About this file
This is an interoffice procurement plan memorandum from the Orange County Transportation Authority (OCTA) documenting the planned procurement approach for RFP 250352, "Sales Tax Audit and Recovery Services." The Authority seeks qualified consultants to provide comprehensive sales tax audit and recovery services under a five-year contract term effective through September 30, 2031. The RFP procurement type was selected because multiple non-cost factors require evaluation beyond pricing considerations. The scope of work requires the selected firm to demonstrate expertise in California Transactions and Use Tax Law, access and analyze confidential sales tax data on behalf of the public agency, implement various audit techniques, and possess knowledge of local jurisdictions and entities operating within Orange County.
The contract type is structured as firm-fixed price compensation based on a percentage of recovered unrealized sales tax revenue, with no base contract value as annual payments vary depending on recovery amounts and may potentially exceed $250,000 annually. Compensation derives from recovered revenue rather than OCTA's operating budget, eliminating the requirement for Board approval per established procurement policies. Evaluation criteria weightings are: Qualifications of the Firm (25 percent), Staffing and Project Organization (25 percent), Work Plan (30 percent), and Recovery Rate Percentage (20 percent). The evaluation team comprises five internal members: May Hout (Principal Financial Analyst, Revenue Administration), Franchesca Ching (Department Manager, M2 Program Management Office), and John Garbowski (Principal Financial Analyst, Financial Planning and Analysis). Retention and liquidated damages provisions apply to this procurement. The requisition number is R002022, and an independent cost estimate has been received.
