SUMMARY OF CHANGES

SECTION C - DESCRIPTIONS AND SPECIFICATIONS

The following have been added by full text:

RFI AMEND 0003

1. Section L, D. FACTOR 3: PAST PERFORMANCE, reads as only State government and/or commercial projects require PPQs, i.e. Federal government projects do not require a PPQ. Please confirm that PPQs are not required for Federal government projects?

RESPONSE: Please see the added clarification in Section L, Factor 3 Submission Requirements.

2. Section L, D. FACTOR 3: PAST PERFORMANCE, – States that “The Offeror shall include the sealed envelope in Volume I of the proposal. Only one copy of the sealed PPQ is required, rather than a sealed PPQ for each copy of the proposal.” This is an electronic submittal. Must PPQs be U.S. Post Office mailed? If so, to whom and how are they to be labeled?

RESPONSE: Original PPQs are not required. Please see adjusted language in Section L, Factor 3 Submission Requirements.

3. Reference to clause 52.228-1, is a bid bond required?

RESPONSE: A bid bond is not required with the submission of proposals. Please also see the answer to Amendment 0001, Question 3.

4. Reference to clause 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013), states in (d) “The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.” Should this be updated to 750 employees?

RESPONSE: No. That information is accurate. Please refer to paragraph (c) of the clause which refers you to size standards based on NAICS codes. The size standard for this procurement is 750 employees.

5. Regarding experience project descriptions, we respectfully request that an IDIQ project with multiple task orders be evaluated as one project due to fact a single TO can focus on a narrower scope of work than the entire contract may include and given we are limited to no more than five projects, it is difficult to convey the full scope of work accomplished.

RESPONSE: The requirements remain unchanged.

6. Reference Section L, A. General Submission Requirements, states that all pages including cover letters, table of contents, blank pages, dividers, etc. count in the page calculation. Since the space that many of these items utilize is not readily determined until proposal content is complete and thus difficult to plan for initially, would USACE consider eliminating proposal cover, cover letter, table of contents/list of tables and graphics, divider/tab pages, and acronym list from the page count limitations?

RESPONSE: The requirements remain unchanged. Offerors are advised that cover letters, divider pages, etc. are not necessarily required.

7. Section L, Factor 1: Experience states: "A project is defined as work performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project;

rather, Offerors should submit the work performed under a task order as a project.” For ID/IQ contracts with multiple task orders under one contract all located on one project site, may the offeror use all the related task orders for the one site as a single project?

RESPONSE: The requirements remain unchanged.

8. What portions of the work are considered construction and require performance and payment bonds? (52.228-15 Reference in IDIQ information)

RESPONSE: There are no portions of the seed task order which are considered to be construction. However, future task orders may include construction line items, which would require performance and payment bonds.

9. Reference Section L, A. General Submission Requirements and B. Factor 1, is it acceptable to present a project experience description on an 11x17 with the understanding that each 11x17 counts as two pages (we note current language may limit such usage to tables and graphics, but it is also suitable for project presentation)?

RESPONSE: 11x17 pages may be used for project experience descriptions. However, they will be counted as two pages and must still meet the margin and font limitations.

10. Requirement for Factor 3 Past Performance say “This volume shall contain past performance information…” Earlier in the RFP it was indicated Factors 1, 2, and 3 would all be included in Volume I. please confirm that Factor 3 will be included Volume I, and not a separate volume.

RESPONSE: Yes, Past Performance information shall be included in Volume I. Please see adjusted language in Section L, Factor 3 Submission Requirements.

11. Requirements for Factor 3: Past Performance include submission of PPQs in sealed envelopes. RFP delivery instructions indicate that AMRDEC is the only authorized transmission method for proposals. Please confirm that PPQs should be included n our electronic submittal and that no hard copy submittal required.

RESPONSE: Please see response to Amendment 0003, RFI #2.

12. Under Factor 3, Submission Requirements, the RFP states: “For non-Federal Government projects and commercial projects […] the client shall include a sealed envelope in Volume 1 of the proposal.” However, offerors are required to upload only PDFs of final proposals. Please confirm that offerors can submit scanned PPQs with digitally uploaded proposal files.

RESPONSE: Please see response to Amendment 0003, RFI #2.

