AMENDMENT 0009 to DRAWINGS and SPECIFICATIONS for Long Beach Costal Storm Risk Management Project Contract 1

TO OFFORERS

The following changes shall be made to the drawings and specifications.

DRAWINGS

1. The following DRAWINGS have been REVISED but NOT REISSUED:

- For new groins A and B, the excavation quantities are based on the 2014 beachfill line as shown on the drawings. For new groins C and D, excavation quantities are based on the 2013 existing grade line shown on the drawings. This is noted on the plan sheets.

2. The following DRAWINGS have been REVISED and REISSUED:

- G-002

3. The following DRAWINGS have been ADDED:

- NONE

SPECIFICATIONS:

1. The following SPECIFICATION SECTIONS have been ADDED and are provided in their entirety herein:

- NONE

2. The following SPECIFICATIONS SECTIONS have been EDITED in specific sections:

- Spec Section 35 31 29.40, page 1, delete "ASTM D5420 (2010) Impact Resistance of Flat, Rigid Plastic

Specimen by Means of a Strike Impacted by a Falling Weight (Gardner Impact)" and replace with "ASTM

D5240 (2004) Standard Test Method for Testing Rock Slabs to Evaluate Soundness of Riprap by Use of Sodium Sulfate or Magnesium Sulfate"

- Spec Section 35 31 29.40, page 6, Table 1, Change “ASTM D5420” to “ASTM D5240”

BIDDER’S QUESTIONS AND GOVERNMENT REPLY

(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.)

Question # 1) Sheet CS-101, CS-102, CS-103, CS-104 – Reach 1, Plan and Profiles for Groins A through D.

The excavation limits shown are based on the “existing grade” contours. If the beachfill has been constructed, then the limits of excavation should be revised to allow for the required slope. If the excavation slopes are eroded due to incoming tides, will these backfill quantities be paid for?

Answer # 1) Excavation limits for Groins A and B on sheets CS-101, CS-102, CS-301, and CS-302 will be revised to show excavation to the “beachfill” line, reflecting beachfill that was placed in Spring 2014. Actual beach profile may vary at the time of construction. The amount of back fill material available is limited to the required excavation limits per actual beach conditions. No additional back fill material will be imported or paid for. The contractor is advised/required to protect the excavated sand by stockpiling it away from tidal influence (reference note 2 on sheets CS-101 through CS-104). Additionally, the contractor is also responsible for coordinating and protecting the on-going construction work in such manner to minimize impacts by weather as well as tidal actions. Please refer to spec sections 012200.0018 (Measurement and Payment), paragraph 1.3.2 (Excavation for New Groins, Groin Rehabilitation and Revetment Rehabilitation, Foundations, Backfill & Beach fill), and 353129.40 (Stone Construction), paragraph 3.14 (Excavation) for additional details.

Question # 2) The 6" tolerance/ deviation line is not shown on ALL sections for new and rehabilitated groins.

Clarify if the 6" tolerance applies to the entire groin trunk and head, or if the drawings accurately reflect the design intent. i.e. Does Specification Section 35 31 29.40 Part 3.13 OR Drawings prevail with respect to allowable deviance?

Answer # 2) Drawings have been corrected to show 6" tolerance on all groin head and trunk sections. Drawings and specifications are now in agreement.

Question # 3) In Groin profiles and sections, does SOLID LINE underneath dashed "existing grade" line specifically indicate EXCAVATION is required? If the actual conditions differ from those as shown in the bid drawings, must contractor excavate and place underlaying stone (bedding stone, core stone), or may armor stone be placed directly on existing grade, such that armor crest widths and slopes can still be met without excavating or placing underlaying stone? Profiles and cross sections are unclear.

Answer # 3) For new groins A-D, excavation is required to the bottom elevation of the bedding stone as shown in groin and profile sections. For Rehabbed groins, solid line underneath the dashed "existing grade" line indicates excavation or stone removal is required. For rehabbed groins, armor stone may be placed directly on existing stone provided armor stone can be well-seated and interlocked with adjacent stone per 35 31 29.40 paragraph 3.11, as well as achieving final grade.

