About this file
This is a Claim of Business Confidentiality form issued by the State of Nevada for an Electronic Monitoring Request for Proposals (Solicitation Number 99SWC-S3474). The document serves as an attachment to the RFP and allows offerors to designate specific information within their proposals as confidential, proprietary, or protected. Offerors must elect whether they are claiming confidentiality protections for any proposal information or submitting a proposal with no confidentiality claims. If claiming confidentiality, offerors must submit a redacted version of their proposal clearly marked as such and complete a detailed table documenting each confidential claim.
For any information claimed as confidential, offerors must provide the proposal section reference, a description of the confidential information, the basis for the claim, and an explanation of how the information meets the definition of protected material under Nevada Revised Statutes. Proprietary information may only be labeled a trade secret if it derives independent economic value from not being generally known and is subject to reasonable efforts to maintain secrecy. Offerors are expressly prohibited from marking pricing or entire proposals as confidential. By signing the form under penalty of perjury, offerors acknowledge that claiming confidentiality does not guarantee non-disclosure under applicable public information laws and that failure to properly submit redacted copies or comply with confidentiality procedures results in waiver of all confidentiality claims and liability protections.
