BIDDERS’ QUESTIONS AND GOVERNMENT REPLY:

(Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s).

Questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans or specifications.)

Bidder Inquiry 01: On Sheet 11, Sheet Identification C-101B, and Sheet 12, Sheet Identification C-101C, there is a note PROPOSED PUMP STATION INTAKE SLAB, with a leader pointing to the upstream side of the pump station between the wingwalls and the headwall, PS-1., These plans clearly show the intake slab extending beyond the wingwall limits of the pump station. To date we have been unable to locate any additional length shown on the structure drawings that would indicate the additional length of the slab. Could you please clarify the end of slab dimensions and provide a section and or details?

Government Response: All structural drawings associated structural drawings have been revised and reissued to detail the pump station intake slab.

Bidder Inquiry 02: With regards to the schedule and progressing the work and installation and testing of the test piles, there seems to be a lengthy delay from the time the test piles are driven, tested and restruck. Section 31 62

16.16, STEEL H-PILES, paragraph 3.3.4.2 - Pile Load Testing Schedule we need to wait 21 days after all the piles are driven for the test piles to perform dynamic load test and the compressive load test. Then another 21 days if a tension test is required. Then the Government will require 4 weeks to analyze the data before the Contractor can get pile lengths. Then the Contractor need to procure the piles. Once driving begins the government may want job piles restruck, 21 days after the pile is driven. This means concrete cannot be placed for almost 3-4 months after the test pile is driven. This could severely impact the schedule especially in terms of the pump station, as well as increase the project pricing. We respectfully request that the ACOE reconsider these time frames, as they are not industry standards.

Government Response: Due to the nature of the subsurface soils at this project area, Section 31 62 16.16, STEEL H-PILES, paragraph 3.3.4.2 - Pile Load Testing Schedule will not be revised.

Bidder Inquiry 03: It is unclear how the Levee Toe Drain ties into the Pump Station and Pump Station Intake Slab.

Please provide construction details for the Levee Toe Drain tie-in at the Pump Station/Intake Slab.

Government Response: The Levee Toe Drain does not tie into the Pump Station. The drain would be stopped against the concrete wing wall.

Bidder Inquiry 04: Is the USACE’s intent to fill in the existing Pond at STA 29+50? If so, what material is to be used to fill this area and how is this work measured and paid?

Government Response: The Contractor is advised to fill in the existing pond that would conflict with the footprint of the levee and the 15-foot strip along toe of the earthen levee. Backfilling material and compaction should be similar to those used to backfill the 5-foot over-excavation along the levee (i.e., excavating the existing top 5 feet of soil in areas where there is no pond).

Bidder Inquiry 05: The Note in Detail 1 – Earthen Levee on Plan Sheet 34 states that the Cut Off Wall terminates at STA 36+91. Plan Sheet 16 states that the Cut Off Wall terminates at STA 37+08. Please clarify this and indicate where the Cut Off Wall terminates in this area.

Government Response: The cut-off wall (sheetpile wall) shall be terminated at STA 36+91.

Bidder Inquiry 06: I need clarification on a seed mixture. Spec. Section 2.1.2.2 'Contract 5 Native Grass Seed Mix for "protected Side Grass Mix (elevation greater than or equal to 3)", the % by weight for the component seeds adds up to 110%. Please verify that it cannot be 110% and what is the correct mixture % by weight number.

Government Response: Section 32 92 19 paragraph 2.1.2.2. states that Native Grass Seed Mix may be adjusted by the Contractor’s wetland scientist, based on site conditions, with approval of the contracting officer.

Bidder Inquiry 07: With regard to the Surcharge at STA 27+37 and shown on Sheet C-512 please clarify the following: (a) why is this Surcharge necessary at this particular location; (b) what is the purpose of the localized

Surcharge at his location.

Government Response: The Surcharge load is needed at that location for two reasons: (A) There is rather a thick, soft stratum that would settle under the weight of the drainage structure (Drainage Structure C3-4), and (B) There is a concern that the drainage structure will be overstressed by the rather large settlement of ground expected at this location/station.

