About this file

This document provides details on a federal contract opportunity for the construction of a new VA medical center campus in Louisville, KY. The U.S. Army Corps of Engineers Louisville District intends to issue a Request for Proposal for construction services over $500 million to replace aging facilities at the Robley Rex VAMC. The project will relocate operations to a new 34-acre site and construct a 104-bed hospital, parking structure for 2,600 cars, campus infrastructure, central utility plant, laundry facility, roadways, and landscaping. The contract duration is 1,554 calendar days with a target ceiling of approximately $705 million. The solicitation is anticipated for release on December 3, 2020 and will utilize a best value tradeoff selection process evaluating past performance, management, key subcontractors, schedule, small business participation, and price. Award is intended without discussions but the right to conduct discussions is reserved if in the government's best interest.

1.4 SOLICITATION BACKGROUND, STRUCTURE, AND RESOLUTION OF INCONSISTENCIES

1.4.1 Background

1.4.1.1 This project, the Louisville VA Medical Center, was designed to be constructed in two phases utilizing two separate construction contracts.

“Phase A” was to start with the existing conditions and perform the initial site work such as the majority of the mass grading, installation of main site utilities, and construction of the South Parking Garage. “Phase B” was to perform all of the other work necessary for a complete and usable facility, and was intended to begin after Phase A was substantially complete. Following this procurement strategy with two separate solicitations (Phase A and Phase B), two separate sets of plans and specifications were developed. Each solicitation had numerous references to the other so as to avoid confusion about which construction contract was

00 80 00.00 06 – 6

AMENDMENT 0007

required to complete each feature of work, and to ensure a coordinated effort between the two contracts.

The Government no longer intends to use this two-solicitation strategy to construct this facility.

1.4.1.2 The current procurement strategy is for this facility to be constructed under a single construction contract. This solicitation is for the entire project, to include both Phase A and Phase B. The successful contractor for this solicitation will be responsible for both the Phase A and Phase B scopes of work, resulting in completion of the entire Louisville VA Medical Center campus including, but not limited to, all site work, buildings, and associated structures.

1.4.1.3 Up to and including the Division 01 specifications, the two versions

(Phase A and Phase B) of each document have been merged into a single, coordinated version that applies to all work performed under this contract.

However, the plans (drawings) and all specifications beyond Division 01 remain unmerged, and both versions (Phase A and Phase B) of these documents are included in this solicitation. This paragraph describes the methods that were used to combine the Phase A and Phase B design documents and describes the process that will be used to resolve any potential inconsistencies and/or conflicts resulting from this combining process.

1.4.2 Structure

1.4.2.1 The following documents and sets of documents appear only once in this solicitation, and apply to all work described within this solicitation regardless of whether (or if) such work is described as part of Phase A and/or Phase B:

1.4.2.1.1 Standard Form 1442 Solicitation, Offer, and Award

1.4.2.1.2 Specifications Division 00 PROCUREMENT AND CONTRACTING

REQUIREMENTS – included within the Table of Contents for and packaged with the Phase B Specifications

1.4.2.1.3 Specifications Division 01 GENERAL REQUIREMENTS (sometimes referenced as ‘Section 01 00 00 GENERAL REQUIREMENTS’) – included within the Table of Contents for and packaged with the Phase B Specifications

1.4.2.1.4 Submittal Register and Delegated Design List (attachment to Section 00 80 00.00 06 SPECIAL PROVISIONS) entries associated with Specification Divisions 00 through 01 – included within the Submittal Register and Delegated Design List for Phase B

1.4.2.1.5 Plans, with the exceptions noted below

1.4.2.2 The following documents and sets of documents appear twice, either in whole or in part, within this solicitation. They appear once in relation to the former Phase A scope of work, and once in relation to the former Phase B scope of work:

1.4.2.2.1 Submittal Register and Delegated Design List (attachment to

Section 00 80 00.00 06 SPECIAL PROVISIONS) entries associated with Specification Divisions 02 through 48 (technical sections)

00 80 00.00 06 – 7

AMENDMENT 0007

1.4.3 Resolution of Inconsistencies and/or Conflicts

1.4.3.1 The Contractor is required to provide a completed facility that corresponds to the facility that would have been completed had the Contractor constructed the Phase A portion of work followed by the Phase B portion of work.

1.4.3.2 The former Phase A and Phase B solicitations both contained language stating that certain features of work were “Not in Contract” (or similar language to that effect) because those features were included as part of another contract (i.e., part of the other phase). That language still exists in the unmerged portions of this solicitation (the plans and Div.

02-48 specifications). Notwithstanding any such language, the Contractor is required to perform any and all work described anywhere in this solicitation as being required of either phases, even if language in another part of this solicitation excludes that work, except as allowed here:

Exception: The Contractor is not required to complete, or if applicable reverse, work required by the former Phase A solicitation that has the sole function of facilitating a transition to the Phase B contractor. Instead, the Contractor may sequence the work in such a way as to avoid the necessity to install and reverse these temporary measures, providing all other requirements of the contract are satisfied.

Example A: The Contractor is not required to install the site distribution water line caps as shown on Phase A drawings CU100-CU106 and then remove those same caps in order to extend those water lines as shown on Phase B drawings CU100b through CU104b, provided the Contractor sequences the water line installation such that caps are not required.

Example B: The contractor is not required to first grade the site according to Phase A Drawing CG100, then re-grade the site according to Phase B Drawing CG110b. The contractor may elect to sequence site grading in whatever manner is most efficient as long as all other requirements of this contract are met.

Example C: The Contractor is not prohibited from utilizing blasting for Phase B features of work so long as all other requirements of the contract are met and the sequencing of the blasting does not damage in place features of work (e.g., drilled piers from either Phase).

1.5 NOT USED

This monthly deduction will continue until an agreement can be reached between the Contracting Officer and the Contractor regarding the accuracy and completeness of working as-built documents. This includes conversion of submittals and other miscellaneous documents (e.g., shop drawings, product data, cut sheets, RFI responses, extensions of design, etc.).

1.7.2.2 Record As-Builts Drawings Prepared by Others

The Government intends to have the digital record as-built drawings and Record BIM Model completed by others.

However, the Contractor is required to provide the Contracting Officer's Representative completed working as-built drawings and other electronic files such as extension of design submittals and the Construction BIM Model.

Delays in providing the final working as-built drawings and other materials shall be subject to withholding per paragraph "Failure to Maintain" if not provided in a timely manner.

1.7.3 Maintenance of Working As-Built Drawings

The Contractor shall revise digital PDF drawings by a red-line process to show the as-built conditions during the prosecution of the project. These as-built marked drawings shall be kept current on a weekly basis and available at all times. To assist with the sharing of information during construction, the Contractor shall establish a protocol for digital data access and exchange, to include working as-builts. The system shall address interoperability, model divisions, and user access requirements for both the Government and DOR. The use of a system for this requirement does not negate, override, or supercede the overall requirement for the use of the Resident Management System (RMS) (SECTION 01 45 00.15 10 RESIDENT MANAGEMENT SYSTEM CONTRACTOR MODE (RMS CM)) for the monitoring and administration of this contract.

Changes in the work from the contract or additional information which is uncovered in the course of construction shall be accurately and neatly recorded as they occur by means of details and notes. The actual changes must be reflected on all sheets that the change affects. In addition, the changes shall be electronically hyperlinked, as appropriate, to any associated documentation (e.g., submittal, responses to Requests for Information (RFIs), fabrication information, revision addenda, construction contract modifications, extensions of design, design addenda, construction change directives (CCDs), and substitution requests provided by the Contractor).
