Government Response superseding the response to Bidder Inquiry 79 in Amendment 7: Bidders shall include the cost for this scope under CLIN 0018AB-EARTHEN LEVEE which includes “all work necessary to construct the earthen embankment levee” within Option 2.
Bidder Inquiry 02: Note 3 On Sheet 9, Sheet Identification B-101, states “SOFT PEAT MATERIALS OF ABOUT 5' IN DEPTH WAS ENCOUNTERED IN THE BORING LOGS BETWEEN STA. 10+00 AND STA. 31 +00.
THESE MATERIALS SHALL BE REMOVED AND REPLACED WITH STRUCTURAL FILL MATERIALS. SOFT PEAT MATERIALS UNDER AND EXTENDING TO 10' OUTSIDE OF LEVEE FOOTPRINT SHALL BE HAULED OFFISTE, yet only a few borings show this peat material. Is the intent to undercut the entire levee area as stated or only where encountered. If the intent is only where the material in encountered should this not be a solicitation line item to bid?
Government Response: Soft peat materials encountered during construction under and extending to 10' outside of levee footprint shall be removed and replaced with structural fill materials.
All prices associated with this work shall be included in CLIN 0002 Earthen Levee.
Bidder Inquiry 03: Specification 31 62 16.16, subpart 3.2.5.8, requires a coal tar epoxy paint system, or equivalent, to be applied to at least the top 10 feet of the H-piles unless specified otherwise.
And, Specification 31 41 16, subpart 3.2.6, requires a coal tar epoxy paint system, or equivalent, to be applied to the top 10 feet of the sheet piling unless specified otherwise. Also, a coal tar epoxy paint system is to be applied to at least the top 25 feet for the piles of the generator building. However, we cannot find a specification section that covers the materials to be used, or the required dry film thickness, or the process that is to be used for the coal tar epoxy coating system, such as “wet on wet”, and the bidders need to know if third party inspections are required at the coating factory. Please provide this missing information as quickly as possible.
Government Response:
1) For Steel H-Pile specification 31 62 16.16 subpart 3.2.5.8 have been revised and reissued, the coating requirement for at least top 10-ft is for all piles along floodwall except the pump station where at least top 25-ft requires to be coated;
(2) For Metal Sheet Piling specification 31 41 16 subpart 3.2.6 have been revised and reissued, “….shall be applied for all above ground portion and continuous for at least 10-ft of the embedded portion for both faces of the sheet piling unless specified otherwise.”
(3) For coating thickness, the minimum requirement for H-Pile is 16-mil, for Sheet Pile 24-mil; specification section has been revised and reissued accordingly.
(4) Coating inspection and report are required including the thickness of the coating from coating factory;
(5) There are standard specifications regarding the coating system and shall be part of the specs or otherwise will be further clarified.
Bidder Inquiry 04: Sheet #C-508 only provides conceptual design information regarding the construction of Sanitary Manhole #1, which is a deep, reinforced concrete chamber that needs to accommodate a large 10’ x 10’ sluice gate. Note #1 (under the plan view of the chamber) states that the chamber structure shall be built according to the NJDOT Specifications. However, there are no NJDOT Standard Specifications or Standard Details that cover this type of custom-designed chamber structure. Also, this project is not a Design-Build Project, and the Government has the duty to provide the Bidders with design details for all permanent features and components required for this project. Therefore, please revise and re-issue Sheet C-508 with complete details and design information for Manhole #1, including:
compressive strength for the concrete; steel reinforcement; design invert; inside dimensions; thickness of floor, walls and roof, etc.
