About this file
This file consists of an Authorization to Proceed (ATP) letter and Finding of No Significant Impact (FONSI) documentation from the Office of Surface Mining Reclamation and Enforcement (OSMRE), U.S. Department of the Interior, to the West Virginia Department of Environmental Protection (WVDEP) regarding the Sullivan Refuse and Clogged Stream abandoned mine lands reclamation project located in Sullivan, Raleigh County, West Virginia. The project addresses health and safety issues associated with uncontrolled drainage from collapsed mine portals, exposed coal refuse piles, and a clogged stream section. Work scope includes installation of six wet-type mine seals, regrading of four coal refuse piles totaling approximately 4.0 acres, reconstruction of 0.4 mile of clogged stream, installation of surface drainage control structures, erosion and sediment control measures, equipment mobilization and demobilization, access road construction, clearing and grubbing, and regrading and revegetation of disturbed areas. The total area of disturbance is approximately 21 acres. OSMRE authorization was issued on December 4, 2024, allowing the WVDEP to proceed with project expenditures in accordance with AML grant terms and conditions.
The project has been documented in the enhanced Abandoned Mine Land Inventory System (e-AMLIS) in compliance with OSMRE directives and has received environmental clearance through a NEPA review with no significant impacts identified. OSMRE determined that minor to moderate impacts may occur on hydrology, vegetation, fish and wildlife, soils, recreation, air quality, noise, socioeconomic resources, and topography, but no significant environmental effects are anticipated. No hazardous waste has been identified within the project area, no adverse effects on federally listed species are anticipated, and the project will not negatively impact low-income or minority populations. Federal funding is provided through AML grant programs, and the project is contingent upon OSMRE approval of any subrecipients through subaward agreements.

Travis Parsons, Deputy Director Office of Abandoned Mine Lands and Reclamation West Virginia Department of Environmental Protection 601 57th Street Charleston, West Virginia 25304
Dear Mr. Parsons:
The Office of Surface Mining Reclamation and Enforcement (OSMRE) has determined that the Sullivan Refuse and Clogged Stream abandoned mine lands reclamation project has met the following criteria:
1. The project has been entered, or will be entered, into the enhanced Abandoned Mine Land Inventory System (e-AMLIS) prior to construction activities, in compliance with Directive AML-1.
2. Environmental documents, including compliance information for the National Environmental Policy Act (NEPA), and other environmental requirements, have been documented with a Finding of No Significant Impact, signed by OSMRE on December 4, 2024.
3. The Authorization to Proceed (ATP) request included an AML eligibility statement and basis for documenting AML eligibility.
Accordingly, pursuant to 30 CFR 886.16, you are authorized to proceed with this project and expend Federal funds in accordance with AML grant terms and conditions. If this project provides funding to a subrecipient through a subaward, the subrecipient must be approved by OSMRE separately from this ATP. OSMRE subrecipient approval can be requested either through the initial award application or through a separate request.
Please contact us should you have any questions.
Sincerely, Justin Adams, Director Charleston Field Office

Abandoned Mine Lands Reclamation Project
Sullivan, Raleigh County, West Virginia
Sullivan Refuse and Clogged Stream (WV6766)
This project area is located on the Crab Orchard U.S.G.S. 7.5-minute quadrangle with a general location of 37º 42' 01.6” latitude and 81º 11’ 16.5” longitude. The West Virginia Department of Environmental Protection (WVDEP) has requested authorization from the Office of Surface Mining Reclamation and Enforcement (OSMRE) to conduct reclamation activities at this site to address the health and safety issues associated uncontrolled drainage from several collapsed mine portals, four (4) exposed coal refuse piles and a section of clogged stream. The work proposed at the site consists of the installation of six (6) wet-type mine seals, the regrading of four (4) coal refuse piles totaling approximately 4.0 acres, the reconstruction of 0.4 mile of clogged stream and the installation of various types of surface drainage control structures. The proposed work will also include the installation of proper erosion and sediment control measures, mobilizing/demobilizing equipment, constructing access roads, clearing and grubbing, and regrading and revegetating disturbed areas. The area of disturbance will be approximately 21 acres.
OSMRE has thoroughly reviewed the environmental documents prepared by WVDEP’s Office of Abandoned Mine Lands and Reclamation and submitted to OSMRE on November 19, 2024.
The information provided adequately discusses the environmental issues and impacts for OSMRE’s authorization purposes for abandoned mine lands reclamation construction activities.
This project will not affect historic and cultural resources. Minor or moderate impacts are likely to occur on the following resource values: hydrology, vegetation, fish and wildlife, soils, recreation, air quality, noise, socioeconomic resources, and topography. No known hazardous waste has been identified within the project area. The project will not create negative impacts on low income and minority populations (Executive Order 12898). The project, as proposed, is not likely to adversely affect any federally listed species based on our consultation with appropriate state and federal agencies.
Based on the analyses in this environmental assessment, we find that this abandoned mine lands project will have no significant effects on the quality of the human environment. Therefore, we conclude that no detailed environmental impact statement is necessary.
