This project is being solicited using the tw o-phase design-build selection procedures authorized by FAR 36.3. The project is being solicited UNRESTRICTED. The North American Industry Classification System (NAICS) Code is 236220 and the Small Business Size Standard is $36,500,000.00 in average annual receipts for the past three years. FAR 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns is applicable to this project. A Small Business Subcontracting Plan w ill be required from Large Business concerns selected to submit proposals in Phase Tw o, and the plan must be submitted w ith their Phase Tw o proposals. 2. NOTES

2.1. Instructions for the preparation of proposals are located in Sections 00100, 00110 and 00120.

2.2. This procurement is being solicited using the Two Phase solicitation process authorized by FAR 36.3. This process requires potential contractors to submit their past performance, basic technical approach and capability information initially for review and consideration by the Government. Following the review, evaluation, and rating of these proposals, the Government intends to select three, but no less than two and not to exceed five, of the highest rated contractors to receive the Project Requirements Manual and to participate in the Phase Two solicitation. All offerors will be notified of their selection or non-selection to Phase Two. The names of the offerors selected to participate in Phase Two will be published in the Federal Business Opportunities website, https://www.fbo.gov.

2.3. Offeror’s attention is invited to the insurance requirement contained in this solicitation (FAR Clause 52.228-5 Insurance – Work on a Government Installation). Certification of the required coverage for the prime contractor shall be furnished prior to beginning work on this contract, and the Contracting Officer may request evidence of the required insurance at any time during the life the contract.

2.4. Reference DFARS Provision 252.236-7008, CONTRACT PRICES – BIDDING SCHEDULES (DEC 1991). The term “Bidding Schedule” shall also be construed to mean “Offer Schedule” or “Schedule”. The terms “bid” and “offer”, and “bidder” and “offeror” shall be construed as having the same meaning in this solicitation and resulting contract.

2.5. For all those contractors who compete in both Phase One and Phase Two, the contractor’s proposal shall be defined as all information that was submitted in response to the requirements of both phases of the solicitation.

Section 00100 - Bidding Schedule/Instructions to Bidders

SECTION 00100

SECTION 00100 - INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS

1. SCOPE

1.1. You are invited to submit a proposal in response to our design-build Request for Proposal (RFP) W912LP- 17-R-0002 for Project Number VSSB099014, Title: Consolidated Support Functions (CSF) at the 185th Air Refueling Wing (185ARW), Iowa Air National Guard Base, Sioux City, Iowa. As a result of this Solicitation, the Government intends to award a single Firm Fixed Price (FFP) contract to the responsible offeror whose proposal represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.

1.2. This solicitation is Unrestricted. The HUBZone preference of 10% is applicable to the solicitation in accordance with FAR 52.219-4.

1.3. This solicitation is for the design, permitting, site preparation, construction and commissioning of the facility in accordance with the Project Requirements Manual (PRM). Scope of the project includes the design and construction of a one- or two-story facility consisting of administrative offices, medical clinic spaces, dining room, training, classroom, kitchen, toilet and shower, storage, locker, and support spaces to be constructed on approximately 5.3 acres at the 185th Air Refueling Wing, Iowa Air National Guard Base, located at Sioux Gateway Airport/Col Bud Day Field, Iowa. The approximate size of the building is not to exceed 37,060 SF. Site work will include, but is not limited to, site preparation and improvement, utilities, roadways, parking, sidewalks, storm drainage, security lighting, landscaping and demolition.

1.4. Design and construction shall comply with the Project Requirements Manual (PRM) contained in the Phase Two RFP. The contract award for design and construction should not exceed $11,040,000.00. Sections 00110 and 00120 provide details on price/cost proposal requirements and evaluation.

