SUMMARY OF CHANGES

SECTION C - DESCRIPTIONS AND SPECIFICATIONS

The following have been added by full text:

RFI AMEND 0006

1. Section C IDIQ PWS – So that we can determine future bid and performance and payment bonding capacity requirements for the contract, what elements of future TOs are expected to be considered construction line items?

RESPONSE: Future task orders may include, but are not limited to, utility upgrades related to storm water conveyance systems, new pump station construction or existing pump station upgrades, construction activities associated with storm water management, construction activities associated with landfill consolidation, and capping.

2. The definition of “Team Member” on page 10 of Amendment 1 restricts offerors’ ability to use competitive bidding for major functions such as transportation and off-site disposal of waste. A possible consequence of this requirement is that offerors will be compelled to obtain certain functions through sole-source procurement. To enable offerors to solicit competitive bids from multiple vendors, we ask that the government restrict the term “Team Member” to denote only the prime offeror, JV members, and named subcontractors. Please eliminate the clause “and other partners who will be performing the majority of work for any of the following key work functions: contaminated soil excavation; transportation and consolidation of waste material at OU#4; transportation and off-site disposal of PHC Waste/contaminated soil; installation of a low-permeability cap; and soil confirmation sampling and air monitoring.”

RESPONSE: These key elements of work are most critical to the contract and need to be evaluated to determine the best value to the Government. All key work functions remain unchanged with the exception of “transportation and off-site disposal (T&D) of PHC Waste/contaminated soil.” Please see changes to Section L, Submission Requirements.

3. Offerors’ selection of subcontractors is constrained by the instruction on page 10 of Amendment 1 that states “The prime offeror and Team Members must be identified at least once in the submitted three to five projects required above.” The best value to the government may not come from re-using vendors who performed similar work for the offeror on the cited projects. Would the government consider removing this instruction to enable offerors to seek competitive pricing for all areas of work?

RESPONSE: The requirements remain unchanged. The Offeror may submit projects that demonstrate Team Member experience, even if the Offeror was not involved in the project.

4. Section L.B (Factor 1: Team Experience & Organizational Approach) and Amendment

001 indicate that the prime/team members who are performing the majority of the work for five key work functions (contaminated soil excavation, transportation and consolidation of waste material at OU#4, transportation and off-site disposal of PHC Waste/contaminated oil; installation of a low permeability cap, and soil confirmation sampling and air monitoring) must be identified in the 3-5 projects submitted to meet this requirement. However, transportation and off-site disposal of PHC Waste/contaminated soil will be performed by a T&D contractor/disposal firm (specialty subcontractor that is competitively bid). Therefore, please confirm that this work activity involves management of off-site transportation and disposal versus self-performing this activity (i.e., T&D coordination, profile development, manifesting, compliance, etc.) and that it doesn’t require us to provide a project for a subcontractor (not a team member) for an activity that is typically competitively bid.

RESPONSE: Please see response to Amendment 0006, #2.

5. We understand that a copy of a Joint Venture agreement should be included in Volume I, Factor 1. Should the other requirements noted in paragraph (2) of Appendix B also be included in Volume I, Factor 1, or should they be included in a different section or volume?

RESPONSE: Please include in Volume I, Factor 1.

6. Based on Amendment #1 issued 10/3/2018, is the USACE considering the off-site transportation and disposal (T&D) firm to be a required Team Member or is the T&D firm underneath the prime offeror as the Prime typically manages all aspects of the T&D?

Please confirm that the T&D of PHC Waste/contaminated soil can be covered under the prime offeror’s project descriptions showing that they managed this aspect of the project.

RESPONSE: Please see response to Amendment 0006, #2.

7. The bidding Schedule has a 0012 Pavement Restoration under 200 Ferry Blvd. There is just as large an area requiring pavement restoration at the Lot Behind 326 Ferry Blvd.

Can the Bidding Schedule be modified to reflect the Pavement Restoration at this additional location?

RESPONSE: The pavement restoration for the “Lots behind 326 Ferry Blvd” is to be included under the “Site Restoration” Bid Item.

8. During the site walk, garbage, and debris was observed within the limits of clearing at OU4. Is it the contractor’s responsibility to remove this debris? If so, would the government consider adding a unit rate line item for the management and disposal of this debris? It was difficult to quantify the amount of debris because much of OU4 was inaccessible during the site walk.