Bidder Inquiry 08: Note #1 on Sheet C-512 needs further clarification in order for Bidders to determine how to address this Note in their cost estimate for this project. The Note states that existing sewer lines may need to be temporarily re-routed and temporary drainage may need to be provided by the Contractor prior to placing the

Surcharge at STA 27+37. Since this is not a Design-Build Contract, it is not up to the Bidders to determine whether or not this re-routing work is necessary to perform. The Designer should have studied the problem and determined if the re-routing work is necessary. If the re-routing work is necessary then the Bidders should be provided with design information, details, and a definitive scope of work for firm pricing to be provided for the re-routing of existing sewer(s) and providing temporary drainage. Please clarify this issue as soon as possible.

Government Response: Re-routing of these utilities is not expected or required by this design, Note #1 on

C-512 is included due to the close proximity of existing utilities which may require relocation due to the contractor’s means and methods of construction.

Bidder Inquiry 09: The Notes on Sheet C-512 do not address when the Drainage Structure C3-4 and Levee are constructed relative to the Surcharge Placement. It appears that the Drainage Structure C3-4 and the Levee are expected to be constructed prior to the placement of the Surcharge at STA 27+37. Is that true?

Government Response: No; the Levee and Drainage Structure C3-4 will be constructed after Surcharge work is finished and the rate of settlement of the ground is so small; please see note #9 regarding the duration that the surcharge will be in place.

Bidder Inquiry 10: If the Surcharge at STA 27+37 is placed after the Drainage Structure C3-4 and Levee are constructed, then what is going to happen to the Drainage Structure, which is not pile-supported, when the ground settles?

Government Response: The Drainage Structure C3-4 and the Levee are constructed after the surcharge has been removed.

Bidder Inquiry 11: How much ground consolidation and vertical settlement is expected to occur by the end of the

Surcharge Settlement Period at STA 27+37?

Government Response: The amount of ground settlement, under the weight of surcharge, will be measured on site. It is expected to be more than six inches.

Bidder Inquiry 12: Please clarify the two dimensions on Sheet C-512 that pertain to Surcharge Section #2. One dimension is 37.5’ and the other dimension is 37.7’. What is the purpose of providing these two dimensions and what are they supposed to be measuring?

Government Response: The dimensions are from the toe of the proposed earthen levee to the edge of soil to be excavated out and replaced with select granular fill, etc. Please see Sheet C-512 in Amendment #9.

Bidder Inquiry 13: The dimensions are from the toe of the proposed earthen levee to the edge of soil to be excavated out and replaced with select granular fill, etc. Please see Sheet C-512 in Amendment #9.

Government Response: Subpart 3.16.1 in spec. sec. 35 41 00 has been modified to read as follows:

3.16.1 General

The materials in each layer of the fill shall contain the amount of moisture, within limits specified below or as directed by the Contracting Officer, necessary to obtain the required compaction. The compacted fill shall have an in-place moisture content between 2-percent below and 2-percent above the optimum moisture content. The optimum moisture content shall be determined in the laboratory according to ASTM D1557. Material that is not within the specified moisture content limits after compaction shall be reworked to obtain the specified moisture content, regardless of density.

Subpart 2.1.1 Compacted Embankment fill in spec. sec. 35 41 00 has been modified to read as follows:

This material shall consist of soils classified in accordance with ASTM D2487 as CL, CL-ML, ML, SC, and SM with a Plasticity Index ranging between 2 and 15, and the select embankment fill shall be well graded having a maximum particle size not exceeding 1/2 of the placement lift thickness up to a maximum of 3 inches in diameter and not less than 35 percent by weight passing a Standard No. 200 sieve.

Levee fill material and backfill material of inspection trench must have a maximum permeability rate of

1X10-7 ft/second when compacted to 95 percent of ASTM D1557 maximum dry density.

Bidder Inquiry 14: Subpart 3.16.1 of the Levee Construction Specification Section 35 41 00 appears to be setting up conditions that will adversely impact the ability of the Contractor to construct the earthen levees in a practical and productive manner because this specification is using Moisture Content as the governing priority over In-place

Density. This specification needs to provide a flexible approach to the moisture content, and it needs to provide a reasonable amount of tolerance so that the placement of the earthen levees can progress without unnecessary delays caused by a lack of tolerance regarding the moisture content. The type of cohesive soils that will be used to construct the earthen levee are very moisture sensitive and it can be very difficult and time-consuming to tightly control the moisture content of the levee soils unless there are prolonged periods of optimal weather conditions during the placement of the levee soils. Therefore, it would be appreciated if this aspect of the levee construction can be more completely addressed and clarified to ensure that the earthen levees can be constructed in an efficient and productive manner.

