The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

52.212-2 EVALUATION--C OMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will utilize a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement.

(b) Only those proposals determined to be Technically Acceptable will be eligible for award. Offerors whose technical proposals are determined “Unacceptable” will not be eligible for award. For a proposal to be determined “Technically Acceptable” and receive consideration for award based upon low price submitted, the proposal must receive a rating of “Acceptable” for all factor and sub-factors.

(c) The Government intends to evaluate the offer and award a contract without discussions. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

Adjectival Ratings

1. The adjectival ratings to be utilized for proposal evaluations are consistent with the DoD Source Selection Procedures and the Army Source Selection Supplement (AS3). A single rating system will be used to evaluate the Technical Acceptability (to include Subf actor 1 and Subf actor 2, as indicated below). Price will be evaluated for reasonableness and will not receive an adjectival rating.

Technical Acceptable/Unacceptable Ratings

Rating
Description
Acceptable
Proposal clearly meets the minimum requirements

of the solicitation.

Unacceptable
Proposal does not clearly meet the minimum

requirements of the solicitation.

Evaluation Criteria

Evaluation criteria consists of the following factors and Subfactors. The proposals will be evaluated under the following three factors:

Factor 1: Technical Capability Subfactor 1: Technical Capability Subfactor 2: Management and Staffing Approach Subfactor 3: Phase-In Subfactor 4: Quality Control Plan

Factor 2: Past Performance Factor 3: Price

Factor 1 – Technical Capability Factor. The Technical Factor evaluation provides an assessment of the offeror’s capability to satisfy the Government’s minimum requirements.

Subfactor 1: Technical Ability. To be considered acceptable, this sub-factor is met when the Offeror's proposal demonstrates thorough knowledge and understanding of the requirement in all areas, effective procedures to monitor and manage performance, and a sound, practical, and efficient technical approach that ensures all tasks are performed in a manner to successfully meet the needs of the requirements outlined in the Performance Work Statement (PWS).

Subfactor 2: Management and Staffing Approach. To be considered acceptable, this sub- factor is met when the Offeror's proposal demonstrates an effective and efficient management approach for planning and executing the technical requirements of the PWS, which also includes the organizational structure. The Offeror must demonstrate a staffing approach with staffing labor mix of qualified personnel in the appropriate labor categories to perform all tasks and accommodate fluctuating workloads and cross-utilization of personnel. The Offeror must demonstrate how it will recruit and retain sufficient qualified personnel to successfully perform the requirements outlined in the PWS. The proposal’s overall management and staffing approach has little potential to disrupt or degrade performance.

Subfactor 3: Phase In: When evaluating this element the Government will evaluate the approach to determine the Offeror’s understanding of the technical requirements of the PWS and assess the offerors ability and methodology to meet or exceed the minimum requirements to ensure a transition from the contract award date to full operational status by the contractor.

Subfactor 4: Quality Control Plan: The Government will evaluate the offeror’s understanding of the technical requirements and assess the offeror’s ability and methodology in meeting, or exceeding, the performance standards.

The Government’s technical evaluation team will evaluate the Technical Capability Sub-factors on an acceptable or unacceptable basis. Any sub-factor that is rated Unacceptable will result in the overall Technical Capability factor being determined Unacceptable. Only those proposals determined to be technically acceptable will be considered for award. The Technical Factors will receive one of the adjectival ratings defined below. The Subfactor ratings will be used to determine an overall rating for the factor.

Table C-1. Technical Acceptable/Unacceptable Ratings

Rating
Description
Acceptable
Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable
Proposal does not clearly meet the minimum requirements of the solicitation.

(2) Factor 2 – Past Performance. In lieu of requesting past perf ormance inf ormation, Past Perf ormance Inf ormation Retrieval System (PPIRS), Federal Awardee Perf ormance and Integrity Inf ormation System (FAPIIS) and other commercial databases will be utilized in reviewing past perf ormance.

Past Perf ormance Evaluation Ratings

Rating
Description
Acceptable
Based on the off eror’s perf ormance record, the Government has a reasonable expectation that the off eror will successf ully perf orm the required ef fort, or the off eror’s perf ormance record is unknown.
Unacceptable
Based on the off eror’s perf ormance record, the Government has no reasonable expectation that the off eror will be able to successf ully perf orm the required ef fort.

(3) Factor 3 – Price. The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 15.404-1(b) will be the primary means of assessing Price analysis for commercial items to determine price reasonableness. To be viable for award, an Off eror’s price must be determined f air and reasonable and not exceed the established f air market price in accordance with FAR 19.807. The Off eror’s total proposed price will be utilized to evaluate if the proposal represents a f air and reasonable price. The total evaluated price includes the price of the phase-in period, base period, all option periods (to include the option to extend services in accordance with FAR 52.217-8).

Total Evaluated Price (TEP): The TEP to be used for the determination of price reasonableness will be calculated as follows: The sum of all CLINs‘ (to include the travel plug f igure), the base period and f irst option period, second option period, and ½ of the second option period price as an evaluation of potential pricing under FAR Clause 52.217-8.

Unbalanced Pricing: Unbalanced pricing will be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential perf ormance risk which could result in unreasonably high prices. Technical and past performance, when combined, are equal.

(a) Options. The Government will evaluate off ers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an off er is unacceptable if the option prices are signif icantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Off eror’s f inal option period prices to the Off eror’s total price. Thus, the Off eror’s total price for the purpose of evaluation will include the phase in and base period, 1st option, 2nd option, and 1/2 of the 2nd option. Off erors are not required to enter a price for the six-month period.

(b) A written notice of award or acceptance of an off er, mailed or otherwise f urnished to the successf ul off eror within the time for acceptance specif ied in the off er, shall result in a binding contract without f urther action by either party. Bef ore the off er's specif ied expiration time, the Government may accept an off er (or part of an off er), whether or not there are negotiations af ter its receipt, unless a written notice of withdrawal is received bef ore award.
