BIDDER’S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.)
Question # 1) Specification: 35 31 29.40 page 9 subpart 2.4.1.1-VARIATION IN ESTIMATED
QUANTITIES IN SECTION 007700 CONTRACT CLAUSES.
Please provide Section 007700 since this was not provided in the bid documents.
Answer # 1) Please see Section 00 72 00 – CONTRACT CLAUSES, CLAUSES INCORPORATED BY
REFERENCE.
Specification 35 31 29.40 Subpart 2.4.1.1 will be corrected to read:
“…variation in estimated quantity, for payment purposes, will be determined as defined in Contract Clause 52.211-18, VARIATIONS IN ESTIMATED QUANTITIES, in Section 00 72 00 CONTRACT
CLAUSES.
Question # 2) Please advise on the numbering and exact quantity of groin that need to be rehabilitated.
The specification indicates different Groin locations to be rehabilitated which are not on the drawings.
Specifications indicate Groin 24, 26, 28, 45, 48 are to be rehabilitated; however the drawings indicate NO rehabilitation. The drawings indicate rehabilitation of 30, 32, 39, and 43 which are not listed in the specifications list to be rehabilitated. Lastly, drawing G-102 doesn’t provide numbering of the groins.
Answer # 2) Groins to be rehabilitated/not rehabilitated in the City of Long Beach are:
24 – Nevada Blvd NO REHAB 25 – Georgia Blvd Rehab 26 – Maryland Blvd NO REHAB 27 – Tennessee Blvd Rehab 28 – Wyoming Blvd NO REHAB 29 – Arizona Blvd Rehab 30 - New York Blvd Rehab 32 - Grand Blvd Rehab 33 - Lindell Blvd NO REHAB 34 -Washington Blvd Rehab 35 - Lafayette Blvd Rehab 36 - Laurelton Blvd Rehab 37 - Magnolia Blvd NO REHAB 38 - National Blvd Rehab 39 - Edwards Blvd Rehab
40 - Riverside Blvd Rehab 41 -Long Beach Blvd NO REHAB 42 - Monroe Blvd Rehab 43 - Lincoln Blvd Rehab 44 - Franklin Blvd Rehab 45 - Neptune Blvd NO REHAB 47 - Roosevelt Blvd Rehab 48 - Pacific Blvd NO REHAB
Specification 35 31 29.40 page 1, subpart 1.1 will be revised to read:
“-rehabilitate fifteen (15) groins in the City of Long Beach (Groins 25, 27, 29, 30, 32, 34, 35, 36, 38, 39, 40, 42, 43, 44, and 47)”
Drawings correctly indicate rehabilitation of 30, 32, 39 and 40.
Question # 3) Specification Section 35 31 29.40, Paragraph 2.4.1 gives the factors used to calculate stone quantities. The stone SSD used is 2.73, which yields 174.72 pcf when water is assumed at 64 pounds per cubic foot. Paragraph 2.4.1.1 goes on to describe how the bid quantities will be modified by the percentage by which this differs from the SSD of the actual stone used. Specification 01 22 00.00 10, Paragraph 1.3.3.2.a states that stone will be measured by the ton (2000 lbs) as determined by certified weight scale. However, Paragraph 1.3.3.2.b states that stone will only be paid for at 165 pcf. Therefore, if the contractor supplies 175 pcf stone, they will only be paid for 94.3% of the material used. Please clarify the reasoning and intent of the shorted pay rate even though all other calculations are based on an SSD of ~175 pcf.
Answer # 3) Table in Specification Section 35 31 29.40, Paragraph 2.4.1 has been updated as follows:
STONE
MATERIALS
BULK
SPECIFIC
GRAVITY
(SSD)
PERCENT
VOIDS
CUBIC FEET OF VOLUME PER TON
INCLUDING COMPENSATION FOR VOIDS
(For Excess Quantity Calculations)
Armor Stone 2.58 33 18.12 Underlayer Stone
2.58 33 18.12
Core Stone 2.58 33 18.12 Bedding Stone 2.58 20 15.15
Question # 4) Stone testing: Subpart 3.2 of Section 35 31 29.40: Can the contractor assume that all existing rehab stone is the same material type and one test will suffice? Will more than one test of the existing stone be required, or will one test per Groin be required?
