3.13 ACCEPTANCE SECTIONS
3.13.1 Section Designations
Completed work on the rock reinforcement shall be accepted in 100-foot sections. The accepted sections may be backfilled to its design dune grade with sand. Dune reinforcement shall not be left exposed without backfill for lengths greater than 500-feet.
RFI SET #3:
Question 8. Sand Fence material-The Current market shows Aspen as the available wood slat Sand fencing option. Is the intent to utilize current available market products for this project?
Response: Yes.
Question 9. Please provide the specification for the “Sumac” as designated “S” on the Planting plan (page 7 of Spec 32 94 00). This species is not identified under 32 94 00 paragraph 2.1. Please advise if this item should be removed from the planting plan and indicate its substitution if this is in error.
Response: Added the following language to section 32 94 00 - Sumac (Rhus aromatic): plant size 1 quart, planted 36" off center with staggered rows, each plant planted 7"-9" deep. Each plant shall be hand planted.
All areas stated in paragraph 1.2 above and shown on planting plan attachment at the end of this section.
Planting shall occur between April 15 and June 1.
Question 10. Marine Concrete 03 31 30- Supplemental Corrosion Protection- No mention is given in plan set, please confirm that this is not to be included in cost of concrete cap?

RFI SET #4:
Question 5. Clause 52.211-12 Liquidated Damages -- Construction (SEP 2000) states that “if the contractor fails to complete the work within the time specified in the contract the contractor shall pay liquidated damages to the Government in the amount of $6,593 for the first tier for each calendar day of delay until the work is completed or accepted and of $1648 for the second tier of each calendar day of delay until the work is completed or accepted”. Please clarify what is considered first tier and what is considered second tier with regard to assignment of liquidated damages.
Response: Response: “First tier” demurrage is based upon costs incurred in administration of the contract past the completion date. This amount does not include any liquidated damages for each day of delay that would accrue to the using service from exclusion of beneficial occupancy. The “second tier” demurrage is if the contractor fails to complete documented punchlist items after the date of beneficial occupancy.
Question 6. The installation of the Core Stone and Armor stone against the new NZ14 sheetpile wall/concrete cap will require significant excavation and stockpiling of material to be used for backfill. During the armor stone installation, while the fill is stockpiled, if a storm event occurs and washes away the stockpile, will the contractor be reimbursed for importing additional fill to replenish the material that was lost?
Response: The contractor shall take all reasonable precautions to protect the excavated sand, as required by the contract. In the event that a storm is forecast that may be severe enough to cause significant loss of material, it should be predictable with enough lead time to allow the contractor to take extra steps to secure the sand – which is also required by the contract.
RFI SET #5:

What length screws should be used for the 2x6 decking boards?
Response: 2.5” screws shall be used. Specification section will be updated to match structural drawings in next Amendment package.
RFI SET #7:
Question 2. Please provide any grain size analysis that was taken on projects in the past.
Response: Information provided with this amendment.
Question 3. The specifications state that if the Options are exercised, Bid items 0013-0020 will be exercised within three years of the contract period of performance. If exercised, when does the Government anticipate Option 0019 – Hydraulic Fill taking place?
Response: Optimally it would take place right after base fill, if exercised.
Question 4. The specifications state, “No construction activities associated with this project may take place from March 21 – September 1 from Beach 6th Street to Beach 85th Street.” Please provide the beach stationing where this work restriction applies.
Response: Approximately STA 351+58 (eastern end of project area) to STA 160+00. Also note the rest of the specifications section par 01 57 19 par 3.5.1.1 1 - “Pre-construction surveys shall be undertaken in the remainder of the project area by an approved qualified biologist (on the basis of behavioral observations regarding territorial, courtship, nest building, egg laying, and brood rearing). If located, their breeding areas will be protected and no construction activities shall occur within 1,000 m of the delineated breeding area.”
Question 5. The specification state, “Proceed with the placement of the beachfill in a continuous manner along the shoreline moving generally east to west, starting at Beach 9th Street, or as directed by the COR.”
Due to the Time of Year Work Restrictions along with the December 1, 2022 completion requirement, this requirement will greatly limit the sequencing of potential dredging Contractors and will force the work to be done in less favorable weather conditions. In order to provide the best value for the Government, we would like to request that Contractors be able to define their order of work and commence in the western portion of the project if deemed beneficial.
Response: Beachfill deadline extended to March 14, 2023. Sand placement must be east to west along the shoreline, the starting point is flexible if deemed beneficial to start elsewhere.
RFI SET #8:
The following questions reference Rockaway Contract 2 Specification Section 32 94 00
Question 1. Paragraph 1.2 Area to be Vegetated, identified the Beach grass quantity of 13552 culms, however a quantity of 4840 plants without a description of if the word plants, units and/or culms. Please define and clarify if Plants refers to goldenrod, beach rose, bayberry, and beach plum, or if it is inclusive of beach grass and should be added to 13552.
