1) Reopen Solicitation for a period of ten (10) days to allow offerors a chance to revise proposals in response to these posted solicitation changes. The new deadline for f inal proposals shall be December 17, 2018 at 1000 am EST.

2) Revised Solicitation re-align CLINs and adds Estimated Qty's for Special Events. Reference Revised Section L (FAR 52.212-1) and and

Revised Section M (FAR 52.212-2) w ith changes highlighted in yellow .

3) Please also see revised clarif ications of previous vendor Q&A.

4) This RFP amendment also updates Technical Exhibit # 8 (changes are highlighted in Yellow ).

INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

1. SUBMISSION OF PROPOSAL.

a. Fax submissions will not be accepted. Proposals SHALL be delivered by the deadline for the submittal of proposals indicated in the solicitation. All proposals shall be submitted through email:

2. GENERAL INSTRUCTIONS.

a. The selection of an offeror for award purposes will be conducted utilizing source selection (negotiated) procedures as outlined in FAR Part 15.3. Offers will be evaluated using the criteria outlined in ADDENDUM TO

FAR Clause 52.212-2, Evaluation – Commercial Items.

b. The submission of the documentation specified below will constitute the offeror's acceptance of the terms and conditions of the Request for Proposal (RFP), concurrence with the Performance Work Statement, and contract type.

c. It is the Government’s intention to award without discussions. Offerors are encouraged to present their best technical proposal and pricing in their initial proposal submission. However, in accordance with (IAW) FAR Part

15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and offerors notified. The Contracting Officer may limit the competitive range for purposes of efficiency IAW FAR Part 15.306(c)(2).

d. Instructions outlined in paragraph (3) below, prescribe the format for the proposal and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.

e. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the Offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.

f. If an offeror believes the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the offeror shall immediately notify the Contracting Officer in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

g. All referenced documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) web site at http://www.fbo.gov. Potential Offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation

h. Debriefings. The Contracting Officer will promptly notify offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505. The

Contracting Officer will notify offerors who were in the competitive range but were not selected, whereupon they may request a debriefing in accordance with the requirements of FAR 15.506.

3. PROPOSAL PREPERATION INSTRUCTIONS

a. Offeror’s proposal will consist of three (3) volumes: RFP Documents, Technical Capability, and Price.

b. All pages of each offer must be appropriately numbered and identified with Solicitation Number: W91248-18-R-

0001 in the header and/or footer of each page. If RFP page limits are exceeded, the pages in excess of the limit will be removed and not evaluated.

c. Electronic copies of all volumes shall be provided. Page limitations are indicated in the chart below:

d. Proposal Limitation. The proposal shall not exceed the limits stated above. If the page limits are exceeded, the pages in excess of the limit shall be removed and returned, unread, to the offeror. The Government will not accept any changes to the contractor’s proposal after the closing date of the solicitation (See FAR 15.208 for further information regarding late proposals). If discussions become necessary, page limitations may be placed on responses to Evaluation Notices (ENs). The specified page limits for EN responses will be identified in the letters forwarding the ENs to the offerors.

e. Page Limit Includes: All appendices, charts, graphs, diagrams, tables, photographs, drawings, etc.

f. Page Limit does not include: covers for volumes, tables of contents, glossary of abbreviations and acronyms, indices, title pages, cross reference indices, and section dividers/tables if they are inserted solely to provide ease to the reader in locating parts/sections of the proposal. Pages will be counted if they contain any other information, i.e., diagrams, extraneous data, etc. Pages marked “This page intentionally left blank” will not be counted.

g. What Counts As A Page. A page shall be an 8 1/2 X 11” sheet of paper. When both sides of a sheet display printed material, it shall be counted as two pages. Letter size and spacing requirements for illustrations and tables can be at the discretion of the offeror but must be easily readable. Fold-outs will be counted as the appropriate number of pages based on an 8 ½” X 11” sheet of paper. Margins shall be at least 1 inch on the top, bottom, and sides of the document. The Contractor shall number each page in order to eliminate any confusion. In the event the contractor creates an ambiguity in their numbering of pages, the Government may exercise its own discretion in counting pages.

h. Indexing. NA

i. Glossary of Abbreviations and Acronyms. Each volume shall contain a glossary of all abbreviations and acronyms used, with a definition for each.