1.5. Two-Phase Design-Build Solicitation Process

1.5.1. This procurement is being solicited using the Two-Phase solicitation process authorized by FAR 36.3. As part of Phase One, potential contractors shall submit their past/present performance and technical capability information for review and consideration by the Government. Following the review, evaluation, and rating of Phase One proposals the Government intends to select three (3); but not less than two (2) and not to exceed five (5), of the highest rated contractors to receive a Phase Two RFP. Phase Two offerors shall provide a technical proposal (Management & Execution Plan and Technical Data) and cost/price proposal for consideration by the Government.

The Government will review the technical and cost/price proposals of the Phase Two offerors in accordance with FAR Part 15 and the evaluation criteria set out in Section 00120 – PROPOSAL EVALUATION AND BASIS FOR AWARD. The final evaluation will consider the past/present performance from Phase One, and the technical and cost/price proposals from Phase Two. Price information, provided during Phase Two, will not be rated but will be evaluated in response to the funding limitations set out in this section and Section 00120 cost/price evaluation.

1.5.2. Firms formally organized as design/build entities, or by design firms and construction contractors that have associated specifically for this project, may submit proposals. For the purpose of this solicitation, no distinction is made between formally organized design/build entities and project-specific design/build associations. Both are referred to as the Design-Builder or the Design/Build offeror, (or simply "offeror"). All designs must be accomplished under the direct supervision of licensed professionals registered in the appropriate technical disciplines, and meeting other certification and licensing requirements specified in the request for proposal.

1.5.3. All Phase One offerors will be notified of their selection or non-selection to Phase Two. The names of the offerors selected to participate in Phase Two will be published on the Federal Business Opportunities at https://www.fbo.gov.

1.6. The Project Requirements Manual (PRM) has been developed based on the specific criteria as defined by, and in accordance with, Air National Guard Engineering Technical Letter (ANGETL) 15-01, ANG Design Policy dated 01 May 2015, and associated ETL’s. The design is developed to approximately 5%. The Project Requirements Manual (PRM) will include general project description, relationship diagrams, data on existing site conditions (existing utility plan, geotechnical exploration report, topographical survey, etc.), programming documents, and other performance requirements. These documents will be made available to the selected offerors as part of the Phase Two RFP.

2. NOTICE OF PRE-PROPOSAL CONFERENCE

2.1. A Phase One pre-proposal conference will be conducted on 6 April 2017 at 10:30 AM at the 185ARW, Iowa Air National Guard Base, Bldg. 220, 2920 Headquarters Avenue, Sioux City, Iowa, for the purpose of briefing on the Phase One proposal requirements and answering questions regarding this solicitation. Interested Contractors are encouraged to attend the scheduled pre-proposal conference and are strongly encouraged to bring members of their intended design and construction team to this conference.

2.2. The Government may elect to conduct a Phase Two pre-proposal conference for those offerors selected to participate in the Phase Two process. Offerors will be notified of date and time. Offerors selected to participate in Phase Two will be afforded the opportunity to investigate the project site with their team members at dates/times arranged by the contracting officer.

2.3. To enter the military installation, individuals must have a picture identification card available when entering the front gate. Due to security conditions, all offerors must register to attend this conference and site visit.

2.4. This information must be provided in advance, not later than three (3) business days prior to the meeting, in order to ensure access to the military base and conference site and ensure adequate seating for the conference attendees. Even if you have access to the base, you must register to ensure adequate seating. The furnishing of the above information is voluntary; however, your failure to furnish all or part of the requested information may result in the Government’s denial of your access to the pre-proposal conference. This information will be provided to the Security Forces who will authorize your entrance to the site.

2.5. Visitors must present Government-issued photo identification at the Installation’s Main Entry Gate upon arrival. You may be required to present the following information upon arrival: (1) Vehicle Registration, (2) Valid Driver’s License, (3) Proof of Insurance for Vehicle, and/or (4) Safety Inspection and Car Rental Agreement, if applicable. Any of the above information furnished by you is protected under the Privacy Act and shall not be released unless permitted by law and/or you have consented to such.