Government Response: Please note that Subpart 3.16.1 of the Levee Construction Specification Section

35 41 00 allows the Contracting Officer to adjust the requirement of the moisture content of in-place fill.

The Contractor should be aware that the in-place dry density of the compacted levee fill shall be at least 95-percent of the maximum dry density as determined in the laboratory using ASTM D1557.

Bidder Inquiry 15: Subpart 3.17.2 of the Levee Construction Specification Section 35 41 00 does not specify the loose lift thickness when the levee soil layer is compacted with an approved roller. Please confirm that the loose lift thickness is at least 12” for this application.

Government Response: The thickness of loose lifts, for the construction of the earthen levee, shall be 14 inches at most when compacted using equipment other than hand-operated compactors.

Bidder Inquiry 16: With regard to the Typical Earthen Levee Section #1 on Dwg C-503, please clarify the purpose and need for the Inspection Trench. What exactly needs to be inspected, what are we looking for, and who is supposed to perform the Inspections?

Government Response: The purpose of the Inspection Trench is detailed in the project specifications section 35 41 00, paragraph 3.7.5. A representative of the USACE – New York District, will do that inspection.

Bidder Inquiry 17: The bid item description for Line Item #0007 makes reference to constructing drainage swales with erosion control matting. However, the Trapezoidal Swale Details on Sheet C-503 do not make reference to the placement of Erosion Control Matting, and the Erosion Control drawings do not provide any details for Erosion

Control Mating being placed in the Swales. This is an important cost concern because the Swales run almost continuously along the of the entire length of the project. Please clarify.

Government Response: Erosion control matting references have been removed from the bid schedule description.

Bidder Inquiry 18: With regard to the very large quantity of Peat Removal, please clarify whether or not this material passes the New Jersey Residential Direct Contact Soil Standards.

Government Response: The contents of this peat material is to be determined if/when it is excavated during construction. If this RFI is meant to determine if this RFI is intended to delineate between residential and non-residential definitions, please refer to New Jersey Department of Environmental

Protection (NJDEP) remediation standards rules (N.J.A.C. 7-26D) where Residential properties would be defined as residences, private and public schools, charter schools, and childcare centers, and non-residential properties as properties used for commercial or industrial purposes.

Bidder Inquiry 19: With regard to the undercutting and off-site disposal of the Unsuitable Peat Layer, please provide a separate Line Item for this work just like there are separate line items for other unsuitable soils that are to be removed from the project. There is a separate Line Item #0021 for the off-site removal and disposal of ID-27

Soil, and there is a separate Line Item #0022 for the off-site removal and disposal of Unsatisfactory Material.

Government Response: Peat is considered Unsatisfactory Material.

Bidder Inquiry 20: The reason why the 5 feet of Peat is to be removed under the Earthen Levee is because the Peat

Layer is compressible and will not provide a good foundation for the Earthen Levee. If the underlying ground conditions were stable, then there would be no need to perform the undercutting and replacement operation.

Therefore, the geotechnical properties of the replacement material need only provide a stable foundation for the

Levee, which can be accomplished by replacing the Peat Layer with a Common Sand Fill, rather than using the cohesive and relatively impermeable Levee Soil that is specified for the Earthen Levee. The use of Levee Soil to replace the Peat is very problematical because the Levee Soil is cohesive and very moisture sensitive and there are strict requirements in the Levee Specifications regarding moisture content, and because there are high ground water conditions in the salt marsh area where the Levee will be constructed. Because the high ground water conditions will be difficult to control, the type of replacement material should be a type of soil that is not moisture sensitive, such as a Common Sand Fill.. Since there is a Sheet Pile Cut-Off Wall running the full length of the Earthen Levee, there is no need to use the relatively impermeable characteristics of the Levee Soil to backfill the 5 foot undercut.

