BIDDERS’ QUESTIONS AND GOVERNMENT REPLY:

(Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s).

Questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans or specifications.)

Bidder Inquiry 01: Dwg C-101B: Water tap diameter and pipe size and material is needed.

Government Response: ¾” Type-L Copper pipe as shown on Detail 6 sheet C-507.

Bidder Inquiry 02: Dwg C-101C: Please indicate the sizes of the proposed elliptical pipe class IV (20LF and

216LF)

Government Response: The elliptical pipe shall be the same as coming from the road and shown on plan and the profile sheet 38”span x 24”rise. C-101C and C-203 shall be updated to show the size and class.

Bidder Inquiry 03: Dwg C-102:

a) Existing poles BT40988MDT and 216108-58450 (AKA BT40987) are to be removed by Contractor or by utility company.

b) What Option # the removal falls under. Same with the overhead utility associated with these two poles.

Government Response:

a) Pole removal is to be done by the owner, some of the poles are owned by either JCP&L or Verizon.

b) The poles fall in Option 2.

Bidder Inquiry 04: Dwg C-103: The note “Provide Cellular confinement system on both sides and on top of levee” appears to apply only to the base contract and the Option 2 areas. Please confirm.

Government Response: Concur, the cellular confinement system is on the levee which shall be constructed in Base and Option 2.

Bidder Inquiry 05: Dwg C-503, detail 4, Road Rising Cross sections: Please confirm if the existing asphalt pavement is to be removed.

Government Response: Yes, the existing pavement shall be removed. After pavement removal, the compaction of existing subgrade, placing fill, etc., should be done according to the project specifications.

Bidder Inquiry 06: Item No. 20, Option 4 – Splicing: Please point to the drawing sheet/ and details where this work is indicated.

Government Response: Field locations of pile splicing are to be coordinated with the COR during construction.

Bidder Inquiry 07: Please advise the bidders as to how the Government will be addressing the current and foreseeable volatile market conditions that are causing Force Majeure conditions for contractors who are incurring daily and weekly price increases on the types of materials and services that are major cost components for this project such as: Fuel, Trucking, Asphalt, Cement, Concrete, Steel, etc. The Government needs assure the Bidders that the Contractor for this project will be compensated for cost increases that can be documented and attributed to these unprecedented Force Majeure market conditions over which the Contractor has no control.

Government Response: The bids submitted shall be a firm fixed price bid.

Bidder Inquiry 08: Sheets C-509 and C-510 show a PZ22 Sheet Pile Cut-Off Wall under the Headwalls of Drainage Structure C3-1 & C3-4. The Cut-Off Wall details show a Tip Elevation of Minus 25 feet, which conflicts with the 10 foot depth that is also shown. Please clarify which is correct: the tip elevation or the 10’ depth.

Government Response: Sheets C-509 and C-510 have been corrected and will be issued in the upcoming Amendment 5.

Bidder Inquiry 09: Please confirm our interpretation that the costs of the Sheet Pile Cut-Off Walls are to be included in the price for Drainage Structure C3-1 and C3-4.

Government Response: Yes, the sheet pile cut off wall for the headwalls shall fall under the drainage structure. Cut off wall with levee or flood shall fall under the respective structure

Bidder Inquiry 10: Please note that the Headwalls shown on Sheet C-509 & C-510 cannot be Precast Concrete as detailed on those drawings, and these structures will need to be cast-in-place. Therefore, we request that the reference to a Precast Headwall be removed from those two drawings.

Government Response: The structures are permitted to be cast in place. The word precast in the section titles will be revised to read “concrete.”

Bidder Inquiry 11: Item 0017 - Option 1: Note stating that “This line item is NOT PRICED and is for INFORMATIONAL PURPOSES only.” Does it mean that none of the work shown on drawing C-101C and related, such as the swale excavation, headwall BA-1, manhole BA-1 among others are to be performed under this Contract? If that’s the case, it makes little sense for items 0017AA and 0017AB. Please confirm.

Government Response: All work from STA 1+20BA through STA 6+20BA is part of Option 1 of this contract. The Government will amend the bid schedule to add a CLIN 0017AC to bid on all other material and labor not included in 0017AA 0017AB required to construct from STA 29+80 through STA 37+30 and STA 0+00RR through STA 12+54RR.

Bidder Inquiry 12: In a related issue, there is a net amount blank field under option 17, does it mean that bidders have to enter an amount for this item in spite of the note cited above? This situation repeats itself through several bid items. Please clarify.

Government Response: Similar to the above response, an additional sub clin will be added to 0018 and 0019 to allow for bidding of all other material and labor not included in current sub clins.

Bidder Inquiry 13: Drawing C-101G: There is an note “End Retaining Wall” at Sta 34+15. Please provide cross sections and details of said retaining wall.