2.6. Information provided at this conference or site visit shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

2.7. Offerors are requested to submit questions for the conference to Ms. Vicky Williams at vicky.l.williams10.civ@mail.mil not later than three (3) business days prior to the conference. Information provided at this conference or on site shall not qualify the terms and conditions of the solicitation and Project Requirements Manual (PRM). Terms of the solicitation and PRM remain unchanged unless the solicitation is amended in writing.

If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation are amended in writing. If an amendment is issued, normal procedures relating to the acknowledgement and receipt of solicitation amendments shall apply.

2.8. A record of the conference shall be made and furnished to all prospective offerors via posting to https://www.fbo.gov. The record will include minutes of the meeting, including questions (on a non-attribution basis) and answers, and a list of attendees.

3.2. Any explanation desired by an offeror regarding the meaning or interpretation of the solicitation or Project Requirements Manual (PRM) must be requested in writing and with sufficient time allowed for a reply to reach offerors before the submission of their offer.

All questions and requests for information (RFI) must be received NOT LATER THAN five (5) calendar days prior to closing of each phase of the two-phase process and answers will be posted not later than three (3) calendar days prior to closing of the applicable phase. The Contracting Officer reserves the right to address questions received after this time following solicitation closing with those offerors in the competitive range should one be established. 3.4. Any clarifications made will be in the form of an amendment to the solicitation (Phase One and Phase Two) or PRM (Phase Two only) and will be furnished to all prospective offerors via posting to Federal Business Opportunities (https://www.fbo.gov).

3.4.1. Offeror must acknowledge receipt of amendments in the space provided on the SF 1442 or by returning a signed copy of the amendment by the time set for receipt of proposals. Explanations or instructions given in a form other than an amendment to the solicitation shall not be binding. Questions (on a non-attribution basis) and answers shall be furnished to all prospective offerors via the web site.

3.4.2. For security reasons, all technical and engineering data related to this solicitation will be distributed via Federal Business Opportunities (FedBizOpps), a web-based portal designed to safeguard acquisition-related information for all Federal agencies. Interested bidders/offerors must register with FedBizOpps before accessing the system.

4. AMENDMENTS PRIOR TO DATE SET FOR RECEIPT OF PROPOSALS

4.1. The Government reserves the right to revise or amend the solicitation or Project Requirements Manual (Phase II) prior to and/or after the date set for receipt of proposals as necessary. Such revisions, if any, will be announced by an amendment or amendments to this Request for Proposal. All information relating to this RFP, including pertinent changes/amendments and other information applicable prior to the date set for receipt of proposals will be posted at https://www.fbo.gov.

4.2. Offerors are strongly cautioned to check this site frequently and to “refresh” their web page to ensure they have the latest information.

5. HAND CARRIED PROPOSALS

5.1. A repository is provided for hand carried proposals and is located at USPFO for Iowa, Bldg. 3475, 7105 NW 70th Ave, Johnston, Iowa 50131-1824.

5.3. Offerors are cautioned that approval to enter the base must be obtained prior to the closing date for receipt of proposals. Follow the procedures outlined in paragraphs 2.3 – 2.5 for entry. Delays are probable at the entry point and should be accommodated for. Late receipt of proposals due to entry delays may not be deemed excusable and the Contracting Officer may declare the proposal late and remove it from consideration.

6. WAGE DETERMINATION (Applicable to Phase Two Only)

6.1. The Construction Wage Rate Requirements, formerly known as Davis Bacon Wage Rates, are applicable to this project. The current prevailing wage determination(s) at time of issuance of solicitation is IA170148, for Woodbury County, Iowa. In the event the current prevailing Wage Determination is changed by the Department of Labor prior to closing date of the Phase Two portion of this solicitation, the most current wage determination is in effect. Should the wage rate change after closing, but prior to award, the updated Wage Determination will be incorporated by amendment and issued to all offerors that have not been eliminated from the competition. If applicable, these offerors/contractors will be given a reasonable opportunity to provide revised proposals solely to amend proposals due to Wage Determination changes. If the wage determination modification does not change any affected wage rates, then the provisions of FAR 22.404-5(c)(4) will apply.