Answer # 4) Specification 35 31 29.40, paragraph 3.2 will be revised to clarify testing requirements for removed stone. Laboratory testing listed in Table 1 in Spec Section 35 31 29.40 for removed stone will not be required. Other requirements of section 35 31 29.40 will apply for removed stone to be reused.
Question # 5) Specification 35 31 29.40, page 10, subpart 3.2 Stone Removal for Reuse or Disposal, 35 31 29.40 page 4, subpart 2.1.2 Sampling, Testing and Acceptance of Stones: Please confirm that the sampling and testing methods described in subpart 2.1.2 are the only testing requirements for subpart 3.2 testing criteria needed for acceptance.
Answer # 5) Specification section 35 31 29.40 paragraph 3.2 will be revised to clarify testing requirements for removed and reused stone. Laboratory tests listed in Table 1, Paragraph 2.2.1 are not required for removed stone. Other requirements given in section 35 31 29.40 will apply to removed stone prior to its reuse.
Question # 6) Specification: 35 31 29.40, page 10, subpart 3.2 Stone Removal for Reuse or Disposal 35 21 29.40 page 4, subpart 2.1.2 Sampling, Testing and Acceptance of Stone.
Please confirm that the sampling and testing methods described in subpart 2.1.2 are the only testing requirements for subpart 3.2 testing criteria needed for acceptance.
Answer # 6) Laboratory tests listed in Table 1 in Specification 35 31 29.40 are not required for removed stone. Other requirements given in Section 35 31 29.40 will apply to removed stone prior to its reuse.
Question # 7) Please refer to Drawing CS-301 for Reach 1. The cross section provided for STA 2+50 shows an unlabeled layer of material between the existing grade and the proposed 2’ thick layer of bedding stone, is this layer additional bedding stone or sand fill?
Answer # 7) Plan sheet will be adjusted in Amendment 0007, to show filling with bedding stone down to existing grade.
Question # 8) Please provide a detail for an acceptable barrier for excluding piping plover chicks as required by the NYSDEC permit Item 6 for the work at the Terminal Groin in Reach 1.
Answer # 8) Silt fencing can be used. A detail is provided in Amendment 0007 on sheet G-0002.
Question # 9) General Note 12 on Drawings G-003 for Reach 1 and G-002 for Reach 2 states, “BEACH FILL WILL BE PLACED UNDER A SEPARATE CONTRACT.” Specification Section 35 31 29.40 Part
3.14 states that excavated material that meets the beachfill requirements can be used as beachfill but that payment will not be made for the fill if particles greater than 1.5” in diameter are not removed from the excavated material first. There is not beachfill item in this solicitation, please clarify if we are to include the cost of spreading excess suitable material from excavations in the beach template.
Answer # 9) Spec section has been revised and reissued in Amendment 0007.
Question # 10) There is a large discrepancy in the bid quantities and our takeoff for items 0003AF Core Stone and 0003AG Bedding Stone. Please confirm that there is no bedding stone used in the Groin 58 Rehab as shown on Drawings CS-107 and CS-307 for Reach 1.
Answer # 10) There is no bedding stone used in the Groin 58 rehab. Quantities have been updated and the bid schedule will be reissued. Sheets CS-107 and CS-307 have been revised and reissued in Amendment 0007.
Question # 11) Drawing CS-108 for Reach 1 shows that the proposed concrete retaining begins at STA 0+00R and ends at STA 5+70R+/-. Drawing CS-308 for Reach 1 has a cross section labeled STA 5+80R which shows the concrete retaining wall. Please clarify the limits of the concrete retaining wall.
