About this file

This is an interoffice procurement memorandum from the Orange County Transportation Authority (OCTA) dated June 1, 2026, regarding RFP 250352 for Sales Tax Audit and Recovery Services. The Authority is seeking qualified consultants to provide sales tax audit and recovery services under a five-year contract term effective through September 30, 2031. The RFP procurement type was selected because multiple evaluation factors beyond cost must be considered. The evaluation criteria are weighted as follows: Qualifications of the Firm (25%), Staffing/Project Organization (25%), Work Plan (30%), and Recovery Rate Percentage (20%). The firm must demonstrate thorough understanding of California Transactions and Use Tax Law, experience accessing and analyzing confidential sales tax data for public agencies, knowledge of local Orange County jurisdictions, and capability to implement various audit techniques as outlined in the scope of work.

The contract is structured as firm-fixed price compensation based on a percentage of recovered unrealized sales tax revenue, with no set dollar amount from OCTA's budget since payments are commission-based and derived from recovered funds. Annual payments may potentially exceed $250,000 but will vary year to year. The contract includes retention provisions and liquidated damages requirements. An evaluation team of five members is required, including May Hout (Principal Financial Analyst, Revenue Administration), Franchesca Ching (Department Manager, M2 Program Management Office), and John Garbowski (Principal Financial Analyst, Financial Planning and Analysis). Board approval for contract award is not required per OCTA's Procurement and Contract Management (CAMM) policies since funding does not come from the Authority's budget. An independent cost estimate has been received, and a requisition number R002022 has been assigned.
