(d) Alternate offers. (1) When an offer includes foreign construction material, other than designated country construction material, that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material. EVALUATION CRITERIA
SECTION 00 22 12 - PROCEDURES FOR SUBMITTAL OF OFFERS AND PROPOSAL EVALUATION
CRITERIA
1. Overview.
1.1 The intent of this solicitation is to select one contractor for the New Veterans Affairs Medical Center, in Louisville, Kentucky. The Government will evaluate the proposals in accordance with the criteria described herein, and award a firm fixed price contract to the responsible offeror, whose proposal conforms with all the terms and conditions of the solicitation and whose proposal is determined to represent the overall best value to the Government.
1.2 The basis of award is the Tradeoff Process. The Contracting Officer will award a firm fixed price contract to the responsible offeror whom the Source Selection Authority (SSA) determines conforms to the solicitation, is fair and reasonable in price, and offers the best overall value to the Government. The Government reserves the right to award to other than the lowest priced offeror or to other than the highest technically rated offeror, or to reject all offers.
2. Submittal of offers.
2.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein.
The proposals must include information sufficiently detailed to clearly describe the offeror's past performance, technical approach, and management capabilities necessary for successful completion of the project. Requirements stated in this Request for Proposal (RFP) are minimums. Innovative, creative or cost-saving proposals that meet or exceed the requirements are encouraged and will be rated accordingly.
2.2 Offerors shall submit their proposals to the US Army Corps of Engineers, 600 Dr. Martin Luther King, Jr.
Place, Room 821, Louisville, KY 40202-2267 no later than the time and date specified in Block 13 of Standard Form 1442. NOTE: The Louisville District is in the Eastern Time Zone.
2.3 Offerors are required to submit a proposal made up of Past Performance, Management, Key Subcontractor Experience, Schedule, Small Business Participation Plan, and Price and Pro Forma. All proposal materials shall be submitted in binders with a table of contents and tabbed section dividers. The sections should parallel the submission requirements identified below. Volume I shall be submitted in original and 7 (seven) paper copies and one electronic copy on CD/DVD*. Volume II shall be submitted in original and 1 CD/DVD* only and shall be placed in a separate envelope. Failure to place the required submission information under the appropriate tab (factor or subfactor) may result in a lower rating if the evaluators cannot readily find the appropriate information.
*NOTE: Provide the complete Volume I proposal submittal including text, renderings, drawings, photographs, etc on CD/DVD (one copy). Provide the complete Volume II proposal submittal on a separate CD/DVD (one copy), including the final price breakout schedule if the final price breakout schedule(s) are available electronically. The paper copy of the proposal shall be used for evaluation and will control any conflicts or discrepancies between the two media. Offeror is responsible for ensuring the paper copy is consistent with the electronic copy of the proposal.
There is a total limit of 200 pages for Volume I (excluding dividers; double sided pages count as two pages) using a minimum font size of 11 and a minimum margin size of one-half inch on all sides. Page size must be 8.5” x 11” for all pages unless otherwise stated/allowed. Please see the submission requirements below for additional page limitations for individual evaluation factors. Format restrictions will be strictly adhered to and enforced.
Information submitted which exceeds the specified total limit or individual limits will not be evaluated.
2.4 The target ceiling for contract award is $705,000,000, exclusive of the Government Field Office, based on funds currently made available for this project. The Government cannot guarantee that additional funds will become available for award. Offerors are under no obligation to approach this ceiling.
3. Proposal Evaluation Process.
3.1 A Source Selection Evaluation Board (SSEB) comprised of representatives of the U.S. Army Corps of Engineers (USACE), User/Customer, and other required personnel will evaluate the proposals. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence. The number and identities of offerors are not revealed to anyone who is not involved in the evaluation and award process or to other offerors.
Proposals will be evaluated based on the factors described herein, and the basis of award is the Tradeoff Process.
3.2 The evaluation process essentially consists of five parts: proposal compliance review, technical evaluation, Source Selection Advisory Council review, price evaluation, and price/technical trade-off analysis.
3.2.1 Proposal Compliance Review: This is an initial review to ensure that all required forms and certifications are complete and that both a technical and price proposal were received.
3.2.2 Technical Evaluation: The SSEB will evaluate and rate the technical proposals (i.e., Volume I) against the RFP requirements. Factor I – Past Performance will be rated using Tables 1 and 2 below. The rating will be based on overall confidence in performance, with the final confidence assessment rating based on the extent of recent, relevant past experience, and how well the offeror performed on that experience. Factors II-IV (Management, Key Subcontractor Experience, Schedule), including all subfactors, will be rated using Table 3 below. Factor V – Small Business Participation Plan will be rated using Table 4 below.
3.2.3 Source Selection Advisory Council (SSAC) Review: The SSAC will review the evaluation results of the SSEB to ensure the evaluation process follows the evaluation criteria, and the ratings are appropriately and consistently applied. The SSAC will consolidate their advice and recommendations into a written comparative analysis and recommendation for use by the SSA in selecting the offeror who represents the best value to the Government.
3.2.4 Price Evaluation: The SSEB, SSAC and SSA will evaluate price proposals independent of the technical evaluation. The SSEB will not have access to price information until completion of the technical evaluation of the original proposals.
3.2.5 Price/Technical Trade-off Analysis: After all above evaluations are complete, the SSA will compare the relative advantages and disadvantages of technical proposals and compare prices. The SSA will then consider all factors to select the proposal offering the best value to the Government.
4. Proposal Information and Related Evaluation Factors.
4.1 Proposals will be evaluated in accordance with the factors and subfactors below, listed in relative order of importance. NOTE: To be eligible for award, Factor I, Past Performance, must be rated at least Satisfactory Confidence, and Factors II through V, including subfactors, must be rated at least “Acceptable.” All non-priced factors, when combined, are approximately equal to price. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in Federal Acquisition Regulation (FAR) 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