13. Per the requirements for Factor 3 Past Performance, the PPQs for non-federal government clients are to be provided in a sealed envelope. Per Section L, paragraph A, General Submission Requirements, no other transmission methods (email, facsimile, regular mail, hand carried, etc.) other than AMRDEC will be accepted. Please clarify and confirm that completed PPQs may be provided as part of the electronic file of Volume I submitted through AMRDEC rather than a sealed envelope.

RESPONSE: Please see response to Amendment 0003, RFI #2.

14. In which Section of Volume II should the bid bond be included? Also, please confirm that per the General Submission Requirements, that only an electronic copy of the bid bond is required, and a hard copy is not required to be provided.

RESPONSE: There is no bid bond requirement for the seed task order.

15. Please provide the bid schedule for the seed task, as referenced in the RFP “Factor 2. The price proposal will be submitted by completing the Bid Schedule.”

RESPONSE: The bid schedule is included on FBO.gov beginning on page 4 of the Seed Task Order Specification PDF document.

16. Volume II, Section 2 states that a duly executed SF1442 is to be submitted. Should this be a SF33?

RESPONSE: Yes. Please see adjusted language in Section L, Factor 4.

17. Please confirm that the bid guarantee required is for 20% of the seed project price.

18. Do you want a hard copy of the Bid Bond with original signatures and seal? If so, please provide due date and mailing instructions.

19. Reference Section 4 of Price Proposal requirements, requiring completion of reps and certs document. Typically, a copy of offeror’s SAM record is an option vs. completing a separate reps and certs document. Is submittal of a copy of our SAM record acceptable to fulfill the reps and certs requirement for this solicitation?

RESPONSE: Yes.

Do not assume that electronic communication is instantaneous. It can take several minutes or even hours in some cases.

The government will not be responsible for proposals delivered to any location or to anyone other than those designated to receive proposals on its behalf. Offerors are responsible for ensuring that proposals are submitted so as to reach the designated recipient of proposals.

Offerors are responsible for allowing sufficient time for the proposal to be received in accordance with the instructions provided.

GENERAL REQUIREMENTS:

Offerors are cautioned that “parroting” of the requirements of the Performance Work Statement with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform.

Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of their proposal. Proprietary information shall be clearly marked.

Pages that are revised (due to discussions or proposal revisions) shall be a different color and have revised information clearly marked by a vertical line in the right margin of the page. The revised pages shall be dated.

Agreements or letters of commitment submitted for Factor 1 will not be counted toward the page limit.

NOTE: 11X17 folded pages are acceptable for tables/graphic representations; however, each 11X17 page counts as two pages.

B. FACTOR 1: TEAM EXPERIENCE & ORGANIZATIONAL APPROACH

Factor 1 Submission Requirements

The term Team Member, as used throughout this solicitation, refers to the prime Offeror and all joint venture members, subcontractors, and other partners who will be performing the majority of work for any of the following key work functions: contaminated soil excavation; transportation and consolidation of waste material at OU#4; transportation and off-site disposal of PHC Waste/contaminated soil; installation of a low-permeability cap; and soil confirmation sampling and air monitoring.

The term Offeror’s Team consists of the prime Offeror and all other proposed Team Members.

Offerors shall submit a minimum of three (3) and a maximum of five (5) environmental remediation projects that best demonstrate the Offeror’s T e a m experience on recent, relevant projects that are similar in scope, complexity, size, and price to the work required under this solicitation. For all submitted projects, a narrative of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods, etc.).

The prime Offeror (the entity signing the SF33) and Team Members must be identified at least once in the submitted three to five projects required above. The Offeror may utilize experience of another Team Member that will perform major or critical aspects of the requirement to demonstrate experience under this evaluation factor. If an Offeror is utilizing experience of Team Members, then Team Member projects submitted must include recent and relevant work similar to the work to be performed by the Team Member for this requirement.

The maximum number of projects that may be submitted is five (5), regardless of the number of Team Members. If more than five (5) projects are submitted, only the first five (5) projects will be evaluated.

If the Offeror is a Joint Venture (JV), recent and relevant project experience shall be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have experience, such projects shall be submitted for each Joint Venture partner.

As applicable, Offerors should submit a signed copy of their current joint venture agreement, partnership agreement, teaming agreement, approved mentor-protégé agreement, or letter of commitment for each above member of the Offeror's team in order to receive credit for their experience and/or past performance. These documents submitted in Factor 1 will also be considered in the evaluation of Factor 3. Offerors providing firm commitments in the form of the documents listed at the beginning of this paragraph may be more highly rated, due to reduced risk to the Government.