Government Response: The mentioned NJDOT Standards have been provided as part of Amendment 7
Bidder Inquiry 05: With regard to the Peat Removal Work, please clarify the following: (a) is this excavated unsuitable material to be placed in a stockpile at the job site; (b) is the Contractor required to remove the Peat from the site; (c) if off-site removal of the Peat is required, please clarify if the Bidders are to assume that the Peat will be environmentally clean, and meet NJ Residential Direct Contact Standards?
a. If the excavated unsuitable material is not contaminated, it may be placed in a stockpile.
b. If the excavated unsuitable material is contaminated, the Contractor will be required to remove the Peat from the project site.
c. There is no data found in subsurface investigations to assume that excavated material is expected to be unclean. The contractor shall test excavated materials in accordance with specifications and regulations.
Bidder Inquiry 06: On Plan Sheet 62, Section 9, Note C, USACE requires that the subgrade shall be prepared to a point that extends 5’ minimum beyond the limits of the foundation. Please clarify this and advise if this note applies to the Flood Wall Footing from STA 0+00 to STA 10+00.
Government Response: Subbase for floodwall such as crushed stone shall follow the design drawing (S-301 sections and note #3) and related specifications.
Bidder Inquiry 07: We are concerned that the Drainage Structures are not currently designed to be pile-supported. These structures will suffer from differential settlement issues if not pile-supported, for which the Contractor cannot be held responsible. Please clarify.
Government Response: Settlement is not expected on these drainage structures. Drainage structure C3-1 is integral with a floodwall, which is on piles, therefore C3-1 is not expected to encounter settlement issues. C3-4 is placed on the surcharge area, the surcharging process would continue until the time-rate of settlement is very small (0.017 inches per day or less).
When that happens, the settlement is deemed complete. The contractor then needs to remove the surcharge material, then install outfall culvert #C3-4 and then build the levee (layer by layer). Please see drawing C-512 surcharge area details.
Bidder Inquiry 08: Line Item #0013 includes 9,150 Shrubs but the bid item description does not provide any Stationing for this work or describe the type of Shrubs that are to be planted. With regard to this Line Item please clarify the following: (a) does this Planting Work only include the Shrubs for the Base Bid Contract Limits; and (b) are all Shrubs to be the ones identified on Sheet L-101?
Government Response: Line item 0013 has been corrected to include 5, 500 Baccharis shrubs which are to be planted through out CT5, as shown in L-101, not just in the base bid limits.
Bidder Inquiry 09: Please clarify if the 14.99 Acres of Seeding in Line Item #0013AB covers only the Base Bid work area.
Government Response: Line item 0013AB covers the seeding throughout the CT5 area as shown in L-101, not just in the base bid limits.
Bidder Inquiry 10: Please clarify if the 2.86 Acres of Herbivory Fence in Line Item #0013AC covers only the Base Bid work area.
Government Response: Line item 0013AC cover the herbivore fence throughout the CT5 area shown in L-101, not just the base bid area.
Bidder Inquiry 11: Why is the Herbivory Fence being priced-out per Acre in Line Item #0013AC when the fence is installed in a lineal fashion and fence work is always priced per Lineal Foot.
Government Response: CLIN 0013AC units has been changed to Linear Ft. This CLIN includes fencing around the Dune and Maritime Forest area.
Bidder Inquiry 12: Please clarify the scope of work that is to be included in Line Item #0014AB, which states that it is Seeding Work South of Port Monmouth Road. Isn’t this Seeding Work covered by Line Item #0013AB?
Government Response: Line 0014AB covers the seeding work in former CT3 area shown in SK-3.
Line 0013AB covers the seeding work throughout CT5 area shown in L-101.
Bidder Inquiry 13: Please clarify if the Seeding Work covered in Line Item #0014AC is for the Option #1 work area.
Government Response: Line Item 0014AC is in the former Contract 2 area shown in SK-2, it is not in the Option #1 work area.
Bidder Inquiry 14: Please clarify if the Seeding Work covered in Line Item #0014AD is for the Base Bid Swale Area.
Government Response: Line Item 0014AD is in the former Contract 2 area shown in SK-2, it is not in the Option #1 work area.