7. PROPOSAL EXPENSES AND PRE-CONTRACT COSTS

This RFP does not commit the Government to pay costs incurred in preparation and submission of initial and subsequent proposals or for other costs incurred prior to award of a formal contract.

8. REMOVAL OF SECTIONS AT TIME OF AWARD.

Sections 00100, 00110, 00120, and 00600 will be physically removed from the resulting award, but will be deemed to be incorporated by reference in that award.

9. DISPOSITION OF UNSUCCESSFUL PROPOSALS:

In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposals. The Government will destroy extra copies of unsuccessful proposals. No destruction certificate will be provided.

10. INFORMATION REGARDING AVAILABILITY OF UTILITY SERVICES

It has been determined that all temporary utilities shall be the responsibility of the contractor. The contractor will pay all charges (hookup fees, metering, monthly usage, etc.) resulting from temporary utilities. The offerors shall take this into consideration when computing their offers. (FAR Clause 52.236-14, Availability and Use of Utility Services.)

11. EXCEPTIONS. If the offeror takes exception to any of the requirements specified in this solicitation, the offeror shall clearly identify each such exception and include a complete explanation of why the exception was taken and what benefit accrues to the Government. All exceptions to the solicitation requirements (Section 00010 through 00700) and supporting rationale shall be included in an addendum to the proposal and clearly labeled "Exceptions." An addendum is only required if the offeror takes exception to any requirement in the solicitation.

(The Addendum does not have a page limitation, but shall only include information relevant to exceptions taken to the solicitation requirements.) The Government will assume an offeror takes no exceptions to any solicitation requirement if the offeror does not submit an Addendum identifying exceptions. Offerors are advised that solicitation requirements are not necessarily negotiable and such exceptions may render an offeror's proposal unacceptable and ineligible for award.

SECTION 00110

SECTION 00110 - SUBMISSION REQUIREMENTS AND INSTRUCTIONS

1. PROPOSAL PREPARATION INSTRUCTIONS

1.1. These instructions prescribe the format of proposals, and describe the approach for the development and presentation of the proposal data. They are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals. Carefully review this section prior to commencing proposal preparation. All solicitation amendments must be acknowledged in accordance with Section 00100, FAR Provision 52.215-1, Instructions to Offerors – Competitive Acquisition.

1.2. Offerors are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete proposal. Failure to furnish a complete proposal, at the time of proposal submission, may result in the proposal being unacceptable to the Government and eliminated from consideration for award.

1.3. Proposal Due Date Schedule. The entire Phase One proposal, (Volumes 1, 2 and 3) is due by the date and time set for the receipt of proposals shown in Block 13 of the Standard Form (SF) 1442. Offerors shall request their past performance references to provide questionnaire responses to the Contracting Officer not later than the closing date. The date and time for receipt of the Phase Two proposals will be issued in the Phase Two solicitation to those offerors selected to proceed to the Phase Two portion of this procurement.

2.0 PROPOSAL CONTENT

2.1. Prospective offerors shall submit the following volumes in separate packages, for each phase.

3. Written Proposal Format. (Unless noted otherwise these general instructions apply to both Phase One and Phase Two proposals.)

3.1. Purpose. These instructions prescribe the format of proposals, and describe the approach for the development and presentation of the proposed data. The proposal shall include all of the information requested in the specific instructions. Failure to include all information requested may adversely affect the evaluation. A proposal that merely reiterates or promises to accomplish the requirements of the RFP will be considered unacceptable. A proposal that is orderly and sufficiently documented will be easy for the Government to understand and will enable the Government to perform a thorough evaluation.

3.2 Offerors are cautioned to submit enough information to enable the Government to fully ascertain each offeror’s capability to perform all of the requirements contemplated by this solicitation. All commitments made in the proposal may become a part of the resultant contract. The data submitted with each proposal should be complete and concise, but not overly elaborate. Excessive reliance on promotional brochures is discouraged.