4. PROPOSAL CONTENT

A. Volume I – General. Volume I – RFP Documents. Offerors are required to submit a completed SF 1449

(including acknowledgment of Amendments) and Addendum to FAR Provision 52.212-1. Failure to follow the below Contract Proposal preparation instructions may cause your proposal to be deemed unacceptable by the

Government. Volume I will be organized as follows and contain the identified information.

TAB A, Executive Summary. Provide an executive summary that introduces the contractor team and proposal submission, to include a list of team members and subcontractors and the task areas they are designated to provide support. The executive summary shall also include a list of the proposal package contents. Exceptions/Assumptions (if required) - Identification and explanation of any exceptions or deviations. Additionally, any assumptions used in the proposal preparation must be identified.

TAB B, Solicitation, Offer and Award. The SF 1449 will be submitted fully completed. The offeror is cautioned that the SF 1449 must contain an original signature in block 30a of the form. The contractor will acknowledge all amendments to the RFP in accordance with the instructions on the SF 1449 and with

Addendum to FAR 52.212-1, Instruction to Offerors Commercial Items. The offeror shall provide the name, title and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.

TAB C, Section B (Services and Prices) - Section B shall be submitted fully completed and error free. It shall contain the offeror’s prices for the established Contract Line Items Numbers (CLINS).

TAB D, Section K (Representation, Certifications, and Other Statements of Offerors) – The offeror shall ensure that Section K is submitted thoroughly completed with all blocks in each certification/representation completed truthfully and completely.

B. Volume II – Technical Volume. The Technical Volume shall be clearly marked “VOLUME II –TECHNICAL

PROPOSAL, RFP W91248-18-R-0001.” The Technical Capability, Volume II, should be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims in the Offeror’s proposal. Legibility, clarity and coherence are very important. Your responses will be evaluated against the

Technical factors/elements defined in Section M, Addendum to FAR Clause 52.212-2, Evaluation – Commercial

Items. The Offeror should address, as specifically as possible, the actual methodology used for accomplishing the

PWS tasks. The proposal should not simply rephrase or restate the Government's requirements, but rather should provide convincing rationale to address how the Offeror intends to meet these requirements. Statements that the

Offeror understands, can, or will comply with the PWS (including referenced publications, technical data, etc.);

statements paraphrasing the PWS or parts thereof (including applicable publications, technical data, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., will raise questions regarding an Offeror’s technical ability to perform the services contained herein and may be grounds to eliminate the proposal from further consideration for contract award. Offerors should assume that the Government has no prior knowledge of their facilities and experience, and that it will base its evaluation on the information presented in the Offeror’s proposal. Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired. Submission of resumes are not required.

The Technical Volume shall, at a minimum, be prepared in a form consistent with the Performance Work Statement

(PWS) and the evaluation criteria for award set forth in Section M of this solicitation. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the contractor’s technical competence and ability to comply with the contract task requirements specified in the PWS.

The offeror shall address as specifically as possible the actual methodology you would use for accomplishing the

PWS tasks. The volume shall be organized according to the following general outline.

Factor 1: Technical Capability Volume. The Technical Capability Volume shall include, at a minimum, the following information.

Subfactor 1: Management Approach. The Offeror shall provide:

a. The offeror demonstrates their plan to maintain or acquire the required equipment necessary to complete all requirements of the PWS; to include the additional containers that may be required during contract performance IAW PWS Annex A Para 8.

b. The offeror demonstrates their capability to operate and maintain Waste/Recyclables Convenience

Center with properly trained personnel in accordance with PWS Annex A paragraph 8.4 and TE 8.

c. The plan describes how the offeror will implement an initiative plan and the methodology they will utilize to achieve their goal IAW Annex A 8.7.4.

d. The offer describes their methodology to generate and produce reports of outcomes/saving associated with PWS Annex A 1.2.7 and 8.7.

e. The management plan demonstrates an acceptable organizational chart which identifies the management structure of key personnel, including a description of roles and responsibilities.

f. The management plan demonstrates the offeror's understanding of the skills required to execute contract tasks, as well as, how they are to be implemented and utilized in contract performance in accordance with the PWS (procedures to develop collection schedules, source separations, transporting refuse and recycle, weighing).

g. The plan includes how the offeror will ensure all personnel possess and maintain the required certifications in accordance with PWS Annex A 2.5.4. 8.2.