Question # 4) Specification Section 31 05 22 3.2.1 States: "Place the geotextile in the manner and at the locations shown." However, Geotextile is not shown in Profile or Sections, except at Groin 58. Is Geotextile expected to be placed at all groins, new construction and rehabilitation, or only at Groin 58, as shown on drawings? Please clarify the intent.

Answer # 4) Geotextile is used only under the Groin 58 Revetment. See Sheet S-101, parapet wall section.

Question # 5) For Reach 1 - Point Lookout, Profiles show beachfill as having been placed in Spring 2014, but also show an "Existing Grade" line. What is the current existing condition to be considered for quantity verification of excavation/removal?

Answer # 5) Excavation quantities shown in the bid schedule were calculated based on maximum conditions.

Excavation for groins A&B is based on Spring 2014 conditions, following placement of beachfill. Excavation for

Groins C & D is based on the "existing grade" line which was surveyed in 2013. Actual conditions at the time of construction may vary.

Question # 6) To further clarify the Answer to Question 8 of Amendment No. 0005, is it correct to assume that Bid Item No.'s CLIN0002AA, CLIN0003AA, and CLIN0008AA are the quantities THEMSELVES required to be excavated and that 50% of THOSE numbers are available for reuse?

Answer # 6) Correct.

Question # 7) Current union contract rates do not match rates listed in Amendment No. 0004. Please clarify.

Answer # 7) The relevant Wage Decision is published by the US Department of Labor, the proponent for establishing rates applicable for federal procurement.

Question # 8) Refer to Amendment 0007, Question 7 “RFI #7: Question: Please refer to Drawing CS-301 for Reach 1. The cross section provided for STA 2+50 shows an unlabeled layer of material between the existing grade and the proposed 2’ thick layer of bedding stone, is this layer additional bedding stone or sand fill?

Answer #7: Plan sheet will be adjusted to show filling with bedding stone down to existing grade.”

Answer # 8) This answer has been modified as follows: It is anticipated that sand lies below the bedding layer on STA 2+50 due to beachfill placed in Spring 2014. No material will be needed below the 2 ft thick bedding layer.

Please see drawing CS-301 from Amendment 0008.

Question # 9) Specification 35 31 29.40 page 5, 2.2.1 Quality, Amendment 0007 Answer #17 stipulates that new stone must comply with Table 1 Stone Test Requirements as well as with Section 35 31 29.40 paragraph 2.2.1 Quality and Paragraph 2.3 Stone Classification. Answer #28 Limestone materials do not meet project specification.

Amendment 003 – Answer #3 – Stone may be acceptable as long as it meets the criteria per the specifications. The question was for sedimentary stone use on the project.

There is a conflict (3 different answers) in the response to the stone quality question. Please confirm the response that applies to this project.

Answer # 9) Spec section 35 31 29.40, Paragraph 2.2.1 Quality States: “Each stone accepted for use in the groins shall be composed of hard, sound, dense, strong rock of crystalline igneous or metamorphic origin (i.e. not sedimentary) which shall be separated from bedrock by quarrying…” Sedimentary stone is not acceptable for this project as it does not meet project specifications.

Question # 10) Included in Amendment 7, in the RFI responses, is the following:

Question # 28) SECTION 35 31 29.40: STONE CONSTRUCTION, Section 2.2.1 Quality. As our quarry is a limestone quarry, the above section would disqualify us from this contract. The gentlemen that contacted us about this bid/contract stated that as long as the stone passes the labs tests, that would supersede the part above in the spec about not being able to use sedimentary stone? Can you please advise on this being true or not.

Answer # 28) The proposed materials do not meet project specifications.

An earlier RFI answer to a question about stone quality from Amendment 3 states:

Question # 3) Specification 35 31 29.40 page 5, subpart 2.2.1 Quality: Is sedimentary stone acceptable for use in this project? Based on conversations with the local stone suppliers, we understand that sedimentary stone has been approved by the Government on similar groin projects close to this project location.

Answer # 3) Stone may be acceptable as long as it meets the criteria as per the specifications.