Government Response: Refer to Sheet C-205.

Bidder Inquiry 14: Soil analytics are needed for a proper characterization of the soil disposal per items 0021 and 0022. Please provide.

Government Response: CLIN 0021 and 0022 are for soil characterization found during construction which are not current captured in the boring reports.

Bidder Inquiry 15: Due to the significant and complex nature of the scope of the work on the project, the time required for contractor design of temporary works, and the time required to coordinate with specialty subcontractors and material suppliers, please provide an extension to the bid of at least three (3) weeks until May 17, 2022.

Government Response: Please see Amendment 4 extending bid opening to 16-JUN-22.

Bidder Inquiry 16: From the PDF document titled “W912DS22B0003.PDF” included in this Solicitation, please confirm that the SF 1442 (Pages 1 & 2 of 81), Section 00 10 00 (Pages 3 to 35 of 81), and Section 00 20 00 (Page 36 of 81) are “Provided by the Contracting Division” for inclusion in Section 00 10 00 of “Division 00 – Procurement and Contracting Requirements” of the “Specifications”.

Bidder Inquiry 18: The PDF document titled “W912DS22B0003.PDF” included in this Solicitation does not include a Section 00 22 10 as stated will be “Provided by the Contracting Division” for inclusion in Section 00 22 10 of “Division 00 – Procurement and Contracting Requirements” of the “Specifications”. Please confirm that Section 00 22 10 of the “Specifications” is not applicable to this Contract.

Government Response: Yes.

Please provide this specification section as it is critical to the preparation of the Contractor’s Bid.

Government Response: This Section 00 24 00 “Evaluation for Award” is intentionally not included in this solicitation as it is an Invitation for Bid (IFB) not a Best Value Trade Off (BVTO).

Bidder Inquiry 20: From the PDF document titled “W912DS22B0003.PDF” included in this Solicitation, please clarify if Section 00 70 00 (Page 44 to 70 of 81) and Section 00 73 00 (Page 71 of 81) are being “Provided by the Contracting Division” for inclusion in Section 00 72 00 of “Division 00 – Procurement and Contracting Requirements” of the “Specifications”.

Bidder Inquiry 21: From the PDF document titled “W912DS22B0003.PDF” included in this Solicitation, please clarify if Section 01 00 00 (Page 72 to 81 of 81) is being “Provided by the Contracting Division” for inclusion in Section 00 90 00 of “Division 00 – Procurement and Contracting Requirements” of the “Specifications”.

Bidder Inquiry 22: In Section 00 10 00 – Solicitation, there are no CLINs included in the Bidding Schedule for the work to be performed for Option 1 from STA 1+20BA to STA 6+20BA other than Vibration Monitoring and E & S Control. Please revise the Bidding Schedule to include the appropriate CLINs as it is critical to the preparation of the Contractor’s Bid.

Bidder Inquiry 23: In Section 00 10 00 – Solicitation, many of the CLINs required to construct Option 2 are not included in the Bidding Schedule. Please revise the Bidding Schedule to include the appropriate CLINs as it is critical to the preparation of the Contractor’s Bid.

Government Response: Similar to the above response, an additional sub clin will be added to 0018 and 0019 to allow for bidding of all other material and labor not included in current sub clins.

Bidder Inquiry 24: The NJDEP DLRP Letter included in Section 00 31 24.01 indicates “A timing restriction from March 1 through June 30 is imposed on all in water work for each given year for the protection of anadromous species”. Please advise as to what specific features of work and what specific work areas on the site are considered to be “in water” (if any).

Government Response: Any channel that is inundated during the tide cycle will be subject to that restriction. These areas are the Proposed Outlet Swale C3-1OUT, the PROPOSED TRAPEZOIDAL PUMP STATOIN OUTLET SWALE, and the PROPOSED OUTLET SWALE C3-4.

Bidder Inquiry 25: The NJDEP Permit included in Section 00 31 46 indicates that the permittee shall submit proof of purchase for 1.70 mitigation credits if it is purchasing credits from a mitigation bank to satisfy a mitigation requirement. Its appears as though this is USACE’s strategy as evidenced by Item No. 0028 for Option

12. However, the in the Bidding Schedule is 1.04 Job. Please clarify the purpose and quantity for Item No. 0028.

Government Response: CLIN 0028 - Wetland Mitigation Bank Credits, has been revised to CLIN 0029.

The quantity has also been revised to .79 credits.

Bidder Inquiry 26: Please confirm that the Contract is Tax Exempt.

Government Response: The offeror's attention is directed to FAR 52.229-3, Federal State and Local Taxes. Determination of the applicability of taxes is the offeror's responsibility, and offerors are responsible for including all applicable taxes in their proposal. After award, the Contracting Officer may be able to assist with obtaining tax exempt certificates, however, assistance with provision of a form is not an assurance that the contractor will be able to purchase materials that are tax exempt.