Subfactor 2: Staffing Plan. The Offeror shall provide:

a. The staffing plan shall identify adequate staffing and include the labor categories and number of personnel proposed to successfully perform the tasks in the solicitation. This plan provides offerors’ intended methodology for accomplishing the following: accommodating fluctuating workloads, minimizing personnel turnover, recruiting and retaining qualified and experienced personnel, cross-training and cross-utilization of personnel.

b. A staffing matrix which identifies each labor category, quantity of labor category proposed, and crosswalk to each task identified in the PWS deemed necessary to perform the requirement.

C. Volume III – Price. Price will not be assigned an adjectival rating; however, price will be evaluated for reasonableness in accordance with FAR 15.404-1. The Government will evaluate the Offeror’s total price, to include the base period, first option period, second option period, third option period, fourth option period, and one-half of the fourth option period, using price analysis techniques. Pricing must be provided for all line items in order for an offeror to be considered for award. Those offerors not providing pricing for all line items may be removed from consideration for award. The KO reserves the right to de-conflict minor clerical/mathematical errors that are not substantive or have only a negligible impact on price, delivery or qty.

Please elaborate on the Army’s evaluation criteria for the RFP in the even that a firm bids this low, and in what scenario would a low, unrealistic bid be thrown out. Would the Government please add a price realism clause to the contract?

All submitted proposals shall be evaluated for

Technical Acceptability and Price Reasonableness.

Prices with low, unrealistically low amounts are usually dismissed as Technically Unacceptable. No price Realism analysis will be conducted.

This is very confusing to have to standalone documents that somewhat mirror each other but contradict. Strongly consider the

Government condenses the two documents and provide one document or remove one.

The Annex A and Annex E are the requirements of

IMCOM Readiness. The descrepency will be corrected to metal lids on 8 cubic yard cardboard and refuse.

22 Annex A 2.1.2.1 Please consider making the phase in 30 days or longer. Since the 8 yd refuse containers now need to be standup with doors, the incumbent himself would be hard pressed to change out all 527+ 8 Yd refuse containers in 10 days. This is an unrealistic timeline for a Base of this size.

23 Annex A 7.5.1.1 Please confirm rear loader needs scales, as the incumbent is currently only scanning the

95 GAL containers and not weighing the containers. If they do need scale, what type of scales are needed.

IAW Annex A PWS 7.5.1.1 On-Board Weighing

System (OBWS) / Recording Responsibilities:

Contractor shall be responsible for providing vehicles

(front, side and rear loading) used in the collection of refuse and recyclable materials. Each vehicle shall have an on-board weighing system capable of generating a weekly report listing each container, date and time of collection, weight (gross, tare & net) and location of disposal and is acceptable for commercial use.

24 Annex A 7.5.1.1 Why are the scales needed on FEL containers? Please consider removing as this is expensive, time consuming, and a massive pain in the neck and 10 out of 10 times the Government doesn't even use the data that it receives.

Front end loader are required to have on-board scales.

25 Annex 8.15 If items are found from Base housing that have been illegally placed or a command that refuses to use the FEL/RO containers provided to them appropriately, and the contractor alerts the

Government/COR multiple times, at what point will the

Govt step in and relieve the contractor of the obligation of collecting items at no charge? Also, we disagree with the comment that "the contractors level of efficiency for this item is largely dependent on the effectiveness of the contractors refuse collection system." Consider removing, as this is more of a communication effort between COR and Contractor, the COR making sure the commands and base housing understand the correct protocol, and not all on the contractor. If the two do not work together to get to the crux of the problem then these items will continue being placed and dumped incorrectly.

There is no Annex 8.15. However, base housing maintains their own refuse and recycling contract.

26 Annex 8.1.9.1 15% of the PWS is a large increase to not be able to charge additional monies to cover. Consider revising.

PWS will change to reflect 5% addional. Additional container services are covered under CLIN 0009.

27 Annex 8.1.9.1 Please confirm that this paragraph does not apply to newly added buildings. As the paragraph states 15% increase from "#/size of containers at any collection point". In other words, the 15% only applies to what is on the PWS day 1 of the contract, and any new buildings can be added via modification to the contract with a monetary increase.

28 Annex A 8.8.1.3/Appendix E 2.3.1 What if recyclable items that are required by the Government to be collected no longer hold rebate value and the contractor must pay to recycle. Will the Government reimburse the contractor for these fees? If so by what payment vehicle?