Projects provided must be completed within the past seven (7) years, as of the issue date of this RFP, to be considered recent. A project is defined as work performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather, Offerors should submit the work performed under a task order as a project.

The Offeror shall also submit an organizational chart AND narrative description of the Offeror’s planned organizational structure that clearly defines any teaming arrangements, including overall structure and management of the project team. This should include the Offeror’s overall structure and management of the project team from the Offeror’s Headquarters to the Offeror’s site office(s). If the experience of an entity is being claimed in Team Experience, that entity must be named in the above narrative and organizational chart and will be considered a Team Member.

The chart and narrative should:

Identify all offices involved in this contract;

Identify relationships between the headquarters’ office and site office;

Identify Key Personnel, including resumes;

Describe communication pathways with Key Personnel and USACE personnel during the project period of performance;

Describe Key Personnel relationships.

Describe how the Offeror will ensure quality consistently across the team.

Discuss quality control lines of authority between Key Personnel.

Describe management for performance of the contract including Offeror’s planned approach to: staffing, and obtaining, retaining, coordinating, and managing subcontractors.

Describe, at a minimum, which entity will perform the following roles and responsibilities for key work functions: contaminated soil excavation; transportation and consolidation of waste material at OU#4; transportation and off-site disposal of PHC Waste/contaminated soil;

installation of a low-permeability cap; and soil confirmation sampling and air monitoring. The Offeror should describe the roles and responsibility for each Team Member in detail.

Identify any additional and/or unique management advantages their proposal provides to the Government.

C. FACTOR 2: SEED TASK ORDER TECHNICAL APPROACH

Factor 2 Submission Requirements

The Offeror should submit a narrative proposal to describe their Technical Approach for the work required to be performed in the Seed Task Order as described in the Seed Task Order Performance Work Statement (PWS), as attached to the solicitation. The Seed Task Order will be awarded to the successful offeror as soon as practicable after the award of the IDIQ. The proposal shall demonstrate the Offeror’s ability to successfully complete all required work and achieve the final restoration/cleanup objectives for the project. The proposal narrative shall identify all required work elements, identify significant risks to completion of the tasks, document the approach for completing the work, document the sequencing of the work, and identify measures that will be implemented to mitigate risks. All technical assumptions shall be clearly documented. Resources required to perform each task (such as personnel, Team Members, equipment) shall be identified.

Along with the narrative, the Offeror shall include a project schedule (Gantt chart or bar chart created using MS Project or similar scheduling software) presenting its plan for the completion of the Seed Task Order.

The narrative and schedule should identify and include schedule milestones, critical design and construction work plan submittals, critical material procurements, and representation of Definable Features of Work (DFOW). Government review periods, activity durations, and constraints should be clearly identified. The schedule shall identify the critical path with relationships. For the purpose of this schedule, the Offeror shall assume a Notice to Proceed date of 01 March 2019.

D. FACTOR 3: PAST PERFORMANCE

Factor 3 Submission Requirements

This volume factor shall contain past performance information for each project submitted by the Offeror in Factor 1 – Team Experience & Organizational Approach, including those completed by Team Members.

Offerors shall submit past performance information as follows:

a. For Federal Government projects completed within the last 6 years: provide the contract number, contract place of performance, and DUNS number. In the case of Indefinite Delivery type contracts, GSA contracts, and Blanket Purchase Agreements, include Task or Delivery Order Numbers.

b. For non-Federal Government projects, Government project completed over 6 years ago, and commercial projects: provide a Past Performance Questionnaire (Appendix A). The Offeror shall complete Blocks 1-4 of the PPQ and send it to the non-Federal project client or commercial project client. The client shall complete Blocks 5-8 along with the two page questionnaire and return to the Offeror in a sealed envelope. The Offeror shall include the sealed envelope PPQ in Volume I of the proposal. Only one copy of the sealed PPQ is required, rather than a sealed PPQ for each copy of the proposal.

If the Offeror is unable to obtain a completed PPQ from a client for a project before the proposal closing date, the Offeror should complete and submit, with the proposal, the first page of the PPQ, which will provide contract and client information. The Government may make reasonable attempts to contact the client noted for that project to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires.