RESPONSE: For the purpose of executing the work required by the Seed Task Order, it will be the contractor’s responsibility to relocate and consolidate the miscellaneous debris, as needed, within the paved area of OU4. It is anticipated that this relocated/consolidated debris will be removed as part of a future task order.

9. Given that excavation, consolidation, dewatering, subgrade preparation, and erosion and sediment controls are a part of the Seed Task Order, what new elements are anticipated to be introduced in future task orders that might be considered construction activities?

RESPONSE: Please see response to Amendment 0006, #1.

10. Specification section 01 22 00, Measurement and Payment, Paragraph 1.4.v – Optional Item 0022, Contaminated Water Disposal – states that this item is for the management and disposal of contaminated water from dewatering operations. The base bid items do not include any water management and disposal for the decon water for each of the sites.

Please clarify if the Decontamination water generated from each site shall be captured under optional item 0022 or shall it be captured in a separate task. If it is to be captured under each site individually, please clarify in which item it shall be included.

RESPONSE: Water/material from decontamination operations (before the truck leaves the site) should be included in the work for that line item. If additional water is encountered and the site requires dewatering, it would fall under the optional line item.

11. There does not appear to be a line item for Pavement Restoration for the Vacant Lots Behind 326 Ferry Boulevard in the Bid Form. Please advise where the paving line item is to be applied.

RESPONSE: The pavement restoration for the “Lots behind 326 Ferry Blvd” is to be included under the “Site Restoration” Bid Item.

12. Specification Section 01 11 00 Part 1.14.B states... “The Contractor will be billed by the local police departments for the cost of such special officers under the most closely associated bid item in the Bid Form.” Please clarify whether these should be considered extra costs that will be negotiated with the Contractor following award, or whether these costs should be carried in Contractors Seed Task bid for this support service?

RESPONSE: The price for these services should be carried in the contractor’s Seed Task Order proposal.

13. It is our understanding that the Prime’s Binding Rate Table must include all billing rates in our proposal for both the Prime and Subcontractors, including craft labor. Is this correct?

RESPONSE: The binding rate table should only include the positions listed on the provided binding rate table.

14. If craft labor is required in the Binding Rate Table, do we need to include two Binding Rate tables, one for SCA positions, and one for Construction wage (Davis Bacon) rates for future TOs?

RESPONSE: Craft labor is not required for the binding rate table.

15. As noted in Amendment 03 question #9, we are permitted to use 11x17 pages for project descriptions. Is it permitted to use a font size smaller than 12 pt. for the project descriptions?

RESPONSE: No. Only tables and illustrations may use a reduced font size no less than 8-point.

16. Due to the size of the project schedule included in the submitted and in order to meet the page limitations of Volume 1, will the Corps consider removing the schedule from the page limitation?

RESPONSE: No. The requirements remain unchanged.

17. Seed TO PWS 4.2 Seed Task Order Performance Objectives and Standards and Seed Project Specifications 00 41 00 – Seed TO PWS includes Task 1 – General Conditions and Task 4 – Prepare Completion Report; however, the Bid Schedule provided in the specifications does not have line items for these tasks. Please clarify how Tasks 1 and 4 should be priced in the Bid Schedule.

RESPONSE: Task One and Task Four as described in the document titled “Performance Work Statement For Remedial Action Contract Task Order No. 1 (Seed) Raymark Superfund Site Stratford, Connecticut 28 AUGUST 2018” have been added as line items in the Bid Schedule and Section 01 22 00 – Measurement and Payment.

18. Referencing the Seed Project Construction Solicitation and Specifications: In the Bid Schedule and Section 01 22 00 M&P, there is no mention of Work Plans, Project Management, QC, H&S, Temporary Facilities, mobilization/demobilization, etc.

Referencing the PWS for Task Order No. 1, it lists 6 different Tasks and describes the requirements for each Task. It appears that the Seed Project Bid Schedule in the specifications are for Task 2 only?

RESPONSE: Please see response to Amendment 0006, #18.

19. In the Bidding Schedule, line items 0012A and 0012B descriptions are “First 200 Cubic Yards” and “Over 200 Cubic Yards”, respectively. The units are SY (square yards).

Please confirm that the descriptions should note square yards, not cubic yards.

RESPONSE: Yes, the description should specify square yards, not cubic yards. The bidding schedule is updated accordingly.

20. The bidding schedule does not include CLIN items for preconstruction meetings and submittals. Are these tasks included in the Seeding TO, or recognized as a separate task of the overall project? If included in the TO, which CLIN should demonstrate these costs?