The use of a Common Sand Fill as the replacement material will provide a stable foundation for the Levee and will provide the Contractor with a more constructable method of backfilling the undercut. Therefore, we request that the bid documents be revised to use a Common Sand Fill as the replacement material under the Earthen Levee.

Government Response: The Contractor shall use Select Granular Fill Material, as detailed in spec. section

31 00 00, subpart 2.1.7; however, the Select Granular Fill need not comply with filter criteria stated in subpart 2.1.7

Bidder Inquiry 21: Note #1 on Sheet S-301 provides the Government with 4 weeks to analyze the Pile Load

Results and provide final pile lengths for the Flood Wall. This period of time is too long and needs to be reduced.

We request that the Government be provided with a 2 week period to review the Load Tests and provide pile lengths.

Government Response: The Government will review pile load-test results and determine the required length of piles in two to four weeks.

Bidder Inquiry 22: The contract calls for an excess amount of over excavation to a depth of 5 feet and 10ft beyond the toe of the levee construction.

a. Please explain why this is necessary.

b. What is the specification for material to meet to fill this void in, other than at the inspection trench?

c. Is paid for this over excavation and embankment placement to be included in the items for levee construction?

Government Response:

a. The top five feet of subgrade soils consist of soft soil that is unsuitable to have an earthen levee built over it. The over-excavation, and subsequent placement and compaction of Select Granular Fill Material, would result in a firmer bearing stratum. Extending the over-excavation and backfill work to 10 feet from levee toe would help stabilize the levee.

b. The Contractor shall use Select Granular Fill Material, as detailed in spec. section 31 00 00, subpart

2.1.7; however, the Select Granular Fill need not comply with filter criteria stated in subpart 2.1.7.]

c. Over-excavation and placement of Select Granular Fill Material, etc., are parts of the earthen levee bid item.

Bidder Inquiry 23: Please clarify if pile quantities to be measured for payment will include their embedment length in concrete.

Government Response: Confirmed. Contractor may reference top elevation of piles as shown on plans.

Bidder Inquiry 24: Proposal Item 22 Option 6, “Haul and Dispose of Excess or Unsatisfactory Material at Offsite

Location”, please address the following:

a. Please clarify that this is for the offsite disposal of all surplus excavated material generated from all other operations performed under this contract, that does not meet the requirements for embankment or levee construction.

b. Please clarify that this is for the offsite disposal of all surplus excavated material generated from all other operations performed under this contract, over and above quantity needed for reuse on this project.

c. Please explain why this item is identified as an Option. Is there any cause that the base bid could be awarded without the award of this Option?

Government Response:

a. The cost to perform the described work shall be included under this CLIN.

b. The cost to perform the described work shall be included under this CLIN.

c. This optional CLIN is intended to be exercised at the discretion of the COR only if unsatisfactory material is encountered during construction.

Bidder Inquiry 25: Drawing S-301 Note 4 calls for the floodwall to be stained and have an anti-graffiti coating.

Please provide the limits of application for the stain and anti-graffiti coating.

a. Are both sides to be stained and coated?

Government Response: Yes.

Bidder Inquiry 26: Detail 1, drawing C503: The soft peat material replacement is not shown on the cross section depicted on this detail. For bidding purposes, should the keyway under the levee shown on this drawing need to be constructed under the 5 ft soil replacement? The bottom of the keyway would then be located approx. 11 ft below the existing grade, which would require temp support of excavation and additional dewatering. Please confirm.

Government Response: The bottom of the keyway (inspection trench) is at six feet below the existing grade. The depth of excavation, below existing grade, for levee construction would not be 11 feet.

Bidder Inquiry 27: Note #6 for the Cellular Confinement System on Sheet C-502 states that an Erosion Control

Blanket is to be placed over the Cellular Confinement System, and that the Erosion Control Blanket shall be sized for the hydraulic conditions of the site in order to prevent wash-out prior to establishing full grass cover for the entire levee top and side slopes. With regard to this Erosion Control Blanket, please note the following: (a) it is not up to the Contractor to design or specify the type of Erosion Control Blanket that is suitable for this application; (b)

Subpart 2.2 of Spec Section 31 32 11 makes reference to a Type 1 Erosion Control Blanket but that is very vague and cannot be used to determine what type of Erosion Blanket to provide; and, (c) please confirm that all Erosion

Control Blanket is to conform to Subpart 2.6 of Spec Section 32 92 19.