Bidder Inquiry 15: Please clarify why the bid proposal price sheets do not provide any Line Items that are specifically provided for the Restoration Work (seeding and planting) required for the Optional Work Areas.
Government Response: Seeding and planting along the entire CT5 alignment, shown on L-101, is combined in the base bid.
Bidder Inquiry 16: Section 32 93 00.1.7.2 Planting Dates. There are no planting dates listed for the dune grass, Ammophila brevilligulata. Please provide.
Government Response: October 1- March 30.
Bidder Inquiry 17: Bid Item No. 0013AA. Is it possible to get a breakdown of the 9,150 shrubs to be planted (i.e. quantity for each species)?
Government Response: Line item 0013AA has been revised to 5,500 shrubs, these are all Baccharis, as shown in the Shrub Plants Table of L-101 plan sheet.
Bidder Inquiry 18: Section 32 93 00.2.2.1 Marsh Fertilizer. There is no Osmocote branded 8-6-12 fertilizer manufactured for sale (there is a 18-6-12 fertilizer). Please verify the requirement for Osmocote 8-6-12 fertilizer.
Government Response: Section 32 93 00.2.2.1 Marsh Fertilizer has been revised to correct all references of ‘8-6-12’ to read ‘18-6-12.’
Bidder Inquiry 19: Section 32 92 19.1.3.SD.07 Certificates. Please confirm that there is a two-year plant guarantee but only a signed one-year plant guarantee.
Government Response: There is a two-year plant guarantee across the board, Section 32 92 19 has been corrected.
Bidder Inquiry 20: Section 01 56 10.3.1 Method, Par. 4 It is stated that "each section or cell that calls for goose protection will receive interior stakes and nylon twine shall be strung horizontally between the stakes across the top of the planting area in a pattern as shown on the drawings." There is no indication on the drawings as to where the interior stakes should be placed. Please identify the locations of the interior stakes.
Government Response: Interior stakes should be located/placed at the landscapers discretion based on the specifications in plan sheet C-513.
Bidder Inquiry 21: Please provide the floor slab thickness for the Drainage Structures CS-1 and C3-4 on Sheets C-509 & C-510.
Government Response: Drainage structure 3-1: top of footing is shown as El. 0.0 on C-
509. Top of slab shall match bottom elevation of pipe as shown on C-509. Depth of depression for sluice gate to be coordinated with mechanical drawings.
Drainage structure 3-4: the thickness of the footing below the depression for the sluice gate will be 12". The total thickness will be greater than 12" outside of the sluice gate, depending on the depth of depression required. Coordinate depth of depression with mechanical drawings.
Drawing will be revised in an upcoming addendum. See C-514 for a similar footing to use as an example.
Bidder Inquiry 22: Please advise if any concrete over 3 feet thick will be considered mass concrete on this project. If so, will any specifications be provided by the USACE?
Government Response: Specifications are provided; see section 03 30 00, paragraph 1.2, item f, and ACI 301 as cited in paragraph 1.1 of the same specification section
Bidder Inquiry 23: Proposal Item 13AA “Shrubs” is to be measure per each. Will the USACE indicate which species is to be paid under this item?
Baccharis, as shown in the Shrub Plants Table of L-101 plan sheet.
Bidder Inquiry 24: The bid package did not include a separate specification section for reinforcing steel.
Please specify what, if any, coating will be required for the reinforcing steel and at which application.
Government Response: Specifications will be updated in a future amendment. Rebar in floodwalls will have no coating. Rebar in pump station will be epoxy coated.
Bidder Inquiry 25: Option 12, Item 28 call for 1.04 acres of freshwater wetland mitigation bank credits. The NJDEP permit(s) included in the specs require mitigation for the project stipulated impacts:
a. How does the USACE plan on mitigating the impacts stipulated. Permanent Impacts (NJDEP File & Activity # 1331-14-0001.7 CDT210001) (NJDEP Permit # 1331-14-0001.7
LUP210001):
i. 0.387 acres Scrub Shrub freshwater wetlands
ii. 0.587 acres Emergent freshwater wetlands
iii. 6.926 acres Coastal wetlands
iv. 0.028 acres Intertidal and Subtidal Shallows
v. 0.339 acres Transition areas
b. Where is this mitigation work get priced within the proposal?