3.3 Written proposals shall be prepared on standard 8.5 x 11 inch paper (charts may be landscaped but must be on 8.5 x 11 inch paper) and shall be in a legible font size (10 min.). Type size for graphics, charts, diagrams and tables, shall be of an appropriate font and size for the application, and must be clearly readable without magnification assistance to the normal eye. Page size for schedules may be up to 11” x 17” and all other charts, tables etc. must not exceed normal legal size (8.5”x14”). All pages of each proposal shall be appropriately numbered, and identified with the RFP number. For ease of reference, consecutive page numbering with tabs is required. To the maximum extent practicable, proposal submission shall be double sided. Where page limits exist, a page is defined as one single side of a page. Double sided pages count as two pages. Unless otherwise stated, tabs, indexes and dividers do not count in the page count.

3.4 Indexing: Each binder will contain a “Table of Contents” for that volume. The “Table of Contents” will identify major areas, paragraphs and subparagraphs by number and title, as well as by page number and volume locations. Tab indexing will be used to identify Sections as appropriate.

3.5 Page limits include all appendices, charts, graphs, diagrams, tables, photographs, etc. except as noted elsewhere in the instructions. Failure to observe these requirements may result in non-compliant proposals being evaluated at the maximum number of pages had the instructions been followed. All pages in excess of the stated limits will not be evaluated.

3.6 Binding. Elaborate format and binding are neither necessary nor desirable. Binders (3-ring “D” or slant ring preferred) shall be capable of lying flat when opened. The cover and spine of each binder will clearly identify the offeror’s name, Volume number(s), Project number, RFP number, RFP title and copy number, (e.g. copy 2 of 3).

The original for each volume will be clearly identified on the cover and the spine. All binders will allow for easy removal and replacement of pages.

3.7 If revised proposals are requested, narrative revisions shall be identified with pipelines in the margin of the revised pages. Revised pages shall be printed on one side and hole-punched along the left margin. The number of revised copies to be submitted is the same as the initial proposal.

3.8 Electronic Copy. Provide one (1) electronic copy of all of the proposal information. Electronic copies may be submitted on CD/DVD, readable in Microsoft Word or Adobe Acrobat (11.0) (“Read Only” files are acceptable).

All disks shall be virus checked prior to submission.

3.9 Phase Two Drawing sheets use drawings no larger than ANSI “D” size (22” x 34”) or smaller than size ANSI “B” (11” x 17”). No electronic drawing files are required to be submitted at the proposal stage. Drawings are NOT required in Phase One.

3.10 Offeror may, at the discretion of the Government, be asked to provide clarifications regarding their proposals in accordance with FAR 15.306(a). Requests for such information do not constitute discussions.

3.11 The offeror shall be held responsible for the validity of all information supplied in his/her proposal, including that provided by potential subcontractors. Should subsequent investigation disclose that the facts and conditions were not as stated, the proposal may be rejected.

4. PHASE ONE –SUBMITTAL CONTENTS. Each offeror’s proposal shall be submitted as set forth below and all information shall be confined to the appropriate part to facilitate independent evaluation. Proposals which do not include the requested minimum information may be eliminated from further consideration for award.

4.1. Volume 1 - Pro Forma Documents. Volume 1 Pro Forma Information consists of the SF 1442, Section 00600 – Requirements, Executive Summary and Joint Venture Agreements (if applicable). This information in original and one (1) copy shall be in a separately marked envelope, labeled Pro Forma Information, with the proposal.

4.1.1. Complete in its entirety the “Offeror” portion of the SF 1442. An official having the authority to contractually bind your company must sign the SF 1442 in accordance with FAR 4.102. One (1) copy of the SF 1442 is required to have an original signature.

4.1.2. All potential offerors are required to register in the System for Award Management (SAM), at http://www.sam.gov. Ensure your SAM profile information is up-to-date. Complete annual Representations and Certifications within SAM if you have not already done so. You are not required to provide a copy of the Representations and Certifications completed in SAM with your written proposal. Do include any Representations and Certifications and other statements of offerors contained in Section 00600 of this solicitation, which are in addition to the annual certifications in SAM.

