PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT TO PERFORM FENCE-TO-FENCE (F2F)
ENVIRONMENTAL SERVICES AT:
MOUNTAIN HOME AIR FORCE BASE, IDAHO MALMSTROM AIR FORCE BASE,
MONTANA
14 March 2019
1.0 SCOPE
In carrying out work assignment(s) issued under this Contract, the Contractor shall furnish the personnel, services, equipment, tools, materials, vehicles, facilities supervision and other requirements necessary for, or incidental to, the performance of work set forth herein; assure any and all program and/or project related costing information (regardless of its stage in development) is secured, and be responsible for safeguarding proprietary and other sensitive information. The Contractor shall be immediately capable of addressing and interpreting all aspects of environmental law and regulation.
1.1 Introduction
This Performance Work Statement (PWS) defines the scope of a full range of environmental operations and services activities necessary to meet Mountain Home and Malmstrom Air Force Base requirements. This Contract is performance-based to the maximum extent practicable in accordance with (IAW) Federal Acquisition Regulations (FAR) Subpart 37.6.
The Government is faced with shrinking budgets and reduced staffing. In an effort to gain efficiencies through volume purchasing and to reduce the administrative burden of managing multiple contracts for various environmental services, the government is seeking to procure multi-year, fence-to-fence (F2F) contracts for environmental services at AF installations.
Services to be provided support the AF Environmental Quality (EQ) program. This PWS encompasses the full range of methods, technologies, and supporting activities necessary to conduct environmental operations and services efforts to address F2F environmental compliance needs at Mountain Home AFB and Malmstrom AFB in accordance with technical and regulatory requirements.
The Contractor shall provide environmental services to support one or more of the following environmental compliance programs on the AF base, as needed/regulated by the Idaho Department of Environmental Quality (IDEQ), Montana Department of Environmental Quality (MDEQ), U.S. Environmental Protection Agency (EPA), and/or other state and local regulatory agencies: Hazardous Waste (HW) Program, Hazardous Materials (HM) Program, Air Program, Storm Water Program, Natural Resources Management Program, Environmental Management System (EMS) Program, and other environmental compliance programs as necessary. This PWS outlines the current known requirements as identified by the IDEQ, MDEQ, WDOH, U.S. EPA, and/or local regulatory agencies.
1.2 Policy and Requirement Statements
It is AF policy to use innovative and sustainable approaches to environmental management and technology to accomplish its mission. Sustainable projects may reduce the burden of compliance for the AF but are intended to not deplete resources, degrade the environment, nor impact human health. The Contractor shall incorporate pollution prevention (P2) and sustainability initiatives into all aspects of this Contract. The Contractor shall operate in a manner that promotes energy management to include energy efficiency, use of renewable energy, and water conservation. The Contractor shall comply with the AF base’s Environmental Management System (EMS). The contractor shall also participate in the AF base’s Environmental Compliance Assessment and Management Program (ECAMP) (formerly known as Environmental, Safety, and Occupational Health Compliance Assessment and Management Program [ESOHCAMP]), as required. All health and safety plans must be updated to reflect the Government’s requirements in USACE Engineering Manual (EM) 385-1-1, and submitted to the Government / USACE COE for approval prior to the commencement of any work activities.
The Contractor shall function as an integral team member in support of Air Force Civil Engineer Center (AFCEC) and the AF mission to include sharing of information with other Government contractors and in cooperation with communities, regulators, and other Government entities.
Requirements include efficient management of this Contract including, but not limited to, the submission of accurate, on-time, quality deliverables and timely identification and solution of impediments to successful project execution. Technical requirements include, but are not limited to, early involvement in the process to allow for the development of the most cost-effective and technically sound approach or solution. The Government will rely on the Contractor’s expertise in recognizing and addressing problematic issues and successful execution of this Contract.
