L.4 PROPOSAL FILES

1. Format.

The submission needs to be clearly indexed and logically assembled. Each volume should be clearly identified and begin at the top of a page. All pages of each volume need to be appropriately numbered and identified by Offeror name, date and solicitation number in the header and/or footer, redacted as necessary for the SANITIZED version (i.e. Offeror name). Create a Master Table of Contents to sequentially list the content contained in the hard copy Master Volume and a separate Table of Contents to sequentially list the content contained in each separate electronic file within each volume. The Table of Content is not included in the page count. Letters of Commitment (Volume III) and Teaming Agreements (Volume I) may be submitted as an Appendix in searchable Adobe Acrobat (.pdf) format. Use the following page setup parameters with MS Word (.docx) files:

Table Three: Page Setup Parameters

Margins Top, Bottom, Left, Right - 1
Page Size, Width - 8.5
Gutter – 0
Page Size, Height – 11

Exceptions to the above, the MS Excel Cost Workbook, Staffing Worksheets, and large complex graphics or charts may be printed on 11 x 17 paper. Counts as two pages.

From Edge Header, Footer - 0.5

Both hard and electronic submissions are to follow the above format. Additional direction for electronic packaging is in the paragraph below. Exceptions are: MS Excel Cost Workbook, Staffing [Plan] Worksheets and large complex graphics or charts may be printed on 11 x 17 paper, Letters of Commitment (Volume III) and Teaming Agreements (Volume I).

2. Electronic File Packaging.

(a) Complete electronic volumes are to be submitted in Microsoft Office format; readable by Microsoft (MS) Word (.docx), MS Excel (.xlsx), MS Power Point, and/or Adobe Acrobat (.pdf). Do not password protect electronic copies. All MS Excel formulas and hidden columns shall be viewable by evaluators. All electronic copies must be submitted using the Safe Access File Exchange described in RFP Section L.1. Proposals submitted via e-mail will not be evaluated.

(b) Each file is to contain a Master Table of Contents for that file. Do not use "Pivot Tables" in Offeror spreadsheets. Electronic versions are to be an exact duplicate of the original hard copy proposal. The Government is not responsible for identifying inconsistencies between the two and may rely on either version at its discretion. Page format restrictions and limitations (as identified in Table Two and Three) apply. Sound or video (e.g. MPEG) files are not to be embedded into the proposal files.

(c) Cost/Price requirements: Files contained on the Volume IV Cost may not be password protected. If the Cost/Price Volume contains electronic links, the links must be intact and maintained through all revisions.

(d) No cost information shall be presented in any part of the proposal except the UNSANITIZED cost proposal, except for the cost data (indirect rates and financial responsibility documentation) specified to be provided in Volume I – General at Section L.5.. Proposal volumes shall not contain classified data. NO ZIPPED FILES are permitted.

3. Content Requirement.

(a) Confine all information to the appropriate file. If information is not located in the appropriate file, that information may not be evaluated and may be considered omitted. The Offeror should limit information to essential matters, sufficient to define the proposal in a clear and concise manner, to permit a complete and accurate evaluation of each proposal.

(b) Number all pages in each volume sequentially with Arabic numerals (1, 2, 3, etc.). Information that can be construed as correctly belonging in another volume of the proposal may be so construed and counted against the appropriate volume’s page limitation (the Government will not double count pages).

(c) Pages submitted in excess of the respective volume page limit will be removed and will not be evaluated by the Government.

(d) Title pages, tables of contents, cross-reference matrices, glossaries, acronym lists, page tabs, and section dividers that do not contain material that can be construed as proposal information will not be counted as part of the page limitations. However, these pages shall be numbered with lower case Roman numerals (i, ii, iii, etc.) or marked as tabs as appropriate to provide ease of reference for the Government.

(e) At a minimum, each file is to consist of a Table of Contents and a narrative discussion. Any proprietary information shall be clearly marked as such. Content for each proposal volume narrative discussion is prescribed in the following volume instructions.