21. Item 12A and B of the Bidding Schedule both state cubic yards and the unit rates state square yards. Which is correct?

RESPONSE: Please see response to Amendment 0006, #20.

22. The Bidding Schedule does not have a line item for Plans and Reports preparation. As this is a significant item is the Contractor to divide this cost over the various Site Prep units or can this be added as a separate line item to the Bidding Schedule?

23. The PWS describes several pre-construction submittals (Project Management Plan, Construction Work/Site Plan, etc.). The Bidding Schedule does not have a line item for Work Plans. Under what task(s) should these costs be captured?

24. To allow for accurate pricing of construction line items, will the government revise the bid schedule to include a line item for Task 1 (General Conditions)? If not, would the government consider providing a line item for Task 1.2 (Prepare and Submit Plans)?

25. CLINs 12A and 12B of the bid form for pavement restoration list the first 200 Cubic Yards and over 200 Cubic Yards. The unit on the bid form is listed as Square Yards.

Likewise, the measurement and payment section for this CLIN is in Square Yards.

Please confirm that this item is for First 200 Square Yards and Over 200 Square Yards.

26. The bidding schedule does not include CLIN items for backfill delivery, placement, and compaction. Please identify the CLIN that Offerors should use to price backfilling tasks.

RESPONSE: The fill quantities are defined well enough (four foot depth) to be included in the site restoration and/or other line items for each site, as they are also subdivided for overages.

27. Please clarify the appropriate units for CLIN 0012. The description states Cubic Yards, but the Units indicate SY.

28. Specification 00 41 00: Bidding schedule for Seed Project contains all field elements outlined in the Seed Project PWS, specifications and drawings. However, this bid schedule does not provide for the following tasks from the Seed Project PWS: Task 1.1 – Project Management/Project Controls, Task 1.2 – Prepare & Submit Plans, and Task 4 – Prepare Completion Report. Please update to the bid schedule to include these additional tasks.

29. Specification 00 41 00: Item 12 Pavement Restoration on bidding schedule for Seed Project list units for pavement restoration as both “cubic yards” and “SY”. Which unit is correct for pavement restoration?

30. Spec 31 23 00, Section 1.7.3 states that analytical results will be processed using an automated data review procedure (to the extent feasible). Please define what the ADR procedure is and whether it applies to just the lab or lab and validation data? Specialized software may be needed to run data through ADR.

RESPONSE: Automated Data Review (ADR) is an automated way to check sample hold times, potential blank contamination, and other QC sample results and take validation actions (qualify data) accordingly. The contractor validation team/chemist will understand what Automated Data Review is and recommend specific applications to support it.

31. We understand bonding is not required for the seed project; however, it may be required on future TOs. Should evidence of our bonding be provided? If so, where should we provide it?

RESPONSE: No evidence of bonding is required.

Agreements or letters of commitment submitted for Factor 1 will not be counted toward the page limit.

NOTE: 11X17 folded pages are acceptable for tables/graphic representations; however, each 11X17 page counts as two pages.

B. FACTOR 1: TEAM EXPERIENCE & ORGANIZATIONAL APPROACH

Factor 1 Submission Requirements

The term Team Member, as used throughout this solicitation, refers to the prime Offeror and all joint venture members, subcontractors, and other partners who will be performing the majority of work for any of the following key work functions: contaminated soil excavation; transportation and consolidation of waste material at OU#4; transportation and off-site disposal of PHC Waste/contaminated soil; installation of a low-permeability cap; and soil confirmation sampling and air monitoring.

The term Offeror’s Team consists of the prime Offeror and all other proposed Team Members.

Offerors shall submit a minimum of three (3) and a maximum of five (5) environmental remediation projects that best demonstrate the Offeror’s T e a m experience on recent, relevant projects that are similar in scope, complexity, size, and price to the work required under this solicitation. For all submitted projects, a narrative of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods, etc.).

The prime Offeror (the entity signing the SF33) and Team Members must be identified at least once in the submitted three to five projects required above. The Offeror may utilize experience of another Team Member that will perform major or critical aspects of the requirement to demonstrate experience under this evaluation factor. If an Offeror is utilizing experience of Team Members, then Team Member projects submitted must include recent and relevant work similar to the work to be performed by the Team Member for this requirement.

The maximum number of projects that may be submitted is five (5), regardless of the number of Team Members. If more than five (5) projects are submitted, only the first five (5) projects will be evaluated.

If the Offeror is a Joint Venture (JV), recent and relevant project experience shall be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have experience, such projects shall be submitted for each Joint Venture partner.