The Contractor shall perform all work in accordance with applicable federal, state, and local statutes and regulations, Executive Orders (EOs), Department of Defense/Air Force (DoD/AF) policies and instructions, and the AF base requirements including, but not limited to, the AF base Activity Management Plan (AMP), Environmental Action Plan (EAP), Integrated Cultural Resources Management Plan (ICRMP), Integrated Natural Resources Management Plan (INRMP), Hazardous Waste Management Plan (HWMP), Hazardous Materials Management Plan (HMMP), Storm Water Management Plan (SWMP), Asbestos Management Plan, P2 Plan, Spill Prevention Control and Countermeasure (SPCC), the AF base General Requirements for Environmental Protection, and Storm water Pollution Prevention Plan (SWPPP). The contractor shall be immediately capable of understanding and addressing environmental laws and regulations as they pertain to work performed under this Contract.
1.3 Continuation of Essential DoD Contractor Services during Crisis The performance of these services is not expected to be mission essential during time of crisis (e.g., FPCON level is elevated to a point where installation access becomes limited). Should a crisis be declared, the CO or his/her representative will verbally advise the Contractor of the revised requirements, followed by written directions.
2.0 ADMINISTRATIVE AND MANAGERIAL REQUIREMENTS
The Contractor shall perform management and planning functions, as well as performance monitoring and measurement, during the course of this effort, as specified in this contract.
2.1 Coordination with Government Offices
The Contractor is responsible for completing specific tasks as assigned and completing those tasks to the satisfaction of the USACE Seattle District’s Contracting Officer’s Representative (COR) official, and to the specific AF component groups to include, but not be limited to, Civil Engineering (CE), transportation, communications, operations, security forces, safety, surgeon general, and the AF base command structure. In the event of an exercise on either the AF base, the Contractor shall set-up and remove temporary Initial Accumulation Points (IAPs) in support of units visiting the AF base for exercises or similar activities. The Contractor shall also provide HM/HW data, as requested, in order to support the exercise. The Contractor may also be required to interface with other AF staff components on certain tasks to include, but not be limited to, legal and public affairs. The types of tasks that the contractor may be asked to perform include, but are not limited to, environmental compliance.
2.2 Regulatory Interface
The Contractor shall assist in the application of general and site-specific regulatory requirements that pertain to assigned AFCEC projects and maintain currency with changing DoD regulations and federal, state, and local statutes and regulations.
The Contractor is not an employee of the Government and shall not represent the Government in an official or unofficial capacity without the express prior written permission from the CO. This notwithstanding, in the event that any regulatory representative approaches the Contractor with a stated intent to inspect the activities of the Contractor without the previous direction of the CO, the Contractor shall respectfully inform the regulatory representative and the COR that requested inspection must be delayed until the CO is properly notified and a duly appointed COR is present or other direction is issued by the CO. If this is not possible, due to project constraints, the Contractor shall notify the CO, COR, and the AF base point of contact (POC) at the earliest possible time following the inspection.
2.2.1 Document Preparation
Any document preparation accomplished by the contractor that has legal consequence to the AF shall be submitted through the CO or the COR for appropriate AF component approval, including the AF base POC, before submission to any regulatory authority external to the AF.
Documents of legal consequence include, but are not limited to:
Any document requiring affirmative certification by an AF official that the contents of the document are true and correct to the best of his or her knowledge (e.g., Resource Conservation and Recovery Act [RCRA] permit applications);
Any document that could lead to administrative or criminal sanctions against the AF if the information is determined to be incorrect, misleading, or inaccurate; or
Any document providing information about internal AF operations being requested by an external agency as part of an investigation or inquiry.
2.2.2 Reporting Noncompliance
The Contractor shall immediately report any noncompliance with applicable federal, state, or local environmental laws, or nonconformance with Air Force Instructions (AFIs) as applied through the EMS to the AF base POC, CO, and COR.
2.3 Coordination with Other Contractors
The Contractor shall cooperate fully with other contractors and Government employees. The Contractor shall not commit any act that will interfere with the performance of work by any other contractor or Government employee. The CO and COR will resolve work schedule conflicts between this Contract and other contracts. The CO will provide written direction to the Contractor to reschedule work when required.