L.5 VOLUME 1 - GENERAL

1. Proposal Transmittal Letter. A letter formally transmitting the proposal shall include the following appendices:

(a) Statement of Compliance. Each Offeror shall include a statement indicating complete compliance with the solicitation, or detailed analysis of any objections, exceptions, contingencies, or additions. Any objections, exceptions, contingencies, or additions shall include an appropriate rationale and must be cross referenced to the particular paragraph(s) in the solicitation document to which they apply.

(1) Offerors are cautioned that they take exception to any requirements (including objectives and constraints) or Terms and Conditions of the solicitation at their own risk. The Government may, at its option, reject an offer which contains any such exceptions. Nonetheless, any exception taken by the Offeror, at its own risk, shall be identified in the Statement of Compliance.

(2) If no exceptions are taken, the Offeror shall include the following statement in the Statement of Compliance:

(3) “[Name of Offeror] takes no exception to any requirement or Terms and Conditions of Solicitation No. W91RUS-18-R-DA04, USARCC-C Information Technology Support Services.

(b) Proprietary Information. Each Offeror shall include a statement indicating whether the Offeror intends to make use of any proprietary or patent information. In the event that use of such information is anticipated, the specific areas of use by the Offeror and its subcontractors must be clearly defined, including the level of rights that are applicable. Each Offeror shall indicate the cost to the Government for acquisition of each and all proprietary information identified in the proposal. Each Offeror shall carefully complete the appropriate representations and certifications, keeping in mind the above requirements.

(c) Format and Content. Each Offeror shall describe any deviations of their proposal from the specified format. If the content of the Offeror’s proposal differs significantly from these guidelines, Offerors shall state the differences and explain the reason for the differences.

(d) The Proposal Adequacy Checklist. The Proposal Adequacy Checklist is required in accordance with 52.215-20.” Issues related to alternative business arrangements will be addressed on a case by case basis and will be coordinated between the appropriate Government agencies, such as DSS, SBA, DCAA, etc..

(e) DOD Security Clearance. The Industrial Security Facilities Database (ISFD), maintained by the Defense Security Service (DSS), is the repository of information about Department of Defense (DoD) cleared contractor facilities. Each Offeror shall provide, as part of their proposal, a screenshot from the ISFD system that verifies the Offerors Facility Clearance Level and safeguarding capability of the NISP contractor. If an Offeror has an alternative business arrangement, such as a JV, either the JV or each JV member may provide a screenshot from the ISFD system verifying the JV or its members’ Facility Clearance Level and safeguarding capability. To access the system, enter the following URL in the browser: https://isfd.dss.mil/ISFDweb . If you need assistance, then please call the DoD Security Services Call Center at 888-282-7682. Include a statement certifying that all personnel employed to perform under the resultant contract meet the qualifications (to include the requisite security clearances, and National Agency Checks) in the DD Form 254 - Contract Security Classification Specification at Section J, as of the performance start date. Along with this statement please provide the following for both the Prime and Subcontractor(s):

(1) Cage Code

(2) DUNS Number

(3) Legal Company Name (identify all “aka” or “dba” names used also)

(4) Complete physical address of cleared facility (of facility which will have primary security responsibility)

(5) Facility Clearance Level

(f) DCMA and DCAA Points of Contact. Each Offeror shall provide their cognizant field office information to include the point of contact’s name, address, phone number, and e-mail address. Offerors shall include this information for all subcontractors. Each Offeror shall provide their most recent DCMA Forward Pricing Rate Agreement (FPRA), Forward Pricing Rate Recommendation and/or DCAA Provisional Rate Recommendation or DCAA Provisional Rate Agreement, as well as any DCAA audit reports relative to your direct labor, indirect expense, and any other rates or factors. If you are an Offeror who does not have an assigned DCAA representing office, please contact your regional DCAA office for the contact information to supply in response to this RFP.

