Project Title: FY15 Israel MATOC Project Location: Israel
Solicitation Number: W912GB-14-R-0030 (Attachment 5)
1. The items described below are exceptions to the “no Israeli content” restrictions and may be acquired locally for use in IDF projects under the solicitation.
2. End products or construction materials that by their nature or as practical matter can only be acquired in the geographic area concerned, e.g., ice or books; or bulk materials such as sand, gravel, or other soil material, stone concrete masonry units, or fired brick, are exceptions may be purchased locally for use on IDF projects. We consider subcontracts to deliver or place bulk materials to be included in the bilk material exception. Note that this is broader than the “bulk Materials” exception.
Examples of items included in the above exceptions, which may be purchased locally for use on IDF projects include, but are not limited to the following:
- Cranes, excavation equipment, items of a similar nature;
- Unique local items, such as possibly electrical fixtures, etc.;
- Rebar;
- Conduit;
- Temporary Office facilities, housing for contractor employees;
- Leasing of office equipment, computer services;
- Testing of materials, testing, and validation of mechanical, electrical, and equipment systems, laboratories, etc;
- Formwork;
- Landscaping and plantings;
- Herbicides;
- Locksmith, keying, testing cipher locks, etc;
- Cleanup, waste disposal;
- Lease of construction fencing, portable potties, etc;
- Warehousing and storage;
- In-country transportation, leasing of vehicles;
- Maintenance and warranty services;
- Field training of IDF personnel on operation of installed equipment;
- Preparation of O & M manuals;
- Port Services, expediting;
- Translations;
- Purchase of Israeli technical standards, reference materials;
- Geo-technical investigations;
- Services for TCN workers;
- Site preparation and site clearance;
- Borrow material, including the cost to transport;
- Asphalt, cement.
The above list is not considered all-inclusive; however, contractors must request specific written Contracting Officer (NOT ACO or COR) approval in advance of purchase, to add items not listed. Contracting Officer approval will be given provided legal review finds the request to be in accordance with applicable OSP guidance, laws and regulations.
3. Purchase or lease in Israeli of items manufactured or originating in the U.S. will be allowed for use on IDF projects.
4. Perishable products are and exception per FAR 25.303 and may be purchased locally for use on IDF projects.
5. Petroleum products are and exception per FAR 25.303 and may be purchased locally for use on IDF projects.
6. Items listed in FAR 25.104 may be purchased locally for use on IDF projects. (Not very helpful, includes items like tea, and “opium, crude”).
7. Branches or subsidiaries of U.S. firms that are at least 51% owned by the parent U.S. firm will be considered U.S. content.
8. Labor of dual nationals who are U.S. citizens will be considered U.S. content.
9. Contractor overhead and profit at U.S. firms is considered U.S. content.
10. Local nationals employed by a U.S. firm specifically to working Israel on this project are not considered U.S. content; this does not apply to dual nationals who are U.S. citizens. However, employees of U.S. firms, including branches or subsidiaries in Israel that are 51% owned by the U.S. parent, will be considered U.S. content., regardless of citizenship, provided such employees are permanent employees of the firm, not hired specifically for this project or other FMS funded projects. This is based upon the impracticality of reviewing the citizenship of each employee of a U.S. firm.
11. How OSP will be calculated on contracts for IDF projects:
- First, subtract out from the total contract price, the excepted items, such as those listed above, and subtract out items from the designated countries under the Trade Agreements act.
– At least 51% of the remaining amount must be U.S. content.
12. Items specifically required by the contract specifications to be purchased in Israel may be purchased locally after the contractor identifies those requirements t the Contracting Officer and obtains Contracting Officer approval for the purchase.
13. Items of Israeli origin not included in the listing above will be considered for use under the contract, but must be specifically approved in writing by the Contracting Officer (not ACO or COR) in advance of purchase, following legal review of the request for consistence with OSP guidance, laws and regulations.