2.4 Special Notification
2.4.1 Health Risks
The Contractor shall immediately report to the CO, COR, the AF base POC, verbal telephone or e-mail notification pursuant to the Contract, any issues or incidents which may indicate potential imminent risk to contracted, federal, or local personnel, the public at large, or the environment.
Following the verbal or e-mail notification, a written notice with supporting documentation, to include photographic documentation whenever appropriate, shall be prepared and delivered within three (3) working days to the CO. Upon request of the CO, or the COR, the contractor shall provide pertinent raw laboratory data immediately (not to exceed two [2] weeks) via e-mail, and then provide final results and laboratory quality data via standard mail as soon as possible.
2.4.2 Identification and Change of Critical Contractor Personnel The Contractor shall submit an organizational chart displaying key personnel involved in the effort, their organization, their respective labor categories, and their roles and responsibilities for each AFB. The Contractor shall immediately notify the CO and COR, in writing or email, of any changes in key Contractor personnel. The Contractor shall obtain CO and COR approval of any proposed changes in project personnel along with the steps taken/proposed to ensure there are no impacts to the schedule or costs associated with individual tasks. The Contractor shall provide subcontractor qualifications and define roles and responsibilities to the CO and COR prior to subcontractor utilization.
2.4.3 Unexploded Ordnance
Following the award of the contract, the Contractor will be provided with the Point of Contact on the Installation, for Unexploded Ordnance (UXO). The Contractor shall inquire via the provided Installation UXO POC as to whether the potential for Unexploded Ordnance (UXO) potential exists in the field location planned for field work, prior to starting any field work. If the potential for UXO exists, the Contractor shall inquire as to whether the work site has been cleared of all UXOs prior to commencement of field activities. If UXOs are discovered during field activities, the contractor shall halt work immediately and report the discovery to the AF base POC and COR via telephone, and be followed by e-mail notification. Additionally, the Contractor shall take action to secure the work site and prevent unauthorized entry. Some actions satisfying notification of AF base POC and securing the site may include, but is not limited to, notification of the AF base command post, security police, fire department or others of authority, once they arrive. Once work has been halted due to the presence or suspected presence of UXO, work shall not commence until notified by the CO after clearance is authorized by Explosive Ordnance Disposal (EOD) personnel.
2.4.4 Historic and Archeological Resources
If whole or fragmented skeletal elements (bones), fossils, or historic or archeological artifacts, resources, features, or sites are discovered during field activities, the Contractor shall halt work immediately and report the discovery to the AF base POC, the CO, and the COR via telephone, to be followed within 24 hours by written notification to the CO. Additionally, the Contractor shall take action to secure the work site, prevent unauthorized entry, and avoid any further damage or disruption to the location; notifying security police, command post, or others of authority satisfies the securing the site requirement once they arrive. Permission to proceed with field activities in the area will be granted by the CO, after coordination with the AF base or local/regional AFCEC Cultural Resources Manager. The Contractor shall not publicize or disclose the existence of said elements, artifacts, etc., to unauthorized persons or entities without specific written permission from the CO, who will coordinate with the local/regional AFCEC Cultural Resources Manager.
2.5 Laboratories
2.5.1 General
The Contractor shall select a laboratory that complies with applicable AF, federal, state, and local standards and requirements including certification and accreditation programs, where applicable. The Contractor shall select a laboratory with analytical capabilities sufficient for the methods specified in the AF base environmental plans (e.g., HWMP, SWPPP, SWMP), and adequate throughput capacity to handle the project’s analytical workload during all field activities. A laboratory that provides results via files that are compatible with the U.S. EPA Staged Electronic Data Deliverable (SEDD) format is required to facilitate importing sample analytical results into the Enterprise Environmental, Safety, and Occupational Health Management Information System (EESOH-MIS).
2.5.2 Data Quality Objectives
The U.S. EPA has developed the Data Quality Objective (DQO) Process as the agency’s recommended planning process when environmental data are used to select between two alternatives or derive an estimate of contamination.
