The West Virginia Department of Environmental Protection, Office of Abandoned Mine Lands and Reclamation, is soliciting bids through an Agency Request for Quote (ARFQ 0313 DEP2500000045) for construction and remediation services related to the Sullivan Refuse and Clogged Stream Maintenance project located in Sullivan, Raleigh County, West Virginia. This is a federally funded abandoned mine land reclamation project that encompasses comprehensive environmental remediation including refuse pile grading and removal (approximately 9,603 cubic yards), stream restoration and reconstruction (0.4 mile of clogged stream with approximately 4,122 cubic yards of excavation), installation of six wet-type mine seals with stone bulkheads, surface drainage control structures, erosion and sediment control measures, site revegetation across 20 acres, equipment mobilization and demobilization, and clearing and grubbing across approximately 21 acres of total disturbance. Key deliverables include 14,250 cubic yards of unclassified excavation, 2,550 cubic yards of saturated sediment excavation, 2,040 linear feet of vegetated stream bank restoration, 700 linear feet of riprap-lined vee channel, 800 tons of gravel drive rehabilitation, multiple stream habitat enhancement structures (rock cross vanes, log cross vanes, constructed riffles), installation of two 36-inch HDPE pipes for driveway repair, and 1,200 square yards of stabilization fabric and 600 linear feet of woven belted silt fence for erosion control. The mandatory pre-bid meeting was held on January 15, 2025, at 10:00 AM Eastern Time; technical questions were due by January 22, 2025, at 4:00 PM Eastern; and bids must be submitted electronically through wvOASIS Vendor Self Service at www.wvOASIS.gov by January 29, 2025, at 10:30 AM. Bidders must submit unit pricing for each of the 31 line items, with certain cost categories subject to maximum percentage limitations of the total bid amount: mobilization/demobilization (3%), construction layout (3%), quality control (2%), site preparation (5%), pump around operations (3%), and impoundment dewatering (3%). Required qualifications include a valid West Virginia contractor's license prior to contract award, submission of a drug-free workplace affidavit, 5% bid bond, 100% performance bond, and 100% labor and material payment bond; commercial general liability and automobile liability insurance of $2,000,000 per occurrence; compliance with Davis-Bacon wage rate requirements; and submission of subcontractor lists for any subcontractors performing work exceeding $25,000.
This procurement is restricted to contractors meeting specific federal and state requirements for abandoned mine land projects. All bidders must complete and submit the Abandoned Mine Lands Contractor Information Form and obtain organizational family tree information from the Applicant Violator System (AVS) within 30 days of submission to be considered eligible. The project is subject to Build America, Buy America (BABA) requirements, mandating that all iron, steel, and manufactured products be produced in the United States with a minimum of 55% domestic content by cost, with limited exemptions only for temporary tools, equipment, and supplies not integral to finished infrastructure. Additionally, contractors must hire 75% of employees from the local labor market and must serve as Co-Applicant #1 on the NPDES stormwater permit, transferring permit responsibility to the contractor prior to Notice to Proceed issuance. The project has received environmental clearance through a NEPA review with no significant impacts identified, and federal authorization was issued by the Office of Surface Mining Reclamation and Enforcement (OSMRE) on December 4, 2024. No incumbent vendors or existing contractors are identified in this solicitation. The engineer's estimate for the project is $610,891.00, with the contract structured as an open-end maintenance and construction contract for an initial one-year term with potential renewal for up to three successive one-year periods by mutual written consent. All work must be completed in accordance with comprehensive construction specifications, supplemental specifications from the West Virginia Division of Land Restoration, and detailed construction drawings prepared by The Thrasher Group, Inc., with general permit registration for stormwater discharge (WV0115924) valid through June 7, 2025.