1. If Provisional Billing Rates have not been established, then the following information shall be provided to establish Provisional Billing Rates in accordance with FAR 42.704 – Billing Rates.

a. The Offeror shall submit a Provisional Billing Rate Proposal (BRP) to include documentation to validate the proposed direct and indirect rates. Because the final rates are DCAA determined, in addition to providing to the Contracting Officer, the Offeror shall also submit the BRP to the Offeror’s cognizant DCAA Office. Electronic submissions are encouraged. Provide in excel format on a CD or through e-mail. The auditor shall establish Provisional Billing Rates (PBR) on the basis of information resulting from recent review, previous rate audits or experience, or similar reliable data or experience of other contracting activities. Examples of documentation which may be submitted for proposed direct labor rates could be recent actual direct labor rates supported by payroll records, and/or paystubs, Letters of Intent (LOIs), or salary survey data. If providing LOIs, you and/or your subcontractors shall include the direct hourly labor rate for the proposed employee, identify the position, submit the LOI on your subcontractor’s letterhead (as applicable) with both the prospective employee’s and the employer signatures, and state that the LOI is for the subject procurement. You and/or subcontractors shall provide the range of rates for each labor category based on its salary structure.

b. The Provisional Billing Rate Proposal (BRP) shall include documentation to validate the proposed indirect rates. Documentation for the BRP indirect expense rates shall include the forecasted expense pool (by expense account) and allocation base detail, along with the last three years’ actual pool (by expense account) and allocation base information.

· Proposed billing rate calculations (Pool and Base) with brief rationale

· Prior three fiscal year (FY) pool and base

· Current FY to date pool and base

· Current FY budget pool and base, if available

· Comparative analysis with explanation of any significant differences

This information shall include any incurred cost submissions along with your and/or your subcontractors’ certifications.

c. The above requirements to provide DCMA/DCAA points of contact and to provide a Provisional Billing Rate Proposal (BRP), if one hasn’t already been established, apply to the Prime and all Subcontractors. Offerors are encouraged to reference DCAAP 7641.90, Information for Contractors, located at www.dcaa.mil. This manual has been designed to assist contractors in understanding applicable requirements and to help ease the contract audit process. Chapter 6 explains Incurred Cost Proposals.

2. The rates reflected in the FPRA, FPRR, FPRP, BRP or DCAA/DCMA audit or review should directly match the proposed rates as detailed in the proposal. If the proposed rates do not match the FPRA, FPRR, FPRP, or DCAA/DCMA audit or review, you and/or your subcontractors shall provide sufficient detail explaining how the proposed rates are realistic.

(g) Direct Billing Authorization. Contractors approved by DCAA for direct billing authorization shall provide, as part of their proposal, a copy of their DCAA direct billing authorization memorandum. This memorandum will be signed by the cognizant DCAA office manager and state that the contractor has adequate internal controls over its billing system and submits incurred cost proposals and final vouchers per FAR 52.216-7; therefore, provisional DCAA approval of interim vouchers is not needed.

TITLE 13—Business Credit and Assistance

CHAPTER I—SMALL BUSINESS ADMINISTRATION

PART 125—GOVERNMENT CONTRACTING PROGRAMS

125.6

What are the prime contractor's limitations on subcontracting?

125.8

What requirements must a joint venture satisfy to submit an offer for a procurement or sale set aside or reserved for small business?

125.9

What are the rules governing SBA's small business mentor-protégé program?

In accordance with FAR 9.603, each proposal shall identify the teaming arrangements and fully disclose company relationships so that the Government may evaluate the teaming arrangement to ensure it is legal. For example, to ensure that it conforms to the limitations described in FAR 9.604, which does not authorize contractor team arrangements in violation of antitrust statutes. In addition, contractor team arrangements cannot limit certain Government rights, such as the right to hold the prime contractor fully responsible for contract performance regardless of the composition of the team. This requirement applies to the traditional Prime and Subcontractor team arrangement. Documentation describing the teaming arrangements and company relationships shall be included as an attachment to the proposal transmittal letter within this Volume I - General. Note: The Cost Workbook captures the amount of work subcontracted in both dollars and percentage of work on the “Summary” Worksheet.

The Contracting Officer will request a DCAA audit of your accounting system and provide the checklist and ICQ to DCAA when the audit is requested. The preaward accounting system survey is an examination of a contractor's accounting system to reach an informed opinion as to whether or not the design of the prospective accounting system is adequate for accumulating and segregating costs under a cost reimbursable contract. Accounting System compliance will be conducted as part of the responsibility determination prior to award for only the apparent awardee's proposal. If the Contracting Officer and DCAA are unable to deem the Offerors accounting system as adequate at time of award, their proposal will be determined non-responsive and non-responsible and will not be eligible for award.