Alternatively, Offerors may submit a copy of the client’s signed PPQ for a completed contract or task order.

The Offeror may retain PPQs in its files for submission on future procurements. In cases where the validity of the completed PPQ is questioned, contracting personnel may contact the reference for verification or additional information. The standard PPQ for USACE is Form PPQ-0 (9/30/11) provided in the solicitation.

USACE does not intend to create or maintain a database of PPQs submitted by Offerors. Therefore, it will be the Offeror’s responsibility to ensure the submission of PPQs in its proposal that are relevant to the solicitation.

Alternatively, the Offeror may obtain an updated/new PPQ from its client(s) for submission as provided above.

The Government may use data provided by the Offeror in its proposal, and data obtained from other sources, including data in Government files. The Government reserves the right to obtain past performance information from any source available and has the right to contact customers other than those listed by the Offeror to evaluate past performance. The Government reserves the right to verify statements the Offeror makes regarding its past performance to determine whether they are substantiated.

F. FACTOR 4: PRICE

The Offeror shall provide a table of contents and shall number all pages consecutively. Volume II should be submitted in a separate file from Volume I. The price proposal should be broken down into sections as defined below.

Section 1:The name(s) and title(s) of the person(s) authorized to negotiate and sign a contract.

Also, provide a Certificate of Corporate Authority or other applicable documentation of authorized signature(s) for each authorized individual.

Section 2: The Offer (the SF1442 33) duly executed with an original signature by an official authorized to bind the company.

Section 3: Acknowledgement of all amendments to the solicitation in accordance with the instructions on the Standard Form 30 (amendment form).

Section 4: The completed Section K of the solicitation (i.e., Representations, Certifications, and Other Statements of Offerors). Certification of cost or pricing data in compliance with FAR 52.215-20 will be required for task orders above the Truth In Negotiating Act threshold negotiated under the subsequent contract, but is not required in response to the solicitation. All cost and pricing data supplied by Offerors will represent data other than certified cost or pricing data as defined by FAR 2.101.

Section 5: Binding Rates – The Offeror shall complete the binding rate table provided as an attachment to the solicitation. The Offeror’s binding rates for labor shall be submitted for all five years of the contract from the award date.

The Offeror shall provide binding rates regardless of whether the labor is provided by the Prime or by a Team Member.

Section 6: Seed Task Order Price – The Offeror shall prepare a price proposal to accomplish the tasks in the Seed Task Order and in accordance with their Seed Task Order technical approach in Factor 2. The price proposal will be submitted by completing the Bid Schedule.

The Offeror shall also submit a price breakdown of man-hours, wage rates, indirect rates, travel, material, subcontractors, other direct costs and profit. This price breakdown will be used to ascertain that the binding rates proposed in Section 5 were used to prepare the Offeror’s price proposal. The Seed Task Order price shall be consistent with rates utilized by the offeror in the Binding Rates.

Price reasonableness will be determined in accordance with FAR 15.305(a)(1). Normally, competition establishes price reasonableness. Comparison of the proposed prices is expected to satisfy the requirement to perform a price analysis, however, the Government may, if necessary, analyze the Offeror’s price breakdown to establish reasonableness of an otherwise successful offeror’s price.

Travel Costs – The Offeror shall comply with the Joint Travel Regulations (JTR) for the Seed Task Order and all task orders negotiated subsequent to the IDIQ award.

G. FINAL SELECTION

The Government intends to award without discussions. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a technical and price standpoint. Proposals will be analyzed to determine which is most advantageous to the Government based upon information provided in response to evaluation factors.

The Government reserves the right to conduct discussions if the Source Selection Authority (SSA) later determines them to be necessary. If the SSA determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the SSA may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. If the Government does conduct discussions, these will be in writing.

The Contracting Officer will award a contract to the responsible Offeror whose proposal, as determined by the Source Selection Authority (SSA) conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, all factors considered.

The Government will award a contract resulting from this solicitation to the firm selected in accordance with the above procedures. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.

In the course of evaluating Offerors' proposals, the SST may contact references submitted by the Offerors. The Source Selection Team (SST) may also check past performance information obtained from sources other than those identified by the Offerors. All gathered information will be used to evaluate the Offerors’ overall past performance.

At no time during this process, or during the debriefing, or after award, will the names of individuals providing reference information about an Offeror's past performance be revealed to the Offerors or to any other party.