4.1.3. Include an Executive Summary. At a minimum, include Offeror Name, Complete Address, Point of Contact, Authorized Negotiators, Email address(s), Phone Number, Cage Code, DUNS Number, and Tax Identification Number.

4.1.4. Joint Venture Requirements. Parties wishing to propose as a joint venture must submit, with the Phase One Proposal Pro Forma documents, an executed copy of the joint venture agreement. The joint venture agreement shall be executed in accordance with FAR 4.102(d). Each joint venture partner shall submit evidence satisfactory to the Contracting Offer that its Board of Directors has approved its participation in the joint venture or by an instrument of similarly binding character in the case of an unincorporated entity. Offerors are reminded that to obtain an award the awardee, to include a joint venture, must be registered in the System for Award Management (SAM) database.

4.2. Volume 2 - Technical Capability. Submit in one (1) original, three (3) hard copies and one (1) electronic copy.

4.2.1. Subfactor: Technical Approach Narrative. Narrative for this subfactor shall be limited to a maximum of fifteen (15) pages, exclusive of table of contents, tabs, and dividers.

4.2.1.1. Demonstrate an understanding of the design build process and address any anticipated risks associated with this process for this project. Describe in general terms how the offeror will approach the design and construction of this facility.

4.2.1.2. Provide a detailed discussion addressing the proposed organization and the roles and responsibilities of the various sub-contractors for both design and construction.

4.2.1.3. Include the offeror’s proposed processes for handling field problems, assuring quality and assuring Designer of Record involvement throughout the construction period.

4.2.2. Subfactor: Offeror’s Team Experience. Narrative for this Subfactor shall be limited to a maximum of fifteen (15) pages, exclusive of table of contents, tabs and dividers. Provide a narrative of projects that demonstrate the team’s experience with performance-based design build projects. Projects must have been completed not later than five (5) years prior to the date of the solicitation. The Government will use SF 330 forms, provided by A&Es in the Past/Present Performance volume, in the evaluation of this subfactor. (Note: This information may be similar to the information provided in the Past/Present Performance factor but is obtained here for the purpose of identifying the extent of the offeror and their teams experience, where in the Past/Present Performance factor the information is obtained for identifying “how” the work was performed.)

4.2.2.1. Provide a discussion of at least three (3) projects for which the offeror has been responsible. The examples should be as similar as possible to this solicitation in delivery method (performance-based design build), magnitude, complexity, cost, design or features and scope. Each example shall indicate in detail the general character, scope, location, cost, and date of completion of the project. If the offeror represents the combining of two or more companies for the purpose of this RFP, each company shall discuss project examples.

4.2.2.2. Demonstrate that all lead design personnel have experience and required qualifications in assigned roles on projects of similar complexity, size, scope and delivery method (performance-based design build). Specific projects detailed on the SF 330 should be referenced, to ensure proper consideration. As a minimum discuss the project architect; the engineers responsible for civil, electrical, mechanical, and fire protection.

4.2.2.3. Demonstrate that all lead design personnel are registered and/or certified in their discipline. In order for a firm, or individual, to be permitted by law to practice the profession of architecture or engineering, it must be:

4.2.2.3.1. Licensed by the state in which it is practicing, or

4.2.2.3.2. A registered professional in the state in which they are practicing, or

4.2.2.3.3. Practicing in a state which recognizes the professional registration of another state

4.2.2.4. Demonstrate that all lead construction personnel have experience and required qualifications in assigned roles on projects of similar delivery method (performance-based design build), magnitude, complexity, cost, design or features and scope. Discuss as a minimum the project manager; the quality control manager; LEED professional, and the construction manager and/or project superintendent.

4.2.2.5. Discuss previous projects completed by the Design Build team proposed for this project. Note if the same team was involved in the projects referenced in paragraph 4.3.2.1 above.

