not have a right to unilaterally execute conversion of any CPFF CLIN to FFP.
Response #2: See response to Question #1 (above) regarding the explanation of the term “NTE” as it pertains to the CPFF CLINs.
The CPFF CLINs 0005, 1002, 2002, and 3002 will not be exercised or converted to FFP without a bilaterally agreed upon modification to the contract.
As stated within the Attachment J.2 Pricing Schedule_Amendment 0006, Notes needed for pricing tab, “Upon the completion, delivery, and final acceptance of CLIN 0003, Design of modifications to the Baseline aircraft #1 to meet the requirements and configurations in accordance with the SOW and Specifications within Appendix A, the following CLINs will then be modified to Firm Fixed Price (FFP) items via a negotiated, bilateral modification to the contract: CLINs 0005, 1002, 2002, and 3002.” The Government will not convert the CPFF CLINs until it is in the overall best interest of the requirement to do so, and will bilaterally negotiate this conversion with the Contractor.
Question #3: Period for Past Performance Questionnaire (RFP Amendment 0005; Attachment)
The response to question #2 in the Amendment 0005 re-statement of questions and answers states that the Attachment J.4 Past Performance Questionnaire due date has been revised to April 26, 2024 at 2pm.
See updated Attachment J.4 Past Performance Questionnaire_Amendment 0004 documentation.
The 26 April 2024 date pre-dates the date of the amendment. Can you please confirm that this was an inadvertent error and the Attachment J.4 Past Performance Questionnaire is due on 31 May 2024.
Response #3: This was an inadvertent error within the Amendment 0005 SF30 Responses;
the Attachment J.4 Past Performance Questionnaire_Amendment 0005 correctly states the date of May 31, 2024 at 2PM, ET.
Question #4: Incrementally Funded Cost Reimbursement CLINs (RFP Amendment 0005, Section I.62 and I.73)
Amendment 0005 incorporates clause I.50 FAR 52.232-22 Limitation of Funds (Apr 1984). Given that only CLINs 0003, 0005, 1002, 2002 and 3002 are CPFF, use of 52.232-20 was expected. Please provide a list of CLINs that will be incrementally funded, and to what extent.
Reference: The prescription clause for FAR 52.232-22 located at FAR 32.706-2 prescribes the use of FAR 52.232-22 Limitation of Funds in solicitations contracts if an incrementally funded cost reimbursement contract is contemplated. For fully funded cost reimbursement contracts, FAR 52.232- 20 Limitation of Cost is prescribed.
Response #4: The FAR Clause 52.232-22, Limitation of Funds (APR 1984) has been removed and replaced with FAR 52.232-20 Limitation of Cost (APR 1984).
Question #5: Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data (Nov 2021); Alternate I (Oct 2010) and Alternate IV (Oct 2010)
Alternate I: - A requirement is established for certified cost or pricing data for less than the complete proposal. Pursuant to FAR Part 15, proposals are certified – not individual CLINs. In addition, an exemption to the submission of certified cost or pricing data exists for adequate price competition.
It is requested that the requirement for certified cost and pricing data be deleted from the RFP utilizing in lieu thereof the same provisions as in Alternate IV providing the elements of cost data delineated in Section M.5 CAR 1352.215-76 COST OR PRICING DATA (Apr 2010).
Response #5: The requirement for Certified Cost and Pricing data has been removed; only Other than Certified Cost and Pricing Data is required. As a result, FAR 52.215-20, REQUIREMENTS FOR CERTIFIED COST OR PRICING DATA AND DATA OTHER
THAN CERTIFIED COST OR PRICING DATA (NOV 2021), and relevant language within the RFP, has been revised within the RFP 1305M224RNMAN0230_C-130J Aircraft Production_Amendment 0006 and noted in red text.
Question #6 – FAR 15.404-1(c), (d), Cost Realism Analysis
RFP Amendment 0005 states that “provided NTE amounts of CLINs 0003, 0005, 1002, 2002, and 3002 will be utilized in the TEP” but also that “The Government will evaluate the CPFF CLINs in accordance with FAR 15.404-1(c), Cost realism analysis.”
Please confirm that the Government will perform both FAR 15.404-1(c) Cost analysis, and FAR 15.404- 1(d) Cost realism analysis.
15.404-1(d)(2) requires the Government to determine the probable cost of performance for each offeror
– which may differ from proposed cost – and to adjust cost and fee where appropriate. Please clarify that the cost evaluation will adjust CPFF CLINs as appropriate to develop the TEP.