Answer # 11) The limits of the concrete retaining wall are 0+00R to 5+70R +/-. The cross section on CS- 108 will be revised from 5+80R to station 5+65R. Sheet CS-108 will be reissued in Amendment 0007.
Question # 12) Specification: New York Department of Environmental Conservation Permit page 3 of 8 Section 5 Activity Window, indicates no on-beach activities are allowed in the area between Groin 52 and 56 between April 1 and August 31 of each year.
a. Subpart 3.9.1.1 of Section 01 57 20.00 10 indicates work may proceed or resume if no piping plovers have been observed for two weeks following an observation or if no breeding behavior is observed by July 15. Will the New York Dept of Environmental Conservation Permit allow on-beach activities if no breeding behavior is observed after July 15th?
Answer: Yes, if there is no plover activity in the area and upon confirmation with NYSDEC.
b. Drawing G-002, note 16, indicates no equipment on the beach is allowed in Reach 1 April 1 to August 31. Does this note override the permit wording (above) which may allow for a shorter no work time frame?
Answer: Please see revised plans in Amendment 0007.
c. There is no Groin 52 shown, should this be Groin 58? Please confirm.
Answer: No. Groin 52 is to the west at approximately E1,085,650. It is an existing groin on the beach. Attached in Amendment 0007 is a google earth map with the approximate locations of Groins 52, 53, 54, and 55.
Question # 13) Note 17 on Sheet G-002 in the Reach 1 plan set states that a "maximum 1000 feet beach closure per structure" is allowed during construction. Please clarify in light of the following:
a) Are multiple structures permitted to be under construction simultaneously, as long as they are contained within a 1000 ft beach closure?
Answer: Yes, multiple structures are permitted to be under construction simultaneously as long as they are contained within a 1000-ft beach closure, subject to requirements of the Water Quality Certificate.
b) Are multiple 1000 ft beach closures permitted?
Answer: Yes, multiple 1000-ft beach closures are permitted, subject to requirements of the Water Quality Certificate.
c) How do Groin 58 and the revetment figure into this requirement?
Answer # 13) Work on Groin 58 and the revetment may be performed between 1 April and 31 August within a maximum 200-meter (656-ft) beach shut down area, to be contained within the overall project work area shown on sheet G-002. Work on Groin 58 and the revetment may be performed between 1 September and 31 March within a maximum 1000-ft beach shut down area, to be contained within the overall project work area shown on sheet G-002.
Question # 14) For groin 58, the rock placement in the profile view on CS-107 does not match the rock placement shown on the cross sections on CS-307. Specifically, drawing CS-107 shows placement of rock on top of the existing grade from STA 1+50 to STA 4+00. In contrast, the cross sections on CS-307 show excavation and rock placement below existing grade from STA 1+50 to STA 4+00. Please clarify.
Answer # 14) Corrections have been made to sheets CS-107 and CS-307. Please see revised sheets in Amendment 0007.
Question # 15) For groin 35, CS-107 and CS-307 show significantly different stone placement at the end of the groin. CS-107 and CS-307 show approximately 5ft and 2ft core stone thickness near STA 3+85, respectively. Please clarify.
Answer # 15) Corrections have been made to sheets CS-107 and CS-307. Please see revised sheets in Amendment 0007
Question # 16) Question #7 response in Amendment 0002 indicates Testing per Specification 35 31 29.40, Table 1, Paragraph 2.2.1 is not required for removed stone. Also, per Specification 35 31 29.40, paragraph 2.2 indicates reused stone shall not contain cracks, joints, etc. However, paragraph 2.2.1 also indicates “each stone shall meet all the following test requirements for quality” which is Table 1: Stone Test Requirements. Please confirm that the Table 1: Stone Test Requirements is NOT required for removed stone which meets criteria for reuse.
Answer # 16) Laboratory tests listed in 35 31 29.40 Table 1: Stone Test Requirements are not required for removed stone. Other requirements of paragraphs 2.2 and 2.3 of the same spec will apply.
