About this opportunity

The Orange County Transportation Authority (OCTA) is requesting proposals for sales tax audit and recovery services under RFP 250352, with proposals due July 14, 2026 at 2:00 p.m. Questions are due June 24, 2026, and interviews are scheduled for August 6, 2026.

The contract is a five-year engagement with no set-aside or preference program. Compensation is structured entirely as a tiered percentage of recovered unrealized sales tax revenue remitted by the California Department of Tax and Fee Administration (CDTFA) — not from OCTA's operating budget — with graduated rates applied to three recovery brackets: $0–$3,000,000; $3,000,001–$10,000,000; and over $10,000,000. Offerors must propose percentage rates for each bracket on the Price Summary Sheet. Annual payments may exceed $250,000 but vary year to year based on actual recoveries.

The scope requires identifying and correcting sales tax collection, allocation, and distribution errors within OCTA's jurisdiction, conducting transaction and use tax reviews extending back as far as CDTFA records allow, developing target lists of taxpayer reporting errors, submitting correction documentation to CDTFA, and monitoring outstanding corrections. Deliverables include a continuously maintained Excel-based database of all businesses generating sales tax within the jurisdiction, quarterly status reports, reconciliation worksheets for budget projections, copies of CDTFA submissions for each identified correction, and an alphabetical listing of misallocated or underreported accounts. The consultant must demonstrate expertise in California Transactions and Use Tax Law, experience analyzing confidential sales tax data, and knowledge of local Orange County jurisdictions.

The contract includes retention provisions and liquidated damages requirements. Insurance requirements include Commercial General Liability ($1,000,000 per occurrence), Automobile Liability ($1,000,000 combined single limit), Professional Liability ($1,000,000), and Workers' Compensation as required by California law, with OCTA designated as additional insured. The consultant operates as an independent contractor; OCTA retains ownership of all work products.

Evaluation criteria are weighted as follows: Qualifications of the Firm (25%), Staffing and Project Organization (25%), Work Plan (30%), and Recovery Rate Percentage (20%). Proposals must not exceed 50 pages excluding appendices, cover letters, resumes, and forms. The contract term runs through September 30, 2031. The incumbent contract is C-1-3494.