4.2.3. Subfactor: Other Capability Information. Total Narrative for this information is limited to 10 single pages, exclusive of table of contents, tabs, and dividers. Clearly label this section and place after the Offeror’s Team Experience. Number pages in this Subfactor exclusive of table of contents and tabs.

4.2.3.1. Describe your firm’s capabilities for using Building Modeling and Information System and other forms of automation on this project.

4.2.3.2. Describe your firm’s capabilities for project scheduling with a project of similar magnitude and complexity.

Include programs you utilize and experience of personnel in these programs. Discuss briefly your plan for scheduling of this project, to include updates. A sample schedule is NOT desired.

4.2.3.3. Describe your firm’s capabilities for ensuring proper administration of a project of this magnitude and complexity.

4.2.3.4. You may provide additional information on your capabilities, but please be brief.

4.2.4. Subfactor: Bonding Capability. Total Narrative for this information is limited to 5 single pages, exclusive of table of contents, tabs, and dividers. Clearly label this section and place after the Other Capability Information.

Number pages in this Subfactor exclusive of table of contents and tabs.

4.2.4.1. Submit a letter of commitment from a surety, signed by an officer or agent authorized to bond, that identifies the offeror's available bonding capacity and limits that the surety will bond the Offeror, as the successful awardee for this project, taking into consideration the Cost Ceiling Limitation described in this Solicitation. The surety must be acceptable to the Government and must appear on the Department of Treasury Circular 570 "Companies Holding Certificates of Authority as Acceptable Sureties on Federal Bonds and Acceptable Reinsuring Companies." If the Offeror submits evidence from an individual Surety, the individual surety must include documentation meeting the requirements of FAR 28.203 and contract provision 52.228-1.

4.2.4.2. If the joint venture involves a constructor and an A-E firm and the constructor intends to provide the bond, provide a complete explanation with confirmation from the surety.

4.3. Volume 3 - Past/Present Performance.

4.3.1. Submit in one (1) original, three (3) hard copies and one (1) electronic copy. Past/Present Performance, which includes current on-going (present) performance, will be evaluated using the evaluation criteria set forth in Section 00120 of the solicitation.

4.3.2. This volume is obtained for the purpose of evaluating past/present performance. Past/present performance includes current and on-going performance. It includes Exhibit A, Parts 1 & 2, the offeror’s Performance Relevancy Questionnaire; Exhibit B, the Subcontractor Information and Consent Form; Design team’s SF 330; and any discussion and or additional information, awards, letters, etc. concerning past/present performance the offeror includes. A Past Performance Evaluation Questionnaire is included at Exhibit C.

4.3.3. Exhibit A: Offerors shall complete in detail Exhibit A Part 1, Performance Relevancy Questionnaire, for not more than five (5) contracts (or substantially complete contracts, at least 90%) to be used for reference and evaluation purposes. Exhibit A, Part 2, contains information that only needs to be submitted one time. If the offeror represents the combining of two (2) or more companies for the purpose of this RFP, each company shall submit Exhibit A, except that design team member’s firms need only submit a current completed SF 330 in lieu of the

Exhibit A, Part 1. Exhibit A, Part 2 must be provided by all team members. Detailed instructions are provided in Exhibit A.

4.3.3.1. Offerors shall provide information to demonstrate a history of performance on contracts that are similar in delivery methods employed (performance-based design build), size, scope, cost magnitude, location, client type (e.g.

federal government) and complexity of work performed to those described in the scope of this procurement.

Offerors shall explain what aspects of the referenced contracts they deemed relevant to the proposed effort.

4.3.3.2. Offerors should consider the currency and relevancy of the past/present performance information. To be considered, the performance must have been completed during the past five (5) years. The period begins five (5) years prior to the solicitation release date and includes current performance. Current performance may have greater impact than older performance.

4.3.3.3. Offerors should include with their proposal information on problems encountered on the identified contracts and the offeror's correction actions and/or explanation.