As applicable, Offerors should submit a signed copy of their current joint venture agreement, partnership agreement, teaming agreement, approved mentor-protégé agreement, or letter of commitment for each above member of the Offeror's team in order to receive credit for their experience and/or past performance. These documents submitted in Factor 1 will also be considered in the evaluation of Factor 3. Offerors providing firm commitments in the form of the documents listed at the beginning of this paragraph may be more highly rated, due to reduced risk to the Government.

Projects provided must be completed within the past seven (7) years, as of the issue date of this RFP, to be considered recent. A project is defined as work performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather, Offerors should submit the work performed under a task order as a project.

The Offeror shall also submit an organizational chart AND narrative description of the Offeror’s planned organizational structure that clearly defines any teaming arrangements, including overall structure and management of the project team. This should include the Offeror’s overall structure and management of the project team from the Offeror’s Headquarters to the Offeror’s site office(s). If the experience of an entity is being claimed in Team Experience, that entity must be named in the above narrative and organizational chart and will be considered a Team Member.

The chart and narrative should:

Identify all offices involved in this contract;

Identify relationships between the headquarters’ office and site office;

Identify Key Personnel, including resumes;

Describe communication pathways with Key Personnel and USACE personnel during the project period of performance;

Describe Key Personnel relationships.

Describe how the Offeror will ensure quality consistently across the team.

Discuss quality control lines of authority between Key Personnel.

Describe management for performance of the contract including Offeror’s planned approach to: staffing, and obtaining, retaining, coordinating, and managing subcontractors.

Describe, at a minimum, which entity will perform the following roles and responsibilities for key work functions: contaminated soil excavation; transportation and consolidation of waste material at OU#4; transportation and off-site disposal of PHC Waste/contaminated soil;

installation of a low-permeability cap; and soil confirmation sampling and air monitoring. The Offeror should describe the roles and responsibility for each Team Member in detail.

Demonstrate experience in managing off-site transportation and disposal.

Identify any additional and/or unique management advantages their proposal provides to the

Government.

C. FACTOR 2: SEED TASK ORDER TECHNICAL APPROACH

Factor 2 Submission Requirements

The Offeror should submit a narrative proposal to describe their Technical Approach for the work required to be performed in the Seed Task Order as described in the Seed Task Order Performance Work Statement (PWS), as attached to the solicitation. The Seed Task Order will be awarded to the successful offeror as soon as practicable after the award of the IDIQ. The proposal shall demonstrate the Offeror’s ability to successfully complete all required work and achieve the final restoration/cleanup objectives for the project. The proposal narrative shall identify all required work elements, identify significant risks to completion of the tasks, document the approach for completing the work, document the sequencing of the work, and identify measures that will be implemented to mitigate risks. All technical assumptions shall be clearly documented. Resources required to perform each task (such as personnel, Team Members, equipment) shall be identified.

Along with the narrative, the Offeror shall include a project schedule (Gantt chart or bar chart created using MS Project or similar scheduling software) presenting its plan for the completion of the Seed Task Order.

The narrative and schedule should identify and include schedule milestones, critical design and construction work plan submittals, critical material procurements, and representation of Definable Features of Work (DFOW). Government review periods, activity durations, and constraints should be clearly identified. The schedule shall identify the critical path with relationships. For the purpose of this schedule, the Offeror shall assume a Notice to Proceed date of 01 March 2019.

D. FACTOR 3: PAST PERFORMANCE

Factor 3 Submission Requirements

This factor shall contain past performance information for each project submitted by the Offeror in Factor 1 – Team Experience & Organizational Approach, including those completed by Team Members. Offerors shall submit past performance information as follows:

a. For Federal Government projects completed within the last 6 years: provide the contract number, contract place of performance, and DUNS number. In the case of Indefinite Delivery type contracts, GSA contracts, and Blanket Purchase Agreements, include Task or Delivery Order Numbers.

b. For non-Federal Government projects, Government project completed over 6 years ago, and commercial projects: provide a Past Performance Questionnaire (Appendix A). The Offeror shall complete Blocks 1-4 of the PPQ and send it to the non-Federal project client or commercial project client. The client shall complete Blocks 5-8 along with the two page questionnaire and return to the Offeror. The Offeror shall include the PPQ in Volume I of the proposal.

If the Offeror is unable to obtain a completed PPQ from a client for a project before the proposal closing date, the Offeror should complete and submit, with the proposal, the first page of the PPQ, which will provide contract and client information. The Government may make reasonable attempts to contact the client noted for that project to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires.