Bidder Inquiry 27: Rightfully so, the NAICS Code for this Solicitation is 237990 – Other Heavy and Civil Engineering Construction. However, the Wage Rates included in Section 00 90 00 (or 01 00 00) of the Specifications via the PDF document titled “W912DS22B0003.PDF” indicates the Construction Type as “Heavy Dredging” and provides Wage Rates accordingly. Heavy Dredging is not applicable to this Contract. Therefore, Wage Rates should be provided for Heavy and Civil Engineering Construction such as Dockbuilders, Crane Operators, Excavator Operators, other Heavy Equipment Operators, Ironworkers, Carpenters, Laborers, Truck Drivers, etc. Please provide the appropriate Wage Rates for this Contract.

Government Response: Wage rates NJ20210058 are to be used for this contract, this has been corrected via Amendment 0002.

Bidder Inquiry 28: In Section 01 11 00 of the Specifications, are the Calendar Day durations listed for Options 1, 2, and, 3 (194, 305, and 336 Days) in addition to or included in the 570 Calendar Days required for Completion? Please advise as to when Contract Time will start for each Option and how the overall Contract Time will be calculated with each Option if all or some of the Options are awarded by USACE.

Government Response: Calendar Days for Options 1, 2, and, 3 (194, 305, and 336 Days) are from the exercise of each Option which may or may not be included in the base 570 Calendar Days.

Bidder Inquiry 29: Section 01 11 00 indicates that “development of permit applications” is a part of the work in the Project Description. No further detail or Specification is provided for “development of permit applications”. Please provide.

Government Response: All permits (other than environmental) needed to complete the construction of this scope shall be developed by the contractor (including but not limited to road opening permit, building permit, fuel oil tank permit, etc.)

Bidder Inquiry 30: In Section 01 14 00 Work Restrictions under “Special Scheduling Requirements”, 1.3(a) is left incomplete. Please provide the proper detail for this Specification.

Government Response: Section 01 14 00 paragraph 1.3.a will be revised as follows under Amendment 0006.

“The construction of the tie-in floodwall located at station xxxx 0+00 must be completed xx 180 days from the issuance/award of Option 3.”

Bidder Inquiry 31: Please confirm that all the Piles listed in the “Pile Schedule” Table on Plan Sheet S-004 for the Floodwall, Generator Building, Fuel Storage Tank, and Pump Chamber are all to be Measured and Paid under Base Bid Item No. 0003.

Government Response: Confirmed.

Bidder Inquiry 32: Please confirm that the entirety of the Traffic Control Plan as shown on Plan Sheet G-102 may be implemented for the Base Bid work and regardless of what Options (1, 2, or 3) may or may not be awarded by

USACE.

Government Response: Traffic Control Plan will be implemented on the Base and as necessary on the options as awarded. The entire Traffic Control Plan shall be prepared by the contractor within the specified window.

Bidder Inquiry 33: Please confirm that the entirety of the Soil Erosion and Sediment Control Plan as shown on Plan Sheet C-103 may be implemented for the Base Bid work and regardless of what Options (1, 2, or 3) may or may not be awarded by USACE.

Government Response: Soil Erosion and Sediment Control Plan will be implemented on the Base and as necessary on the options as awarded. The entire Soil Erosion and Sediment Control Plan shall be prepared by the contractor within the specified window.

Bidder Inquiry 34: Please confirm that the Staging Area adjacent to Port Monmouth Road as shown on Plan Sheet C-103 is available for the Contractor’s use for the Base Bid work and regardless of what Options (1, 2, or 3) may or may not be awarded by USACE.

Government Response: Confirmed.

Bidder Inquiry 35: Please provide an Existing Conditions Plan. It is difficult to see the existing topographic lines and survey notes on the Bid Document Plans Sheets.

Government Response: Please plan sheets 144 of 154 through 154 of 154 for the topographic/utility survey sheets.

Bidder Inquiry 36: Sheet C-205 shows the Road Raising Retaining Walls having a stepped top profile, yet, there is a fence to be mounted on the sheet cap. Is the intent to have a stepped series of fence panels?

Government Response: The fence shall follow the sheet pile profile. The height of the fence shall be from the top of the sheet pile as shown in the detail. Therefore, if the sheet pile steps, the fence shall step as well

Bidder Inquiry 37: The bid proposal for this contract includes numerous Optional Bid Items that cover a significant amount of work that may or may not be awarded, and the current wording allows the Government up to 18 Months to decide if the Optional Work will be awarded. Please be advised that this approach to awarding the Optional Work is not an acceptable contracting approach and it needs to be revised. The Government needs to provide the Contractor with a go/no-go decision on the Optional Work within 30 days of making an award of the base contact so that the Contractor and its Subcontractors can properly plan and schedule the work, and so that they can secure the necessary resources to execute the work. Also, the Government needs to recognize that the current unprecedented and volatile market conditions prevent most manufacturers, suppliers, trucking companies, and subcontractors from holding or forecasting their prices for more than a month, let alone 18 months. Therefore, it is extremely important for this issue to be promptly addressed, and we request that a revised bid proposal be issued ASAP to revise the Optional Work award language accordingly.

