NOTES

AMENDMENT 0001

1-Section 00 73 00 Insert in its entirety the following in paragraph 15:

Printers: Contractor shall provide two (2) wireless/wired all-in-one color laser with printers, copier, scanner capable of producing pdf files, 2-sided duplex, ADF, fax with air print capability.

Provide copy paper and toner cartridges as needed.

2-Section 00 73 00

a. Delete the following in paragraph 34:

Normal Contractor working hours shall be 7:00 A.M. to 4:00 P.M., Monday thru Friday.

b. Replace in its entirety in paragraph 34 with the following:

Normal Contractor working hours shall be 8:00 A.M. to 4:30 P.M., Monday through Friday.

3-Section 00 73 00 Delete paragraph 36 in its entirety and replace in its entirety with the following:

36. INSURANCE PROCURED BY CONTRACTOR

a. The Contractor shall procure and maintain during the entire period of this performance under this Contract the attached insurance policies:

(1) Commercial General Liability Insurance in limits of not less than Five Million Dollars ($5,000,000) combined single limit per occurrence for bodily injury, death, personal injury and property damage, including but not limited to coverage for Broad Form Property Damage.

Such coverage shall not contain any environmental exclusion clause and there shall be no exclusions for property damage arising out of explosion, collapse or underground property damage hazards and no exclusion for waterfront activities.

(2) The policies described above shall be endorsed (i) to include the Borough of Middlesex, Middlesex County, and the State of New Jersey Department of Environmental Protection as additional insured and (ii) to provide that notice of an occurrence to the insurance company from any insured shall serve as notice from all insured.

(3) Comprehensive Automobile Liability Insurance in limits of not less than five million dollars combined single limit per occurrence for bodily injury, death, and property damage covering all owned, non-owned and hired vehicles in connection with the work to be performed in connection with this permit.

(4) Certificates of Insurance evidencing the issuance of all insurance required hereby, and guaranteeing at least thirty (30) days prior notice to the Government of cancellation or non-renewal, shall be delivered to the New Jersey Department of Environmental Protection, Middlesex County, and Borough of Middlesex, prior to entry of the Government's contractors upon the project area, or, in the case of new or renewal policies replacing any policies expiring during the period, no later than thirty (30) days before the expiration dates of such expiring policies.

b. Prior to the commencement of work hereunder, the Contractor shall furnish to the Contracting Officer a certificate or statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interests of the Government in such insurance shall not be effective for such a period as may be prescribed by the laws of the State in which this Contract is to be performed and in no event less than thirty (30) days after written notice thereof to the Contracting Officer.

c. The Contractor agrees to insert the substances of this clause, including paragraph c., in all subcontracts hereunder.

d. Payment items for insurance premium procured by the Contractor under this paragraph shall be for actual expenses at a price not to exceed the maximum listed in the Price/Bid schedule, CLIN 0005, Liability Insurance, as substantiated by the information provided by the Contractors insurance carrier.

Contractor shall submit the following items to the government for payment and verification and only the actual amount will be reimbursed:

1-Insurance Policies.

2-Certification of insurance.

3-Proof of payments.

Payment for the insurance procured by the Contractor under this paragraph shall be in lump sum, "Liability Insurance" (see notes in Bidding Schedule).

4-Section 00 73 00 Delete paragraph 45 in its entirety and replace in its entirety with the following:

Contractor to provide a License Land Surveyor to establish conversion for project reference (NAD27/NGVD 29) to NAD 83/NAVD 88. Conversion shall be indicated on as-builts and in accordance with EM 1110-2-6056 Standards and Procedures for Referencing Project Elevation Grades to Nationwide Vertical Datums. This shall be completed within 30 days of NTP and submit the following, four (4) hard copies of full size, two (2) hard copies of half sized drawings and four (4) copies on digital media format (CD, DVD or usb drive). All future submittals and as-builts with be in NAD83/NAVD 88.

5-Section 00 73 00 Insert paragraph 46 in its entirety:

46. CONTRACTOR FURNISHED MOTOR VEHICLES: The Contractor shall supply two (2) operational motor vehicles to the Government staff for official use. The vehicles shall be utility vehicle type, seven-passenger with 4-wheel drive, no more than three (3) years old. Insurance, registration, fuel and maintenance of the vehicle including State Inspections shall be the contractor’s responsibility.

6-Section 00 90 02 Insert Engineer Manual EM 1110-2-6056 Standards and Procedures for Referencing Project Elevation Grades to Nationwide Vertical Datums in its entirety.

2) DRAWINGS:

1-Drawings have been amended and reissued C-101, C-102, C-104, C-501, C-503, S-101, S-709, SF-801, SF-804, SF-806, SF-807, SF-808.

3) QUESTIONS AND ANSWERS

(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.)

Bullet 1: I noticed the excavation spec does not take any contaminated/hazardous material into consideration for disposal. I don’t see any prior analytical testing being done and there appears to be no soils report. How are we to price this material? Will it be an unforeseen condition that will be paid for through a change order? How can we include this in our bid without a provision or allowance? We would have to assume a worst case scenario, which would greatly increase the price. Please advise.

Bullet 2: Drawing B-103 states that an HTRW sample was taken based on a gas odor and a visible sheen in the soil. Specification Section 31 00 00, Earthwork, states that subsoil investigation report and samples of materials taken from subsurface investigations may be examined at URS Geotechnical and HTRW Investigation for Green Brook Flood Risk Management Project dated December 5, 2012.” This report is not readily apparent in the existing bid documents. Offeror respectfully requests access to the URS Geotechnical and HTRW Investigation dated December 5, 2012.

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198‐005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non‐union rates. Example: SULA2012‐007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG‐OH‐0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis‐Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