Alternatively, Offerors may submit a copy of the client’s signed PPQ for a completed contract or task order.

The Offeror may retain PPQs in its files for submission on future procurements. In cases where the validity of the completed PPQ is questioned, contracting personnel may contact the reference for verification or additional information. The standard PPQ for USACE is Form PPQ-0 (9/30/11) provided in the solicitation.

USACE does not intend to create or maintain a database of PPQs submitted by Offerors. Therefore, it will be the Offeror’s responsibility to ensure the submission of PPQs in its proposal that are relevant to the solicitation.

Alternatively, the Offeror may obtain an updated/new PPQ from its client(s) for submission as provided above.

The Government may use data provided by the Offeror in its proposal, and data obtained from other sources, including data in Government files. The Government reserves the right to obtain past performance information from any source available and has the right to contact customers other than those listed by the Offeror to evaluate past performance. The Government reserves the right to verify statements the Offeror makes regarding its past performance to determine whether they are substantiated.

F. FACTOR 4: PRICE

The Offeror shall provide a table of contents and shall number all pages consecutively. Volume II should be submitted in a separate file from Volume I. The price proposal should be broken down into sections as defined below.

Section 1:The name(s) and title(s) of the person(s) authorized to negotiate and sign a contract.

Also, provide a Certificate of Corporate Authority or other applicable documentation of authorized signature(s) for each authorized individual.

Section 2: The Offer (the SF 33) duly executed with an original signature by an official authorized to bind the company.

Section 3: Acknowledgement of all amendments to the solicitation in accordance with the instructions on the Standard Form 30 (amendment form).

Section 4: The completed Section K of the solicitation (i.e., Representations, Certifications, and Other Statements of Offerors). Certification of cost or pricing data in compliance with FAR 52.215-20 will be required for task orders above the Truth In Negotiating Act threshold negotiated under the subsequent contract, but is not required in response to the solicitation. All cost and pricing data supplied by Offerors will represent data other than certified cost or pricing data as defined by FAR 2.101.

Section 5: Binding Rates – The Offeror shall complete the binding rate table provided as an attachment to the solicitation. The Offeror’s binding rates for labor shall be submitted for all five years of the contract from the award date.

The Offeror shall provide binding rates regardless of whether the labor is provided by the Prime or by a Team Member.

Section 6: Seed Task Order Price – The Offeror shall prepare a price proposal to accomplish the tasks in the Seed Task Order and in accordance with their Seed Task Order technical approach in Factor 2. The price proposal will be submitted by completing the Bid Schedule.

The Offeror shall also submit a price breakdown of man-hours, wage rates, indirect rates, travel, material, subcontractors, other direct costs and profit. This price breakdown will be used to ascertain that the binding rates proposed in Section 5 were used to prepare the Offeror’s price proposal. The Seed Task Order price shall be consistent with rates utilized by the offeror in the Binding Rates.

Price reasonableness will be determined in accordance with FAR 15.305(a)(1). Normally, competition establishes price reasonableness. Comparison of the proposed prices is expected to satisfy the requirement to perform a price analysis, however, the Government may, if necessary, analyze the Offeror’s price breakdown to establish reasonableness of an otherwise successful offeror’s price.

Travel Costs – The Offeror shall comply with the Joint Travel Regulations (JTR) for the Seed Task Order and all task orders negotiated subsequent to the IDIQ award.

G. FINAL SELECTION

The Government intends to award without discussions. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a technical and price standpoint. Proposals will be analyzed to determine which is most advantageous to the Government based upon information provided in response to evaluation factors.

The Government reserves the right to conduct discussions if the Source Selection Authority (SSA) later determines them to be necessary. If the SSA determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the SSA may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. If the Government does conduct discussions, these will be in writing.

The Contracting Officer will award a contract to the responsible Offeror whose proposal, as determined by the Source Selection Authority (SSA) conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, all factors considered.

The Government will award a contract resulting from this solicitation to the firm selected in accordance with the above procedures. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.

In the course of evaluating Offerors' proposals, the SST may contact references submitted by the Offerors. The Source Selection Team (SST) may also check past performance information obtained from sources other than those identified by the Offerors. All gathered information will be used to evaluate the Offerors’ overall past performance.

At no time during this process, or during the debriefing, or after award, will the names of individuals providing reference information about an Offeror's past performance be revealed to the Offerors or to any other party.