Response: The numerical number presented in the spec are just a reference number of plants per acer depending on the requested spacing of the plants which ranges form 18-36 inch on center. The plant species are reference in the spec to define the plant spacing.
Question 2. Paragraph 2.1 Plant Material Cape American Beach grass quantifies 19,360 planting units per acre. Please clarify if this language is interchangeable with culms, and the term “plants” utilized in paragraph 1.2.
Response: Yes when the word plant refers to Beach grass.
Question 3. One acre in Paragraph 1.2, adding 13,552 culms with 4,840 plants, equals 18,392.
One acre in Paragraph 2.1 indicates 19,360 planting units of Only Beach grass.
Manual counting of beach grass in the “enclosed basic planting plan” as referred to in 1.2, and as shown on the last page of 32 94 00, provides a quantity of 14,794 per acre.
All bold numbers were within 32 94 00.
Please advise the intent of the quantity of beach grass on this project per acre.
Response: The intent is to plant beach grass 18 in oc. The total numbers per acer are just for reference.
Question 4. 32 94 00 Paragraph 1.2 describes species locations and refers to a planting plan. Both conflicts.
Scenario 5 plants South side:
- beachgrass Crest:
- goldenrod
- beach rose
- beach grass
North side
- beach grass
- bayberry
- beach plum
Conflict:
Planting plan shows 6 plants and introduces Sumac (also does not specify type of species), all plants appear on all sides of dune, not isolated as described above to sides of the dune.
Response: The figure is just an example of the planting scheme; plant sumac specifications were added to section 32 94 00.
Question 5. Please advise layout of crest, and layout of Northside if the intent is not the planting plan provided within spec 32 94 00. Also advise where Sumac is to be planted if the intent is not to utilize the provided planting plan. Additionally, please provide the species of Sumac.
Response: Sumac specifications added to section 32 94 00.
RFI SET #9:
Question 1. Upon review of the plans, there are cross sections that show the new reinforced dune, then the dune berm that goes out at elevation 8, approximately 240’ from the baseline depending on location.
Then there is a note at the bottom of the plan stating “ 3 FILL AREAS WHERE EXISTING GRADE IS
ABOVE THE DESIGN TEMPLATE, THOSE AREAS SHALL NOT DISTURBED. THESE AREAS SHALL
BE VERIFIED WITH SURVEY ON FIELD BY THE CONTRACTOR”. Is it up to the contractor to assume that any area after the dune crest at elevation 18 that is higher than the proposed grade that we are not going to touch it? It is not really clear with having that note, but still showing a proposed grade line that is below the existing grade line. It also makes excavation difficult to attempt to not damage any existing dune that is above the proposed grade location outside of the immediate work area. Also how are the As-builts going to be accepted? Will they be accepted based on proposed grades or based on the preliminary survey grades that were taken?
Response: Contractor to place fill between existing beach and proposed template, and not disturb sand above the proposed template. This only applies for fill, and not for the excavation required to construct the reinforced dune. After the construction of the reinforced dune, sand shall be placed to the proposed template. Refer to section 01 22 00.00 10 Price and Payment Procedures for as-builts/acceptance/payment/measurement.
Question 2. For timber pile driving the testing requirements and quantities were not specified. Is PDA testing acceptable? What quantity of piles required testing? Please advise, thank you.
Response: PDA testing is acceptable and shall be performed on 14” diameter piles supporting the ends of the truss span. Clarifying notes will be added to the structural drawings and specification section 31 62 19 will be revised to include testing requirements in the next Amendment package.
Question 3. Just received Addm #3. . please look at the files that end with .txt all look like IP Addresses?
Please advise.
Response: All the .txt files provided in Amendment 3 are XYZ survey data for the beach placement area and borrow areas. The .txt file is just easting (x), northing (y) and elevation (z) coordinates.
RFI SET #10:
Question 2. Amend 3 -Question #6- Does the response infer a separate NTP for the dredging contractor?
As opposed to the prime contractor? Please clarify?
Response: Only the prime contractor will receive NTP.
Question 3. Section 01 14 00 Work Restrictions- 1.3.1 Order of Work references “Hydraulic beachfill placement must be constructed prior to reinforced dune and crossover construction, and base hydraulic fill must be completed by December 1, 2022”. The date has changed (per Amend 3), however is the order of work mandatory. Will the USACE consider reinforced dune construction starting before Hydraulic beachfill commences?
Response: Yes, pending work plan/contractor’s schedule approvals and if contractor adheres to specification requirements, such as, but not limited to, the following specifications -
Section 31 23 00.00 20 par 1.5 c - Suitable backfill in the quantities required is not available at the project site; hydraulic fill from borrow area is needed in addition to material on site.
Section 35 31 29.40
3.13 ACCEPTANCE SECTIONS
3.13.1 Section Designations
Completed work on the rock reinforcement shall be accepted in 100-foot sections. The accepted sections may be backfilled to its design dune grade with sand. Dune reinforcement shall not be left exposed without backfill for lengths greater than 500-feet.