Question # 17) Assuming all testing requirements are met in Table 1: Stone Test Requirements Subpart
2.2.1 of Section 35 31 29.40 of the specifications, will the stone be approved for this project?
Answer # 17) New stone must comply with Table 1 Stone Test Requirements as well as with Section 35 31 29.40 paragraph 2.2.1 Quality and paragraph 2.3 Stone Classification.
Question # 18) SECTION 35 31 29.40, Par. 2.4.1. The unit weight of rock in the “Factors Used for Converting In-Place Volume to Weights” calculates to 175 lbs/CF. In SECTION 35 31 29.40, Par 2.2.1 the specified weight of new stone is to be 165 lbs/CF or greater and in SECTION 01 22 00.00 10, Par
1.3.3.2 b states, “All new stone acceptable for use in excess of 165 pcf will be paid for at 165 pcf maximum.” Please clarify how the bid quantities were developed.
Answer # 18) Paragraph 2.4.1 Factors based for converting in-place volume to weights has been revised to reflect 165 lbs/ft^3.
Question # 19) Specification 35 31 29.40, Subpart 3.11.2.1 of Specification section 35 31 29.40 states that bedding stone will be utilized for the construction of the groin trunks at the Long Beach (Reach 2) portion of the project. Plans do not show bedding stone. Is this required? If yes, please advise on the line item(s) the bedding stone needs to be assigned to and/or a new line item for the bedding stone at the rehab groins.
Answer # 19) Reference to bedding stone in 35 31 29.40 subpart 3.11.2.1 has been removed and the section has been revised accordingly in Amendment 0007..
Question # 20) Will USACE accept oversized stone for any classification of stone listed in the contract documents? (i.e. Would a 4,000 lbs stone be acceptable as an underlayer stone which is specified to be between 1,800 lbs and 3,000 lbs? Or would a 16 ton stone be acceptable for a Type A Armor stone which is specified to be between 10 tons to 15 tons?
Answer # 20) USACE does not accept oversized stone for any classification.
Question # 21) Is there a limit to the percentage of oversized stone permitted on the project? (For example, oversized stone cannot exceed X% of the total stones in any classification.)
Answer # 21): USACE does not accept oversized stone for any classification.
Question # 22) Lastly, is there an upper size limit to any individual stone in any classification allowed for use on the project? (For example, oversized stones cannot exceed X% of the upper size limit of any classification.)
Answer # 22) USACE does not accept oversized stone for any classification.
Question # 23) Referring to Sheet Reference Number CS-307, Cross Sections 0+00 to 1+50 and the Radial Cross Section do not show a 6” Armor Tolerance for the Armor Stone as do the remaining cross sections on that sheet. Is the 6” Armor Tolerance consistent with all cross sections in the plans, or only as indicated on each cross section?
Answer # 23) A 6” tolerance for armor stone is allowed for all cross sections. Cross section sheets will be revised in Amendment 0007.
Question # 24) Relating to the 6” Armor Tolerance shown in the plans, are the bid item quantities calculated by USACE to the neat line elevations shown or to the upper tolerance limit?
Answer # 24) Bid item quantities are calculated to the upper tolerance limit.
Question # 25) Regarding Amendment 2, RFI Q&A 6 - as I read it, no work activities are permitted.
However, I understand this to allow materials, temporary structures and staging already in place to remain assuming acceptable safety barriers are in place. Please confirm this understanding.
Answer # 25) There is to be no staging of material in reach one during the plover window (no work time). The contractor can stock pile next to the terminal groin in reach one which allows year round work.
Question # 26) Reference to Sheet Reference No. G-003 – Access Road and Staging Point at Point Lookout, notes related to the Potential Temporary Barge Docking, Note 1 which states, “Contractor responsible for obtaining all permits necessary for temporary dock, if utilized. The Town of Hempstead (TOH) has identified this location on TOH property as an available potential docking location for stone transportation by barge.” Also, Note 2 which states, “Some dredged material disposal is available upland on-site. Location and quantity to be coordinated with the Town of Hempstead. Dredged material quantity in excess of TOH capacity to be disposed of by the contractor unless otherwise directed by the COR.” Please confirm that dredging in and around the Potential Temporary Barge Docking location to accommodate the depth of a fully loaded barge to access the dock is allowed.
