RFI SET #1:
Question 1. Will the USACE please provide the XYZ survey data for the project that was used and shown in the specs packages?
Response: XYZ survey data provided.
Question 2. Paragraph 3.5.1.1 “Piping Plover, Least Tern and Red Knot” within Section 01 57 19 states the following, “No construction activities associated with this project may take place from March 21 - September 1 from Beach 6th St to Beach 85th St. Pre-construction surveys shall be undertaken in the remainder of the project area by an approved qualified biologist (on the basis of behavioral observations regarding territorial, courtship, nest building, egg laying, and brood rearing).”
a. Can the USACE please clarify if this environmental window applies to the dredging Contractor? Will the dredging Contractor not be able to perform beach fill operations between Beach 6th Street and Beach 85th Street from March 21st to September 1st?
Response: That is correct, the environmental window applies to the dredging contractor. Work cannot be performed in this area from March 21st to September 1st.
Question 3. Paragraph 1.7 “CONNECTION WITH WORK OF OTHER CONTRACTS” states the following, “During the period of this contract, other contracts may be in force for the construction of other features of work on or adjacent to the site of work being accomplished under this contract. The Contractor must arrange his plant and must schedule and perform the work as to effectively cooperate with all other contractors and Government agencies.”
a. Are there any other Contractors or Projects, other than Rockaway Contract 1 groin construction, scheduled to work or currently working on or adjacent to the project site?
Response: The USACE has only Rockaway Contract 1 groin construction project on the project site.
Question 4. Paragraph 3.4.1 “Construction Monitoring” of spec section 01 57 19 states, “The Contractor shall provide a qualified archaeologist(s) to monitor construction in areas to be discussed with Corps Archaeologist for items that might have historical, archaeological, or cultural value.” However, Paragraph
3.4.3 “Preservation and Recovery of Archaeological Resources” of the same spec section states, “The Corps will provide a qualified archaeologist, who meets the standards of 36 CFR Part 61 (Appendix A) to monitor excavations.”
a. Can the USACE please clarify if Archaeological monitoring will be the Contractor’s responsibility or if it will be provided by the USACE?
Response: Part of Paragraph 3.4.3 “Preservation and Recovery of Archaeological Resources” was revised to state “Monitoring will be required where soil will require excavation prior to the placement of the reinforced dune stones. Placement of other stones that do not require the earth beneath to be excavated or disturbed will not require monitoring. The contractor will provide a qualified archaeologist, who meets the standards of 36 CFR Part 61 (Appendix A) to monitor excavations.”
Question 5. Paragraph 1.7.k within Section 31 24 00.00 18 “Beach Fill Placement” states the following, “New York State Water Quality Certificate. The contractor shall comply with all requirements identified in the NYSDEC Water Quality Certificate (WQC) and NYC dredge permit including all special conditions. A copy of the WQC is included in Section 00 90 02 of this specification.”
a. Can the USACE please provide the NYC Dredge Permit or clarify if obtaining this is the responsibility of the Contractor?
Response: The USACE will be responsible for getting the WQC and are in the process of obtaining it from
NYSDEC.
Question 6. Can the USACE please clarify when the potential dredging Contractor would receive Notice to Proceed?
Response: Estimated about 15 days after award, which is based on sufficient performance and payment bonds being submitted.
Question 7. Can the USACE provide appropriate plan layouts of the groins being constructed or extended in Rockaway Contract 1?
Response: All proposed groins from Rockaway contract 1 groin construction are shown on G-101 for situational awareness. Contract 1 plans will be provided for situational awareness.
RFI SET #2:
Question 4. On the plans, the type A stone is shown to be 3-5 ton, but in the specs, the range is 3-7.5 tons.
Which is correct?
Response: 3-5 ton is correct. Section 35 31 29.40 par 2.3.1 gradation requirements for armor stone was revised and note to use Upper 25% weight at toe was removed.
TYPE A ARMOR STONE
Weight(tons, short) Percent Lighter by Weight 5 100 4 50 3 0
Question 5. On the plans, it calls for a 6" treated gravel bed. Is this the same stone that's called "base course stone" in spec section 35 31 29.40 2.3.3?
Response: Yes.
Question 8. Considering the volatility of the global steel market, and the quantity and value of steel required under the contract, will the Government consider including an Economic Price Adjustment Clause (FAR 52.216-2 or similar) into the contract as prescribed by FAR 16.203?
Response: This is an invitation for bid therefore FAR 52.216-2 is not applicable.
Question 10. Can the construction of the dune reinforcement structure begin when a portion of the dredging is completed?
Response: Yes.
Question 11. Can the dredge window be extended until March 9 of 2023?
Response: Beachfill deadline extended to March 14, 2023.
Question 12. Section 01 14 00 1.3.1 states "There shall be no work/access restriction between Memorial Day and Labor Day..." No work restriction would mean that contractors are allowed to work during that time.
Is this correct?
Response: No, first sentence was revised in section 01 14 00 par 1.3.1. There is no work and no access during the time specified and in the specified area, unless coordinated with the COR.