4.3.4. Exhibit B, Subcontractor Information and Consent Form: Offeror shall provide a list of key subcontractors and/or Teaming Partners to be utilized on this project (the design and prime construction team). As a minimum provide the name(s) of subcontractors to be utilized on the design and oversight team and/or the prime construction contractor (as applicable). Other construction subcontractors may be listed/discussed but are not required or desired in Phase One. Each subcontractor/Teaming Partner proposed shall also complete an Exhibit B, Subcontractor Information and Consent Form, to be considered. The design team shall also provide current SF 330, Parts 1 and 2.

4.3.5. Exhibit C: Reference Package Exhibit and Forms

4.3.5.1. Offerors shall prepare and submit an Exhibit C, Reference Package Exhibit and Forms, to prior client(s), to include the owners of all the projects listed on your Exhibit A submission. Detailed instructions are included in the Exhibit C Package. This includes correspondence explaining the requirement to obtain an independent evaluation of prior contract performance, and the Performance Relevancy Questionnaire for use in evaluating past/present performance.

4.3.5.2. Subcontractor/Teaming Partners (applicable to design team members and subcontractors to be utilized on the design and oversight team): In addition to an Exhibit B, each subcontractor/teaming partner shall also send Exhibit C, Reference Package Exhibit and Forms, to three (3) references for completed projects (or substantially completed projects) to be used for reference and evaluation purposes; and provide a Performance Questionnaire to the Point of Contact for each project listed. Subcontractors/teaming partners may NOT use the offeror on this acquisition as a reference for this purpose.

4.3.5.3. Completed Performance Questionnaire shall be returned to Ms. Vicky Williams, 515-252-4615, vicky.l.williams10.civ@mail.mil. These should arrive not later than the closing date for receipt of proposal shown on the SF 1442. Offeror or subcontractor must not review the Performance Questionnaire prior to submission. Questionnaires must be submitted by the client/evaluator directly to the Contracting Office.

4.3.6. Offerors lacking relevant past/present performance experience may submit information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement if such information is relevant to this acquisition. Such information shall include, at a minimum: (1) Name(s) of Predecessor Company/Subcontractor and/or Key Personnel; (2) Complete Address:

(3) Telephone, Fax Number and email address; (4) Brief synopsis of the experience (a resume may be submitted for "Key Personnel"); (5) Describe in detail relevancy to this project. Note that use of subcontractors or key personnel to obtain relevant past/present performance shall commit the offeror to use the proposed personnel/subcontractors in the performance of the contract.

4.3.6.1. Provide three (3) references for each Predecessor Company, Subcontractor or Key Personnel, and send Exhibit C, Reference Package Exhibit and Forms, to these references. Clearly identify the contractor/individual whom the reference information concerns. Include Exhibit B, Subcontractor Information and Consent Form, for subcontractors/team partners if not already provided.

4.3.7. Other Past/Present Performance Considerations (OPTIONAL in Exhibit A, Part 2). The information, if provided, shall be limited to the period beginning five years prior to the solicitation release date.

4.3.8. Offerors are advised that the Government may use all data provided by the offeror in this volume and data obtained from other sources to include, but not limited to, government–wide databases in the development of performance confidence assessments. Past/present performance information on contracts not listed by the offeror, or that of planned subcontractors, may also be evaluated. The government may contact references identified, as well as other than those identified by the offeror, and information received may be used in the evaluation of the offeror’s past/present performance. While the government may elect to consider data obtained from other sources, the burden of providing current accurate and complete past/present performance information rests with the offeror.

5. PHASE TWO - TECHNICAL & COST PROPOSAL

5.1. General Requirements.

5.1.1. Who May Submit? Proposals may be submitted by the offerors who receive written notification from the Contracting Officer that their firm has been selected to participate in Phase Two of this solicitation. The Government intends to select three (3) of the highest rated Phase One offerors to receive the technical requirements package and to participate in the Phase Two process of this solicitation; but shall select not less than two (2) and not to exceed five (5). Ideally, three (3) offerors will compete in Phase Two.

5.1.2. Submission Deadline. Proposals shall be received no later than the time and date specified by the Phase Two solicitation.
