The solicitation is for a single IDIQ Firm-Fixed Price contract (30-Day Phase-In, 60 Months) using a Lowest Price Technically Acceptable (LPTA) evaluation method. Follow on Questions to Amendment 0001 of Solicitation # W91QF524R1000 Fort Gregg-Adams, VA – Post Refuse & Recycling Services
1. Will the government please provide a conformed copy of the solicitation document incorporating the changes made in Amendment 0001, or at least a conformed copy of Section B – Supplies or Services and Prices, CLINS?
- Yes, please refer to the attached conformed copy.
2. Answer to Q 48 and 73 & Refuse and Recycling Pricing Worksheet Rev Apr 24 and CLIN 0002AB revised description. The answers to the questions and the revised CLIN description indicate that the MSW disposal fees and recyclable processing fees are to be bid in SUBCLIN 0002AB.
The revised CLIN Quantity is 7,275 Tons, however per the Historic Data provided there is 7,275 tons of MSW and a further 1,003 tons of recyclables. Please increase the CLIN Quantity to be consistent with actual tonnages disposed of.
- The AB CLIN is not to be used for recyclables. The AD CLIN will be used for billing recyclable cost per month with receipts for tonnage and cost.
The current market rate for MSW disposal is $50-$60 per ton and the current Single Stream Recyclables processing fee is around $100 per ton, and the answers state that reimbursement will be based on disposal facility receipts. To achieve a lower TEP bidders can enter the lowest possible disposal cost per ton and would still be reimbursed the actual cost once the contract is awarded. For uniformity in evaluation we encourage the government to make this a pre-priced CLIN to avoid bid manipulation.
- These are government-funded CLINs and the Government establishes the funding for CLIN AB and CLIN AD. All refuse billings are charged to the AB CLIN based upon actual cost submitted for the month with receipts. AD CLIN is used in the same manner for recyclable with receipts. Both of these CLINS pricing will be established by the government as they are reimbursement to the contractor for actual cost. The government will bill based on current market value. AD CLIN is used in the same manner for recyclable with receipts. Both of these CLINS pricing will be established by the government as they are reimbursement to the contractor for actual cost.
4. Refuse and Recycling Pricing Worksheet Rev Apr 24 and CLIN 0002AB & 0002AE revised descriptions.
The current market rate for MSW disposal is $50-$60 per ton and the current Single Stream Recyclables processing fee is around $100 per ton due to this large price difference we encourage the government to re-instate the original separate CLINS for Disposal Fees and Processing Fees for Recyclables.
AD CLIN is
5. Refuse and Recycling Pricing Worksheet Rev Apr 24. CLIN AC Hauling Charges for Compactors.
The ELIN Qty of 3,360 equates to each of the 5 compactors being serviced 13 times per week, this quantity is excessively high. Is this the 5-year quantity? Please adjust the quantity to reflect current service levels?
- The quantity has been corrected to 672 in the last revised pricing worksheet dated 23APR2024.
6. Refuse and Recycling Pricing Worksheet Rev Apr 24. CLIN AD Marketing Recyclable Materials. The CLIN Unit is JOB in the worksheet but month in the revised CLIN description, please change the UoM to Month in the worksheet.
- For congruency for the IDIQ, the unit of measure has been changed to Job.
7. Answer to Q27 and Refuse and Recycling Pricing Worksheet Rev Apr 24 and revised CLIN description.
The Unit in the Pricing Worksheet is Each, please amend the CLIN language from Months to Each.
- For congruency for the IDIQ, the unit of measure has been changed to Job.
8. Revised Section L. 3. The revised instructions require the Phase-In Plan to be put into Volume III Price Proposal, however the evaluation criteria Factor 1 Technical Capability, Element 1 d. states “The offeror’s phase-in approach will be evaluated on the likelihood of a smooth transition and full performance at conclusion of the phase-in period.” In order to be evaluated as a Technical Criteria the Phase-In Plan should be included in the Technical Capabilities Volume not the Price Volume. Please provide guidance.
- This statement has been removed from Volume III Price Proposal and move to Volume II
Technical Proposal.
9. Revised Section L. 3. d (iv) and answer to Q 67.. Completed Direct Labor, Table Labor Category, Area Wage Determination Code, FLSA Exempt/Non-Exempt, # of FTEs, Total Labor Hr WageRate, Fringe Benefits. Please explain what is required to meet this requirement or provide the table that we should complete.
- As mentioned before, the Wage Determination 2015-4313, Revision No. 24 is attached on sam.gov.
The attachment is titled Attachment 3- SCA Wage Determination 2015-4313. I have reattached it, as I noticed that the original attachment was corrupted.
10. CLIN AC (3360 qty) appears to be the contract total for compactor hauls, not an annual total (672 annual). Can the Government please clarify and revise.
- This has been revised. Refer to the updated pricing list and amended solicitation.
11. L.4.3 price narrative states that “There should be a description of the services that will be performed during 30 Day Phase-In Period and each year to follow.” It seems like this is a summary of the technical volume. Can the Government please confirm that you want this much non-price specific information in the Price Volume?
- This statement has been removed from Volume III Price Proposal and move to Volume II
Technical Proposal.
12. Per the answer to question 73. While we appreciate the Government’s willingness to adjust to market rates during contract execution, what is stopping an Offeror from bidding under market rates per ton (to create a lower total evaluated price) and adjusting upwards per ton via modification after award? The issue is in the price evaluation where one Offeror could bid market rate per ton and another below and adjust upward per ton post award. Creating a Not to Exceed (NTE) funding amount for CLIN AB would allow the Army to direct all Offerors to use this total amount as the price for CLIN AB. This would apply to all Offerors during the pricing evaluation process creating an equal playing field for all Offerors but will still allow for a price adjustment (should it be needed) during contract execution. This scenario (bidding low and adjusting up) has occurred on previous bids for this contract and other Army awards.
Both of these CLINS pricing will be
13. We are unclear on how to propose a price for CLIN AD which has a qty of 12 (per Job). The pricing sheet directs the Offeror to submit its tickets for reimbursement and states “**Marketing Recyclable Materials: The Contractor shall be responsible for marketing all recyclable materials.
The Contractor shall track commodities of all recyclable material sold, date sold, to what vendor, for how much and money rendered. To be billed on CLIN AD.” And “**Per 1.1.2 Annex E: "Fees and rates will be based on actual receipts and weights tickets from landfill or recycle company where materials are disposed. Physical copies of the receipts, tickets and fees will be required for reporting and payment on CLIN's AB and AD, monthly.” Since there is no quantity in the CLIN that all Offerors are bidding against except what appears to be a monthly total, how do we derive a price? Similar to question 3 above, while we appreciate the Government’s willingness to reimburse the contractor during contract execution, what is stopping an Offeror from bidding $0 (to create a lower total evaluated price) and seeking reimbursement after award? The issue is in the price evaluation where one Offeror could bid the “Job” at $0 and then seek reimbursement.
Creating a Not to Exceed (NTE) funding amount for CLIN AD would allow the Army to direct all Offerors to use this amount as the price for CLIN AD. This would apply to all Offerors during the pricing evaluation process creating an equal playing field for all Offerors but will still allow for reimbursement during contract execution. This scenario ($0 and submitting tickets for reimbursement) has occurred on previous bids for this contract and other Army awards.
AD CLIN is
14. Section L, Volume V Past Performance states “An evaluation will be performed at the end of the base contract period and at the end of each option period.” However the answers to questions 46 and 66 state that there are no option years for this contract, can the Government please deconflict.
- The word “option,” but everything else will remain the same.
