RFIs and Responses
1. The government response to question 1 did not clearly state if the contractor is responsible for omissions not specifically listed in SOW Section 3.3. The response still stated to provide “all-inclusive maintenance services….”. Given this “all-inclusive” statement, is the contractor responsible for omissions not specifically called out in Section 3.3? It is difficult for the contractor to determine what the government considers “all-inclusive”. For clarity the contractor feels this language should be removed and only be held to what is specifically called out in Section 3.3.
Edited in PWS- This is a non-personal services contract to provide comprehensive maintenance services and repair services for the National Bio and Agro-Defense Facility’s (NBAF) UPS Systems, including all necessary components, as detailed in this PWS.
a. For example, the software and firmware updates were not listed in the SOW until the contractor asked the question. Therefore, the contractor is concerned about the “all-inclusive” language and being responsible for performing services not clearly outlined in Section 3.3. The software and firmware tasks were updated and amended prior to receiving the first round of RFI questions due to current situation of not being covered withing the scope of the previous contract.
2. Referencing the government response to Question 6., the response has nothing to do with the question. Please provide a list of parts the contractor is responsible for replacing.
6. Referencing SOW item 3.3.3 it states “replace small, government-provided parts as a required component of the preventative maintenance service”. The contractor respectfully requests a list of parts they will be responsible for installing as the part will impact the amount of labor involved for installation.
Section 3.3.3 requires the Contractor to install small, Government‑provided parts as part of the preventive maintenance service. The intent of this requirement is that the Government will furnish the specific parts identified as faulty by the contractor during maintenance and repair tasks to be installed, and the Contractor is responsible solely for the labor to install them in accordance with manufacturer instructions.
Because these parts are Government‑furnished and may vary based on OEM recommendations, inspection findings, and preventive maintenance cycles, the Government does not maintain a fixed list of parts. The Contractor will only be responsible for installing the parts that the Government provides at the time of service.
This requirement does not obligate the Contractor to supply or identify the parts; it only obligates the Contractor to install Government‑furnished items and document the installation as part of the maintenance record.
3. Referencing the government response to Question 7. (Not 7a or 7b), the government never provided a quantity of parts expected to be replaced under this CLIN. Response to 7b stated parts replacements should take less than 1 hour. However, for accurate pricing the contractor needs to know approximately how many parts they are replacing as this increases the total amount of time on site.
The number and type of these parts vary based on OEM recommendations, system condition, inspection findings, and preventive maintenance cycles. Because these parts are Government‑furnished and are not predetermined, the Government does not maintain a forecasted quantity.
The Contractor is responsible for the labor to install the parts provided at the time of service, and the Government will furnish only those parts required based on actual system needs.
The reference to “less than 1 hour” in the response to Question 7b pertains to the typical installation time for individual small parts, not to the total number of parts or total labor hours.