Government Response: The Erosion Control Blanket details are specified in Subpart 2.6 of spec. sec. 32

92 19, and the Contractor is advised to review that subpart for details of the blankets to be used to protect the levee before grass cover is fully developed.

Bidder Inquiry 28: On Detail 1 S502 – please dimension the length of the flute fin finish.

Government Response: S-502 has been revised and reissued as part of this amendment.

Bidder Inquiry 29: With regard to the Fluted Finish for the Flood Walls, please clarify the following: (a) confirm that the Fluted Finish is only to be provided on the Protected Side of the Flood Walls; (b) please specify the manufacturer and type/model of the desired Form Liner for the Fluted Finish; and, (c) please specify the distance between the bottom of the Flutes and the finished grade adjacent to the Flood Wall.

Government Response: Pump Station intake apron has been clarified in amended drawings in this amendment.

Bidder Inquiry 30: With regard to the Option #2 Road Raising Work, please clarify what is to be done with the existing pavement prior to placing the fill material. Can the existing pavement be scarified and left-in-place, or does the existing pavement need to be completely removed and disposed off-site?

Government Response: The existing pavement shall be removed and disposed off-site.

Bidder Inquiry 31: With regard to the Contractor’s responsibilities that are discussed in the Monitoring of

Archaeological Resources part of Section 01 11 00, please address and clarify the following: (a) will the

Archaeological Investigation be performed as part of the Base Bid Work; (b) will the Archaeological Investigation be performed only if Option #2 is awarded; (c) please revise Sheet C-101G to show the Historical Area of Concern that needs to be excavated in the presence of the Archaeologist because it appears that the footprint of this Historical

AOC is quite large; (d) please clarify what is to be done with the excavated soil; (e) will imported fill material be required to backfill the Historical AOC; (f) please clarify how carefully and how slowly the Contractor will be required to excavate the Historical AOC; (g) is the excavation to be conducted incrementally in small lifts like an

Archaeological Dig; (h) how deep will the excavation need to be performed; (i) we request that a separate Line Item be included in the bid proposal for this work and paid per cubic yard; and, (j) alternatively, we recommend that this work be conducted solely on a Time & Material Basis due to the open-ended nature of this work.

Government Response:

a. No, the Archaeological Investigation will be performed in the area of the levee connecting the Port

Monmouth Road Raising and the existing Contract 1 Dune. This is within the Option 2 area.

b. Yes, the monitoring will take place for any excavation in the area described in part (a).

c. See the following Sheet C-101G markup with the AOC drawn in red.

d. The archaeologist may request that a portion of the soil be placed temporarily in a safe location to allow for inspection and/or screening.

e. No imported fill will be required.

f. Some delay can be expected while the excavation is taking place and the archaeologist may direct the excavator to move more carefully around certain archaeological features if/when they are discovered.

The archaeologist will only stop the excavation if archaeological remains are encountered. If that occurs the excavation may need to stop or slow for a day or two depending on how deep the excavation will be and may require the contractor to shift to work to another location temporarily if a potentially significant archaeological site is encountered and consultation with the NJ state Historic Preservation Office and the

Town/County is required. Delays beyond a day or two or that cannot be accommodated by moving the excavations temporarily to another location are outside this scope and may require a modification.

g. The archaeologist will monitor excavation to the depth required for the construction of this element. The archaeologist will not require excavation beyond the depth of the disturbance that is required to construct the project features.

h. There is no predetermined depth of excavation required, the contractor shall excavate to the depth required for construction. The archaeologist will not require excavation, they are simply observing any earthmoving occurring in the sensitive zone

i. The requested CLIN will not be created.

j. Time and materials work is not permitted on this contract.

Bidder Inquiry 32: Why are there two Spec Sections for Geotextiles? One is called Geotextiles for Earthwork, and the other one is called Geotextile Soll Stabilization. We see Geotextiles called-out on the Typical Earthen Levee

Section on Sheet C-503, but the Typical Section does not state whether or not the Geotextiles are being…