The implication of RFI #3 in Amendment 3 is that stone is not excluded simply by its origin, but that it will/can be approved (indeed has been approved in the past) if it meets the testing and performance criteria. RFI #28 in Amendment 7 contradicts this. Please clarify the intent of the stone quality specification and of the RFIs relating to it.

Answer # 10) The answer to this question is address in RFI #9 above.

Answer # 11) Amendment 0007 Answer #10 – indicates a new bid schedule to be issued. Please provide the revised bid schedule (it was missing from the Amendment 0007 documents).

Answer # 11) The bid schedule referenced in Amendment 0007 was issued earlier, in Amendment 0005. The bid schedule has not changed since Amendment 0005.

Answer # 12) In the stone specification section for the Long Beach Project the testing requirements state using Method ASTM 5420 for Sulfate Soundness. ASTM C 88 is an alternate test method for this test. Will ASTM C 88 results be sufficient to satisfy the Corps requirements for Sulfate Soundness?

Answer # 12) ASTM D5240 is the required test method. Note that there is a typographical error in 35 31 29.40 to be corrected as follows: 35 31 29.40 page 1: Delete "ASTM D5420 (2010) Impact Resistance of Flat, Rigid Plastic Specimen by Means of a Strike Impacted by a Falling Weight (Gardner Impact)". Replace with "ASTM D5240 (2004) Standard Test Method for Testing Rock Slaps to Evaluate Soundness of Riprap by Use of Sodium Sulfate or Magnesium Sulfate".

Answer # 13) Union Rates provided in Addendum 8 still conflict with current union rates. For example, wage rates for Engineers are dated "06/01/2013". Please clarify.

Answer # 13) The relevant Wage Decision is published by the US Department of Labor, the proponent for establishing rates applicable for federal procurement.

Answer # 14) Packing density of core stone will be much denser (i.e. less void space) than armor stone, yet the coefficient ("cubic feet of volume per ton including compensation for voids") for calculating the core stone is the same value (18.12) as the armor stone. Please clarify.

Answer # 14) Percent voids given in 35 31 29.40 Section 2.4.1 are in accordance with COE design guidance, which suggests percentage of voids of 37-38% for armor stone and graded riprap. As listed in 35 31 29.40 Section 2.4.1, percent voids used for this contract are 33% (armor stone, underlayer stone, and core stone), and 20% (bedding stone), based on COE guidance and field experience.

Answer # 15) Section 2.4.1.1, "Revision of Bidding Schedule Quantities" of Specification 35 31 29.40 references Section 00700 "Contract Clauses", however is not provided as a part of the bid documents. Amendment 8, Question 1 answers this question, referring to Contract Clause 52.211-18 of Section 00 72 00 Contract Clauses, but is still not provided. Is specification section 00700 "Contract Clauses" available for review?

Answer # 15) Section 00 72 00 – CONTRACT CLAUSES has been provided in the original solicitation.

Answer # 16) Sheet CS-301, STA 2+50 on Sheet Reference CS-301 of the contract documents changed in Amendment 007. Amendment 008 omitted this change. Was changing STA 2+50 on sheet Reference CS-301 back to the original pre-amendment 007 design intentional?

Answer # 16) Correct. Station 2+50 on Sheet Reference Number CS-301 has been changed back to a 2' thick bedding layer, based on the assumption that actual grade at time of construction will fall between the "existing grade" and "beach fill" lines on the cross-section.

Answer # 17) Sheet G-002 (Amendment 0008), Silt Fence Piping Plover Chick Barrier Details. Is it your intention to have silt fencing installed completely around Groin 58 extending into the water on the East Side as shown by the dashed line on the drawing? Note 2 indicates 12-1/2 gauge woven wire and the Section View indicates 14-1/2 gauge woven wire. Please clarify what size silt fencing is required.

Answer # 17) Piping plover chick barrier should be placed on the west side of the terminal groin (58) year round work area, extending to Mean Lower Low Water. Use 12 -1/2 gauge woven wire. Sheet G-002 has been updated and attached in this amendment.

WELDERS ‐ Receive rate prescribed for craft performing operation to which welding is incidental.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198‐005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non‐union rates. Example: SULA2012‐007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG‐OH‐0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis‐Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations

Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