Government Response: Option 12 - Wetland Mitigation Bank Credits covers the totality of mitigation related price for the contractor to bid.
Bidder Inquiry 26: There are no disconnect switches shown on the drawings for the sluice gate motors, main pump motors, or sump pump motor. Will disconnect switches be required or will the manufacture be providing disconnecting means integral with the controllers.
Government Response: There are no disconnects to be provided for these items. The gate actuators have internal means for disconnecting, any disconnecting shall be done under lockout/tag for safety.
Bidder Inquiry 27: The bid set Telecommunications- SCADA drawings do not include a conduit and cable schedule that would include the information on the cable block diagrams to accurately determine the cable and conduit requirements. Will future drawings with this information be provided for bid purpose?
Government Response: There is not a conduit and cable schedule for the project, no drawings are to be expected to be issued with this information. The contractor shall coordinate these requirements with the control subcontractor.
The following note for the cabling and conduit appears on several drawings. “THE CONTRACTOR
SHALL PROVIDE THE NECESSARY CABLING FOR THE REQUIRED CONTROLS AND SUBMIT
DRAWINGS FOR THE CONTROL CABLING. ALL CABLING SHALL BE INSTALLED IN CONDUIT.”
Bidder Inquiry 28: Is the clearing, grubbing, topsoil stripping and removal and replacement of the 5 ft.
peat layer for the base contract included in Item # 2 – Earthen Levee or Item # 7 – Base Appurtenant Items?
Government Response: Yes, this clin includes all work necessary to construct the earthen embankment levees.
Bidder Inquiry 29: Herbivory fence: Elevation on drawing C-513 calls for 10’0” spacing between stakes, whereas the interior twine detail on same sheet calls for 12’-0”. Moreover, specs section 01 56 10, paragraph 3.1 specifies an 8’ spacing. Please clarify what is the correct spacing.
Government Response: Spacing has been revised in the spec and C-513 to in Amendment 7.
Bidder Inquiry 30: Please provide details of the deer fence indicated around the dune and maritime forest planting area on drawing L-101.
Government Response: An example of the fencing can be found at www.deerbuster.com, it should be a heavy-duty polypropylene mesh fencing.
Bidder Inquiry 31: Please clarify why the 2nd Paragraph under the Project Description makes reference to plan drawings that are not included the contract drawings.
Government Response: This Permit language incorrectly references the USACE site plans as drawing numbers “C5-001, C5-002, C5-003, C5-004, C5-005 and C5-006.” Please instead refer to the civil site plan sheets C-101A, C-101B, C-101C, C-101D, C-101E, C-101F, C-101G.
Bidder Inquiry 32: There are very specific time periods and specific weather conditions stipulated in the Exterior Plantings Spec Section 32 93 00 for the various Plantings that will make it extremely difficult for the Contractor to arrange for all of the Plantings (with their various planting time periods) to be installed and accepted within the 570 calendar contract completion time. Therefore, we request that the first sentence in Subpart 1.1 of Spec Section 01 11 00 be revised to provide an exception to the completion time for the Seeding Work and the Planting work.
Government Response: The planting windows will not be changed. Planting in the existing Contract 2 and 3 areas can begin immediately independent of the construction phasing. Planting along the Contract 5 alignment may be coordinated with the COR to be provided in the immediately following seasonal window with the assurance that all grades are still met by the contractor at that time.