Government Response: To continue to move forward with this project, the current time to award options will not change. Please bid on the bid schedule options based on the allowable award timeframes.

Bidder Inquiry 38: With regard to Optional Item #0028 – Wetlands Mitigation Bank Credits, the current wording allows the Government to take up to 18 Months to decide if this Optional Item will be awarded. Please be advised that it is not possible for the Contractor to obtain firm pricing at bid time from Wetland Banks that would remain firm for that 18-month period of time. Therefore, we request that one of the two following revisions be made to the bid proposal: (a) either remove this Optional Work Item from the bid proposal, or (b) make the go/no-go decision on the award of this Optional Item within 30 days of making an award of the base contract

Government Response: The time to exercise this Optional Item #0028 – Wetlands Mitigation Bank Credits has been reduced to 6 months.

Bidder Inquiry 38: Please clarify the bidding quantity for Optional Item #0028 – Wetlands Mitigation Bank Credits. The bidding quantity is shown as 1.04, but the Unit is shown as “JOB”. We assume that the Unit is supposed to be “ACRE”. Please clarify.

Government Response: The unit is not ACRE but CREDIT.

Bidder Inquiry 39: Please note that the following bid items in the bid proposal contain the following wording “This line item is NOT PRICED and is for INFORMATIONAL PURPOSES only”. We find this language to be very confusing because each one of these bid items appears to cover work that should be priced-out, and each one of these bid items has space to under the Amount Column for pricing to be provided. Please issue a revised bid proposal ASAP to correct this confusing language so that the bidders know what should be done with these bid items.

0006 – Static Compression Load Tests 0013 – Landscaping 0014 – Planting Area 0017 – Work from STA 1+20BA to STA 6+20BA 0018 – Work from STA 29+80 to STA 37+30, etc.

0019 – Work from STA 00+00 to STA 9+90 0024 – Static Tension Load Tests 0025 – Reroute Verizon 0025AB – Reroute Verizon 0026 – Reroute Comcast

0027 – Reroute JCP&L

Government Response: The following CLINs are for informational purposes only and are not separately priced: 0006, 0013, 0014, 0017, 0018, 0019, 0024, 0025, 0026, and 0027. All bids shall be placed on the respective subCLINs.

CLIN 0025AB is a separately priced line item.

Bidder Inquiry 40: Optional Item #0023 that covers Liability Insurance. Please clarify the purpose of making Liability Insurance an Optional Bid and explain why it would take the Government up to 90 days to determine whether or not the Contractor needs to provide this insurance.

Government Response: The purpose is to provide exact pricing to the Non-Federal Sponsor for their insurance. The time to exercise this option is not for determining whether or not the Contractor needs to provide this insurance, this option may be exercised, instead it is the time provided to formally exercise the option.

Bidder Inquiry 41: Specification Section 00 24 00 “Evaluation Factors For Award”, part 1.1 states “to be provided by the Contracting Division”. No further information has been provided within this section. Please indicate what these factors will be.

Government Response: There are no evaluation factors for award, this is an Invitation for Bid.

Bidder Inquiry 42: Specification Section 01 11 00 “Scope of Work” part 1, paragraph 1.1a, states that the total contract time is 570 calendar days (19 months). If the Options are selected, they can be exercised within 570 calendar days of the NTP. Options 1, 2, and 3, if chosen, could require 6, 9 and 11 months respectively in order to complete. The last sentence of this section states that no additional days shall be added to the contract duration.

a. Please clarify whether the USACE can exercise the options within 570 calendar days from NTP per paragraph 1.1a, or within 18 months of NTP per subsection 1.4.

b. Regardless of either case, please confirm that in order not to exceed the 570 calendar days for completion, that Options 1 thru 3 would need to be exercised 13, 10, and 8 months respectively from the NTP.

Government Response: The last sentence of the referenced section which read ““No additional days will be added to the contract duration period” has been deleted under Amendment 05.

a. USACE can exercise the options within 570 calendar days from NTP, subsection 1.4 will be amended to state as such.

b. Calendar Days for Options 1, 2, and 3 (194, 305, and 336 Days respectively) are from the exercise date of each Option. which may or may not be included as part of the base 570 Calendar Days. The specifications statement “no additional days shall be added to the contract duration” shall be removed in an amendment to avoid confusion.

Bidder Inquiry 43: Traffic Control Spec 01.55.26, page 5, refers to Maintenance of Traffic using either…