Response #6: Yes, the Government will perform both a Cost Analysis, in accordance with FAR 15.404-1(c), and a Cost Realism Analysis, in accordance with FAR 15.404-1(d). These methods will be utilized to determine fair and reasonable pricing. The Total Evaluated Price (TEP) will be calculated as stated within the RFP; the Cost Realism Analysis where the Government will develop the probable cost of CPFF CLINs will be utilized in examining the Offeror’s NTE amounts for CPFF CLINs in order to determine prices fair and reasonable.
Question #7 – Attachment J.1 Statement of Work
The file provided with Amendment 0005 entitled Attachment+J.1+Statement+of+Work+ + Amendment 0005.pdf in the title header includes, marked as changed text (in red font) the phrase Amendment 0004.
Please confirm whether this reference to Amendment 0004 was included in the header in error.
Response #7: This title was an inadvertent error and should state “Attachment J.1 Statement of Work_Amendment 0005” as the title header within the document.
Question #8 – Attachment J.1.1 Appendix A Specification
The file provided with Amendment 0005 entitled Attachment+J.1.1+Appendix+A+-+Specification+- +Amendment+0005.pdf in the title header includes, marked as changed text (in red font) the phrase Amendment 0004. Please clarify the amendment number. Is this an oversight?
Response #8: This title was an inadvertent error; however, the Attachment J.1.1 Appendix A - Specification is updated within this Amendment herein (0006) and is provided as the revised “Attachment J.1.1 Appendix A - Specification_Amendment 0006.”
Question #9 – Attachment J.1.1 Appendix A Specification – Cockpit Procedures Trainer
Amendment 0005 Appendix A Specification includes a new requirement received in Amendment 0005 at Section A.8.2.2 for Pilot Training Supplies that includes a cockpit procedures trainer (CPT) to be delivered to the government for installation. This is a new requirement that was not included in earlier versions of the RFP. We are concerned that this late addition provides insufficient time to adequately address this requirement, and its addition at this time may not be in the best interests of the Government.
Would the Government consider deleting the CPT requirement from the RFP with an Engineering Change Proposal to be submitted shortly after award?
In the alternative, please confirm whether the Government will permit the cost of this to be included as part of the CPFF CLIN 0003 as a ‘below the line’ addition to the elemental cost breakouts.
Please also confirm that the CPT does not have to be addressed in the technical volume(s).
Response #9: This information has been removed and the “Attachment J.1.1 Appendix A - Specification_Amendment 0006” is provided via Amendment 0006.
Question #10 – Attachment J.1.1 Appendix A Specification -
Amendment 0005 Appendix A Specification includes a new provision at A.9.6.2.2.1 identified as ‘Highly Desired’ rather than a requirement. The specification should state requirements only. Please confirm whether the functionality stated in A.9.6.2.2.1 is a requirement.
Response #10: As specified within the Attachment J.1.1 Appendix A - Specification this provision at A.9.6.2.2.1 is not required; it is highly desired.
Question #11 – Attachment J.1.1 Appendix A Specification – Paragraph A.9.9.5 Satellite Data Connectivity
Please confirm if two different satellite systems are required to meet the redundancy requirement from the Specification below or if the required redundancy can be met by installing two of the same satellite system.
Reference: A.9.9.5 Satellite Data Connectivity
Contractor shall propose redundant satellite connectivity (two satellite systems) for data transfer. Required minimum data rate of 400 Kbps in geostationary coverage and 64 Kbps worldwide. Desired data rate of 3 Mbps or more worldwide. The satellite systems will be determined by the maturity, data rates and reliability of the system at time of design. Provide Internet connectivity by running Ethernet cables from both satellite data systems to female RJ- 45 connectors in the patch panel within the Network Rack. Contractor shall install modifications or jumpers that are required in the Satcom system to enable network connectivity. Example systems are Iridium, Inmarsat and StarLink. Redundant satellite systems are required to mitigate gaps in satellite constellation coverage at various latitudes.
Response #11: Two independent installations of the same system could meet the redundancy requirement if they provide the coverage and data rates needed, and one system, minimum, operates in a lower frequency band as described below. High data rates are required in NOAA’s primary operating area defined by -10° to +55° latitude. Low data rates are required worldwide and in heavy weather. High data rates worldwide are desired. At least one system must operate on the lower frequency X or Ku band to mitigate attenuation during operations in high precipitation events such as tropical cyclones.