Answer # 26) Other than the Water Quality Certificate provided in the Bid Advertisement, the Contractor is responsible for obtaining all local permits (i.e. Soil and Erosion Control) necessary to complete work.
In regards to modifications to the Water Quality Certificate - Upon Contract Award, the Contractor will provide the Government all necessary plans and data needs and will procure/facilitate the WQC modification. The Government cannot guarantee that a modification to the Water Quality Certificate will allow access dredging to accommodate the depth of a specific size fully loaded barge will be granted.
The above is based on that the "conditional" WQC that DEC issued to the Corps in July 2015 for the subject project that is in the Bid Package has as:
Condition #1. Post Contract Award Meeting Required - The Corps organizes a meeting to be attended by the contractor, USACE, DEC, etc... to finalize any of the project implementation... construction, staging, access, and other details which were undecided as of June 2015 or being deferred until a contractor is selected.
Condition #4 Required Drawings. D. Site plan, cross-section and profile view drawings for any temporary dock, pier or wharf to be constructed to facilitate the completion of the overall project.
Question # 27) Are updated drawings to be issued for the project showing different conditions where the increased excavation and backfill quantities are located?
Answer # 27) Updated drawings have been revised and reissued in Amendment 0007.
Question # 28) SECTION 35 31 29.40: STONE CONSTRUCTION, Section 2.2.1 Quality. As our quarry is a limestone quarry, the above section would disqualify us from this contract. The gentlemen that contacted us about this bid/contract stated that as long as the stone passes the labs tests, that would supersede the part above in the spec about not being able to use sedimentary stone? Can you please advise on this being true or not.
Answer # 28) The proposed materials do not meet project specifications.
Question # 29) AMENDMENT 0005, revised bid form, Bid Item 0004AA, Bid Item 0005AA, Reference Sheet Number CS-101 and CS-102- Reach 1. The revised quantities for Excavation & Backfill for Groin A&B do not match the quantities that are shown on the drawing plan and profile. The revised quantity appears to be calculated from the future beach fill elevation. The original CY quantity was closer in value shown on the drawings than the revised. Please advise.
Answer # 29) Actual profile conditions are expected to be between the “existing grade line” (surveyed in 2013) and the “beach fill line” (representing fill placed in Jan-Feb 2014). Bid quantities were calculated from the 2014 fill placement line.
Question # 30) Please refer to Sheet Reference No: CS-108 – Groin 58 Revetment / Plan & Profile, lnlet side of the revetment. Does any of the rock currently present in this area have to be removed and reset during and after construction of the proposed concrete revetment wall?
Answer # 30) Revetment rehab quantities assume removal of existing revetment material as shown on sheet CS-308. No resetting of existing rocks was assumed. However, if removed existing stone meets the requirements in spec section 35 31 29.40 Stone Construction, it may be placed in new or rehabbed structures.
Question # 31) Sheet: CS-101, CS-102, CS-103, CS-104- Reach 1, Detail: NOTE 1: BEACHFILL SHOWN AS PLACED SPRING 2014 AND IS FOR REFERENCE ONLY. Amendment 0002 – Question/Answer #5 – Beach fill will be placed under separate contract. Amendment 0003 – Question/Answer #13 – Existing grades as shown on Drawings CS-301 for Reach 1 represent contours April 2013, prior to the placement of beach fill on January – February 2014. Please confirm that the beach fill did not occur in 2014 and therefore is not a reference line on the Groin Profile. Note 1 is incorrect and in error.
Answer # 31) Note 1 is correct. Existing grade data were surveyed in April 2013. Subsequently, beach fill was placed in January – February 2014.