RFI SET #3:
Question 1. Section 01 14 00 – 1.2.2 states that dredging can be performed 24 hours a day including Sundays and Government holidays. Later in the same section, (1.3.1) the specifications state that environmental restrictions apply to all dredging work. These two sections appear to contradict one another. Would you please clarify what restrictions, if any, apply to the dredging operations?
Response: Environmental restrictions apply to all construction operations, including dredging.
Question 2. The Contract 1 Construction Schedule provided in Section 01 14 00 shows Groins W9 and W10 being constructed from 08-Feb-23 to 11-Jul-23. Part of this work is taking place within the ‘no work’ restriction between Labor Day and Memorial Day. Please confirm that the Contractor for Contract 1 is exempt from this restriction.
Response: Contract 1 is not exempt; schedule for Contract 1 was provided for information only and is subject to change.
Question 3. The Contract 1 Construction Schedule provided in Section 01 14 00 shows Groins E1 and ER2 being constructed from 05-Oct-23 to 16-Apr-24. Part of this work is taking place within the ‘no work’ environmental restriction between March 21st and September 1st. Please confirm that the Contractor for Contract 1 is exempt from this restriction.
Response: Contract 1 is not exempt; schedule for Contract 1 was provided for information only and is subject to change.
Question 4. The Contract 1 Construction Schedule provided in Section 01 14 00 shows Groin W8 being constructed from 14-Mar-24 to 30-Jul-24.
Question 5. Have any existing Seabeach Amaranth been identified in the project work area? If so, can this information be provided to the Contractor prior to bid submission?
Response: Yes, it was between Beach 60th and 40th streets; it is called out on sheets C-126 to C-128, but it could show up in other places also.
Question 6. In the Introduction to the Biological Opinion, reference is made to re-initiation of the formal consultation if the project has changed from the 15% to 30% design. Is there any plan/need to perform a re-initiation?
Response: At this point in time we don’t see any need to re-initiate. The Biological Opinion is a reference document for section 01 57 19.
Question 7. Within the Biological Opinion, reference is made to no-dredge/work restriction for piping plover from April 1 to September 1 from Beach 19th Street to Beach 70th Street. Specification section 01 14 00 states that dredging can be performed 24 hours a day including Sundays and Government holidays. Which direction takes precedence?
Response: The actual plover window is March 21st through September 1st, which is in the WQC. Refer to specification section 01 57 19 paragraph 3.5.1.1 for piping plover, least tern and red knot environmental restrictions.
RFI SET #4:
Question 1. Specification Section 32 94 00 Part 2.1 Plant Material references 1 quart 36” length plants. 36” length plants are not compatible with 1 quart containers. Please specify which is preferred, 36” length or 1 quart containers?
Response: Quart size is the correct reference.
Question 2. Item No. 0002AG – Removal & Disposal of Timber Piles in the solicitation indicates a unit of measure of 400 “short ton”. Specification section 01 22 00.00 10 “Price and Payment Procedures, section
1.3.7.2 on page 7 indicates a unit of measure of “Cubic yard”. Which is correct? Where on the project is the removal of timber piles required?
Response: Short ton; section 01 22 00.00 10 par 1.3.7.2 revised unit of measure to short ton. C-507, note 5 states “GROINS LOCATED EAST OF BEACH 32ND ST. SHALL BE REMOVED. EXACT LOCATIONS
SHALL BE FIELD DETERMINED AND AS APPROVED BY THE COR.”
Question 3. Does Item No. 0002AG include the removal of the 11 timber groins located on the west end of the project between Beach 147th and Beach 132nd?
Response: No, it does not include the removal of the 11 timber groins in the west end of the project.
RFI SET #5:
Question 2. Is it possible to consider CCA treatment of timber material in lieu of AZCA as specified? Please advise, thank you.
Response: No CCA treatment. AZCA has been deemed acceptable by NYSDEC without the need for the additional cleaning process during construction.
RFI SET #6:
Question 1. Schedule of Rockaway 1 Contract per 01 14 00 page 4, please provide a location for each of these groins shown on the schedule, additionally the completion dates of the groins are after the base hydraulic fill completion of 12/1/22 as per 1.3.1. Is it the intention to have beach fill completed before the groins of Contract 1 are finished ?
Response: Yes.
Question 2. Environmental restrictions windows are mentioned in a few different places throughout the contract, can a comprehensive schedule of work restrictions be provided on one sheet to insure we have them all ?
Response: Section 01 57 19 and Water Quality Certificate.
Question 9. We request an extension of 5 days to the bid date till October 1, 2021.
Response: Bid opening is postponed to October 12, 2021.

PAID HOLIDAYS: New Year's Day, Presidents' Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Election Day, Veterans' Day (Armistice Day), Thanksgiving Day, Day after Thanksgiving and Christmas Day. Employees working two (2) days in the calendar week in which a holiday falls are to be paid for such holiday, provided that they shape each remaining workday during such calendar week.
WELDERS - Receive rate prescribed for craft performing operation to which welding is incidental.
Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to
Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the
EO
is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers.
indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.

HOPPER DREDGE CONSTRUCTION PROJECTS
Note: Under Executive Order (EO) 13658, an hourly minimum of $10.95 for calendar year 2021 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015.
If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.95 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2021. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate, if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60).
Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