Bidder Inquiry 33: Please delete all references to Contract 2 & Contract 3 Wetlands Planting Work from the Exterior Planting Spec Section 32 93 00 for the following reasons: (a) all contract work needs to be shown on the drawings and this Wetlands Planting Work is not shown on any of the contract drawings;
(b) the contract work needs to be identified in the Project Description and this Wetlands Planting work is not identified in the Project Description; (c) all contract work needs to be clearly identified as being covered by one or more of the Bid Proposal Line Items and this Wetlands Planting Work is not identified as being covered by any of the Bid Proposal Line Items; (d) this Wetlands Planting Work is beyond the Limits of Work shown on the Contract Drawings; (e) Wetlands Planting Work is well known to include high mortality rates for the plants and this risk cannot be covered by firm fixed pricing; (f) the stipulated Guarantee Period and Maintenance required for the Wetlands Plants cannot be covered by firm fixed pricing; (g) this Wetlands Planting Work includes design responsibilities; (h) this Wetlands Planting Work is not fully designed and it is uncertain as to where the plants will be positioned according to actual site conditions, such as grading, salinity and tidal inundations; (i) the Wetlands Planting Work includes a trial and error approach that cannot be covered by firm, fixed pricing; and (j) this Wetlands Planting Work should be performed on a “Time and Material” Basis in a separate contract.
a) Contracts 2 & 3 landscaping is shown on drawings SK-2 and SK-3 that are attached to the Specifications.
b) This Contract 2 & Contract 3 wetlands planting scope of work scope is fully defined within the contract plans and specifications.
c) Line items 0014AA, 0014AB, 0014AC, and 0014AD cover the planting and seeding work that is to be completed in former Contract 2 and 3 areas.
d) The inset A and B areas defined in SK-2 and Sk-3 shall be considered within the project working limits.
e) The contractor shall bid on all planting scope defined in the plans and specifications.
f) The contractor shall bid on all planting scope defined in the plans and specifications.
g) All planting scope is fully designed and specified; typical field verification is required based on the sensitivity of wetland planting.
h) All planting scope is fully designed and specified; typical field verification is required based on the sensitivity of wetland planting.
i) There is no trial and error approach contained in these contract documents.
j) Time and Material contract will not be used for this planting scope.
Bidder Inquiry 34: Please clarify why the Exterior Plantings Spec Section 32 93 00 only allows nurseries in New Jersey and New York to provide the thousands of plants that are required for this project.
Government Response: In order to ensure native, local plant stock. Please see Spec Section 32 93 00, paragraph 1.4.2. Note that the quantity of shrubs has been revised and lowered.
Bidder Inquiry 35: Please revise the Guarantee Period in Subpart 1.8, and revise the Maintenance in Subpart 3.7 of the Exterior Planting Spec Section 32 93 00 for the Contract 5 Planting Work to be for One Year and not for the Two Year Period is that is stipulated in the referenced specifications. A One Year Guarantee Period is customary practice in the Landscaping Industry, as well as for other public agencies.
Government Response: The guarantee period is two-full growing seasons, this cannot be revised.
Bidder Inquiry 36: Please clarify why Subpart 1.5 of the Exterior Planting Spec Section 32 93 00 requires the Plantings shown on Sheet L-101 to be acclimated to a salt concentration of 20 parts per thousand, because the Plantings shown on Sheet L-101 appear to be designated for upland planting environments on the protected side of the Levee and on the Dune.
Government Response: The specifications have been amended to clarify that sub-section 1.5 is “when applicable”, such as for low marsh spartina alterniflora plantings in Contract 2 area.
Bidder Inquiry 37: Please clarify whether or not Subpart 1.6.4 of the Exterior Planting Spec Section 32 93 00 applies to any of the Plantings that are identified on Sheet L-101 because the Plantings on Sheet L- 101 have been designed for those locations, and we do not understand why the final grades and salinity would require the layout of these Plantings to be modified based on site conditions.
Government Response: This section is included because experience tells us that planned and as built can differ, further, there can be field variables that are not know at the time of design.
